RESOLUTION N0. 78-145
RESOLUTION ESTABLISHING THE CITY'S RECOGNITION OF
AND SUPPORT FOR "SUN DAY," WEDNESDAY, MAY 3, 1978.
WHEREAS, the realization and the promise of solar energy will be
observed and celebrated throughout the nation on May 3, 1978, and
WHEREAS, throughout the United States people concerned with the nation's
energy and environmental future will be attending teach -ins, conferences, and
solar fairs on May 3, 1978, in celebration of Sun Day, and
WHEREAS, the development of solar technologies will provide an abundant,
economical, safe, and environmentally compatible energy supply, and

II sun and of the need to direct greater effort to solar energy research, and

City to promote public awareness and education concerning solar energy, and
WHEREAS, on Sun Day, May 3, 1978, a day -long celebration will be observed in
i Iowa City featuring a sunrise service, music, theatre, speakers, information
displays downtown, and a sun dance to close the day,
NOW, THEREFORE, BE IT RESOLVED, that the Iowa City City Council officially
proclaim May 3, 1978, as "SUN DAY."
BE IT FURTHER RESOLVED that the City of Iowa City urges all citizens to
be mindful of the importance of this day to the future of our country and to
participate in the celebrations of Sun Day in Iowa City.
BE IT FURTHER RESOLVED that the City of Iowa City urges all citizens, in
concert with the efforts of government, business, and labor, to strive for energy
conservation in all aspects of their lives and to support and promote solar
energy development and technology.

LeRoy Weekes V.F.W. Post 3949, 607 Highway 6 Bypass
Said approval shall be subject to any conditions or re-
strictions hereafter imposed by ordinance or State law.

to he endorsed upon the application and forward the same

The purpose of this letter is to respectfully request that the Iowa City Council act
on the final plat for the subject project at the May 2, 1978 formal council meeting.
We are aware that normal procedures for approval of plats provides for consideration
of plat one week and action by the following week; however, as was the case with the
approval of the preliminary plat, timing is of the utmost importance in our negotiations
with the manufacturing firm. Any delays at this point could possibly cause problems.
We appreciate the extra efforts put forth by the staff and yourselves in the quick
approval of the preliminary plat for the subject project and hope that similar timing
can be achieved in this case.

RESOLUTION APPROVING FINAL PLAT
OF BDI THIRD ADDITION
WHEREAS, a final plat of BDI Third Addition, Iowa City, Iowa, has
been filed with the Clerk of Iowa City, and after consideration was found
to be in accordance with the provisions of the laws of the State of Iowa
and the ordinance of the City of Iowa City, Iowa, by the Iowa City Planning
and Zoning Commission.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Iowa
City, Iowa, that the said final plat of BDI Third Addition be and the same
is hereby acknowledged and approved on the part of Iowa City, Iowa.
BE IT FURTHER RESOLVED that at such time as the certificates required
pursuant to the provisions of Chapter 409 of the Code of Iowa have been
executed and presented to the Clerk, the Mayor and the Clerk are hereby
directed to certify a copy of this resolution to the County Recorder of
Johnson County, Iowa.

RESOLUTION AWARDING CONTRACT FOR THE CONSTRUCTION OF City
Plaza - Central Business District Streetscape Improvement
Project
WHEREAS, Parkview Company _
has submitted the best bid for the construction of the above named project.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF IOWA CITY, IOWA:
1. That the contract for the construction of the above-named project is hereby
awarded to Parkview Company; 2750 S. Riverside Drive; Iowa City, Iowa
subject to the condition that awardee secure adequate performance bond and
insurance certificates.
2. Be it further resolved that City Council has considered the claim of O'Brien
Electrical Contractors, Inc., one of the bidders on this project, that a public
hearing was required on the approval of a certain alternate material and preserva-
tive process for said project and the City Council finds:
a. That the approval of the alternate material and preservative
process does not constitute a change in the plans and speci-
fications of the contract for said project;
b. That the consultant with the approval of the City Engineer is
authorized to approve alternate materials or processes where
such do not materially change the project and are deemed equal
to that specified, consistent with previous City Council policy;
and
c. The claim of O'Brien Electrical Contractors is without merit.

At your informal Council meeting on May 1, 1978, I appeared in behalf
of O'Brien Electrical Contractors, Inc. to point out what I feel to be
a legal defect in the proceedings for the re -advertising for bids and
for the award of the contract for the City Plaza Improvement Project.
Although I discussed the factors relative to this defect with you
informally, I feel it is appropriate to reiterate the basis of the
objection to the proceedings to date so that there will be no mis-
understanding.
The basis of the defect is that a change was made in the original
specifications by the Engineering Department without the prior approval
of the Council, and without a public hearing on the final plans and
specifications, all contrary to the requirements of law.
Section 384.102 of the Code of Iowa provides that the City shall not
enter into a contract for a public improvement costing more than
$10,000.00 without a public hearing on the proposed plans, specifica-
tions, form of contract, and estimated cost for said improvement. A
public hearing was held on this project on February 28, 1978, and on
March 7, 1978 the City Council approved the plans, specifications,
form of contract and estimated cost, and at the same time authorized
the advertising for bids for the improvement, based on said plans and
specifications.
On April 18, 1978, the City Council rejected all bids and authorized
and directed that a new notice to bidders be published for the receipt
of bids on April 28, 1978. This notice re -advertising for bids speci-
fically provided that all work is to be done in accordance with the
pinns, specifications and form of contract previously approved by the
Council and further provided that said plans and specifications were
made a part of said notice.
Following this action by the Council on April 18, 1978, a change was
made in the specifications by the Engineering Department on April 19,
1978 to provide for a different acceptable timber product, and also to
provide for a different acceptable preservative treatment. Although these

changes resulted in a sizeable reduction in cost of the project, these
changes in the specifications were made without the prior knowledge or
approval of the Council, and without a public hearing on the revised
plans and specifications, and such proceedings will, thus, result in an
invalid contract.
At the time of my appearance before you yesterday, I was not able to
advise you of the course of action of O'Brien Electrical Contractors,
Inc. if you proceed to award the contract on the basis of the proceedings
to date. Upon further review with O'Brien Electrical, I can now advise
you that it is their intention to request a Court determination of the
validity of the proceedings and of any contract awarded on the basis
thereof.
I have discussed this matter in detail with your attorney, John Hayek,
both from a standpoint of the alleged defects as well as the alternative
courses available, in an effort to keep this matter from being a late
development without prior notice to the Council or staff. However, I
would like to request that this letter be placed on file in verification
of the matters set forth herein.

A. The Surety hereby waives notice of any alteration or extension of
time made by the Owner.
B. Whenever Contractor shall be, and is declared by Owner to be, in de-
fault under the Contract, the Owner having performed Owner's obliga-
tions thereunder, the Surety may promptly remedy the default, or
shall promptly:
1. Complete the Contract in accordance with its terms and conditions;
or,
2. Obtain a bid or bids for submission to Owner for completing the
Contract in accordance with its terms and conditions, and upon
determination by Owner and Surety of the lowest responsible

contracts of completion arranged under this paragraph) sufficient
funds to pay the cost of completion less the balance of the Con-
tract Price; but not exceeding, including other costs and damages
for which the Surety may be liable hereunder, the amount set forth
in the first paragraph hereof. The term "balance of the Contract
Price", as used in this paragraph, shall mean the total amount
payable by Owner to Contractor under the Contract and any amend-
ments thereto, less the amount properly paid by Owner to Contrac-
tor.
C. The Contractor and his Surety shall, be obligated to keep the improve-
ments covered by this bond in good repair for a period of two (2)
years from the date of acceptance of the improvements by the Owner
for all parts excluding plantings and for a period of one (1) year
from the date of acceptance of the plantings by the Owner.
D. Any suit under this bond must be instituted before the expiration of
two (2) years from the date on which final payment under the Contract
falls due for all parts excluding plantings and one (1) year for
plantings.
E. No right of action shall accrue to or for the use of any person or
corporation other than the Owner named herein or the heirs, executors,
administrators or successors of Owner.
IT IS A FURTHER CONDITION OF THIS OBLIGATION that the principal and Surety
shall, in accordance with provisions of Chapter 573 of the Code of Iowa,
pay to all persons, firms or corporations having contracts directly with
the principal or with subcontractors all just claims due them for labor
performed or materials furnished in the performance of the contract on
accound of which this bond is given. The provisions of Chapter 573, Code
of Iowa, are a part of this bond to the same extent as if they were ex-
pressly set out herein.

The City of Iowa City, Party of the First Part, hcrvalter reft-rred to as City,
agrees to lease to the F'rLends of thu Children's Amsoum, Party of the Sccoud fart,
hereafter referred to as Museum, the two lot, cabins In tlhc lows City City tack
upon the following terms and conditions:
1. That said premises shall be used as a children's museum. This concept could
include facilities for preparing and presenting workshops, progr.hns, excursions,
and performances for children. other aspects of the museum might be to provide
resource services, workshops, and programs for parents, purtens and children,
teachers, and institutions. The museum could be a place for students and local
artists to gain experience in working with children.
2. The City will refurbish the log cabins inthe pioneer style and will thereafter
assume responsibility for only major, structural - type repair. The Museum will
assume responsibility for all other cost factors, except as stated below, in-
cluding maintenance, funding of employees, and security.
}. Written permission must first be obtained from the City before any structural
changes are made and for any and all repairs whose total cost is in excess
of $100.00.
4. The Museum agrees to assume responsibility for obtaining insurance coverage on
any item owned or installed by the Museum or its employees or agents. The
Museum further agrees that it shall assert no claim against the City for the
loss or damage of saLd items.
�I 5. The Museum agrees that written approval from the Dil'erter of Park:: and recreation
must first be obtained for all items sold on leased premir.cs, the cost or said
items and for all fees charged to the public of any kind.
6. The Museum agrees to deliver to the City a set of keys to the leased prcmiseS'
at the close of each museum season, to be returned by the City at the start of
each said season.
7. The Museum agrees to deliver to the Director of Parks and Recreation an informal,
short form report on its financial situation at the close of each season. To be
included in such report will be an accounting of all monies taken in from museum
operations.
8. All employees and agents of the Museum are to sign agreements whereby they
relieve the City from liability for any employee's benefits of nny kind. Further-
more, said employees and agents must agree to waive any other claims of liability
against the City arising from any aspect of museum operation. These liability
waivers are to be similar to the Recreation Intern forms used by the Department
of Parks and Recreation.
9. The Museum agrees that written approval must flrt:t be ohtn(ned from the Ulrector
of Parks and Recreation for any subleasing arrangement:; by the MUr.CUM. Similar
approval must also be obtained before the Museum uses the premises for any
puipose not within the scope of Paragraph 1 or by any other group or pera„m
than the Museum. Failure by the City to take action for such violation :,hall
not conntftute n waiver of its rights to take action at a Inter time.

10. Consideration for this lease agreement shall be One Dollar ($1.00) in hand
paid by the Museum to the City. No rent will be collected or become due under
this agreement.
11. The term of thls lease shall be five (i) years with an optiun for an additional
five (S) years given to the Museum. Said option may nuL bee a::signed or sold
without written approval from the Council. The provisions of Paragraph 11 are
subject to the termination procedure of Paragraph 12.
12. This agreement is formed with the intent of providing a public service to the
people of Iowa City. Since profit is not expected from the operation of the
children':; museum and it is in the nature of a volunteer operation, it is the
intent of the parties to make termination as easy as possible upon presentation
of reasonable cause. Therefore, upon sixty (60) days written notice to the
other party, including in such notice the reason for termination, this lease
shall be considered at an end unless the party receiving such notice shall,
within ten (10) days after receipt, deliver a written objection to the party
seeking termination. This objection shall have the effect of placing a
termination date on the lease of not later than the date on which the museum
was to close for the current year. At the close of said museum season time
other than the museum's open season, receipt of a termination notification
with reasonable cause shall constitute immediate termination of this lease.

RE: Temporary Alley Closing
The contractor for the Telephone Company has installed a standby
generator (housed in a metal shed) in the alley just south of
Burlington Street. The purpose of the generator is to provide
standby power for the telephone system during the construction
of the new addition to the building. A certain amount of
misunderstanding occurred between myself and the architect for
the project which allowed the installation of the machine. I
did in fact consent to partial intermittent closure of the alley
during construction on the assumption that construction vehicles
would necessitate the action. The actual installation of the
generator in a year long position was not discovered until the
installation was essentially complete.
A memo from Bob Bowlin to myself provides for two alternatives
to rectify the situation from a safety standpoint. We work with
the Telephone Company on a daily basis and I believe the request
to remove the generator from the alley would cause friction in a
relatively good relationship. Aside from the cost factor indicated,
there would also be some major technical difficulties to overcome.
I am therefore recommending that the section of the alley between
Burlington Street and the generator (60 feet) be temporarily
closed to all traffic. All residents will still have access to
their property (parking,etc.) from the south end of the alley.
This will create some inconvenience on their part, but 1 feel it
is an acceptable solution.
Should Council pass this resolution, I would expect the Telephone
Company or its contractor to install the necessary signs and
barricades.

I have given further thought to the problem that you brought
to me concerning the generator that sticks partway into the traveled
portion of the alley in the Bell Telephone building block. It seems
to me that there was definitely something short of full disclosure
made to you by the representatives of the telephone company when they
asked you if they could "obstruct the alley during construction." I
would have no trouble with temporary blockage of the alley by trucks
and unloading and that sort of thing. However, 1 think that the
placement of a generator in the traveled portion of the alley for up
to a year is a far different situation then the loading and unloading
of trucks.
As I see it there are two possibilities here. The first would be
to have the contractor move the generator off of the traveled portion
of the alley. I understand from you that this costs several thousand
dollars. The second possibility is to have the City Council, by reso-
lution, temporarily close the alley during construction to all traffic
except construction traffic and local traffic (that is, persons who
must use the alley for access to their properties in that block). This
would require some signing that the alley is close to all except local
traffic and would certainly require good signing and barricades around
the generator that sits in the alley.
The obstruction of a city street or alley is a nuisance under state
law, and I don't see how we can permit this situation to continue unless
we take steps to temporarily close the alley and place appropriate signage.

Design Review of Parcel 82-1b
1. The staff, Design Review Committee, and the City Council have previously
discussed the design of the development to occur on Parcel 82-]b, as part of a
more generalized discussion concerning the Ordinance governing the use of City
Plaza, Mr. Bailey of North Bay Construction, Inc., showed some preliminary
drawings to the Council at its informal session of April 3, 1978. At that time
the Council requested that Mr. Bailey present the plans to the Design Review
Committee, and then return to the City Council.
2. Preliminary design plans were presented to the Design Review Committee on '
April 12. As reflected in the minutes of that meeting, included with the May 2
agenda, the DRC voted unanimous approval of the preliminary plans.
The staff recommends approval, subject to the reservation that signage be reviewed
at a later date, but prior to installation of such signage.
3. The preliminary plans, as reviewed by the Design Review Committee include the
use of a portion of the Dubuque Street right-of-way, in a manner consistent
with the City Plaza Ordinance as now drafted. Mr. Bailey and his architect
are scheduled to present the plans to the City Council at the informal session
of May 1.
4. The review of these plans at this time, prior to the completion of the Contract
with North Bay Construction, Inc., is appropriate, and necessary to provide guid-
ance to the staff in finalizing the contract language as it relates to the land
area to be sold or leased.

RESOLUTION MIENDING RESOLUTION NO. 74-48 ESTABLISHING A DESIGN REVIEW CM24ITTEE

WHEREAS, the City of Iowa City is carrying out an Urban Renewal Project; and,
WHEREAS, the City Council of the City of Iowa City has, by Resolution No. 74-48
dated February 5, 1974, established a Design Review Committee; and,
WHEREAS, it is now desirable to amend Resolution No. 74-48;
NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF IOWA CITY, IOWA, that
Resolution No. 74-48 is hereby amended to decrease the number of members on the
Design Review Committee from 16 members to 10 members, to be appointed by the Mayor
with the consent of the City Council, to serve as an advisory committee.
It was moved by Roberts and seconded by Perret
that the Resolution as read be adopted and upon roll call there were:

RE: Ordinance Governing the Use of City Plaza
1. The Ordinance governing the use of City Plaza is included in the agenda for the
Council meeting of May 2, 1978. The Ordinance is in the form reviewed by the
City Council at the informal meeting of April 3, except for the following
changes:
a. A new Section 6. Animal Regulations has been added, as requested by the
Council.
b. The section [8C(3)] Additional Criteria, which was discussed with the Council
has been inserted into the Ordinance. (See page 7)
c. The last paragraph in Section 8 (top of page 8) has been rewritten in the
form presented to and reviewed by the Council on April 3. This paragraph
contains the provision requiring the vote of five members of the City
Council to override the negative recommendation of the Design Review
Committee.
d. The 33% limitation on building extension per block face has been deleted.
(See Section 7B(1) at the top of page 4)
2. A resolution decreasing the number of positions on the Design Review Committee
from 16 to 10 is also included on the May 2 agenda, consistent with the direction
of the Council received at the April 3 meeting.
