Resolutions and Motions 7.a. September 2019 Disbursements Motion to approve disbursements in the amount of $12,542,792.81 for the period of September 1 through September 30, 2019, as recommended by the Finance Director subject to audit. Disbursements are published and permanently retained in the City Clerk's office in accordance with State Code. 7.b. Loading, Transport and Land Application of Biosolids Resolution authorizing the procurement of Loading, Transport and Land Application of Dewatered Biosolids for the City of Iowa City. Comment This Resolution will approve the procurement of Loading, Transport and Land Application of Biosolids from LCL Farms. The contract will be for three years, with an option to renew for an additional one three-year period. Three proposals were received using the formal request for proposal process. During the initial three-year contract period this purchase will exceed the $150,000 spending authority of the City Manager, thereby requiring Council approval. Over the course of this 3 -year contract, the City expects to expend approximately $160,000 on loading, transport and land application of biosolids. 7.c. Shared use of city fiber ducts 0-61 t Resolution approving, authorizing and directing the Mayor and City Clerk to execute and attest, respectively, a master agreement for shared use projects between the City and Unite Private Networks. Comment: The City has fiber optic assets in the public rights-of-way, has some excess ductwork capacity and seeks to expand and enhance the availability of broadband connectivity to its residents. Unite will be providing the fiber for Verizon's deployment of ff"eneration (5G) wireless technology (small cell infrastructure) in Iowa City and this Agreement will enable a Shared use Project whereby Unite will lease excess ductwork capacity from the City. 7.d. Housing Trust Fund LIHTC Contribution " a-4 Resolution authorizing the City Manager to sign a memorandum of understanding with the Housing Trust Fund of Johnson County for the contribution and use of $200,000 for Low Income Housing Tax Credit projects. Comment This resolution provides the Housing Trust Fund of Johnson County with $200,000 for Low Income Housing Tax Credit (LI HTC) projects. The MOU attached to the resolution requires that funds be used to support LIHTC projects which serve households under 60% of the area median income. Projects must be located within the corporate limits of Iowa City and must comply with the Affordable Housing Location Model. (Second Consideration) Comment On September 26, 2019 a federal judge in the Southern District of lorwa determined Mat Iowa Code Section 723.4(2) was unconstitutionally vague because it did not contain a required intent component or provide adequate notice of what conduct is prohibited. Because two subsections of the Cilys disorderly conduct ordinance and its disorderly house ordinance were drafted in a manner that closely fdbwed section 723.4(2), we must amend the City Code to comply with the reoentfederal decision. Public Art Strategic Plan Adoption �0� Resolution Adopting the Iowa City Public Art Strategic Plan 2020-2025 Comment The City Council requested the development of a strategic plan for the Iowa City Public Art program after receiving a request to increase funding for the program in December 2018. Since that time, the Public Art Advisory Committee has worked with members of the Iowa City arts community and the general public to develop a five-year plan that creates a sustainable, diverse and vibrant program that will bereft all Iowa Citians. The resulting plan is presented for adoption. Late Addition(s): 14.a Deer management/firearms in parks - Ordinance amending Title 10, entitled "Public Ways and Property," Chapter 9, entitled "Parks and Recreation Regulations," to allow persons to carry firearms in parks for the purpose of killing deer pursuant to a deer management plan. Comment: This ordinance allows firearms in parks for the purpose of killing deer pursuant to a deer management plan. In 1998, the City amended Section 8-7-1 of the City Code to allow for the discharge of firearms within City limits for the purpose of killing deer pursuant to a deer management plan. However, a separate provision (Section 10-9-2C) prohibiting persons from carrying firearms into any park was not similarly amended. When the City engaged in sharpshooting from approximately 1999 to 2009, the sharpshooting did not occur in any City park. It is the assessment of White Buffalo, Inc. (the City's sharpshooting contractor), based on the deer population and availability of land, that it will be necessary to shoot in Hickory Hill Park, and perhaps other parks. The Friends of Hickory Hill Park have been consulted and do not object to sharpshooting in the park. The City will be providing public notification and signage of the park's temporary closure from 3:00 pm to dawn from Dec. 1 to Dec. 22 (and again in late winter during the second round of sharpshooting).
