Consent Calendar - Resolutions and Motions 6.a December 2022 Disbursements Motion to approve disbursements in the amount of $15,399,981.19 for the period of December 1 through December 31, 2022, as recommended by the Finance Director subject to audit. Disbursements are published and permanently retained in the City Clerk's office in accordance with State Code. 6.b Indirect Cost Rate Maximum - Police and Researcher Partnerships ,,, _-- Resolution adopting a maximum indirect cost rate in Police and academic researcher partnerships. Comment: In order to further evidence-based practices and improve public safety, the Police Department occasionally engages in partnerships with academic researchers. Such partnerships typically include a funding agreement outlining direct and indirect costs to be paid to the research partner. To ensure the majority of funds paid to the research partner go to the intended research purpose rather than elevated indirect or overhead costs, the City recommends limiting academic researcher based indirect costs to 10 percent. 6.c Melrose Court Sewer Improvements Resolution accepting the work for the Melrose Court Sewer Improvements Project. Comment: The project has been completed by Midwest Concrete of Peosta, Iowa, in substantial accordance with the plans and specifications. The Engineer's Report and Performance and Payment bonds are on file with the City Clerk. • Project Estimated Cost: $ 525,000.00 • Project Bid Received: $ 567,896.35 • Project Actual Cost: $ 711,770.21 6.d Idyllwild Stormwater Drainage Diversion (1 Resolution accepting the work for the Idyllwild Stormwater Drainage - Diversion Project. Comment: The project has been completed by Maxwell Construction of Iowa City, in substantial accordance with the plans and specifications. Comment: The project has been completed by Tri City Electric of Davenport, Iowa, in substantial accordance with the plans and specifications. The Engineer's Report and Performance and Payment bonds are on file with the City Clerk. • Project Estimated Cost: $ 155,000.00 • Project Bid Received: $ 132,695.00 • Project Actual Cost: $ 133,608.00 6.g Court Street Reconstruction 3 D. Resolution authorizing the acquisition of property interests necessary for construction of the Court Street Reconstruction Project. Comment: The City of Iowa City must acquire right-of-way, fee title, permanent easements and/or temporary construction easements to construct the Court Street Reconstruction Project. The project generally includes roadway reconstruction from Muscatine Avenue to First Avenue, Americans with Disabilities Act (ADA) compliant curb ramps at intersections with roadways and facility entrances, installation of water main, storm sewer, and sanitary sewer. 6.h Fiber Optic Communication System and Electrical Transmission Lines License >J Agreement Resolution authorizing the Mayor to sign and the City Clerk to attest an agreement between the City of Iowa City and USCOC of Greater Iowa, LLC to use a portion of public right-of-way way for the installation, operation and maintenance of a fiber optic communication system and electrical transmission lines to facilitate operation of small cell wireless facilities. Comment: This License Agreement, between the City of Iowa City and USCOC of Greater Iowa, LLC , will allow USCOC of Greater Iowa, LLC to install, operate and maintain underground a fiber optic communication system within public right-of-way. February 7, 2023 Iowa City City Council Agenda Page 4 6.i Procurement of Fire Trucks 3.3-- 3 - Resolution authorizing the procurement of three (3) new Pierce Enforcer Fire Trucks. Comment: This Resolution will approve the procurement of three (3) new Pierce Enforcer Fire Trucks. H-GAC cooperative contract FS12-19A will be utilized for this procurement. Total purchase price is $ 2,786,079.00 which exceeds the $150,000.00 spending authority of the City Manager, and so requires Council approval. 6.j Rollins Pass - Request for Extension of Preliminary Plat 9,3 __3S Resolution approving a six-month extension of the Preliminary Plat and Sensitive Areas Development Plan of Rollins Pass, Iowa City, Iowa. Comment: The owner and applicant have requested a 6- month extension of the preliminary plat and sensitive areas development plan of Rollins Pass (SUB18-00013). Preliminary plats expire within 2 years of approval, and the current plat will expire on April 1, 2023. The applicant has been working with staff since submittal of a final plat application (SUB22 -0007), but additional time is needed to incorporate some final revisions. The proposed extension would mean the preliminary plat would expire on October 1, 2023. 7. Consent Calendar - Setting Public Hearings 7.a Rezoning - N. Dodge St. and N. Scott Blvd. Motion setting a public hearing for February 21, 2023 on an ordinance conditionally rezoning approximately 3.87 acres of property located south of the N. Dodge St and N. Scott Blvd. intersection from Commercial Office Zone (CO-1) to Community Commercial Zone with a Planned Development Overlay (OPD/CC-2) for approximately 2.04 acres and to Low Density Multi Family Residential with a Planned Development Overlay (OPD/RM-12) for approximately 1.83 acres (REZ22-0016). Comment: On January 18, 2023 the Planning and Zoning Commission recommended approval of REZ22-0016 by a vote of 5 -0 (Townsend and Wade absent) subject to conditions related to provisions of a landscape plan approved by the City Forester that shows trees replaced within the Scott Blvd. right-of-way, the dedication of a public access easement over pedestrian facilities adjacent to the Scott Blvd. public right of way that provide connectivity to public sidewalks, installation of a right turn lane along Scott Blvd. subject to approval by the City Engineer, installation of a pedestrian crossing with a refuge island on the southside of Dubuque Rd and Scott Blvd. subject to approval by the City Engineer, and no vehicular access shall be allowed onto N. Dodge St. Approval will allow for the development of commercial uses intended as eating establishments, an 8 unit mixed use building, and 9 attached single family units. February 7, 2023 Iowa City City Council Agenda Page 5 7.b 2023 Park Renovations __3 ((, Resolution setting a public hearing on February 21, 2023 on project manual and estimate of cost for the construction of the 2023 Park Renovations Project, directing City Clerk to publish notice of said hearing, and directing the City Engineer to place said project manual on file for public inspection. Comment: This project includes playground, shelter, and restroom replacements, as well as sidewalk and accessibility improvements at Kiwanis, Hunter's Run, Happy Hollow, and Hickory Hill Parks. The estimated construction cost is $865,000available in the Kiwanis, Hunter's Run, Happy Hollow, and Hickory Hill Park accounts, account#'s R4359, R4375, R4371, and R4365 respectively. 7.c Maximum Property Tax Levy -a,.)) —3 7 Resolution setting public hearing on setting the maximum property tax levy for certain levies for the proposed budget ending June 30, 2024. Comment: Cities are required to hold a public hearing to set a maximum property tax levy for certain levies. 8. End of Consent Calendar Action: 9. Benton Street and west of Orchard Street from Low Density Single-Family Residential with a Planned Development Overlay (OPD/RS-5) and Riverfront Crossing - Orchard (RFC-0) to Riverfront Crossing - Orchard (RFC-0). (REZ22-0015) Comment: On January 4, 2023, the Planning and Zoning Commission recommended denial of the rezoning by a vote of 3-4 (Signs, Craig, Padron, and Townsend in the negative). Staff recommended approval subject to several conditions including construction of sidewalks, traffic signalization of the Orchard St. and W. Benton Street intersection, reconstruction of Orchard St. north of W. Benton St., and dedication of a 30' wide public access easement over the pedestrian street. (Second Consideration) Comment: Since 2007, amateur boxing matches in Iowa City have been prohibited in establishments licensed to serve alcohol for on-premises consumption. Staff supports an exception for events sanctioned by USA Boxing, which would ensure a properly run event with appropriate safety standards.
