Wyss explained that all uniformed officers "shall" or must wear body armor, non-uniformed sworn officers "should" but have the option not to with the acknowledgement of risk. Motion carried, 5/0. OLD BUSINESS None. NEW BUSINESS Adding interview process language to materials -King stated that the Board had previously discussed adding language to the complaint form; further explaining who may be a designated representative for the complainant. The Board briefly discussed options and Jensen said she would draft the language and get it to staff to include in the May meeting packet. PUBLIC DISCUSSION None. Wyss RE: January- February 2011 Use of Force Review DATE: 27 April 27, 2011 The "Use of Force Review Committee" met on Apri127, 2011. It was composed of Captain Wyss, Sgt. Hurd and Sgt. D. Brotherton. For the review of submitted reports in January, 12 Officers were involved in 8 separate incidents requiring use of force involving 6 individuals. In February, 7 Officers were involved in 4 separate incidents requiring use of force involving 4 individuals. No training or safety issues were identified. All issues or concerns were identified and addressed at previous levels of review. Of the 12 incidents over the two month period, 6 Officers had drawn sidearm or displayed weapons and two of those were for the destruction of an animal. There were four separate incidents that required a display of weapon response. A Taser was discharged on one occasion, and on two occasions a Taser was displayed which resulted in compliance witYtout deployment. Of the 12 incidents reviewed, 3 suspects sustained superficial injuries and three Officer superficial injuries were documented during this reporting period. All personnel continue doing a good job in their documentation and review of the reports. The PCRB has its own legal counsel. The PCRB reviews reports prepared after investigation of complaints about alleged police misconduct. It then issues its own written reports that contain detailed findings of fact and conclusions that explain why and the extent to which complaints should be sustained or not sustained. The PCRB maintains a central registry of complaints against sworn police officers and prepares annual reports to the City Council on the disposition of these complaints. The PCRB reviews police policies, procedures, and practices, and may recommend modifications to them. The board shall hold at least one community forum each year for the purpose of hearing citizens' views on the policies, practices and procedures of the Iowa City police department. The PCRB has only limited civil administrative review powers and has no The Complaint Review Process • All complaints to the Board must be filed with the City Clerk within ninety (90) days of the alleged misconduct. Any person with personal knowledge of the alleged police misconduct may file a PCRB complaint with the board. In order to have "personal knowledge", the complainant must have been directly involved in the incident or witnessed the incident. If the person with personal knowledge is underage or otherwise unable to complete a PCRB complaint form, the PCRB complaint maybe filed by such person's designated representative. Those who may file a complaint shall include an adult, a minor with an adult's assistance an adult filing on behalf of a minor. or a vulnerable adult with assistance from a family member, friend, clerg~r or a guardian or other similar court appointed reRresentative. • A support .person (as defined above) may accom~any the complainant through the complaint review process. power or authority over criminal matters or • police discipline. The PCRB receives a completed citizen complaint form and immediately forwards a copy to the Police Chief for internal affairs investigation. (If the complaint is about the Chief, the City Manager will conduct the investigation.) The Chief completes the investigation within 90 days and issues a detailed written report that concludes with a finding that the complaint is "sustained" or "not sustained." The PCRB will grant extensions from this deadline for good cause shown. • Copies of the Chief s report are sent to the PCRB and to the complainant, the police officers, and the City Manager. • The PCRB reviews the Chief s report and may conduct additional investigation or request that the Chief do so. Rick Wyss From: Sam Hargadine Sent: Wednesday, May 04, 2011 3:57 PM To: Rick Wyss Subject: Best time to call and brochure suggestion I've got the PCRB packet and it looks like they are discussing changing their form. One thing I've noticed is sometimes we get an additional complaint because of the time of day that a complaint investigator contacts the reporting party. Perhaps on the same line as Telephone number the form was also modified to request the best time to be contacted at this number. In the narrative of the brochure it goes in to detail about who can file a complaint and what is required of the Chief and PCRB but it doesn't explain that a Supervisor or Investigator will be re-contacting them as part of the investigation. Some people feel that their statement is all that is required so they are put out or intimidated when contacted for follow-up. If the brochure could mention that this is a likelihood then maybe they wouldn't be as intimidated when someone from the PD tries to call them. F•. Information Sheet for Filing a Complaint About an Iowa City Police Officer There are two kinds of complaint forms. The form you choose determines how your complaint will be handled. Iowa City Police Department Complaint Form If you use the Police Department form, Iowa City Police Department Policy will determine the level of investigation into your complaint. You can choose to limit your involvement to a discussion between you and the officer's supervisor, or you can choose to participate in an internal investigation which means that you, the officer, and witnesses will be interviewed by Police Department investigators and a written report on the department's fmdings and conclusions will be prepared. Generally, investigations and any officer discipline that may result from them are considered nonpublic, confidential records. By law, the Police Chief decides if and how an officer will be disciplined. When you use the Police Department complaint form, the Police Citizens Review Board will not review your complaint, unless you also file a PCRB complaint form. It usually takes from one week to three months to receive a final response from the department. Police Citizens Review Board (PCRB) Complaint Form If you use the PCRB form, the Police Department will conduct an internal investigation. A Supervisor or Investigator from the Police Department may contact you as part of the investigation process. As soon as you file your form, the PCRB will also receive a copy of it, so they know your complaint is being investigated. All complaints to the Board must be filed with the City Clerk within ninety (90) days of the alleged misconduct. When the internal investigation is completed, the Police Chief will prepare a written report and send copies to the PCRB, to you, and to the officers involved. The PCRB then reviews the Chief s Report and may conduct its own investigation. The PCRB decides whether the Chief's conclusions are reasonable and issues a public report to the City Council. You will be notified of the outcome of the PCRB's review. The PCRB has no authority to discipline police officers. The PCRB handles its work with complaints confidentially and generally does not include information identifying you or the officer in its reports. However, if a complaint is upheld, the PCRB does have the right to include the names of complainants and officers in its reports. When you use the PCRB complaint form, it usually takes ninety (90) days for the Board to receive the Chief's Report on the internal investigation and an additional one to two months for the Board to complete its work. We are sorry about the invalid mailing address that we gave you. Regarding the two issues addressed in our letter and your response: 1) PCRB Annual Report Our original recommendation was: "We recommend that the PCRB prepare an annual report for distribution at the annual PCRB Community Forum, for posting on the PCRB website, and for publication in the local press." In your response you wrote, "The information you have requested is currently available on our website http://www.iowa-cit ~~org/icgov/apps/boards/members.asp?id= 21, and is updated monthly in the Board meeting packets. There is also an annual report which the Board complies and submits to the City Council." One of our members spent the better part of 30-45 minutes trying to locate a PCRB annual report on your website, but without success. After some time, he did locate a table of links to your agendas and minutes. Although the PCRB minutes probably include all the information and data that an annual report would contain, I think you would agree that searching through the minutes of 17 PCRB meetings is hardly a substitute for a clear and concise annual report. Unable to locate the annual report that the PCRB submitted to the City Council, this same board member telephoned Kellie Tuttle in the City Clerk's office and she patiently walked him through the steps necessary to locate the report on the city's website. The PCRB Annual Report FY 2010 consisted of pages 79-83 of the City Council information packet for their 8/26/2010 meeting. We would encourage each of you to try to locate this annual report on the city's website and then you be the judge as to whether one can reasonably state that these PCRB annual reports are readily available to the public. 2) PCRB Publicity Our original recommendation was: "We recommend that the PCRB actively publicize the fact of its existence, the procedure for filing a PCRB complaint, and the efforts made to make the complaint procedure one that is not intimidating." We must confess that you are doing much more to actively publicize the fact of your existence and your complaint procedure than we were aware. Nonetheless, it is our perception that most members of the Iowa City community are not aware of your existence. It might be productive to do some polling of the public (perhaps using city government interns) to confirm or refute our perception. We do appreciate the fact that you are attempting to make the complaint interview process less intimidating, and we commend you for this. Another point, unrelated to our original recommendations, regards scheduling. One of our board members, who occasionally attends a PCRB meeting, reports that whether a meeting is being held as scheduled or canceled or re-scheduled is information that is difficult to obtain without calling the City Clerk's office.
