CALL TO ORDER: Chair Donald King called the meeting to order at 5:30 P.M.

CALENDAR Motion by Jochimsen and seconded Porter by to adopt the consent calendar as
presented or annended.

King questioned the Acknowledgement of Risk in General Order 00-04 (Body
Armor) as to whether the officer had a choice to wear body armor since the
directive in the procedure is "shall". Wyss explained that all uniformed officers
"shall" or must wear body armor, non-uniformed sworn officers "should" but have
the option not to with the acknowledgement of risk.
Motion carried, 5/0.
OLD BUSINESS None.
NEW BUSINESS Adding interview process language to materials -King stated that the Board had
previously discussed adding language to the complaint form; further explaining
who may be a designated representative for the complainant. The Board briefly
discussed options and Jensen said she would draft the language and get it to
staff to include in the May meeting packet.

The "Use of Force Review Committee" met on Apri127, 2011. It was composed of
Captain Wyss, Sgt. Hurd and Sgt. D. Brotherton.
For the review of submitted reports in January, 12 Officers were involved in 8 separate
incidents requiring use of force involving 6 individuals. In February, 7 Officers were involved in
4 separate incidents requiring use of force involving 4 individuals.
No training or safety issues were identified. All issues or concerns were identified and
addressed at previous levels of review.
Of the 12 incidents over the two month period, 6 Officers had drawn sidearm or
displayed weapons and two of those were for the destruction of an animal. There were four
separate incidents that required a display of weapon response.
A Taser was discharged on one occasion, and on two occasions a Taser was displayed
which resulted in compliance witYtout deployment.
Of the 12 incidents reviewed, 3 suspects sustained superficial injuries and three Officer
superficial injuries were documented during this reporting period.
All personnel continue doing a good job in their documentation and review of the reports.

Established in 1997, the Iowa City Police
Citizens Review Board consists of five
members appointed by the City Council.
The PCRB has its own legal counsel.
The PCRB reviews reports prepared after
investigation of complaints about alleged
police misconduct. It then issues its own
written reports that contain detailed findings
of fact and conclusions that explain why and
the extent to which complaints should be
sustained or not sustained. The PCRB
maintains a central registry of complaints
against sworn police officers and prepares
annual reports to the City Council on the
disposition of these complaints.
The PCRB reviews police policies,
procedures, and practices, and may
recommend modifications to them. The
board shall hold at least one community
forum each year for the purpose of hearing
citizens' views on the policies, practices and
procedures of the Iowa City police
department.
The PCRB has only limited civil
administrative review powers and has no

order to have "personal knowledge", the

Chief s investigation are sent to the

Chief reverse his findings if it
determines that they are unsupported by
substantial evidence; are unreasonable,
arbitrary, or capricious; or are contrary
to Police Department policy or practice,

law enforcement authority, knowing that the information is false, or who reports the alleged
occurrence of a criminal act knowing the same did not occur, commits a simple misdemeanor,
unless the alleged criminal act reported is a serious or aggravated misdemeanor or felony, in
which case the person commits a serious misdemeanor.

I've got the PCRB packet and it looks like they are discussing changing their form. One thing I've noticed is sometimes
we get an additional complaint because of the time of day that a complaint investigator contacts the reporting party.
Perhaps on the same line as Telephone number the form was also modified to request the best time to be contacted at
this number. In the narrative of the brochure it goes in to detail about who can file a complaint and what is required of
the Chief and PCRB but it doesn't explain that a Supervisor or Investigator will be re-contacting them as part of the
investigation. Some people feel that their statement is all that is required so they are put out or intimidated when
contacted for follow-up. If the brochure could mention that this is a likelihood then maybe they wouldn't be as
intimidated when someone from the PD tries to call them.

Information Sheet for
Filing a Complaint About an Iowa City Police Officer
There are two kinds of complaint forms. The form you choose determines how your complaint
will be handled.
Iowa City Police Department Complaint Form
If you use the Police Department form, Iowa City Police Department Policy will determine the
level of investigation into your complaint.
You can choose to limit your involvement to a discussion between you and the officer's
supervisor, or you can choose to participate in an internal investigation which means that you,
the officer, and witnesses will be interviewed by Police Department investigators and a written
report on the department's fmdings and conclusions will be prepared.
Generally, investigations and any officer discipline that may result from them are considered
nonpublic, confidential records. By law, the Police Chief decides if and how an officer will be
disciplined.
When you use the Police Department complaint form, the Police Citizens Review Board will not
review your complaint, unless you also file a PCRB complaint form. It usually takes from one
week to three months to receive a final response from the department.
Police Citizens Review Board (PCRB) Complaint Form
If you use the PCRB form, the Police Department will conduct an internal investigation. A
Supervisor or Investigator from the Police Department may contact you as part of the
investigation process. As soon as you file your form, the PCRB will also receive a copy of it, so
they know your complaint is being investigated. All complaints to the Board must be filed with
the City Clerk within ninety (90) days of the alleged misconduct. When the internal
investigation is completed, the Police Chief will prepare a written report and send copies to the
PCRB, to you, and to the officers involved.
The PCRB then reviews the Chief s Report and may conduct its own investigation. The PCRB
decides whether the Chief's conclusions are reasonable and issues a public report to the City
Council. You will be notified of the outcome of the PCRB's review. The PCRB has no
authority to discipline police officers.
The PCRB handles its work with complaints confidentially and generally does not include
information identifying you or the officer in its reports. However, if a complaint is upheld, the
PCRB does have the right to include the names of complainants and officers in its reports.

We thank you for your February 10, 2011 response to our letter dated December 12,
2010. We are sorry about the invalid mailing address that we gave you.
Regarding the two issues addressed in our letter and your response:
1) PCRB Annual Report
Our original recommendation was:
"We recommend that the PCRB prepare an annual report for distribution at
the annual PCRB Community Forum, for posting on the PCRB website, and
for publication in the local press."
In your response you wrote,
"The information you have requested is currently available on our website
http://www.iowa-cit ~~org/icgov/apps/boards/members.asp?id= 21, and is updated
monthly in the Board meeting packets. There is also an annual report which the
Board complies and submits to the City Council."
One of our members spent the better part of 30-45 minutes trying to locate a PCRB
annual report on your website, but without success. After some time, he did locate a
table of links to your agendas and minutes. Although the PCRB minutes probably
include all the information and data that an annual report would contain, I think you
would agree that searching through the minutes of 17 PCRB meetings is hardly a
substitute for a clear and concise annual report.
Unable to locate the annual report that the PCRB submitted to the City Council, this same
board member telephoned Kellie Tuttle in the City Clerk's office and she patiently
walked him through the steps necessary to locate the report on the city's website. The
PCRB Annual Report FY 2010 consisted of pages 79-83 of the City Council information
packet for their 8/26/2010 meeting. We would encourage each of you to try to locate this
annual report on the city's website and then you be the judge as to whether one can
reasonably state that these PCRB annual reports are readily available to the public.
2) PCRB Publicity
Our original recommendation was:
"We recommend that the PCRB actively publicize the fact of its existence,
the procedure for filing a PCRB complaint, and the efforts made to make the
complaint procedure one that is not intimidating."
We must confess that you are doing much more to actively publicize the fact of your
existence and your complaint procedure than we were aware. Nonetheless, it is our
perception that most members of the Iowa City community are not aware of your
existence. It might be productive to do some polling of the public (perhaps using city
government interns) to confirm or refute our perception.
We do appreciate the fact that you are attempting to make the complaint interview
process less intimidating, and we commend you for this.
Another point, unrelated to our original recommendations, regards scheduling. One of
our board members, who occasionally attends a PCRB meeting, reports that whether a
meeting is being held as scheduled or canceled or re-scheduled is information that is
difficult to obtain without calling the City Clerk's office. Is it possible for you to post on
the PCRB homepage the date of the next meeting and any re-scheduling or canceling of
PCRB meetings?

Please allow me to introduce myself. My name is Karen Ullery Williams and I have recently
learned of your interest and work in the field of civilian oversight. I am a member of the
National Organization for Civilian Oversight of Law Enforcement (NACOLE) Board of Directors,
as well as an Analyst with the Office of Community Complaints, providing oversight of the
Kansas City, Missouri Police Department. I am pleased to share with you a little about what
NACOLE does and how we might work together in our shared goals.
NACOLE was founded in 1995 to help communities promote fair, firm and consistent law
enforcement through civilian oversight. In doing so, we provide educational resources and
technical assistance to civilian oversight practitioners and serve as an informational and
educational clearinghouse to those wanting to learn more about current policies, procedures
and other related issues.
To ensure that we are constantly learning and sharing best practices, NACOLE hosts a yearly
conference for its members and those who benefit by the work that we do. This conference is a
great training resource for those new to civilian oversight and those paving the way for new
and improved oversight practices. It brings together scholars, oversight professionals, law
enforcement personnel, government officials, and civic leaders. This September, we will be
hosting our seventeenth annual conference in New Orleans, Louisiana. There will be
workshops, plenary sessions, and on-site training to explore current trends and challenges in

Types of Membership
Organizational Membership:
$300 Annually
Organizational members are defined as agencies or boards who provide civilian oversight by legislative or executive
mandate. These agencies or boards will receive one transferable (voting) membership. All agency or board affiliate
members are eligible to serve on committees; however, election or appointment to the Board of Directors shall be
limited to the designated voting member of the agency or board. Cities or other political subdivisions may obtain one
organizational membership to cover alt the entities within it which meet the requirements for regular membership.
Regular Membership:
$150 Annually
Regular members are defined as those persons who:
• Who are not sworn law enforcement officers;
• Who work for or constitute agencies which are established by legislative or executive authority to investigate and/or
review issues and complaints against law enforcement; and/or
• Who have worked for and/or have constituted agencies, which are established by legislative or executive authority
to investigate and/or review complaints against law enforcement.
Who are mayors, county or municipal managers or who otherwise hold an executive position or are on a board,
council, commission or committee with authority to direct, control, and/or oversee the activities and/or
performance of the chief law enforcement officer of a political subdivision.
Associate Membership:
$100 Annually
Associate members are defined as any person interested in the oversight of law enforcement. Associate members shall
be able to participate in all Association activities including serving on committees, but are ineligible to vote or serve as
an officer or member of the Board of Directors.
Student Membership:
$50 Annually
Student members are defined as individuals currently enrolled either full or part-time in a college or university program
in the area of criminology, criminal justice, law, sociology, political science, public administration, journalism, or a
related field and who are interested in the oversight of law enforcement. Student members shall be able to participate
in all Association activities including serving on committees, but are ineligible to vote or serve as an officer or member of
the Board of Directors.
