Resolutions and Motions: ITEM 3d(1) CONSIDER A RESOLUTION APPROVING AN AGREEMENT BETWEEN THE CITY AND SUMMER OF THE ARTS, INC. TO ALLOW THE I3 23� TEMPORARY AND LIMITED SALE, CONSUMPTION, AND POSSESSION OF BEER DURING ARTS FEST, JAZZ FEST, AND SAND IN THE CITY WITHIN A SPECIFIED AREA ON A CITY STREET. Comment: Section 4 -5 -3 of the City Code allows for the sale and consumption of alcohol in a city park, on a right -of -way, or other public ground, excluding public buildings, pursuant to written agreement. The agreement, which is attached to the resolution, allows Summer of the Arts, Inc. (SOTA) to sell beer in a fenced off area on Iowa Ave. during Arts Fest, on N. Clinton St. during Jazz Fest, and on Iowa Ave. during Sand in the City. In previous years, alcohol was sold only during Arts Fest and Jazz Fest. SOTA has requested that it be allowed to sell alcohol during Sand in the City as well. The exact locations and dimensions of the sites are attached as exhibits to the proposed agreement. The agreement is substantially similar to the one executed last year except for the addition of Sand in the City and the addition of the governmental immunities endorsement (Exhibit D). ITEM 3d(2) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN a3 AND THE CITY CLERK TO ATTEST TO THE PARTIAL RELEASE OF JUDGMENT. Comment: The City obtained a small claims judgment against Max A. Hilton in April 2011. This is relating to the City's acquisition of his flood damaged home. Mr. Hilton requested and received a payment plan of $100 per month from the Court. Mr. Hilton has been making his monthly payments and there remains a balance of approximately $990. He owns a property in North Liberty with his daughter. She resides there; Mr. Hilton does not. Mr. Hilton and his daughter would like to sell the property. This resolution will release the North Liberty property from the City's judgment lien. Staff recommends approval because Mr. Hilton is making regular payments as ordered and because it is not his homestead. May 15, 2012 City of Iowa City Page 3 ITEM 3d(3) /,9- -a 3a CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST TO AN AGREEMENT WITH RIVERSIDE THEATRE THAT ALLOWS THE SALE OF WINE AND BEER UNDER LIMITED CIRCUMSTANCES IN CITY PARK FROM JUNE 14, 2012 THROUGH JULY 8, 2012. Comment: Section 4 -5 -3 of the City Code allows for the sale and consumption of alcohol in a city park, on a right -of -way, or other public ground, excluding public buildings, pursuant to written agreement. Staff has approved the agreement, which is attached to the resolution, that allows Riverside Theatre to sell beer and wine and for attendees to consume beer and wine from June 14 through July 8, 2012 in a specified area in and around Riverside Festival Stage in City Park. The terms in the agreement are the same as last year with the exception of the dates and the addition of the governmental immunities endorsement (Exhibit B of the agreement). ITEM 3d(4) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST TO A SUBORDINATION a �a 33 AGREEMENT BETWEEN THE CITY OF IOWA CITY AND UNIVERSITY OF IOWA COMMUNITY CREDIT UNION, IOWA CITY, IOWA FOR PROPERTY LOCATED AT 15 REGAL LANE, IOWA CITY, IOWA. Comment: University of Iowa Community Credit Union has requested that the City approve a Subordination Agreement for property at 15 Regal Lane. The owner of the property received a Mortgage from the City of Iowa City through the Housing Rehabilitation Program. The property has enough equity to cover the City's lien position. ITEM 3d(5) CONSIDER A RESOLUTION AUTHORIZING AN AGREEMENT BETWEEN THE CITY OF IOWA CITY AND ELIEZER A. SOTILLO RODRIGUEZ (ARTIST) AND MARC MOEN (SPONSOR) FOR INSTALLATION OF MURAL ON CITY OWNED PROPERTY AT 220 S. DUBUQUE STREET AND AUTHORIZING THE MAYOR TO EXECUTE AND THE CITY CLERK TO ATTEST THE SAME. Comment: Marc Moen is sponsoring the painting of a mural on the north wall of the Dubuque Street Parking Facility. An agreement is necessary to preserve the rights of the City to have access to the mural area for purposes of maintaining the structure. ITEM 3d(6) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST TO THE RELEASE OF LIEN REGARDING AN AGREEMENT FOR THE PROPERTY LOCATED AT 213 E. MARKET STREET, IOWA CITY, IOWA. Comment: The owner of the property received assistance through the City of Iowa City Community Development Block Grant (CDBG) funds. The terms of the loan have been satisfied; thus the lien needs to be released. May 15, 2012 City of Iowa City Page ITEM 3d(7) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST LICENSE AGREEMENT BETWEEN THE CITY OF IOWA CITY AND iWIRELESS, L.L.C. TO USE CERTAIN PUBLIC RIGHTS -OF -WAY FOR THE INSTALLATION, OPERATION AND MAINTENANCE OF AN ELECTRICAL TRANSMISSION LINE. Comment: This agreement will allow iWireless to install, operate, and maintain a buried conduit containing an electrical transmission line within City of Iowa City public right -of -way. This electrical transmission line placement is desired to provide electrical service to a proposed cell phone tower to be installed atop the Johnson County Health and Human Services Building by iWireless. ITEM 3e. Setting Public Hearings: ITEM 3e(1) CONSIDER A RESOLUTION OF INTENT TO CONSIDER THE �a 3� PROPOSED CONVEYANCE OF UTILITY EASEMENTS ON AND OVER PORTIONS OF 1807 AND 2001 LOWER MUSCATINE ROAD AND SETTING A PUBLIC HEARING ON SAID PROPOSAL FOR JUNE 5, 2012. Comment: MidAmerican Energy Company has asked for a utility easement across the property at 2001 Lower Muscatine Road and an electrical and gas easement across the property at 1807 Lower Muscatine Road. These easements provide areas for MidAmerican Energy Company to install utility facilities underground in preparation for the City's Lower Muscatine Road Reconstruction Project (Kirkwood Avenue to 1St Avenue). These easements are valued at a total of $2,500. Staff, however, recommends conveying these easement rights without compensation, as the consideration for these rights was factored into the agreement between the City and MidAmerican for acquisition of certain property rights from MidAmerican in conjunction with the Lower Muscatine Road Reconstruction Project (Kirkwood Avenue to 1,t Avenue). ITEM 3e(2) CONSIDER A MOTION SETTING A PUBLIC HEARING FOR JUNE 19, 2012 REGARDING AN AMENDMENT TO IOWA CITY'S FY11 ANNUAL /9 ACTION PLAN, THAT IS A SUB -PART OF IOWA CITY'S 2011 -2015 CONSOLIDATED PLAN (a.k.a. CITY STEPS). Qo1D Comment: A public hearing regarding an amendment to the FY11 Annual Action Plan to use $280,000 of CDBG funds for recreational improvements at Fairmeadows Park, 2500 Miami Dr. A 30 -day public comment period startodon May 18, 2012. 4 May 15, 2012 City of Iowa City Page ITEM 3e (3) CONSIDER A RESOLUTION SETTING PUBLIC HEARING FOR JUNE 5, 1 a 3 7 2012, ON A PROPOSAL TO CONVEY A SINGLE FAMILY HOME LOCATED AT 332 SOUTH GOVERNOR STREET. Comment: The grant for the UniverCity Neighborhood Partnership Program allows the City to purchase twenty -six rental units located in designated neighborhoods surrounding the University, rehabilitate them with up to $50,000 in grant funds, and then sell them to income - eligible buyers. Under the UniverCity Neighborhood Partnership Program, the City proposes to sell 332 South Governor Street. The amount of the sale will be $169,000 (this is what the City paid to purchase the home) plus the "carrying costs," which are which are all costs incurred by the City to acquire the home, maintain it and sell it, including abstracting and recording fees, interest on the loan to purchase the home, mowing and snow removal, utilities, real estate taxes, and any costs in excess of $50,000 to repair and rehabilitate the home. ITEM 3e(4) CONSIDER A RESOLUTION SETTING A PUBLIC HEARING ON JUNE 5, 2012 ON PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE CONSTRUCTION OF THE J STREET & SYCAMORE VIEW WATER MAIN - SOUTHEAST JUNIOR HIGH SANITARY SEWER PROJECT, DIRECTING CITY CLERK TO PUBLISH NOTICE OF SAID HEARING, AND DIRECTING THE CITY ENGINEER TO PLACE SAID PLANS ON FILE FOR PUBLIC INSPECTION. Comment: This project involves installing new water main along J Street and Sycamore View to provide new water main services feeding homes along 1St Avenue. This project also includes a new sanitary sewer service for South East Junior High, and all associated pavement removals and restoration. This work is in preparation for construction of the 1 St Ave /IAIS RR Crossing Improvement Project. The estimated cost of the project is $246,000 and will be funded with Water and Wastewater revenue proceeds and is included in the 1St Ave /IAIS RR Crossing Improvement Project budget. ITEM 3e(5) CONSIDER A RESOLUTION OF INTENT TO CONSIDER THE PROPOSED CONVEYANCE OF PROPERTY KNOWN AS THE i a — a 39 PENINSULA NEIGHBORHOOD, FOURTH ADDITION, IN IOWA CITY, IOWA, TO PENINSULA DEVELOPMENT COMPANY, AND SETTING A PUBLIC HEARING ON SAID CONVEYANCE FOR JUNE 5, 2012. Comment: This Resolution declares the City Council's intent to consider the proposed conveyance of the above property as contemplated in the Development Agreement, sets a public hearing on said conveyance for June 5, 2012, and directs the City clerk to publish notice of said public hearing. 5 May 15, 2012 City of Iowa City Page 6 ITEM 3e(6) r a - aka CONSIDER A RESOLUTION SETTING PUBLIC HEARING FOR JUNE 5, 2012, ON A PROPOSAL TO CONVEY A SINGLE FAMILY HOME LOCATED AT 928 LONGFELLOW COURT. Comment: The Iowa City Housing Authority, under its Affordable Dream Home Program, proposes to sell 928 Longfellow Court. The amount of the sale will be $147,000, which is the appraised value of the home. The family is currently being assisted through the Housing Authority and meets income eligibility criteria. The family has received a written commitment for a mortgage from a local bank in the amount of $110,250. The City will provide a second mortgage for the remaining $36,750. This sale will provide the opportunity for a low- income family to obtain ownership of their own home. ITEM 3f. Approval will increase the number of required parking spaces so that at least 1 parking space is provided for each bedroom for multi - family dwelling units located in a designated impact area close to the University of Iowa campus where parking congestion and the resulting illegal parking is a concern. Comment: This project modifies and updates the east entry of the Robert A. Lee Recreation Center. This includes replacing the ramp, railing, and relocating the stairs, as well as extending the dock area. The existing structural slab is updated with the addition of concrete pavers, a light pole, and benches. Existing canopy lighting will be replaced and repopulated. The patio is extended by the addition of a lower patio to include light poles and concrete planters. ADA parking is relocated and improved. The existing driving path adjacent to the entry will become one directional to facilitate safety. Additional parking stripes and a curb will be implemented in this update. CONSIDER A RESOLUTION APPROVING Action: -,Dab May 15, 2012 City of Iowa City Page 10 p v ITEM 9. CONVEYING VACTED PORTION OF MELROSE PLACE RIGHT -OF -WAY TO THE UNIVERSITY OF IOWA. Comment: The University has requested that they City vacate and convey to it that portion of Melrose Place adjacent to University -owned property in order to facilitate the construction of a surface parking lot. Council is considering the vacation of the subject right -of -way. In the event that such vacation is approved, Staff recommends that the City convey such vacated right -of -way to the University, subject to several conditions, including the retention of an access easement over the parking lot to mitigate traffic congestion at the intersection of Melrose Place and Hawkins Drive, which would direct much of the traffic to a new, more easterly access point along Melrose Avenue. Because the University is a public entity and because they will be providing certain public amenities, such as the access easement, sidewalks, and utility improvements, this conveyance is proposed to be for $0. a. CONSIDER AN ORDINANCE AMENDING TITLE 2 OF THE CITY CODE, ENTITLED "HUMAN RIGHTS," CHAPTER 4, ENTITLED "ENFORCEMENT," TO PROVIDE THAT THE HUMAN RIGHTS OFFICE MAKE THE PROBABLE CAUSE DETERMINATION. (PASS AND ADOPT) Comment: Presently the Human Rights Office investigates a complaint and makes a recommendation of probable cause to the City Attorney, who makes the probable cause determination. Over the past approximately 12 years, staff can recall only 3 occasions where the City Attorney came to a different conclusion than the Human Rights Office. This second layer of administrative review is not legally required and delays the process. Additionally, the Human Rights Office staff interviews the parties and witnesses and is better able to determine credibility, which is often critical in making a probable cause determination. The City Attorney will continue to make the "litigation worthy" determination, which is the decision whether to bring a case with a probable cause finding to hearing. The Human Rights Commission passed a motion accepting this change at its March 20 meeting. Action: OF e ITEM 21. Comment: The construction inspection and administration of this project will be performed by City staff, supplemented with support services from private companies. This contract will provide the material testing and specialty inspection services necessary for this project. This contract will be awarded to Shive - Hattery Architecture and Engineering for $198,820.20 and is included in the budget for this project. TO CONTINUE EXISTING RECYCLING PROCESSING SERVICES. Comment: The existing recycling processing contract with City Carton Company, Inc. expires on June 30, 2012. The contract contains a rollover option which City Carton agrees will be exercised for two years to cover July 1, 2012 through June 30, 2014. The option exists within this contract to move to a single stream processing system. City Carton agrees to modify the fee per ton of recyclables received if the single stream option is exercised. Comment: At the April 17 work session, Council approved a pilot program for four fa gSS benches in the BenchMarks project. This resolution approves the BenchMarks Project for all benches in the downtown and the northside and sets for the parameters of the project. The Downtown Iowa City SSMID will coordinate the project by arranging for artists and submitting designs to the Public Art Committee. The Public Art Committee will ensure that the designs meet the program requirements. The resolution authorizes the City Manager to enter into an agreement with SSMID for the BenchMarks Project. Action: ITEM 24. CONSIDER A RESOLUTION AUTHORIZING THE AWARD OF A CONTRACT TO COMMUNICATION ENGINEERING CORPORATION (CEC) FOR A CITY- _ WIDE SOLUTION FOR NON - PUBLIC SAFETY RADIOS. Comment: This resolution will approve a contract with Communication Engineering Corporation (CEC) for a non - public safety radio solution. Request for Proposal (RFP) #11 -04 Digital Land Mobile Radio System was put out for proposals and resulted in two proposals. Both were judged by an evaluation team based on numerous criteria. The CEC proposal met all City requirements, had data capacity for automatic vehicle location and other data packets, and cost substantially less than the RACOM proposal. Comment: An agreement is being negotiated between the City and Fin and Feather for the use of the Marina Building for recreational equipment rentals and food concessions at the Terry Trueblood Recreation Area. This agreement will be for a three year period of time on a year round basis, enhance the public's ability to fully utilize the park and provide the City some revenue from the concession.
