Brad Comer Clerk, Iowa City Conference Board IOWA CITY CONFERENCE BOARD MINUTES February 9, 2015 Iowa City Conference Board: February 9, 2015, at 5:00 P.M. in the Council Chambers at the Iowa City City Hall, Mayor Matt Hayek presiding. Iowa City Council Members_ Present: Botchway, Dickens, Dobbins, Hayek, Mims, Payne and Throgmorton. Johnson County Supervisors Present: Carberry, Neuzil, Rettig and Sullivan. Iowa City School Board Members Present: Townsend. Others Present: Burkle, Comer, Markus, Fruin, Dilkes, and Karr. Digital Recording: February 9, 2015. Chair Matt Hayek called the meeting to order and Clerk Dennis Baldridge called roll and stated that a quorum was present. The County (Neuzil) moved to accept the minutes of the last Conference Board meeting, March 4, 2014, the City (Payne) seconded and the motion carried unanimously 2/0. The Iowa City School Board, having only one member present, did not have a vote recorded. Iowa City Assessor Dennis Baldridge presented his FY '16 Assessment Expense Fund budget. The increases are $13,410 for a 2.50 to 3.00 percent cost -of -living increase in salaries, $10,950 for merit/step increases, $1,538 for an increase in FICA, $1,782 for an increase in IPERS, $5,000 for an increase in health insurance, $600 for an increase in Board of Review salaries, $400 for an increase in other insurance, $200 for an increase in workers compensation, $3,000 for an increase to the auto replacement fund and $10,000 for an increase in aerial photography. The increases are offset by a $5,000 decrease to leave contingency, $5,500 for a decrease in postage, an alternate year expense, $4,000 for a decrease in printing, also an alternate year expense, and $3,000 for a decrease in software maintenance. There was a short discussion about the City and County percentages for cost of living increases and about county merit increase percentages. It was decided that the recommended amounts would be approved for publication and that the amounts could be adjusted at the formal budget hearing. It was also recommended that since the amount for auto replacement is normally carried over and increased each year to gradually build for future purchases, for clarity this amount should be placed in a Reserve Fund. The County (Rettig) moved to approve the budget for publication. The motion was seconded by the City (Throgmorton) and passed unanimously 2/0. The County (Neuzil) moved to set the public hearing for March 9, 2015 at 5:00 P.M. at the Iowa City City Hall, the City (Mims) seconded and the motion carried unanimously 210. It was moved by Throgmorton of the City and seconded by Sullivan of the County to re- appoint Phoebe Martin to a six year term on the Iowa City Board of Review ending January December 31, 2020. The motion carried unanimously. Assessor Baldridge announced his retirement effective February 28, 2015. Chairperson Hayek congratulated Mr. Baldridge and thanked him for his service on behalf of the Conference Board. Baldridge thanked the board for their support and confidence over the past thirteen years. A discussion was then held concerning the procedures for appointing a new assessor. There being no other business, it was moved by the City (Mims) and seconded by the County (Sullivan) to adjourn at 5:38 P.M. Motion carried unanimously, 2/0. The coefficient of dispersion (C.O.D.) is a measure of assessment uniformity based on the degree to which individual sales ratios vary from the median sales ratio. The goal of the Iowa City Assessor is to keep this C.O.D. below 10. A C.O.D. of 10 is considered excellent. RESIDENTIAL SALES STATISTICAL ANALYSIS The following statistics are for Residential sales, and below are tables of the ranking of Iowa City in comparison to the other 106 assessing jurisdictions in Iowa. For brevity, only the top 10 are shown. Data is for 2013 sales which is the „I _ available. These tables show that Iowa City is still one of only a few jurisdictio sin Iowa with. a C.O.D. of less than 10. Iowa City also has a large number of sales as could be expected by its size and mobile population. Report of Iowa City Assessor Examining Board Pursuant to Iowa Code Section 441,6, the Iowa City Assessor Examining Board hereby submits the following written report of its activities and its recommendation to the Iowa City Conference Board, The Examining Board, composed of Michael W. Kennedy, Chace Ramey and Karin Franklin, initially met with outgoing City Assessor Dennis Baldridge on February 11, 2015 to review the procedure that must be followed by the Board pursuant to Chapter 441 of the Iowa Code. Given the fact that there are over 270 names on the list of eligible individuals on the Iowa Department of Revenue's certified list, showing persons eligible to be appointed as assessor, the Examining Board voted to send out a request for resumes only to those persons on the list who are residents of Johnson County, Iowa or Linn County, Iowa, At the time of this initial meeting, Brad Comer, who is currently a deputy assessor in the Iowa City Assessor's Office, submitted his resume in person to the members of the Examining board. On February 11, 2015, a written notice was mailed by the Examining Board to all persons on the eligible list residing in Johnson County or Linn County, requesting that anyone who wanted to submit a resume should do so by February 20, 2015. No further resumes have been received by the Examining Board pursuant to said notice. On February 18, 2015, the Examining Board received the official certified list of all individuals eligible for appointment as Assessor from the Iowa Department of Revenue. On February 26, 2015, the members of the Examining Board conducted their second meeting telephonically, One of the board members, Michael W, Kennedy, reported that no resumes, other than Brad Comer's resume, had been received. The board therefore decided to conduct an oral interview of Brad Comer on March 2, 2015 at 8;00 A.M. at the office of the Iowa City Assessor, On March 2, 2015 at 8;00 A.M., the Examining Board conducted an oral interview of Brad Comer. All board members participated and asked questions of Mr. Comer. Board member IGarin Franklin was out of town on the date of said interview, but participated in the interview telephonically. At the conclusion of the interview, the board met privately to discuss its recommendation to be made to the Iowa City Conference Board. The Examining Board unanimously concurred that Brad Comer is an extremely well- qualified candidate for the position of Iowa City Assessor, based on his professional background and his work experience as a longtime employee of the Iowa City Assessor's Office. The Examining Board now recommends that Brad Comer be appointed as the new Iowa City Assessor. That was one of the headlines when a Boston woman reported her driver "indecently touched her several times' last month, according to the Boston Police Department. Such incidents seem frighteningly common now. In the past year alone, there have been several high- profile reports of drivers attacking passengers of ridesharing services like Uber. In the United States, there were assaults reported in Boston, Washington, D.C., Chicago, Oklahoma, Los Angeles, and Orlando. But how dangerous is Uber compared with a taxi or limousine? "There's no way to search for that," said Neva Coakley, a spokeswoman for the Boston Police Department. "We wouldn't be able to speak to that because we don't have data to support it. We don't distinguish between what type of suspects they are." In other words, Boston doesn't track assaults by where they happen—in a taxi, in an Uber, or in someone's home—so there's no data to compare reports against Uber drivers versus taxi drivers or limo drivers. That's true in other cities, too. We asked police departments in five cities—Boston, San Francisco, Chicago, New York, and Washington, D.C.—for information about assaults against passengers of taxis or Uber cars. None of them tracked violent crimes at that level. This is meaningful because it underscores how the narrative about ridesharing and public safety is largely anecdotal. It raises another question, too: If Uber is potentially unsafe for passengers, what about taxis? "We don't keep specific data with relation to passengers being assaulted," said Lee Jones, a spokesman for the New York Police Department. "We don't track offenses by whether they occurred in a taxi cab," said Gwendolyn Crump of the Metropolitan Police Department in Washington, D.C. http://www.theatlantic.com/technologylprintl2Ol5/03/are-taxis-safer-than-uberl3862071 3/3/2015 Are Taxis Safer Than Uber? - Technology - The Atlantic Page 2 of 5 "As far as tracking the offenses in taxi cabs specifically, I don't have a way to look this up," said Grace Gatpandan, a public information officer with the San Francisco Police Department in the city where Uber is headquartered. Police officers in Chicago did not respond to multiple interview requests. Allan Fromberg, a spokesman for the New York City Taxi and Limousine Commission, said some Uber complaints are invisible to law enforcement. "Apparently, people often complain to Uber through driver ratings, which only Uber sees." (A spokesman for Uber says it's the other way around: Passengers often call the police before they complain to Uber, and the company finds out about alleged crimes through law enforcement.) One website that tallies Uber incidents is run by the Taxicab, Limousine & Paratransit Association, a trade association representing taxi and limo companies—a group that has a stake in making Uber look bad. "Unfortunately we don't have hard numbers, but anecdotally," said Dave Sutton, a spokesperson for the association, "we see this as an outrageous number of incidents." Uber's recent track record has been troubling. In addition to the recent assault reported in Boston, an off-duty Uber driver is being investigated in connection with a sexual assault near Los Angeles earlier this month, according to the Los Angeles Times. Uber insists it meets the highest standards for safety, and says its background -check process has been in place since April. That process applies to UberX rideshares, but not to black cars and SUVs—those are managed through partnerships with existing local limo companies. "Unlike the taxi industry, our background checking process and standards are consistent across the United States and often more rigorous than what is required to become a taxi driver," the Uber spokesman Taylor Bennett told us. Uber uses a private company called HireEase to conduct background checks. "Ours cover courthouse records, county, state, and federal records," Bennett said. "We cover the gamut in terms of what we look at." There have been several reports about loopholes that have led to Uber approving drivers with criminal histories including felony convictions. And the Fair Credit Reporting Act limits the amount of information HireEase is able to uncover. ("The [act] does not limit the time for reporting convictions," the company explained on its website, "However, adverse matters that did not result in a conviction are only reportable for seven years under the FCRA.") So while taxi companies check a prospective driver's fingerprint records against a database that theoretically (more on that in a minute) includes a person's complete criminal history in the United States, Uber background checks use a database that can only go back seven years for some information. Late last year, San Francisco District Attorney George Gascon called Uber's background checks "completely worthless," according to the Los Angeles Times. And several Uber and UberX drivers in the Washington, D.C., area said Uber's background checks were hardly rigorous. "Not really," said an Uber black car driver in Washington, D.C., who requested anonymity because he feared retribution. "Look, the real background check is getting fingerprinted and that takes how many weeks? This one is just online. A real background check is not like this. But Uber checks kind of. They're kind of background checks." Uber, of course, disagrees with this assessment. Fingerprint scans, the kind used by many taxi services, Uber's Bennett told The Atlantic, offer just a "snapshot in time." The FBI's process takes up to 16 weeks, and involves checking an individual's records related to arrests, federal employment, naturalization, or military service, according to information provided by the agency. "Well it goes as far back as the records we have, and we've been doing this since 1924," FBI spokesman Stephen Fischer Jr., said. "The big key is it is a voluntary process, so law enforcement agencies are not required to provide us their arrest data and criminal history information. We rely on the agencies to provide us the most accurate and up-to-date information, as we are just the repository." Ten percent of Boston taxi drivers who took Uber's background check failed, he said. And some Philadelphia UberX drivers who passed the city's background test ended up failing Uber's, he said. In reality, no background check is perfect. That's according to Michael Fertik, author of The Reputation Economy, which explores the growing influence of a person's online reputation. "If someone has no DUI but every photograph of him is drinking, and then that guy gets into an accident, God forbid, then the media would excoriate Uber for having hired him," Fertik said. "At the same time, before the accident, you can't not hire him because he's photographed drinking." "If someone has a history of disparaging women, given Uber's current PR challenges around women's safety, you have to ask, 'How is this person disparaging women? Does it feel real? Does it feel humorous? Do we care about that distinction?"' Without a perfect background check, there's no way to be fully confident about a hire. Every hire ends up being something of a risk analysis. And it's not just the hiring process that's imperfect, Fertik says. Humans happen to be flawed, too. "There's a difference between making an offhand remark and assaulting someone," he said. "At some point, people have to be able to live their lives. It's not like everyone is going to pass the ultimate background check. It doesn't mean they get to be president, but they might be able to become an Uber driver." What may be more revealing about the safety of Uber versus traditional taxicabs is what happens once an incident has occurred. After an assault against a passenger is reported, Uber says it immediately removes a driver's access to the app while the investigation is underway. Uber also points out that as soon as a driver is suspended, that driver can no longer access the app to pick up a passenger. And without access to the Uber app, drivers don't have access to passengers. "If there are instances of serious behavior that don't meet our quality standards then we absolutely will deactivate riders and drivers," Bennett said. The company doesn't have numbers on how many drivers are suspended for good, versus suspended and reinstated, he said. In cities like Washington, D.C., and New York, taxi companies and the commissions that oversee fleets describe a similar process for suspending drivers accused of assault. In Washington, drivers are suspended as soon as criminal charges are filed, said a spokesman for the District of Columbia Taxicab Commission, the city agency that oversees the local taxi industry. Taxi drivers have been in the headlines just like Uber has. In the past year, there have been assaults against taxi passengers reported in Seattle, Washington, D.C., Portland, Fort Lauderdale, and elsewhere. In 2012, a rash of incidents in Washington—seven assaults over the course of a few weeks— prompted the District's taxicab commissioner to issue a warning to female passengers. At the time, the commissioner promised panic buttons would be installed by the end of that year. Now, three years later, the target date for installation is June of 2015. (Uber says it will add a "panic button" to its app for Chicago passengers later this year, according to the Chicago Sun -Times.) The taxi commission in Washington acknowledged there are still concerns about assault—both from passengers and from drivers—though the scope of the problem is not clear. "It's not as if there's a standard procedure where we get all incident reports," said Neville Waters, a spokesman for the commission. "A lot of it depends on the commander of the particular ward. That also doesn't necessarily mean that all assaults that are occurring in a cab are being captured or that we're even getting that information." The questions about Uber's safety are part of a much larger debate over regulation of what's come to be known as the sharing economy. And the narrative about Uber rides being inherently more dangerous than taxi transportation is, not surprisingly, being pushed by those most threatened by Uber's success. Calling Uber a "success"—the company is valued at $4o billion—seems like something of an understatement. Uber is trouncing the competition. There were 2 million fewer taxi rides in Washington, D.C., last year compared with the year before, Waters told me—that's a 9 percent drop in taxi business in a single year. And taxi business declined a stunning 65 percent in a two-year period after Uber showed up in San Francisco. But there's little to suggest that the newest form of ridesharing is significantly riskier than the old one. As for the relative safety of taxis versus ridesharing, Waters preferred not to speculate. "I know very little about the company's operations," Waters said. "They're pretty secretive and they certainly don't share data with us. I think it would be unfair to base an opinion... I've never used the service. I don't really know." Those are just three of the benefits that could flow from a such a world, says a report being released Thursday by consultants McKinsey & Co., which looks at how "autonomous vehicles could reshape our lives." The short answer: Dramatically -- and within a couple decades. Commuters who consider themselves to be early adopters will be tooling around in self -driving cars by roughly 2025 to 2030, says Hans -Werner Kaas, a McKinsey senior partner who heads the Automotive and Assembly practice. Mass adoption is likely about 2040. The race to create self -driving cars has become a gold rush by both automotive and technology giants. Nissan says it hopes to field a self -driving vehicle by 2020. Google has a fleet of test vehicles in California and Nevada. But Kaas notes that some industries already are a step ahead with autonomous vehicles on the job now in enclosed environments, such as trucks in mining pits and tractors on farms. Long-haul trucks could be next, he says, with companies such Daimler, parent of Mercedes-Benz parent Daimler having already created a prototype. All who try such vehicles will see benefits not just for themselves, but for society overall, the report finds. The 50 minutes a day -- based on average commute times worldwide -- is time would be saved by commuters by not having to drive and during which they could work, relax or be entertained. Since self -driving cars could drop off passengers and then park themselves, parking spaces wouldn't need to be wide enough to allow doors to open. That could free up 6.8 billion square yards in the U.S. that is currently being used for parking lots -- the equivalent of the Grand Canyon and Zion national parks combined -- the report states. Since self -driving cars could eliminate human driver error and be less likely to crash, not only would death and injury rates fall, but property savings would add up to $190 billion in the U.S. alone. Insurers would no longer be insuring drivers against their own mistakes, but would have to switch their models to insure against "technical failure." Premiums would plummet, the report says. There might even be fewer cars overall, says Kaas, since more people may use car -sharing or robotic taxis. But reach this automotive utopia won't be without bumps along the road. Automakers have yet to deploy systems that allow cars to communicate so they can avoid each other. And governments are yet to draft regulations that will define what autonomous cars are allowed to become. We can visualize almost every room now! Nearly all of the SIPS panels that form the roof are in place as well. Structural insulated panels (SIPS) are high performance building panels that are strong, energy efficient, and cost effective. As the SIPS are set in place, moisture barrier material covers them to protect the interior and to prepare the roof for the shingles. The subcontractors have moved inside and are installing HVAC, plumbing, and electrical equipment. The building looks amazing and is coming together well. At the temporary Animal Center location we have started move preparations. We are reducing clutter and have secured offsite storage for supplies used only during disaster relief. Some of our Animal Center staff toured the new building and they are really excited for such a positive change. We are all looking forward to working in a more efficient and better designed building. Of the available funding, $25,000 will be dedicated as grants for projects serving below 30% AMI. Eligible applicants include businesses, nonprofits, builders, developers, and governmental agencies seeking funds for affordable owner -occupied, rental, transitional or emergency housing in Johnson County. The application deadline is 4 p.m. on Friday, March 20th, 2015. An application, AMI guidelines, and additional information may be found online at www.htfjjc.org or by calling 319-358-0212. Minutes Preliminary Human Rights Commission February 17, 2015 — 6 PM Helling Conference Room Members Present: Harry Olmstead, Orville Townsend Sr, Kim Hanrahan, Joe D. Coulter, Stella Hart, Paul Retish, Shams Ghoneim, Ali Ahmed. Members Not Present: Edie Pierce -Thomas. Others Present: Ben Mark (Reporter Daily Iowan). Staff Present: Stefanie Bowers. Recommendations to Council: Yes, two recommendations (see below). Call to Order: Coulter called the meeting to order at 18:06. Consideration of the Minutes from the January 20, 2015 Meeting Date: Motion Olmstead, seconded by Townsend. Motion passed 7-0. (Hanrahan not present). New Business Funding Request from Ko Nec Cultural Diversity Awareness Program The funding request for two students ($500 each for a total $1000) for a Civil Rights tour and visit of historically Black colleges raised concern from Commissioners based on the available budget for co- sponsorship of community events which is around $2000 yearly for the Commission and also the number of persons in the community that the request would benefit. Based upon these two factors the Commission denied sponsorship to this event. Motion Hanrahan, seconded by Townsend to deny sponsorship. Motion passed 5-3. (Ahmed, Ghoneim, Retish in the negative). Co -Sponsorship Request for Night of 1000 Dinners Olmstead reported out to the Commission that the event location (Old Brick) is not accessible for persons in wheelchairs. For Olmstead to participate in this event it would require him to sit in the chair provided by the lift at Old Brick while others would have to carry his electronic wheelchair upstairs. His electronic wheelchair weighs over 500 pounds. Commissioners voted to deny co-sponsorship of this event because of the lack of accessibility for persons who use wheelchairs to attend. Bowers will contact the event planners to provide an alternative location suggestion for the event in the future. Possible locations include the Robert Lee Recreational Center. Motion Townsend, seconded by Olmstead to deny co-sponsorship. Motion passed 8-0. Old Business Funding Request Form Commissioners provided several suggestions for the form that will be used by groups/individuals/organizations who wish for the Commission to fund or co-sponsor an event. Suggestions include whether the venue is accessible for persons who utilize wheelchairs or have visual impairments. Bowers asked for all Commissioners to provide any suggestions for additions/subtractions to the form for a final review prior to June 2015. The form will go into effect July 1, 2015. Volunteer Fair for Retired Persons Retish reported that attempts to organize a volunteer fair for retired persons has been frustrating. Retish does not want to duplicate what is already occurring in the community. Commission Action Plan 2015 Coulter expressed his desire for the Commission to support the racial equity and diversity action plans recently put forth by City staff and the Council in January. Retish and Townsend both noted that they had concerns/questions about the St. Ambrose disproportionate minority contact study. Bowers asked Retish and Townsend to provide the questions/concerns that they have to her and she would forward the questions for a response. Hanrahan reported on the possibility of using the upcoming Soul Food Dinner at City High (being held on February 20) as a listening post. Hanrahan and Hart recently discussed the possible venues for future listening posts. Townsend added that identifying the key players in the community is important to having successful listening posts. Olmstead and Coulter would like the Commission to work with the Council on their listening posts and to be a part of that community initiative. Motion by Hanrahan, seconded by Hart to support the recommendations for racial equity and the diversity action plans. Motion passed 7-1. (Townsend in the negative). Hart is planning on attending a panel discussion on Affordable Housing in March and may revisit the current program plans by the Commission on a similar topic. Ghoneim spoke with the Coalition for Religious Communities on doing outreach to them on the Commission and its role in the community. Ghoneim will have further information on possible presentation dates at the March meeting. She also will look into possible presentations to the Iowa City Mosque and the Iowa Chapter of the American Civil Liberties Union. 2015 Choice Awards Hanrahan who attended the event spoke very highly of it. The Commission was one of many co-sponsors. Juneteenth Hart will attend the March Juneteenth planning committee meeting and report back to the Commission. Education Subcommittee Retish and Hanarahan who are members of the Iowa City Community School District (ICCSD) Equity Committee along with Olmstead spoke of a recent meeting in which Equity Director Kingsley Botchway presented a PowerPoint presentation on the future of equity within the ICCSD. Building Communities Bowers spoke on the status of including Housing Choice Voucher (Section 8) in the definition of public assistance source of income under the Iowa City Fair Housing Ordinance. It is currently excluded in the definition. Adding it to the definition would make it illegal to deny the rental of property to a person based solely on the fact that they hold a Housing Choice Voucher. Bowers noted that the Council would more likely than not defer to the City Attorney's Office for legality prior to moving forward on the recommendation. Motion by Townsend, seconded by Olmstead for Council to add Housing Choice Voucher to the definition of public assistance source of income under the Iowa City Fair Housing Ordinance. Motion passed 8-0. University of Iowa Center for Human Rights Board The book for One Community One Book for 2015 is Just Mercy by Bryan Stevenson. 2 Commission Hart mentioned the upcoming Souper Bowl being sponsored by DVIP on February 19. Tickets are $25 each. Hart also noted an upcoming program being held in March at The Women's Resource and Action Center by the founder of the national Stop Street Harassment organization. Retish mentioned the overlap of persons who are involved with human rights on the local level. He also believes that programming should be directed at human beings as opposed to specific persons. Olmstead reported on Being Black in America a program being held at The Englert Theatre on February 25. He also recently participated in a video produced by City Channel 4 on the importance of removing snow from sidewalks. Townsend announced that Eddie Moore Jr. is holding a discussion on White Privilege on February 23 at The Kirkwood Room. Hanrahan spoke on recent article on Commissioner Retish in the University of Iowa College of Education Journal. Ghoneim reported that the American Civil Liberties Union of Iowa recently hired an Executive Director. Staff Bowers recently presented to the Iowa City Library Board of Directors on ways to increase board diversity. She also presented to the Iowa Legal Exploration class at the University of Iowa College of Law and attended a meeting in Dubuque with a representative from the Government Alliance on Race and Equity ("GARE").
