CPRB Extension Motion Granting a 60 -Day Extension to the Community Police Review Board for the Filing of the Public Report with the City Council on Complaint #19-02. Comment: City Code section 8-87B(8) states The Board's report to the City Council shall be completed within ninety (90) days of receipt of the Chiefs or City Manager's report The City Council may grant requests for extensions to this deadline upon good cause shown. Irl -231 61 Iq-23j DOT Drug and Alcohol Policy Resolution rescinding the 2010 Commercial Driver's License Substance Abuse Prevention Program for Drugs and Alcohol adopted in Resolution No. 10-350 and establishing a new DOT Drug and Alcohol Policy. Comment An August 2019 Federal Transit Authority audit of the Citys drug and alcohol testing program identified necessary updates to the existing Commercial Driver's License Substance Abuse Prevention Program for Drug and Alcohol. The City of Iowa City Drug and Alcohol Policy has been created to comply with Department of Transportation requirements and is recommended to replace the existing policy. City Street Financial Report Resolution approving the City Street Financial Report for the fiscal year ending June 30, 2019. Comment: Iowa Code section 312.14 requires all cities to submit the Street Financial Report (SFR) to the Iowa Department of Transportation by September 30 of each year. Copy of item included in council packet. Budgeted Positions - Senior Center Resolution amending the budgeted positions in the Senior Center by adding one .63 FTE Receptionist - Senior Center position and increasing a .5 FTE Receptionist - Senior Center position to .63 FTE. Comment Based upon discussion at the September 3, 2019 Work Session, City Council directed the City Manager to select three hourly positions to be converted to permanent positions. The City Manager determined that the City would be best served by converting the hourly Senior Center Clerical Assistant position to a .63 FTE Receptionist. This position change W II be in effect upon resolution approval. Procurement of a Microsoft Enterprise Agreement Resolution Authorizing the Procurement of a Microsoft Enterprise Agreement Comment: The City has been purchasing Microsoft licensing on an as needed basis. In an effort to be more cost conscious and efficient the ITS Division entered into an Enterprise Agreement that covers all Microsoft licensing at the City. The cost is $526,470.72 for the proposed agreement. The agreement will have a three-year initial term plus a three year extension. September 17, 2019 Iowa City City Council Agenda Page 3 6.g. Del Ray Apartments Storm Sewer Easement Resolution authorizing the Mayor to sign and the City Clerk to attest a storm sewer and drainage easement agreement with Del Ray Ridge, LP for 628 S. Dubuque Street. Comment The former sanitary sewer line has been relocated and per resolution no. 19- 93 will be released by the City. The current line as relocated will be repurposed as a storm sewer line for the Railroad Depot property, which will require the dedication of a new storm sewer easement to the City on 628 S. Dubuque Street. 6.h. Agreement with Public Space One, Inc (PS1) "z3 Resolution authorizing the City Manager to sign an agreement with Public Space One, Inc. (PS1) for community programming and to maintain the City's current mortgage on the property at 730 S. Dubuque St. Comment This resolution authorizes the City Manager to enter into an agreement with Public Space One, Inc. to maintain the Citys current ban on the property at 730 S. Dubuque St. and for community programming activities. 7. Setting Public Hearings 7.a. Regulating Plan Amendment - 625 S. Gilbert Street Motion setting a public hearing for October 1, 2019 on an ordinance amending the Riverfront Crossings regulating plan to include the property located at 625 S. Gilbert Street in the Central Crossing Subdistrict. (ZCA19-03) Comment At its meeting on September 5, 2019, the Planning and Zoning Commission recommended approval of an amendment to the Riverfront Crossings regulating plan by a vote of &0 (Parsons absent). Gilbert Street Motion setting a public hearing for October 1, 2019 on an ordinance conditionally rezoning approximately 1.6 acres of property located at 305 and 315 E. Prentiss Street and 625 S. Gilbert Street from Community Commercial (CC -2) and Intensive Commercial (CI -1) to Riverfront Crossings -Central Crossings (RFC -CX). (REZ19-07). Comment At its meeting on September 5, 2019, by a vote of 6-0 (Parsons absent), the Planning and Zoning Commission recommended approval of the rezoning subject to the following conditions: 1) dedication of right-of-way along S. Gilbert Street, 2) provision of an access easement for the City to access the manhole for the trunk sewer located near the SW comer of the property, 3) provision of an access easement for the City to access the sanitary sewer line that runs through the SE portion of the property, 4) improvements of Ralston Creek, including removal of invasive trees, addition of rip -rap, tree planting, and dedication a temporary access easement Mhout compensation for the reconstruction of the Prentiss Street Bridge, and 5) exeafion of an affordable housing agreement. (Second Consideration) Comment: Recently Council amended the City Code to treat the operation of electric assist bicycles, electric scooters and electric skateboards the same as the operation of bicycles on streets and sidewalks, but did not include their operation in parks. Bike and Electric Device Fines Ordinance amending Title 3, entitled "Finances, Taxation and Fees," and Title 9, entitled "Motor Vehicles and Traffic," to provide uniform fines for bicycle and electric device code violations. ( Fars -l-- Coy1sfctero-+iorr) Comment The ordinance sets the fine at $15.00 for persons who operate bicycles, electric assist bicycles, electric scooters and electric skateboards in violation of the City Code. Kirkwood's english language learning expansion I q -a O Resolution authorizing funding of $25,000 in FY20, and intent to budget $25,000 each year from FY21 through FY24 for Kirkwood Community C>Z,& College (KCC) to expand English Language learning capacity in the ��- southern end of the Iowa City/Cedar Rapids corridor. Comment Kirkwood Community College has requested financial assistance for the expansion of its English Language Learning programs serving the Iowa City area. They plan a 5 -year pilot program costing $150,000 per year. Kirkwood is funding half of it and they are seeking the balance of the financial assistance form the communities and employers in the Iowa City area. Action: m i m S C n �o . j 7 sr 14. Willow Street Traffic Calming l q --24 Resolution authorizing the installation of speed humps on Willow Street, between Brookside Drive and Muscatine Avenue. 6e,e.- Comment: The residents of Willow Street have successfully completed the City of Iowa Citys Traffic Calming Program. The street qualifies for the program based on traffic speed data. Staff discussed the proposal with residents at a neighborhood meeting held on June 18. A follow-up survey of neighbors yielded an 90% response rate. Of those households that responded, 60% indicated their approval of the proposal to install speed humps. Assessment Schedule 1 q "a y of Resolution adopting an assessment schedule of unpaid mowing, dean -up of property, snow removal, sidewalk repair, and stop box repair charges and directing the Clerk to certify the same to the Johnson County Treasurer for collection in the same manner as property taxes. Comment The City has the aulhorky under Iowa Code §364.13B to assess the nuisance abatement costs in the same manner as a property tax. This resolution allows the City Clerk to certify to the Johnson County Treasurer the abatement cost to be assessed against the property. This assessment is being pursued only after the City took many steps to resolve the matter. The City notified the homeowners to abate the nuisance (for example, to remove snow from the sidewalk) and after the homeowner did not take action to abate the nuisance, the City abated the nuisance and billed the owner. After being billed at least twice, these owners still have not paid the abatement costs. The City has sent a letter to the homeowner giving them notice that this resolution would be on the agenda, a copy of which is attached to the resolution. No interest will be charged if the owner pays within 30 days of the first required publication.
