The applicant, MS Ward Properties LLC is requesting approval of the final plat for Kimball Corner Addition, a 2 -lot subdivision, which would divide an existing lot with a house at 508 Kimball Rd and result in one additional single-family lot on N. Governor Street. The home located at 508 Kimball Rd is a non -conforming structure with regard to the front setback from N. Governor Street, and the driveway is a non -conforming development as it does not meet the minimum driveway length. The house was built in 1954, and garage built in 1966. Both were issued building permits at the time of construction. The proposed subdivision will not increase the current non -conformities. There was no preliminary plat for this subdivision since this is a re -subdivision. ANALYSIS: The lot size, lot boundaries, and total acreage of the final plat of Kimball Corner Subdivision are in general compliance with the subdivision regulations. Legal papers are currently being reviewed by staff, and Public Works has determined that construction drawings are not necessary. It is anticipated that these documents will be approved prior to the October 1 st Council Meeting. There is a deep ravine north of North Governor Street that extends south of N. Governor Street near Lot 2. Storm water travels from the northern ravine to the southern ravine. Public Works assumes an underground structure conveys this water; however, there is no record of the location of this infrastructure. Furthermore, Public Works' staff completed field work in an attempt to identify the location of the storm sewer infrastructure. Due to the topography of the site, staff was unable to identify the exact location and does not believe that any structure built on the site would encounter the storm sewer, if it does exist. If a storm sewer is encountered during construction, however, it would be the owner's PCD\Staff Reports\staff report final.dou 3 obligation to make the necessary modifications to reconcile this conflict at the owner's expense. The City has requested the applicant to dedicate a 25 -foot wide storm sewer easement on the southern property line of Lot 2 for the eventual installation of new storm sewer. Additionally, the applicant has agreed to dedicate 186 square feet of the north corner of Lot 1 to the City as right-of-way for future sidewalk redevelopment in order to make the sidewalk crossing ADA compliant. The is shown as Outlot A on the plat. Neighborhood parkland or fees in lieu of. The City's Parks Master Plan identifies the proposed subdivision as part of the N2 Neighborhood Open Space District. Due to the small size of the newly created 0.38 -acre Lot 2, providing public open space on site is not viable and a fee in -lieu would be appropriate. An appraisal found the lot to be worth $70,000. Based on the neighborhood open space formula and the appraised value of the lot, the applicant must pay $603.33 in neighborhood open space fees. This requirement and the payment of these fees will be addressed in the legal papers. Infrastructure Fees: Prior to the issuance of a building permit, the applicant must pay the required $456.75 per acre water main tap on fee. There is no fee for sanitary sewer service. Payment of the water main fee will be addressed in the legal papers. NEXT S TEP S : Upon approval of the proposed final plat, the applicant will be able to apply for a building permit. STAFF RECOMMENDATION: Staff recommends approval of SUB19-07, the final plat of Kimball Corner Subdivision, a 2 - lot subdivision on 0.58 acres of land located at 508 Kimball Road subject to approval of construction drawings and legal papers by the City Engineer and City Attorney. Background /Analysis: In 2010, Anderson -Bogert completed design of the Burlington Street Median Project. This project included the construction of a median on Burlington Street from the Iowa River to Capitol Street, traffic signal improvements, new water main at the Madison Street intersection, street lighting improvements and landscaping. At that time, the project was put on hold due to uncertainty regarding development in the area and other factors. In 2017, the City hired Anderson -Bogert to revisit the Burlington Street Median Project, evaluate the existing plans to determine what revisions may be needed, and complete the design of the Burlington and Madison Intersection Improvements Project. Final plans were submitted to the Iowa Department of Transportation (I DOT) on September 24, 2019 for the December 17, 2019 bid letting. The project will be bid through the I DOT, but construction administration and inspection will be performed by the City. The plans, specifications, and estimate of cost for construction of the Burlington and Madison Intersection Improvements Project have been filed in the Office of the City Clerk for public examination. The estimated cost of construction is $1,400,000, and will be funded with STBG funds, 3R funds, and General Obligation Bonds. The project is expected to be completed by fall 2020. Background /Analysis: The City has the authority under Iowa Code §364.13B to assess the nuisance abatement costs in the same manner as a property tax. This resolution allows the City Clerk to certify to the Johnson County Treasurer the abatement cost to be assessed against the property. This assessment is being pursued only after the City took many steps to resolve the matter. The City notified the homeowners to abate the nuisance (for example, to remove snow from the sidewalk) and after the homeowner did not take action to abate the nuisance, the City abated the nuisance and billed the owner. After being billed at least twice, these owners still have not paid the abatement costs. The City has sent a letter to the homeowner giving them notice that this resolution would be on the agenda, a copy of which is attached to the resolution.
