Resolutions and Motions 7.a. October 2019 Disbursements Motion to approve disbursements in the amount of $9,054,201.50 for the period of October 1 through October 31, 2019, as recommended by the Finance Director subject to audit. Iowa City Downtown District Budget Motion to accept the proposed FY21 budget for the Iowa City Downtown District, as approved by the Iowa City Downtown District Advisory Board. Comment Per the Operating Agreement between the Iowa City Downtown District (ICDD) and the City of Iowa City, the ICDD Advisory Board must hold a public meeting, approve the proposed budget and submit it to City Council by December 1 each year. November 19, 2019 Iowa City City Council Agenda Page 2 Personnel Policies Update - November 2019 Resolution rescinding Resolution No. 17-198 and adopting updated Personnel Policies. Comment The Citys Personnel Polices have recently been reviewed and updated to incorporate best practices and legislative updates, to streamline policy documents by incorporating other existing standalone policies, and to better communicate organizational expectations. The City Code requires that Personnel Policies be established by resolution of the City Council. 7.d. Creekside Park Improvements 2018 q - 2-7 U Resolution accepting the work for the Creekside Park Improvements 2018 Project. Comment The project has been completed by All American Concrete of West Liberty, Iowa, in substantial accordance with the plans and specifications. The Engineer's Report and Performance and Payment bonds are on file with the City Clerk. • Project Estimated Cost $ 600,000.00 • Project Bid Received: $ 623,450.00 • Project Actual Cost: $ 636,146.14 7.e. 2018 Sanitary Sewer Rehabilitation Construction Resolution accepting the work for the 2018 Sanitary Sewer Rehabilitation Construction Project. 7.f. Comment The project has been completed by Lynch's Excavating of West Branch, Iowa, in substantial accordance with the plans and specifications. The Engineers Report and Performance and Payment bonds are on file with the City Engineer. • Project Estimated Cost $ 115,000.00 • Project Bid Received: $ 104,998.00 • ProjectActualCost: $ 264,271.70 Procurement of Automated Refuse Body Resolution authorizing the procurement of one (1) new Labrie Expert Automated Refuse Body for Refuse Operations. Comment This Resolution will approve the procurement of one (1) new Labrie Expert Automated Refuse Body to be used by Refuse Operations. Sourcewwell cooperative contract #112014 -LEG will be utilized for this procurement The total purchase price is $174,571.40, which exceeds the $150,000.00 spending authority of the City Manager, and so requires Council approval. November 19, 2019 Iowa City City Council Agenda Page 3 7.g. 2018 Roof Improvements —Water Treatment Plant & Water Distribution Facility C� 2 Resolution approving the final contract price for the 2018 Roof Improvements — Water Treatment Plant & Water Distribution Facility Project. Comment: The final cost of this project was incorrectly stated in Resolution No. 19-249 accepting the project on October 1, 2019. This resolution corrects the final contract price to $471,050. Th. Final Plat Tamarack Ridge Resolution approving Final Plat of Tamarack Ridge Subdivision, Iowa City, Iowa. (SUB19-14) Comment A preliminary plat and sensitive areas development plan of Tamarack Ridge was approved on September 17, 2019. Staff recommends approval of the final plat su�ect to approval of legal papers and construction drawings by the City Attorney and City Engineer. It is anticipated that legal papers and construction drawings will be approved prior to the November 17 City Council meeting. Approval will allow the development of the Tamarack Ridge Subdivision, a 60 -lot, 36.58 acre residential subdivision located south of Scott Blvd. 8. Setting Public Hearings 8.a. Zonina code amendment related to utility -scale, ground -mounted solar energy systems Motion setting a public hearing for December 3, 2019 on an ordinance amending Title 14, Zoning related to utility -scale, ground - mounted solar energy systems. (ZCA19-05) Comment At its November 7 meeting, by a vote of 7-0 the Planning and Zoning Commission recommended approval of this amendment with the following change: remove the language in the text amendment that states no after image is allowed. The amendment will allow utility -scale, ground -mounted solar energy systems as a provisional use in Interim Development Industrial (ID -1), General Industrial (1-1), Heavy Industrial (1-2), Neighborhood Public (P-1), and Institutional Public (P-2) zones, and via special exception in all Commercial zones as well as Interim Development Research Park (ID -RP), Research Development Park (RDP), and Office Research Park (ORP) zones. Gilbert St and Highland Ave Motion setting a public hearing for December 3, 2019 on an ordinance conditionally rezoning approximately 1.15 acres of land located at the northeast comer of S. Gilbert Street and Highland Ave from Intensive Commercial (CI -1) zone to Riverfront Crossings - South Gilbert (RFC -SG) zone. (REZ19-11) Comment At its meeting on November 7, 2019 the Planning and Zoning Commission recommended approval of the rezoning by a vote of 7-0 subject to the following conditions: dosing all access points along S. Gilbert St. reducing the number of access points along Highland Ave. to one, and the dedication of additional right- of-way to the City. 8.c. Rezoning Lehman Avenue and Soccer Park Road Motion setting a public hearing for December 3, 2019 on an ordinance rezoning approximately 42.01 acres of land located south of Lehman Avenue and east of Soccer Park Road from Interim Development Multi -Family (ID -RM) and Rural Residential (RR -1) to Low Density Multi -Family (RM -12). (REZ19-12) Comment At the Planning and Zoning Commission's November 7 meeting, the motion to approve this rezoning failed by a vote of 2-5 (Signs and Townsend in the affirmative). 8.d. Prentiss Street Bridge Resolution setting a public hearing on December 3, 2019 on project manual and estimate of cost for the construction of the Prentiss Street Bridge Replacement Project (BROS-3715(663)- 8J-52), and directing City Clerk to publish notice of said hearing, and directing the City Engineer to place said project manual on file for public inspection. Comment This project includes the replacement of the Prentiss Street Bridge over Ralston Creek, roadway improvements on Prentiss Street from the bridge to Dubuque Street and improvements on Linn Street from Prentiss Street to 200' north, storm sewer and water main replacement and installation of ADA sidewalk ramps. Annexation American Legion Road Motion setting a public hearing for December 17, 2019 on a resolution to annex approximately 35.29 acres of land located north of American Legion Road and east of Eastbrook Street. (ANN19- 01) Comment At its November 7 meeting, by a vote of 7-0, the Planning and Zoning Commission recommended approval of the annexation of this property. Approval will allow the future development of this property within Iowa City. 8.f. Rezoning American Legion Road Motion setting a public hearing for December 17, 2019 on an ordinance conditionally rezoning approximately 35.29 acres of land located north of American Legion Road and east of Eastbrook Street from County Residential (R) to Interim Development - Single Family Residential (ID -RS). Planning and Zoning Matters If a majority of the Council is inclined not to concur with the Planning and Zoning Commission recommendation a consult with the Planning and Zoning Commission should be offered before the close of the public hearing. 11.a. Fringe Area Rezoning - Indian Lookout Road SE Letter to the Johnson County Planning and Zoning Commission in support of a rezoning from County Agriculture (A) to County i�t Residential (R) for approximately 2.43 acres of property located in unincorporated Johnson County at 4653 Indian Lookout Road SE. (CZ19-02) Comment At its November 7 meeting, by a vote of 6-1 (Baker dissent) the Planning and Zoning Commission reoornmended approval of the proposed rezoning. Atoigh the proposed rezoning is not consistent with the policies in the adopted Fringe Area Agreement, the Commission recommended approval since the rezoning is consistent with the County's Future Land Use Map, surrounding land uses, and City staff is working with County staff on amending the Fringe Area Agreement in a way that would be consistent with this application. (ZCA19-02) Comment At its meeting on October 17 by a vote of 6-1 (Townsend in the negative), the Planning and Zoning Commission recommended approval of this amendment which would allow units that receive Low Income Housing Tax Credits from the Iowa Finance Authority to qualify as affordable housing and sets a cap on norrrefirement assets for qualifying households. (ZCA19-04) 66-& w Comment At its meeting on October 17 by a vote of 43 (Martin, Baker, and Signs in the e� (( negative), the Planning and Zoning Commission recommended approval of this amendment, which would require a 9 foot separation distance between conforming parking spaces areas and additional paving within the required setback area. Rental Permit -Radon Testing Ordinance amending Title 17, entitled "Building and Housing," Chapter 5, entitled "Housing Code," to require radon testing and mitigation in single- family and duplex rental units. (First Consideration) Comment: The proposed ordinance requires that all residential single family detached structures and duplexes are tested for radon prior to rental permit issuance or renewal. If the unit equals or exceeds 4 pCA , then a radon mitigation system must be installed and tested to ensure radon levels do not exceed this threshold. Deer managemenV rearms in parks ` j Ordinance amending Tittle 10, entitled "Public Ways and Property," Chapter 9, entitled "Parks and Recreation Regulations," to allow persons to carry firearms in parks for the purpose of killing deer pursuant to a deer management plan. (Second Consideration) Comment This ordinance allows firearms in parks for the purpose of killing deer pursuant to a deer management plan. In 1998, the City amended Section 8-7-1 of the City Code to allow for the discharge of firearms within City limits for the purpose of killing deer pursuant to a deer management plan. However, a separate provision (section 10-9-2C) prohibiting persons from carrying firearms into any park was not similarly amended. When the City engaged in sharpshooting from approximately 1999 to 2009, the sharpshooting did not occur in any City park. It is the assessment of White Buffalo, Inc. (the Citys sharpshooting oontractor), based on the deer population and availability of land, that it will be necessary to shoot in Hickory Hill Park, and perhaps other parks. The Friends of Hickory Hill Park have been consulted and do not object to sharpshooting in the park. The City will be providing public notification and signage of the park's temporary closure from 3:00 pm to dawn from Dec.1 to Dec. 22 (and again in late winter during the second round of sharpshooting). Under Section 10-9-21, Hickory Hill Park is dosed from dusk to dawn, and therefore the closure due to sharpshooting will be approximately 2 additional hour.
