Resolution adopting the Statewide Urban Design and
Specifications (SUDAS) Standard Specifications (2023 Edition),
as revised by the SUDAS General Supplemental Specifications,
and the revised City of Iowa City Supplemental Specifications
(January 2023).
Comment This item will approve the use of the 2023 Edition of the SUDAS Standard
Specifications for all public improvement projects and construction within the city right-of-
way,which are annually revised to respond to innovations and changes in construction
technologies,methods,and materials. In addition,the City has revised supplemental
specifications to reflect the 2023 Edition of the SUDAS Standard Specifications.
6.i. Riverfront Crossings Affordable Housing Requirement Fee-in-Lieu
Update

Comment The Riverfront Crossings Affordable Housing Requirement allows for an
owner to contribute a fee as a means to meeting the affordable housing requirement The
ordinance requires that the fee shall be determined biennially by resolution,based on a
formula that analyzes the difference between market rate units and units subject to the
affordability requirement The fee was set at$112,853 in September of 2020.Based on
this analysis method,the proposed fee,effective after passage of this resolution,shall be
$70,291.
6.j. Bancroft/Russell Drives and McLean Street/Lexington Avenue
Sanitary Sewer Repairs
Resolution authorizing the acquisition of property interests

Comment:The City of Iowa City must acquire right-of-way,fee title, permanent
easements and/or temporary construction easements to construct the Highland Court
Sidewalk Infill Project.The project generally indudes the replacement of manholes and
pipes in spot locations.

Comment: ICON Arts Academy has applied for a Climate Action Fund grant to retrofit

Comment Staff recommends approval of the final plat subject to approval of the legal
papers and construction drawings by the City Attorneys Office and City Engineer. It is
anticipated that legal papers and construction drawings will be approved prior to the
January 10 City Council meeting.Approval will allow the for the conveyance of Outlot A
to the City for public open space.

7.a. Comprehensive Plan Amendment- Southwest District
Motion setting a public hearing for January 24, 2023 on a
resolution to amend the Southwest District Plan, a part of Iowa
City's Comprehensive Plan, to update background information
and the concept for the Rohret South Subarea. (CPA22-0002)
Comment At its December 7 meeting,the Planning and Zoning Commission
recommended approval of this comprehensive plan amendment by a vote of 6-0(Craig
absent).Adoption of this resolution will update background information for the Southwest
District Plan of Iowa City and will revise the concept for the Rohret South Subarea.This
indudes adopting a future land use map that follows form-based principles in the Rohret
South subarea.

Motion setting a public hearing for January 24, 2023 on an
ordinance conditionally rezoning approximately 31 .2 acres of
property located east of Camp Cardinal Road and north of
Gathering Place Lane from Interim Development Single-Family
Residential (ID-RS)and Low Density Single-Family Residential
with a Planned Development Overlay (OPD/RS-5)to Medium
Density Single-Family Residential with a Planned Development
Overlay (OPD/RS-8). (RF722-0012)
Comment On December 21,2022 the Planning and Zoning Commission recommended
approval of RF722-0012 by a vote of 6-0(Townsend absent)subject to conditions related to
contributing 50%of the cost of upgrading Camp Cardinal Road to City standards and
maintenance of proposed angled on-street parking.The rezoning would allow the
development of a senior housing community with 35 single-family,8 duplex,20 townhome-
style,and 38 multi-family dwelling units,in addition to 32 assisted IMng beds and a small
neighborhood commercial use after the development is platted.
7.c. Rezoning -W. Benton St. and Orchard St.
Motion setting a public hearing for January 24, 2023 on an
ordinance conditionally rezoning approximately 3.52 acres of
land from Low Density Single-Family Residential with a Planned
Development Overlay (OPD/RS-5) and Riverfront Crossing —
Orchard (RFC-0)to Riverfront Crossing —Orchard (RFC-0).

Comment On January 4,2023,the Planning and Zoning Commission recommended
denial of the rezoning by a vote of 3-4(Signs,Craig,Padron,and Townsend in the
negative).Staff recommended approval subject to several conditions induding
construction of sidewalks,traffic signalization of the Orchard St and W.Benton Street
intersection,reconstruction of Orchard St north of W.Benton St,and dedication of a 30'
wide public access easement over the pedestrian street Approval would allow the
redevelopment of the area in conformance with the Riverfront Crossings form-based
code.

Resolution setting a public hearing for January 24, 2023 to
consider the vacation and conveyance of approximately 266
square foot of right-of-way located at the northwest corner of S.
Riverside Drive and the Iowa Interstate Railroad to FFI Farms,
LLC; Kevin C Kain Revocable Trust; and Lindsay R Kain
Revocable Trust. (VAC22-0002)
Comment At its December 21,2022 meeting,the Planning and Zoning Commission
recommended approval of VAC22-0002 by a vote of 6-0(Townsend absent).The subject
right-of-way was recently acquired by the City for the purposes of creating a pedestrian
tunnel under the Iowa Interstate Railroad.Due to concern from the railroad this project is
not moving forward,and therefore,the City has no use for the right-of-way.The owner of
the adjacent lot desires to purchase the right-of-way for fair market value to increase the
developable area for the proposed redevelopment at the southwest corner of Myrtle
Avenue and S. Riverside Drive.

1-76- recommended approval of RF722-0011 by a vote of 6-0.The amendment would clarify
how solar energy systems fit into the zoning code,remove potential barriers to solar
energy systems,and incentivize solar energy,electrification,and higher energy
conservation standards.Proposed regulations relating to Electric Vehide readiness and
charging stations were removed so staff can evaluate how to incorporate comments
made by the Planning and Zoning Commission at their meeting on November 2,2022.

Comment In order to facilitate development of a newly subdivided lot,the City has been asked to
°` dedicate a private sanitary sewer easement to the adjacent property owner for its sanitary service
line.This easement will allow connection to the public sanitary sewer system in the most efficient
location and is in an area immediately west of the terminus of Southgate Ave.that is intended to
be dedicated as right-of--way,at which time this easement would be terminated.This easement

Ordinance amending Title 2, entitled "Human Rights," Chapter 1, entitled
"General Provisions," to eliminate the prohibition on landlords
discriminating against Housing Choice Voucher(aka, Section 8) holders.

Comment:The City Code prohibits landlords from refusing to lease to tenants who have Housing
Choice Vouchers(aka,Section 8).As of Jan. 1,2023,this provision is unenforceable due to a
2021 state law that preempts local governments from prohibiting landlords from refusing to lease a
unit to a person with a voucher.The ordinance removes the City Code provision prohibiting
landlords from discriminating against tenants with vouchers.Staff is requesting expedited action.

13. Repeal of Rental Permit Cap
9-3 -419 - Ordinance amending Title 17, entitled "Building and Housing," Chapter 5,
entitled "Housing Code," to repeal the rental permit cap provision.
(Second Consideration)
1j Comment: In 2017, City Council established a rental permit cap to limit the percentage
of rental permits for single-family and duplex homes in the central area of the City to
stabilize those neighborhoods. In 2019, a new state law was adopted preempting local
governments from imposing a rental permit cap on single-family or duplex homes.
Although the rental cap provision has been unenforceable for three years, it was never
repealed.This ordinance repeals the provision. Staff is requesting expedited action.

Ordinance amending Title 8, entitled "Police Regulations," Chapter 8,
entitled "Community Police Review Board,"to darify a person who

Comment The City Code allows any person with personal knowledge of police misconduct to
file a complaint with the CPRB.As proposed by the CPRB,this ordinance clarifies a person who

knowledge to file a complaint

15. ARPA Shelter House - Housing Stability Pilot Program
(e Resolution authorizing the Mayor to sign a State and Local Fiscal
Recovery Fund (SLFRF)grant agreement with Shelter House to
administer the Housing Stability Pilot program.
Comment As part of the American Rescue Plan Act(ARPA),the City was awarded State and
Local Fiscal Recovery funds(SLFRF)to respond to the COVID-19 pandemic.This resolution
authorizes a subredpient agreement with Shelter House for$1,137,710 to administer the
Housing Stability Pilot program aimed at preventing homelessness through eviction prevention
and diversion,and improving housing retention through increased partnerships and support.

manager is responsible for maintaining the mandated level of training for members of the
department as well as ensuring all personnel are trained in areas that are necessary for the
efficient functioning of the department. One.5 FTE Civilian Accreditation Manager(a position
recommended in the December 2020 Restructuring of the Iowa City Police Department plan)
will replace the current full time Accreditation Sergeant which will allow for the reallocation of a
full-time supervisor position to Professional Standards.

with CommUnity Crisis Services for Law Enforcement Liaison Support.
Comment This resolution approves an agreement with CommUnity to employ and train two law
enforcement mental health liaisons.The City has a current agreement with Community for one
liaison,and the Police Dept desires to have Community employ and train a second liaison.The
ytL agreement is substantially similar to the current agreement with the City providing 75%of the costs,
