7.a January 2023 Disbursements
Motion to approve disbursements in the amount of $10,506,787.08 for the period
of January 1 through January 31, 2023, as recommended by the Finance Director
subject to audit. Disbursements are published and permanently retained in the City
Clerk's office in accordance with State Code.

7.b Budgeted Positions - Public Works / Engineering
- D _ Resolution amending budgeted positions in the Engineering Division of the Public
Works Department by deleting one full-time Special Projects Administrator
position and adding one full-time Senior Engineer position.
Comment: This resolution will approve the replacement of a Special Projects
Administrator position with a Senior Engineer position. Staff has evaluated the
ongoing needs of the Engineering Division and determined the conversion to a
Senior Engineer position better reflects the current and anticipated workload of
the Division.
7.c Block Party alcohol agreement
D,3 -(-► I Resolution approving an agreement with the Downtown District to allow the
sale and possession of beer and wine during the Block Party.
Comment: Under the City Code, the City may enter into an agreement allowing a
non-profit to sell alcohol on City streets and sidewalks and their customers/patrons
to possess alcohol in limited circumstances. This resolution approves the
agreement with the Downtown District allowing the sale and possession of beer
and wine during the June 24 Block Party. The agreement, which is attached to the
resolution, is substantially similar to the 2022 agreement.
7.d N. Linn St. alcohol agreement
4. )— Resolution approving an agreement with Iowa City Downtown District to allow for
the consumption and possession of alcohol on a portion of the 200 block of N.
Linn Street.
Comment: Under the City Code, the City may enter into an agreement with a non-
profit that allows persons to possess alcohol on City streets and sidewalks under
limited circumstances. This resolution approves an agreement with the Downtown
District allowing the possession of alcohol in the 200 block of N. Linn St. from May
1 to Nov. 1. The agreement which is attached to the resolution, is substantially
similar to the 2022 agreement except it allows for liquor as well as wine and beer
at the District's request. City staff has no objection to allowing liquor on a trial
basis, and the agreement provides the City may prohibit liquor on the site if there
are public safety issues.

7.e Gilbert Street Pavement Repair - CRANDIC Railroad Crossing Approach
Resolution accepting the work for the Gilbert Street Pavement Repair— CRANDIC
Railroad Crossing Project.
Comment: The project has been completed by Bockenstedt Excavating of Iowa
City, Iowa, in substantial accordance with the plans and specifications. The
Engineer's Report and Performance and Payment bonds are on file with the
City Clerk.
• Project Estimated Cost: $ 150,000.00
• Project Bid Received: $ 198,550.00
• Project Actual Cost: $ 203,781.13
7.f Parks and Rec fees.
Resolution establishing a schedule of fees for Parks and Recreation services
and programming and rescinding Resolution Number 20-47.
Comment: City Code requires Parks and Recreation Dept. fees to be approved
by City Council and the Parks and Recreation Commission. The Commission has
reviewed and approved the proposed fees and charges. The proposed effective
date of change is the first day of summer registration, April 18, 2023.
7.g Final Plat - Cardinal Heights Part 1

Comment: Staff recommends approval of the final plat subject to approval of the
legal papers and construction drawings by the City Attorney's Office and City
Engineer. It is anticipated that legal papers and construction drawings will be
approved prior to the February 21 City Council meeting. Approval will result in the
creation 10 residential lots intended for duplexes and 1 multifamily lot for 4
townhomes and 30 multi-family units located east of Camp Cardinal Blvd and
west of Camp Cardinal Road.
7.h Final Plat - Cardinal Heights Part 2

Comment: Staff recommends approval of the final plat subject to approval of the
legal papers and construction drawings by the City Attorney's Office and City
Engineer. It is anticipated that legal papers and construction drawings will be
approved prior to the February 21 City Council meeting. Approval will result in
the creation 12 residential lots intended for duplexes located east of Camp
Cardinal Blvd and west of Camp Cardinal Road.

8. Consent Calendar - Setting Public Hearings
8.a Rohret South Trunk Sanitary Sewer
Resolution setting a public hearing on March 7, 2023 on project manual and
estimate of cost for the construction of the Rohret South Trunk Sanitary Sewer
Project, directing City Clerk to publish notice of said hearing, and directing the
City Engineer to place said project manual on file for public inspection.
Comment: This project includes: a new 30" trunk sanitary sewer main (from Burry
Drive to the west side of US Highway 218), sanitary sewer manholes,
connections of local sanitary sewer pipes, sanitary sewer service reconnection,
water main valves, street pavement, driveways, seeding/sodding, and sidewalk.
The estimated construction cost is $3,475,000 and will be funded by the
wastewater fund.
8.b Willow Creek Trail Replacement
:)3 Resolution setting a public hearing on March 7, 2023 on project manual and
estimate of cost for the construction of the Willow Creek Trail Replacement
Project, directing City Clerk to publish notice of said hearing, and directing the City
Engineer to place said project manual on file for public inspection.
Comment: This project includes the replacement of approximately 0.9 miles of the
Willow Creek Trail from Benton Street to Willow Creek Drive, including a spur of
the trail connecting to Aber Ave and several connecting sidewalks and curb ramps.
The estimated construction cost is $720,500 which is available in the Willow Creek
Trail Replacement Project account #R4387.
8.c Sale of 2021 Taylor Drive
Resolution setting a public hearing for March 7, 2023, on a proposal to convey
a single-family home located at 2021 Taylor Drive.
Comment: As part of the South District Program, the City purchased a duplex at
2021-2023 Taylor Drive, rehabilitated it, and converted it to a 2-unit condominium.
The City has received an offer to purchase 2021 Taylor Drive for $155,000 from
an income-eligible household. The sale will provide affordable owner-occupied
housing.

7:00 p.m. unless an extension is needed to meet a minimum 30 minutes of total time
allocated for the Community Comment period.

10. Planning & Zoning Matters
10.a Rezoning - N. Dodge St. and N. Scott Blvd.
Ordinance conditionally rezoning approximately 3.87 acres of property
located south of the N. Dodge St and N. Scott Blvd. intersection from Commercial
jv Office Zone (CO-1) to Community Commercial Zone with a Planned Development
Overlay (OPD/CC-2) for approximately 2.04 acres and to Low Density Multi
Family Residential with a Planned Development Overlay (OPD/RM-12) for
approximately 1.83 acres (REZ22-0016).
Comment: On January 18, 2023 the Planning and Zoning Commission recommended
approval of REZ22-0016 by a vote of 5 -0 (Townsend and Wade absent) subject to
conditions related to provisions of a landscape plan approved by the City Forester that
shows trees replaced within the Scott Blvd. right-of-way, the dedication of a public
access easement over pedestrian facilities adjacent to the Scott Blvd. public right of
way that provide connectivity to public sidewalks, installation of a right turn lane along
Scott Blvd. subject to approval by the City Engineer, installation of a pedestrian
crossing with a refuge island on the southside of Dubuque Rd and Scott Blvd. subject
to approval by the City Engineer, and no vehicular access shall be allowed onto N.
Dodge St. Approval will allow for the development of commercial uses intended as
eating establishments, an 8 unit mixed use building, and 9 attached single family
units.

Resolution approving project manual and estimate of cost for the construction of
the 2023 Park Renovations Project, establishing amount of bid security to
accompany each bid, directing City Clerk to post notice to bidders, and fixing
time and place for receipt of bids.
seL Comment: This project includes playground, shelter, and restroom replacements, as
Y- `' well as sidewalk and accessibility improvements at Kiwanis, Hunter's Run, Happy
Hollow, and Hickory Hill Parks. The estimated construction cost is $865,000
available in the Kiwanis, Hunter's Run, Happy Hollow, and Hickory Hill Park
accounts, account#'s R4359, R4375, R4371, and R4365 respectively.

11.b Maximum Property Tax Levy

Comment: Cities are required to hold a public hearing to set a maximum

11.c Library Parking
Ordinance Amending Title 9, Entitled "Motor Vehicles and Traffic," Chapter 4,
Entitled "Parking Regulations," to Return Library Parking to a 20-Minute
Limit. (First Consideration)
Comment: There are 6 parking spots in the front of the library designated for
library parking. Prior to COVID, 5 spaces allowed patrons to park for 20 minutes
and 1 space allowed patrons to use the outside drop box for 5 minutes. To
facilitate curbside service for library patrons during the pandemic, the City Code
was amended to limit parking to 10 minutes in all 6 spaces. Both library staff and
patrons recommend returning to the pre-COVID limits.

11.d Purchase of 500 Manor Dr.
','3 -j Resolution approving a purchase agreement for 500 Manor Drive for
flood mitigation.
Comment: Staff has negotiated a purchase agreement with the owner of 500
Manor Drive for $276,000 contingent on City Council approval. The property is
aG1' located within the 100- year floodplain. Staff proposes the house be
demolished and the lot maintained as green space as part of the City's flood
mitigation measures.

11.e Assessment Schedule 'j`�
D,13 c 7) Resolution adopting an assessment schedule of unpaid mowing, clean-up of
property, snow removal, sidewalk repair, and stop box repair charges and
directing the Clerk to certify the same to the Johnson County Treasurer for
collection in the same manner as property taxes.
Comment: The City has the authority under Iowa Code §364.13B to assess the
nuisance abatement costs in the same manner as a property tax. This resolution
allows the City Clerk to certify to the Johnson County Treasurer the abatement
cost to be assessed against the property. This assessment is being pursued only
after the City took many steps to resolve the matter. The City notified the owners to
abate the nuisance (for example, to remove snow from the sidewalk) and after the
owner did not take action to abate the nuisance, the City abated the nuisance and
billed the owner. After being billed at least twice, these owners still have not paid
the abatement costs. The City has sent a letter to the owner giving them notice that
this resolution would be on the agenda, a copy of which is attached to the
resolution. No interest will be charged if the owner pays within 30 days of the first
required publication. Attached as an exhibit to the resolution is a list of the
properties that will be assessed and the amount that will be assessed.

Comment: Better Together is seeking a representative from the City of Iowa City to
serve as a Board Member. It is anticipated the Board will consist of fifteen
individuals representing local government, community and economic development
organizations and the general community. Meeting frequencies and times will be
determined after the board has been formed and by-laws are adopted. The
Council may choose an appointment or ask the City Manager to designate a staff
