Disbursements are published and permanently retained in the City Clerk's office in accordance with State Code. 6.b USG Appointments Motion approving the appointment of Noah LeFevre as the City Council Liaison and Mathew Monsivais as the Alternate City Council Liaison from the Iowa Undergraduate Student Government (USG) to the City Council until May 1, 2024. Comment: Comment: This motion affirms the appointment of USG representative Noah LeFevre as the City Council Liaison and Mathew Monsivais as Alternate City Council Liaison for 2023-2024. Correspondence included in Council packet. 6.c Digester Complex Rehabilitation Phase 1 �3 I-2_9 Resolution approving, authorizing and directing the Mayor to execute and the City Clerk to attest an Agreement by and between the City of Iowa City and Strand Associates, Inc., of Madison, Wisconsin to provide engineering consultant services for the Digester Complex Rehabilitation Phase 1 Project. Comment: This agenda item authorizes an agreement to provide engineering services for the Digester Complex Rehabilitation Phase 1 Project at the Wastewater Treatment Facility. The agreement includes preliminary design, final design and permitting services. Future scope of services is expected to include, bidding, and construction phase services. The total cost of the services is $1,563,400 and funds are available in the Digester Complex Rehabilitation account #V3151. 6.d Iowa City Landfill and Recycling Center --2_- _t' Resolution approving, authorizing and directing the Mayor to execute and the - City Clerk to attest an Agreement by and between the City of Iowa City and Stearns, Conrad and Schmidt, Consulting Engineers, Inc. dba SCS Engineers, a Virginia corporation to provide environmental compliance and engineering consultant services for the Iowa City Landfill and Recycling Center. Comment: This item will approve an agreement for the following services at the Iowa City Landfill and Recycling Center: 1) ongoing environmental compliance and engineering requirements to comply with local, state, and federal regulations and 2) preliminary design, final design, preparation of a project manual for bidding, bidding assistance, and constructions services for an expansion of the dual extraction system to achieve the selected remedy in the Assessment of Corrective Measures (ACM) Report. The negotiated fee is not to exceed $97,770 and funding is available in ACM Landfill Gas Infrastructure Expansion Project - Account # L3344 and Landfill operational funds. Comment: This resolution will authorize the procurement of Right -of-Way Tree Planting for the Parks & Forestry Division and award the contract to Sustainable Landscape Solutions. The contract is for one year with the option for the City to renew for four additional one-year terms. During the first year of this contract, the purchase will exceed the $150,000 spending authority of the City Manager, thereby requiring Council approval. The City expects to expend approximately $156,880.00 during the first year of the contract. 6.f 2023 Water Pavement Patching Z _ ) 3, Resolution awarding contract and authorizing the Mayor to sign and the City Clerk to attest a contract for construction of the 2023 Water Pavement Patching Project. Comment: Bids for this project were received on Tuesday, April 25, 2023 and the following bids were received: Bockenstedt Excavating Iowa City, IA $ 178,843.75 Midwest Concrete Peosta, IA $ 205,208.15 All American Concrete Iowa City, IA $ 220,473.00 Bud Maas Concrete Iowa City, IA Non-Responsive Engineer's Estimate $ 215,000.00 Public Works and Engineering recommend awarding the project to Bockenstedt Excavating of Iowa City, Iowa. Funding is available in the Water Divisions Operating Budget, account #73730130. 6.g Riverside Drive Pedestrian Improvements -2 J _1 3 Resolution fixing new time and place for receipt of bids for the bidding of the Riverside Drive Pedestrian Improvements Project, and directing City Clerk to publish advertisement for bids. Comment: This project generally includes the installation of sidewalk on the west side of Riverside Drive under the Iowa Interstate Railroad Bridge as well as the installation of street and pedestrian level lighting and street trees from Benton Street to the Iowa Interstate Railroad. The estimated construction cost is $520,000 available in the Myrtle/Riverside Intersection Signal, account#S3933. No bids were received on the original bid date of April 25, 2023, and City Staff has made the recommendation to rebid the project. May 2, 2023 Iowa City City Council Agenda Page 4 6.h Classification and Compensation study for City Positions 2:3 _ 13 `_ Resolution authorizing the procurement of Consulting Services for a Review of Internal Equity, Job Descriptions, and Market Analysis for City Staff Positions. Comment: This Resolution will approve the procurement of Consulting Services for a Review of Internal Equity, Job Descriptions, and Market Analysis for City Staff Positions. The contract will be awarded to the Austin Peters Group. This purchase will exceed the $60,000 spending authority of the City Manager, thereby requiring Council approval. Over the course of this contract the City expects to expend approximately $118,745.00. 6.i Planning & Zoning By-Laws Z3 _ 3 Resolution adopting the By-Laws of the Planning and Zoning Commission - and rescinding Resolution No. 16-203. Comment: The Planning and Zoning Commission approved amendments to its By-Laws to adopt rules of conduct, to clarify procedures for electronic meetings, and to make a few non-substantive changes. The rules of conduct largely mirror those of Council. The By-Laws are not effective until approved by the City Council. The Council Rules Committee has reviewed the proposed amendments to the By- Laws and has recommended adoption. End of Consent Calendar Action: l U r / I , 7 (7 rnA 7. Approval will amend the approved Planned Development Overlay and Sensitive Areas Development Plan to allow for the development of a 16 bedroom multi-family building intended for assisted senior living. 1. SE from Commercial Office Zone (CO-1 ) to Intensive Commercial Zone (CI-1) (REZ23-0002). (Second Consideration) Comment: On March 1st, 2023 the Planning and Zoning Commission recommended approval of REZ23-0002 by a vote of 6-0 (Signs absent), subject to a condition regarding the dedication of Dane Road adjacent to Outlot A, JJR Davis, 2nd Addition. Subsequent to that recommendation, it was determined said right-of-way had been dedicated in fee simple to the City pursuant to said final plat and thus the condition no longer necessary. Regular Formal Agenda 9.a Utility Rate Public Hearing Ordinance Amending Title 3, Entitled "City Finances, Taxation And Fees," Chapter 4, Entitled "Schedule Of Fees, Rates, Charges, Bonds, Fines, And Penalties" of the City Code to increase or change charges and fees. (Second Consideration) Comment: Title 3, Chapter 4 amendments include a 4% increase in water users charges, a 2% increase in wastewater user charges, an increase of residential solid waste collection fees for curbside solid waste disposal by $ 1.00 per dwelling unit per month, an increase of additional refuse carts over 1, per month by $1.00 each, and an increase in residential solid waste collection fees for curbside recycling fees by $1.00 per dwelling unit per month, an increase of$7.50 for the first bulky item and $ 4.00 for each additional bulky item per pickup, an increase in the minimum tipping fee charged at the landfill for Iowa City residents by $7.00 per visit and for non- Iowa City residents by $7.50 per visit, an increase in stormwater user charges by $.50 per equivalent residential unit per month, an increase in the monthly parking permit fee by $5.00 per month, the annual advance monthly parking permit by $57.00 per year and the annual moped/scooter/motorcyclel1permit by $5.00 per year in fiscal year 2024. Action: f' -e 11 tits l , PT 9.c TRC Consultant Contracts — Joint Meeting with the Ad Hoc Truth and Reconciliation Commission Resolution approving consultant contracts with Kearns & West, Think Peace, Healing Partners, and Three Native Partners to assist with facilitating the work of the Iowa City Ad Hoc Truth and Reconciliation Commission. Comment: The Ad Hoc Truth and Reconciliation Commission (TRC) have approved a proposal from Kearns & West, Think Peace (an initiative of the Mary Hoch 1.. Foundation), Healing Partners (Astig Planning, LLC and Mediation Services of Eastern Iowa), and Three Native Partners (individuals Manape LaMere, Terry Medina, and Donielle Wanatee) to provide facilitation services for the TRC. Comment: On September 15, 2020, Council passed Resolution 20 -228 establishing the Ad Hoc Truth and Reconciliation Commission (hereinafter, the "TRC") and set the deadline for their work as June 30, 2022. O n December 14, 2021, Council es-I-r'a-- extended the timeframe through June, 2023. The TRC has again recommended that their timeframe be extended, from June 30, 2023 to December 31, 2024, so that they can complete the work mandated in Resolution 20-228. Comment: A resolution is required for the use of federal CDBG and HOME funds 6e-e- for local projects. The Housing and Community Development Commission met on cu March 30, 2023 to formulate a funding recommendation, which the FY24 Annual Action Plan, for Council consideration. Attached to this resolution is Exhibit B which lists the FY24 CDBG and HOME projects and planned activities recommended for funding. May 2, 2023 Iowa City City Council Agenda Page 8 9.g Assessment Schedule ( Resolution adopting an assessment schedule of unpaid mowing, clean-up of- property, snow removal, sidewalk repair, and stop box repair charges and directing the Clerk to certify the same to the Johnson County Treasurer for collection in the same manner as property taxes. Comment: The City has the authority under Iowa Code §364.13B to assess the nuisance abatement costs in the same manner as a property tax. This resolution allows the City Clerk to certify to the Johnson County Treasurer the abatement cost to be assessed against the property. This assessment is being pursued only after the City took many steps to resolve the matter. The City notified the owners to abate the nuisance (for example, to remove snow from the sidewalk) and after the owner did not take action to abate the nuisance, the City abated the nuisance and billed the owner. After being billed at least twice, these owners still have not paid the abatement costs. The City has sent a letter to the owner giving them notice that this resolution would be on the agenda, a copy of which is attached to the resolution. No interest will be charged if the owner pays within 30 days of the first required publication.
