5.a Approval of FY2024 Interfund Transfers
Z-�v -ZSS Resolution Amending and Adopting FY2024 Interfund Transfers.
Comment: Iowa Administrative Code requires that the City Council adopt all
interfund transfers by resolution.
5.b Amending the Purchasing Policy Manual
Resolution approving and adopting the new Purchasing Policy Manual for
City procurement.
Comment: The City's Purchasing Policy Manual is being amended with two major
changes as well as many other minor language clarifications. The major provisions
are increasing bid limits and purchasing authority as a result of inflationary impacts on
expenditures, and modifications for online bidding software.
5.c Bus Rapid Transit Feasibility Study
Resolution authorizing the procurement of Consulting Services to develop a
25i Bus Rapid Transit Feasibility Study.
Comment: This Resolution will approve the procurement of Consulting Services for
a Bus Rapid Transit Feasibility study. The firm shall collaborate with the
Metropolitan Planning Organization of Johnson County (MPOJC), the CRANDIC
railroad; Johnson County; the cities of Iowa City, Coralville, North Liberty; and the
University of Iowa, to complete a Bus Rapid Transit Feasibility Study utilizing the
existing CRANDIC Railroad right-of-way between Iowa City and North Liberty
Iowa. A Request for Proposal was released on 3/3/2023. The evaluation team
recommends Felsburg, Holt & Ullevig to receive the award for RFP23-21 Bus
Rapid Transit Feasibility Study for a not to exceed amount of $254,785.
5.d Landfill Equipment Building Replacement
Resolution approving, authorizing and directing the Mayor to execute and the
City Clerk to attest an Agreement by and between the City of Iowa City and
Shive-Hattery, Inc., of Iowa City, Iowa to provide engineering consultant services
for the Landfill Equipment Building Replacement Project.
Comment: This item will approve an agreement with Shive-Hattery, Inc. to
provide land surveying, civil engineering, structural engineering, electrical
engineering, mechanical engineering, and architectural services to provide
preliminary to final design, preparation of bidding documents, bidding assistance,
and construction services for the Landfill Equipment Building Replacement
Construction Project. The project will construct a new building to replace one of
the existing buildings. The negotiated fee is not to exceed $384,200 and will be
funded by the Landfill Equipment Building Replacement, Account #L3328.

Comment: The project has been completed by Selzer Werderitsch Associates of
Iowa City, Iowa, in substantial accordance with the project manual. The Engineer's
Report and Performance and Payment bonds are on file with the City Engineer.

5.h Oktoberfest-alcohol agreement
Resolution approving an agreement with the Downtown District to allow the
'2-3 -_�_CoZ sale, consumption, and possession of beer during Oktoberfest on City streets.
Comment: The City Code allows private non -profit entities to sell and their
customers to consume and possess alcohol on public right-of-way under limited
circumstances. The Downtown District would like to be able to sell beer in a
demarcated area on Market St. and N. Linn St. during Oktoberfest on
September 23, 2023. This resolution approves an agreement with the Downtown
District, which is substantially similar to the 2022 agreement. The area on
Market Street and N. Linn Street is attached to the agreement.
6. Consent Calendar - Setting Public Hearings
6.a Iowa City Senior Center Exterior Building Envelope Preservation, Restoration and
Rehabilitation
Resolution setting a public hearing on October 3, 2023 on project manual and
estimate of cost for the construction of the Iowa City Senior Center Exterior
Building Envelope Preservation, Restoration and Rehabilitation Project, directing
City Clerk to publish notice of said hearing, and directing the City Engineer to
place said project manual on file for public inspection.
Comment: This project includes exterior limestone repair and restoration,
dismantling and reconstruction of existing parapet piers and parapet
balustrades, repair and termination of existing roofing system. The estimated
cost of construction is $1,910,000 and funds are available in the Senior Center
Facility Exterior Improvements account #K1001.

Public comment is intended so that members of the public may be heard by Council. Because
Community Comment is for items not properly noticed on the agenda, Council cannot engage
in discussion or debate due to open meetings laws.
Individuals will be provided 3 minutes to speak. The Community Comment period will end at
7:00 p.m. unless an extension is needed to meet a minimum 30 minutes of total time
allocated for the Community Comment period.
The Mayor reserves the right to reduce the 3 minute period based on the number of
individuals desiring to speak. Additional comments can be sent to the City Council
via council@iowa-city.org or through the City Clerk's Office.
9. Planning & Zoning Matters
9.a Zoning Code Amendment - Housing Choice, Supply, and Affordability Ordinance
amending Title 14, Zoning Code, to improve housing choice, increase housing
supply, and encourage housing affordability (REZ23-0001)
Comment: At its August 2 meeting, the Planning and Zoning Commission
recommended approval of REZ23-0001 by a vote of 5-0 with the exception of the
proposed amendments related to accessory apartments, which they voted to
defer. The proposed amendments would increase flexibility for a range of housing
types to facilitate diverse housing choices, modify design standards to reduce the
cost of construction while creating attractive and pedestrian -friendly
neighborhoods, and provide additional flexibility through dimensional standards to
enhance the supply of housing. The proposed amendments also create regulatory
incentives for affordable housing to encourage income -restricted units throughout
the community and address fair housing concerns to help support a range of living
situations and advance the City's equity and inclusion goals. Correspondence

9.b Rezoning - 715 N Dodge Street - Local Historic Landmark
Ordinance rezoning property located at 715 N Dodge Street from Medium Density
Single -Family Residential with a Historic District Overlay (OHD/RS-8) to OHD/RS-
8 in order to designate the property as an Iowa City Historic Landmark. (REZ23-
0006)
Comment: At its meeting on August 16, the Planning and Zoning Commission
e recommended approval of REZ23-0006 by a vote of 7-0. The rezoning
recognizes the property as an Iowa City Historic Landmark. The property at 715
N Dodge Street was the original location of the Emma Goldman Clinic, which is
celebrating 50 years of providing healthcare to women this month.

Ordinance amending Title 3, entitled "Finance, Taxation and Fees," Chapter 4,
entitled "Schedule of Fees, Rates, Charges, Bonds, Fines and Penalties", of
the City Code to increase or change charges and fees.
Comment: Title 3, Chapter 4 amendments include updating Section 4
"Wastewater Treatment Works User Charges" and Section 5 "Solid Waste
Disposal" to match the language in Section 3 "Potable Water Use and Service" on
the 10 percent delinquency charge that was approved in October 2020. It was
inadvertently missed in Sections 4 & 5. It also includes amending Section 5 to
increase the amount of pounds to 600 for the minimum fee in lieu of tonnage fee.

Ordinance amending Title 2, entitled "Human Rights," Chapter 1, entitled "General
Provisions," to eliminate the prohibition on landlords discriminating against Housing
Choice Voucher (aka, Section 8) holders. (Pass & Adopt)
�� Comment: The City Code prohibits landlords from refusing to lease to tenants who
have Housing Choice Vouchers (aka, Section 8). As of Jan. 1, 2023, this provision
is unenforceable due to a 2021 state law that preempts local governments from
prohibiting landlords from refusing to lease a unit to a person with a voucher. The
ordinance removes the City Code provision prohibiting landlords from
discriminating against tenants with vouchers.
