Consent Calendar - Resolutions and Motions 6.a Annual TIF Certification Filing Resolution directing the filing of Tax Increment Financing (TIF) certification under 2 3 -cj Iowa Code Section 403.19 for the 2023 end of year certification of urban renewal projects. Comment: The City is required to file an annual TIF debt certification with the County Auditor by December 1 st of each year. 6.b 2023 Annual Urban Renewal Report (AURR) Resolution approving the Fiscal Year Ending 2023 Annual Urban Renewal (Q Report (AURR). Comment: Per state law, the City must obtain approval by a majority of the City Council to file an AURR for each urban renewal areas in effect prior to the publication and adoption of the city budget. While Iowa City has 14 urban renewal areas, only 11 are active, so only those 11 urban renewal areas need be included in the report. Filing this report is required before the Department of Management will certify the City's taxes back to the County Auditor. Resolution authorizing the Mayor to sign and the City Clerk to attest a License Agreement between the City of Iowa City and Iowa Network Services, Inc., to use certain public rights -of- way for the installation, operation and maintenance of an electrical transmission line. Comment: This License Agreement, between the City of Iowa City and Iowa Network Services (d/b/a Aureon), will allow Iowa Network Services to install, operate and maintain underground electrical transmission lines within public right-of-way. 6.d Winter Shelter Agreement Resolution approving an agreement with Shelter House for a winter shelter. Comment: Shelter House has provided additional temporary overnight shelter during the winter months since 2015. This agreement provides $100,000 in financial assistance to Shelter House to provide a winter shelter at 340 Southgate Avenue for fifteen weeks beginning the first Monday in December and ending on the third Monday in March and outlines the requirements of the winter shelter in terms of staffing, number of beds and nights available. The winter shelter is distinct from the permanent emergency shelter at 429 Southgate Avenue, which also provides overflow capacity in the lobby as needed during winter months. 6.e Donation to Animal Shelter Resolution authorizing Animal Services Supervisor to sign acceptance on behalf "Z -2-&C1 of the City for a gift of life insurance benefits. Comment: Jacqueline Flake named the Iowa City Animal Care and Adoption Center as the beneficiary of a life insurance policy. She has passed away, and the life insurance company needs a corporate resolution authorizing a person to sign a claim form on behalf of the City for acceptance of the policy benefits. This resolution authorized the Animal Services Supervisor to sign a claim form on behalf of the City. Comment: This agreement authorizes Foth Infrastructure and Environment LLC to provide consultant services including design development, preparation of construction documents, bid phase services, and limited construction administration services for the Taft Avenue Reconstruction Project. The Project generally includes the reconstruction of Taft Avenue from American Legion Road to Lower West Branch Road. The total cost of the services is $ 1,035,886 and will be funded through Account #S3959 — Taft Avenue Reconstruct — Am Legion to Lwr West Br. 6.j Terrell Mill Skate Park Redevelopment Resolution approving, authorizing and directing the Mayor to execute and the 2-3 —27 q City Clerk to attest an Agreement by and between the City of Iowa City and Hitchcock Design Group of Naperville, Illinois, to provide consultant services for the Terrell Mill Skate Park Redevelopment Project. Comment: This agreement authorizes Hitchcock Design Group to provide preliminary and final design services and construction services for the Terrell Mill Skate Park Redevelopment Project. The project involves renovation of the existing skate park and access paths and the addition of a bicycle pump track. The consultant agreement is for $248,100 and will be funded through Account #R4372 — Terrell Mill Skate Park Redevelopment. October 3, 2023 Iowa City City Council Agenda Page 6 6.k Burlington Street Bridge Resolution authorizing acceptance of Bridge Investment Program (BIP) Funds from Z3 �7c the Iowa Department of Transportation for the Burlington Street Bridge Project and authorizing the City Manager to sign the Project Agreement. Comment: This item authorizes the acceptance of Bridge Investment Program (BIP) funds from the Iowa Department of Transportation for the Burlington Street Bridge Project. These funds are expected to assist with the study, environmental review and preliminary design phases of the project. 6.1 DOT Fiber Swap Resolution authorizing the Mayor to sign and the City Clerk to attest a Cooperative Agreement between the City of Iowa City and Iowa Network Services, Inc., to collaboratively swap fiber optic transmission lines. Comment: Both the City and the Iowa Department of Transportation have extra fiber optic lines to share with each other, efficiently and cost- effectively increasing the network reach of each entity. The City benefits from fiber swaps generally, and in this instance by securing a secondary fiber path to Fire Station 4 and other locations of need. 6.m Grant Management Specialist Position Resolution amending the budgeted positions in the City Manager's Office Department by renaming the Grants Manager position to Grant Management Specialist and the Administrative pay plan by adding the position Grant Management Specialist to grade 26. Comment: This resolution authorizes the City Manager's Office to proceed with hiring a Grant Management Specialist position, which was funded by the City Council with the FY 2024 operating budget. The position will help departments identify and secure grant funding, while also assisting with compliance efforts. 6.n TRC By-laws Resolution adopting the by-laws of the Ad Hoc Truth and Reconciliation Commission. Comment: The Ad Hoc Truth and Reconciliation Commission (TRC) approved by-laws. After reviewing the TRC proposed by-laws, the Council Rules Committee recommends approval with four changes. The Community Comment period will end at 7:00 p.m. unless an extension is needed to meet a minimum 30 minutes of total time allocated for the Community Comment period. The Mayor reserves the right to reduce the 3 minute period based on the number of individuals desiring to speak. Planning & Zoning Matters 8.a Zoning Code Amendment - Housing Choice, Supply, and Affordability Ordinance amending Title 14, Zoning Code, to improve housing choice, increase housing supply, and encourage housing affordability (REZ23-0001) (Second Consideration) S� Comment: At its August 2 meeting, the Planning and Zoning Commission recommended approval of REZ23-0001 by a vote of 5-0 with the exception of the proposed amendments related to accessory apartments, which they voted to defer. The proposed amendments would increase flexibility for a range of housing types to facilitate diverse housing choices, modify design standards to reduce the cost of construction while creating attractive and pedestrian -friendly neighborhoods, and provide additional flexibility through dimensional standards to enhance the supply of housing. The proposed amendments also create regulatory incentives for affordable housing to encourage income -restricted units throughout the community and address fair housing concerns to help support a range of living situations and advance the City's equity and inclusion goals. The rezoning recognizes the property as an Iowa City Historic Landmark. The property at 715 N Dodge Street was the original location of the Emma Goldman Clinic, which is celebrating 50 years of providing healthcare to women this month. Comment: This project includes exterior limestone repair and restoration, dismantling and reconstruction of existing parapet piers and parapet balustrades, and repair and termination of the existing roofing system. It was inadvertently missed in Sections 4 & 5. It also includes amending Section 5 to increase the amount of pounds to 600 for the minimum fee in lieu of tonnage fee. Comment: Water and sewer utility service lines and interior plumbing and drainage lines are privately owned and must be repaired at a property owner's expense. Emergency repairs can be unexpected and expensive, and staff has sought to help property owners plan for these expenses. This resolution will approve a marketing agreement between the City and Utility Service Partners Private Label, Inc., d/b/a Service Line Warranties of America ("Company"), to allow the Company to use the City logo on mailed solicitations for optional service line and interior plumbing and drainage repair plans to Iowa City property owners. Comment: In 2020 the Court ordered the owner of 91 Commercial Dr. to install a solid wood fence to screen its industrial use from the adjacent residential use as required by the Zoning Code. When the owner failed to do so, the Court authorized the City to do so and assess the cost against the property. The City installed a fence at a cost of approximately $18,500. The owner offered to make monthly payments of $500 if the City would not assess the property and staff agreed. The owner made monthly payments until March 2023 and has not responded to staffs inquiry regarding the delinquent payments. This resolution assesses the remaining amount due, which is $2,440.08.
