7.e Dive Team Agreement
Resolution authorizing the Mayor to sign and City Clerk to attest a Chapter 28E
2-3 JU 1 agreement for the joint provision of underwater and recovery operations (aka, a
dive team).
Comment: The City along with the County, Coralville, North Liberty, and other local
governments entered into an agreement in 2015 for the provision of underwater
search and recovery services, (aka, a dive team). Johnson County Emergency
Management Agency is proposing a new agreement to add University Heights, to
remove some local expenses, and to modify the diver qualifications. This
resolution authorizes the City to sign the agreement. The 2015 agreement remains
in force until all parties sign the new agreement.

7.g City Street Finance Report
Resolution approving the City Street Finance Report for the fiscal year ending
Z 3C 3 June 30, 2023.
Comment: Iowa Code section 312.14 requires all cities to submit the City Street
Finance Report (SFR) to the Iowa Department of Transportation by December 1
of each year.
7.h ICDD FY25 Budget
Motion to accept the proposed FY25 budget for the Iowa City Downtown
District, as approved by the Iowa City Downtown District Advisory Board.
Comment: Per the Operating Agreement between the Iowa City Downtown
District (ICDD) and the City of Iowa City, the ICDD Advisory Board must hold a
public meeting, approve the proposed budget and submit it to City Council by
December 1 each year.
7.i So.6 SSMID FY25 Budget
Motion to accept the proposed FY25 budget for the South of 6 Business District,
as approved by the South of 6 Advisory Board.
Comment: Per the Operating Agreement between the South of 6 Business
District (So.6) and the City of Iowa City, the So.6 Advisory Board must hold a
public meeting, approve the proposed budget and submit it to City Council by
December 1 each year.

7.j Digester Complex Rehabilitation
Resolution approving, authorizing and directing the Mayor to execute and the City
2� -3c)q Clerk to attest Amendment No. 1 to the May 2, 2023 Consultant Agreement by
and between the City of Iowa City and Strand Associates, Inc., of Madison,
Wisconsin to provide engineering consultant services for the Renewable Natural
Gas Project.
Comment: This item authorizes an amendment to the Consultant Agreement for
the Digester Complex Rehabilitation Project to include design services for the
addition of renewable natural gas equipment and systems into the project. The
total cost of the additional services is $1,418,500 and funds are available in the
Wastewater Digester Gas Improvements account #V3184.
7.k Agreement for Tobacco Enforcement Program
Resolution authorizing the City Manager to sign a 28E Agreement with the
�- � - 3e 5 Iowa Department of Revenue for tobacco enforcement.
Comment: The Iowa Dept. of Revenue is authorized to provide enforcement for
Iowa's tobacco, alternative nicotine and vapor product laws and is willing to
provide funding in FY24 to the City for engaging in compliance checks and
enforcement checks for Iowa's laws governing these products. This resolution
approves the attached 28E Agreement for Tobacco, Alternative Nicotine and
Vapor Product Enforcement, which is substantially similar to past agreements.
7.1 Energy Efficiency Grant - Hamburg
Resolution approving energy efficiency agreement between IC Burg, LLC, and
'2 3 3 c G the City of Iowa City.
Comment: This agenda item provides an energy efficiency grant to the
Hamburg Inn No. 2 to replace an old a/c system with new high efficiency units.
8. Consent Calendar - Setting Public Hearings
8.a Sale of 320 N. Governor St.
Resolution setting public hearing for December 12, 2023, on a proposal to
23 _.3 -7 convey a single-family home located at 320 N. Governor Street.
Comment: The property at 320 N. Governor St. was declared a public nuisance,
and the City acquired it for $106,000 through condemnation. State law requires
the City to convey the property to a buyer that will either rehabilitate the home or
demolish it and construct a new house. City staff has negotiated a purchase
agreement, subject to formal approval by City Council, for the sale of the
property for $115,000. This sale will reimburse the City for most, but not all, the
expenses incurred.

10.a Zoning Code Amendment - Reduction of maximum allowable height in the RNS-
12 Zone
Ordinance amending Title 14, Zoning to reduce the maximum allowable height in
the Neighborhood Stabilization Residential (RNS-12) zone from thirty-five (35)
5 e� feet to twenty-seven (27) feet for single-family and duplex uses. (REZ23-0005)
eV+r6L- Comment: The Northside Neighborhood Association requested a reduction in the
maximum allowable height for single-family and duplex uses from 35' to 27'. At
the Planning and Zoning Commission meeting on October 18, a motion was made
to maintain the current 35' height maximum. The motion passed by a vote of 4-3
(Elliott, Hensch, and Townsend in the negative), thus the Commission
recommends denial of this amendment.

10.b Zoning Code Amendment -Encouraging accessory dwelling units to improve
housing choice, supply and affordability
2 ) �r< Ordinance amending Title 14, Zoning Code, to improve housing choice,
increase housing supply, and encourage housing affordability by adjusting
standards for Accessory Apartments. (REZ23-0001) (Second Consideration)
Comment: The proposed amendment would adjust standards for ADUs to provide
additional flexibility and enhance the supply of housing. At the Planning and
Zoning Commission meeting on October 4th, staff recommended several
modifications to the City's accessory apartment standards. These changes
included, but are not limited to, removing the requirement for on -site parking,
allowing accessory apartments in all zones that allow single-family uses,
increasing the size of the accessory apartment, providing design flexibility, and
removing the owner -occupancy requirement. Staff also recommended changing
the phrase "accessory apartment" to "Accessory Dwelling Unit (ADU)". By a vote of
4-3 (Craig, Padron, and Quellhorst dissenting), the Commission recommended
approval of the Staffs proposed amendments except the proposal to eliminate the
owner -occupancy requirement. The ordinance reflects the Commission's
recommendations. Correspondence included in Council packet. Staff is requesting

Comment: The First Avenue and Scott Boulevard roundabout, American Legion
and Scott Boulevard roundabout, and American Legion Road from Scott
Boulevard to Taft Avenue have recently been reconstructed. This project includes

locations. The estimated construction cost is $205,000 and will be funded through

Comment: This project will reconstruct Dubuque Street between Iowa Avenue and

Linn Street. The work will include new pavement, storm sewer, water main,
sidewalks, pedestrian and roadway lighting, and landscaping features. The
