artorlal stroot, both the 1978 ComprehensIve Plan and the 1983 Plan Update
envisIoned much of the eastern edge of tho PenInsula Area north of Taft Speedway
dmloplng for residential purposes at a density of 8-16 dwellIng units per acre,
In addItIon to provIdIng housIng options In the PenInsula, It was antIcIpated
thIs hIgher densIty land use would also offset the Increased costs assocIated
with development located In a flood prone area. It was also anticIpated,
however, that, due to environmental lImItatIons wIthin the southeastern part of
the Peninsula and to Its exposure to a major entrance to the cOftlllunlty,
dovelopers may be InclIned to develop the ar.a desIgnated for hIgher densIty
development as a planned development.
Th. 1989 Compr.henslve Plan descrIbes the envlronmantally fragIle nature of the
PenInsula Area and emphasIzes that any development occurrIng In that area should
be controlled to ensure that the envIronment Is protected. The plan's
envIronmental policIes also er.courage the preservatIon and enhancement of the
city's entranceways. SInce the eastern edge of the PenInsula Area Is a promInent
part of the North Dubuque Street entrance to the comnunlty, the plan update
recOftlllends that development of this portIon of the PenInsula proc.ed In a careful
IIlInner.
The 1989 Plan Update states that the envIronmentally sensItIve nature of the
eastern part of the PenInsula, coupled wIth Its vIsIbIlIty from a major entryway
Into the cOftlllunlty ....justlfy encouragIng future development that adapts to and
Is harmonIous wIth the natural features of thIs part of the cIty. A low densIty
slngl.-famlly resIdentIal zonIng classIfIcatIon on thIs tract would assure that
the envIronmental fragIlIty of thIs tract would be gIven more consIderatIon and
that the purpose of the CIty's envIronmental polIcIes would be bettor fostered..
The CIty Is, therefore, InItIatIng the rezonIng of the portIon of the Fonlnsula
generally bounded by foster Road, Dubuque Street, the Iowa RIver and the Elks
Club from RS-8 to RS-S In conformanco wIth the land use polley change for thIs
part of the PenInsula.
STAFf RECOMMENDATION:
Staff recomnends that the portion of tho PenInsula Area generally bounded by
foster Road, Dubuque Street, the Iowa RIver and the Elks Club be rezoned from
RS-8 to RS-S.

The recently adopted 1989 Iowa CIt Com rehenslve Plan U date recommends that

uses. II It was the Rlverrront CommIssIon's understanding that this Comprehensive
Plan recommendation was made baud, as stated In the Comprehensive Plan, on the
"envlronmentally sensitive nature or these undevelor.ed tracts coupled wIth their
vIsibility rrom a major entry way Into the communIty,' The Rlverrront CommIssion
strongly agrees with thIs land use pol/cy adopted ror the PenInsula Area,
The Rlverrront CommissIon has serious concerns about tieIng the downzonlng or
the Peninsula Area to, and In errect, holdIng It hostage to a particular development
request, Any devIation rram the ComprehensIve Plan should be consIdered hIghly

The staff has recently convened, particularly those responsible for
subdivision review and knowledguble of the historic decisions that have
affected the City Council pollcymaklng over the years,
The Phnnlng and Zoning Commission, In Its review of the Idyllwlld
Subdivision, has expressed the fact that the potential for an Increase In
flooding by permitting the proposed development In the floodphln, Is
minimal. The Commission also questioned the ability to reject a
subdivision which comflles with applicable City codes and state hws.
This Is not to say tha the neighborhood con~erns are not legitimate based
upon their historic perspective, that Is, the land In question has
experienced water retention. However, the CIty Council In its review of
this subdivision must do so according to Its legal and administrative
responslbll itles under current ordinances and state statutes, legal and
financial liability can be evaluated based upon these ordinances.
Extraordinary political concerns, although applicable to a local setting,
are not addressed In the state statutes, local ordinances, and are not
part of this memorandum,
In your deliberation concerning this subdiviSion, It appears that you must
deal with the development and administrative principles applied to
floodplain management and, the appltcatlon of the floodphln management
ordinance to related community development activities occurring within our
community. The fl oodpla In management ordinance provides for development
opportunity In the floodpl~ln under controlled circumstances and a
federally authorized Insurance program Is In place to protect the property
owner In a floodplain area from the risks of flood damage.
The floodplain management ordinance applies uniformly throughout the city
In all arm designated In the floodplain, These mas must meet the
federal standards for development, which establish eltglblltty for
participation In the Insurance program. If you were to amend the flood.
plain management ordinance, development activity (both current and In the
future) throughout the city In floodplain areas would be affected. Any
changes you make with respect to this ordinance would have an effect on
other floodplain areas,

Due to the sweeping nature of the floodplain management ordinance and the
fact that federal standards and an Insurme program ire lude mlhble
through this ordinance, selective decision making, that Is, speCifying an
area by area, subdivision by subdivision review may place some Jeopardy on
the Insurance program and property values and thereby Increase the risk to
others currently owning property In fleodplaln management areas,
In order to develop a policy analysis that allows you to determine what
level of legal/financial lIablllty you lIay have, u well u the general
development consequences, I believe the City Ceuncll IIUSt address a very
bulc Issue, That Issue Is whether ,there Is a bulc agreement or dis-
agreement with respect to the current floodplain management ordinance u
It affects all areas of the city, or whether there Is Simply a disagree-
ment with respect to the application of the ordinance to this particular
subdivision proposal, When and If this question can be answered, we will
be more able to Identify the appropriate legal and financial risks you are
undertaking wm respect to approval or dIsapproval of this subdivision.
In order to discuss basic policy Issues, hopefully the follOWing will be
helpful to you as you reflect upon your Individual policy concerns.
If you were to amend the floodplain lIanagement ordinance, you will need be
assured that any amendment does not Jeopardize the status of the federal

The Issue of property values Is likely to be raised, not only by those
residents along Taft and Foster expressing their concerns, but also by
others owning properties In the floodplain area. Prohibition on develop-
ment would not only diminish the value of property currently located In
the floodplain, but also diminish future development potential. This
prohibition would have a chilling affect on property values, It Is at
this point that the legal question can be raised as to whether the City,
through the city-wide enforcement of floodplain management ordinances and,
In particular, If that ordinance provides for development prohibitions
and/or so severely restricts development, that those residing In the
floodplain have experienced diminished value In their properties.
It had been my understanding that the Urban Ad Hoc Environmental Committee
chose not to address the Issue of floodplain management and turned their
attention to the Issues of gradIng, erosion control, wooded areas, etc.
They were of the opinion that the existing poliCies and ordinances are

I, Deficiencies:
The deficiency noted In the March 17, 1988, Staff Report has been
resolved, however, two additional deficiencies remain:
a, Identify existing two-Inch gas line on Taft Speedway, Foster Road
and Callbrla Court,
b, IIlldwood Street wlll need to be renamed as there Is an ex 1st Ing
street by that name that extends north of IIhltlng Avenue,
Staff continues to recommend that the preltmlnary plat be deferred
pending resolution of these last two Items,
2, Fleodplaln Management:
A lot of discussion has centered around the fact that the subject
parcel Is located In the floodplain and whether the parcel Is suitable
for development, GIven this concern, a review of the National Flood
Insurance Program and the Iowa City Floodplain and Hanagement Ordi-
nance would be appropriate,
Iowa City Is a partiCipating community In the National Flood Insurance
Program (NFIP), Participation In the program required completion of a
Flood Insurance Study (FISl, published by the Federal Emergency Han-
agament Agency In 1977, and revised In 1985, and adoption of a flood-
plain management ordlnance'(Chapter Ii, Iowa City Code of Ordinances)
which comprises the regulations and administrative procedures used to
minimize flood hazards, The FIS was designed to Investigate the
existence and severlt, of flood hazards In Iowa City, During the
course of the study, lood hazards were Identified and their severity
was determined through deta Iled analysis of hydrologic and hydraulic
characteristics, Participation In the NFIP enables the City to qual-
Ify for disaster relief In the event of a major flood, and makes flood
Insurance available fer those persons owning property III fleod prone
areas,
Areas Inundated by flood waters const Hute the floodplain, The meas-
ure of flOOding used as a standard of the NFIP Is the lOO-year flood,
The level of flooding that Is reached In the occurrence of a 100-year
flood Is the base flood elevation. The floodplain Is divided Into two
separate components called the floodway and the floodway frlngo. (Soe
Figures I and 2) The floodway Is the channel of a stream, plus any

water heights wtll not Increase by more than one (1) foot (surchargel'
Relating this to the area Including rdyllwlld Subdivision, full deve _
opment of the entire floodway frlnoe, both upstream and downstream,
would result In an Increase In floodwater heights of not more than O,S
feet, A cross-section of the 100-year floodplain was taken through the
centar of the site, cross-section L, as shown In Figure 4, Specific
Information regarding this cross-section Is represented In a Floodway
Data Table In the F1S, Figure 6 Is a copy of the table, The most
significant Information h contained In the collxnns "Sm Flood Water
Surface Elevat Ion," The two columns "With Floodway" and "Without
Floodway" represent the difference In floodwater heights as a result
of development In the floodway fringe, Another way of reading these
columns Is "with encroaclvnent" and "wIthout encroachment" respec-
tively, Referring to cross-section L In the table, we see the differ-
ence In floodwater heights h O.S feet, Since City Park, which Is on
the south side of the Iowa River will never be fully developed, It Is
very unlikely that this area will ever experience the O.S foot In-
crease, Correspondingly, the development of Idyllwl1d Subdivision
w111, in and of Itself, have a negligible Impact on floodwater
heights,
J, Other Infonnation:
Enclosed Is a memorandum fram Joyce OeLong, Public Werks Department,
regarding the elevation and Improvement of Taft Speedway, It Is
Important to note that flooding conditions as a result of Improvement
of Taft Speedway will not Increase or worsen, Frank Farme~, City
Engineer, will be present to address any questions with regard to Taft
Speedway and other Issues the Commission may have,
There Is no statutory standard regarding the composition of fill
material, The State Department of Natural Resources advises that fill
be comprised of no more than 15 percent by volume of organic material
InclUding asphalt, Asphalt grlndlngs and pavement sections are often
used as subgrade material for the construction of roadways,
