direotly affeoted by the rezoning, perhaps more than other neighbors.

neighborhood of moatly duplexea and aingle family housea, Even if no new
bU1ldinga allowed under RH-44 would bo built, the mere faot that on the
zoning map our neighborhood of duplexea ia evor more tightly aurrounded
by RH-44, areaa, will lead to a deoreaae of real eatate valuea of the
. 'duplex neighborhood, People who like to live in duplexea aimply do not
want to live olose to hiah denaity areaa,

are not ao high, who oan guarantee that this will remain ao in the
future? Experienoe shows that whenever a zoning allows higher denaity of
oooupation, it will eventually be materialized, Thia would be a very
unweloome development for the adjoining duplex area and would load to

erea: before 1981 our neiihborhood waa all Quiet and poaoeful all most
neiihborhoods in Iowa City, In about 1961 new oonstruotion took place in
an adJscent R/i-44 zone, After 1981 the Quality of tho ne1ahborhood
ohanied, On my own properties I had to oope with orullhed soreens,
rellultini from attempted break-ins. I noticod pressuro marks stemmini
,from metal inatrumenta in window ftnd door framea, My tenantll reported to
me about lltranio visitorll on the premillell at n1iht, brawla and oalla for

I support the City-initiated rezoning of the
Peninsula Aroa generally bounded by Foater Road,
North Dubuque Stroet, the Iowa Rivor and the Elks
Country ClUb from RS-O to RS-5.
This aroa has experiencod flooding IInd tratfic
probloms in tho past. Traffic studioB Boom to
indicato that it is not a problom, I cannot agroo
with that summation. Turning onto and otf ot
Dubuque Street is difficult and dangerous at
cortain times of tho day in normal daily liVIng
patterns and is compoundod on football and baskotball
game days and many of tho lIanchor functlono.
Flooding is a prOblem, to wit, as I came south on
Dubuque Street to attond tho moeting of 8/14/89
thero was A man on the median in rain slickor and
knee boots directing traffic through tho east lanos
pt Dubuque Stroet because tho pavement was undor
muddy I swirling water.
I am opposed to the proposed subdivision called
Greek Place. It does not fit a low density Bingle
Camily residential area.
Even though I live severnl blockn north of the
traternitleB on Dubuquo Stroet I somotimes hear the
noiso from groups cOllocting and I tind it very
repulsivo to drive down Dubuque Street on Sunday
mornings and see all the litter trom the Saturday night
parties. Recently my soven year old grandson pointod out
the litter ot paper and styrotoam cups extending beyond
Gloria Doi Church. ThiB is not the example I wish to
present in my neighborhood.

we object to the proposed downzoning of the PeninSUla Area,
Zoning Item Z-8910. As a part of that objoction, we have
the following comments I
1. The proposal here is based on a Staff opinion that
a lingle family development will provide greater protection
to the environmont. Thera is no such opinion from outside
land usa experts. Staff has had regular conflict with my
client, and I believe that it is import~nt that an outside,
objectivo opinion be obtninodl .
~. Tho other stated reason for the downzoning is the
aosthotic impact of seoing a duplex development upon enter-
ing Iowa Citi from Interatate 80. This is onco again an un-
supported op nion of the Staff. An attractively designed
IUbdivision should have no detrimental impact. In addition,
this area is set back from Dubuque Streot and the curvo of
the road directs attention away from rather than toward this
area. Also, no such objection was raised to the duplex de-
velopment on the wast sido of Iowa City. This is easily
seen from Interstate 380, yot is not claimed to detract from
the appearance of the City for those entering from Highway

Least you think the Helghborhood Englert Tract Proservatlon Group did not
follow through on their desire to purChase the land, wo did raise ninety
thousand dollars, and wo did go to the lale. Heedless to say, we didn't got
a chance to bid.
The Group spent soveral hundred dollars en lawyers to get a non.proflt
status. Unfortunately, before wo got the status tho land went up for salel
thereforo we could not solicit funds throughout tho city. We did tho best
we could. We made a valiant effort financially and physically.

As to the status of the land today, I fool every warning from all the
experts that were brought bofore the Planning and Zoning Commission wore
blatantly Ignored. Instead of fewer houses I the developer Is planning
double the number of houses planned by Glasgow.
How Is this posstble when the Planning Department recommends down zoning of
the entire peninsula area? The Planning Commission delayed voting on down
zoning until after the Idyllwlld Subdivision was approved thereby giving Hr.
Oaks 0 go.ahead on RS.8 density. /low unfair. lie asked tllllO and tflll8 again
why the zoning was not voted on before the plot was approved. We worn told
It was the Commission right to dotenAlne when Items wore voted upon. Isn't
this strange? IIho profits from the delay In zone voting.
Then the Commission decided to spot zone the orca. Throwing the citizens 0
bone of environmental enticement. They were going to consider making the
IIet Land 0 Park. this Is ridiculous because Wet Lands are not for peoplo.
The IIet Lands are for flora, fauna, birds and animals. Peeple are tho least
desirable occupants as visitors to a wot land area.
In order to sensibly make the area along the river Into a true Wet Land, the
Taft Speedway road must either be left os It Is or be raised on pile driven
supports to allow free flow of water on both sides of the road. The Glasgow
property must be cleared of fill. As It Is, It Is 0 damn blocking free flow
of wator. Please get advice on this. Ho one has given creative thought to
treating the road os a ratsed or elevated street.
No one has thought about making a frontage road to alleviate the traffic
prOblem which would be created by developing the peninsula area. This
prOblem has not been addressed. It has to be If the entry Into Iowa City
remains satisfactory for all concerned, That Is people coming Into tho City
and people trying to get out of the pentnsula area on to Dubuque.

the daveloper to avoid paying for tho pavement of Ho Hamo Road. The
Planning Department Indicated that stre6t was a part of the devolopment and
~uld have to be upgraded by the developer. So, the developer's creative

posslbl. lots on the west side of the street would be land locked. The
utilities and drainage ditch along the road would be wasted. The twolve
families living on Taft Speedway would be fsolated. Ho Hame Road Is the
highest point In that area with a lolld base. It Is the last land Inundated
during the vet lands overflow. It Is the mast solid piece of land. Yet the
doveloper wants to vacate It and move the oscape routo to the svampy marsh
In the field. This Is only benefiting one person . the developer and

way to handle Taft Speedway. It could even be Incorporated Into a frontage
road. It would be expensive. but very sensible. It would help alleviate
tltO problems.
Curve the raised road alan? Terrill park and allov traffic to gradually flov
onto Dubuque Streot. That I creative thinking. Hot vacating No Hame Road
for the advantage of one man.
In closing I ask you why the Planning COlII1llsslon Is advising you to approve
so many recommendations that are ObviOUSly against the best Interest of the
citizens of Q~owa City end the ComprehenSive Plan developed by the Planning
Department ~n paid City staff. Only one man will benefit from these
recommendations while the entire citizenry of lova City viII suffer. Until
more study has been done concerning the best development of the peninsula
area do not rush Into an affirmative vote on any of these recommendations.
You would not be penaliZing the developer. Hr. Oaks has ovned the Englert
Tract for many many years. He Is well aware of all the problems that have
been presented. I canlt believe he has gone against all the natural factors
of the area to place approximately 122 houses In a swamp and 12 others In
the river.

Enclosed are two maps. The first map indicates Iowa-Illinois Gas and
Electric Company electric facilities in the subject location. The
second map indicates our gas facilities. As we discussed on November
27, 1989, Iowa-Illinois Gas and Electric Company desires easement
rights be retained for the existing facilities. The width of the
easement required is 10 feet per each facility as shown on the
attached maps. Please forward to me a copy of the Planning and Zoning
Staff Recommendation Report and the recorded vacation plat with our
easement shown as it becomes available.
The route ot the underground ga8 line will be flagged and painted
immediately.
