and the Identlflad need for sarvlces to provld. Information and to coordlnata
various ,,"orts of solid wllte manllJement wIthIn Johnson County.

Howaver, I believe this propoIII stopped short or the recognition or ECICOC's
regional efforts of solid waste manegllllent practlc.. and If a proposed Johnson
County progrllll were Implemented, It could erfectlvely hinder ECICOO'a endeavor
In this area, It seems to me that your proposed position may be too all_
encompIIslng for the county level and may be more approprIate at the ECICOC
level. Consider the following:

The.e .tate initiated landate. will require that each lunicipality
and rural re.ident in John.on county modity to a qreat oxtent,
exi.tinq collection and dispoaal practices. This will be ICSt
directly reintorced by chanqes in what and how materials will
be accepted at the Iowa City sanitary Landtill.
For example, startinq July 1, 1990, yard wa.tes mu.t be separated
trom other qarbaqe. On January 1, 1991, yard wastea can no lonqer
be landtilled. This chanqe will require that municipalitiel develop
alternative collection proqrams. This will entail paaaaqe ot
local ordinances and increased handlinq and disposal costs. At the
preaent time there is a qood deal or uncertainty about thil
requirement amcnq moat municipal qovernments in the county.
The development ot recyclinq proqrams is also encouraqod
by HF 753. There is qrowinq intereat in orqanizinq luch proqrama
in the county. However, alliltance in coordinatinq collection,
proceasinq and marketinq or laterials is necellary. Economic
conaiderationa involved in orqanizinq and operatinq recyclinq
activitiea can be aiqniricantly enhanced throuqh cccporative
municipal and private actiona, The developmont or an cn-qoinq
public intcrmation/education proqram hal been tound to be
eaaential in communities currently involved in recyclinq and
waste reduction proqrals.

inquiry rogarding tho Council's oxocutivo sossion procoduro
at its DocoNber 11th Noeting. Tho opon Neetings statute is
one which hes served tho peoplo well and I view such
inquiries to NY ottico as a signiticant responsibility.
Mayor McDonald was immodiately rosponsivo to my call to
him. lie was opon, thorough and accurato in describing the
Council's procodure. As is my normal practice in such
instances, I reviewed your agenda and the tape rocording ot
the action to go into oxocutive sossion. I also roviowed,
as is my preterenco and usual request, the tape recording
ot tho executivo session itsolt.
I concluded that your procedure was in teChnical, albeit
unintendod, violation ot tho statuto in one rospoct. Your
agenda, the motion to go into exocutive session and the
initiation ot the exocutivo sossion all assumed that tho
individual boing evaluated requostod an executivo sossion.
There is nothing ot rocord to support this assumption. The
individual's request tor a closed or executive session is
an absolute prerequisite under Section 21.5(1)(i) ot the
Codo.
