REI Comprehensive Water supply plan
I believe it is time to begin tho formal work on the
Comprehensive Water Supply Plan. I have prepared a subject
outline of the material I would like to see in the Plan. It is
comprehensive because we should evaluate water quality, quantity
and emergency water supply needs. We should fully and
objectively consider all reasonable water supply resources and
evaluate our present treatment plant processes and equipment. We
should expect to see recommendations for both structural
(constructionl improvoments and non-structural solutions such as
policies, rates or regulations.
We really have nothing much to work with from the past
engineering studies which were done specifically for the water
plant. We basically have a process which has not changed much in
the last 100 years. In the 19th century people were concerned
with prevention of water-borne diseases in the water supply. Now
we are also concerned with carcinogens, toxins, spills, and
aesthetic values. It is a much more sophisticated issue.
The timing is good to begin now because we are completing work on
several capital improvement projects which were primarily needed
for increasing storage or replacing worn out machinery. These
projects include I
.,new 1,000,000 gallon treated water storage tank in the
U of I parking ramp
..new 3000 gallon per minute high service pump
..rebuilding the well pump and 4 other pumps
..complete replacement of the computer control system
including all field instruments and meters
..replacement of the electronic meter reading system for
customer meters
The University of Iowa just completed a substantial addition to
their treatment plant in 1989. The extra capacity will allow
temporary help when some of our plant must be shut down for
reconstruction or replacement.

I am happy to Inform you that under the Iowa Finance Authority's Housing
AssIstance Fund Program, your project Is considered worthy of fundfng based
upon meeting certafn conditions to be contained In our contract with your
organization. Funding will be fn the form of a $60,000 loan at 0 percent
Interest for 10 years with a 12 month deferred first payment - quarterly
payments thereafter. Exact terms and conditions will be enumerated and
defined In the contract. Any other use of these funds Is not allowed without
previous written approval from the Iowa Finance Authority and Is subject to
non-reimbursement.
Your receipt of these funds Is dependent upon the successful completion and
execution of a contract between your organization ~wa Finance
Authority. We will be SCheduling an fndlvldual meeting with you here In our
offices to go over your application In more dotall, and to ensure that we
thoroughly understand your project and that you have other additional funding
or commftments arranged, No funds will be awarded until the contracts are
prepared and the Iowa Finance Authority Is satisfied that everything fs In
order.
Funds expended prior to our written notification to you Indicating that the
project IMY start are non-relmburseable. In some cases, construction lien
waivers and other documentation will be requfred before you receive funds from
the Authority.
We will be In contact with you shortly regarding these matters and will also
be Scheduling meetings at that time.

7.04(A) OF TIlE 10llA CITY CODE OF ORDINANCES, IN ORDER TO CLARIFY PROCEDURES
CONCERNING SUPPlEHENTARY PETITIONS FOR INITIATIVE AND REFERENDUH PROCEDURES, AND
ALSO CLARIFYING MINIHUH NUHBER OF SIGNATURES REQUIRED FOR THE INITIAL PETITIONS.
IIHEREAS, the current Charter provides that supplementary petitions for
referendum and Inltlatlvo procedures must be riled with the City Clerk within IS
days of recolvlng a certificate of Insufficiency from the City Clerk; and
IIHEREAS, the Charter provisions are designed to allow supplementary petitions
only when the original petition had the minimum required signatures attached
thereto. but was not designed to permit garnering the minimum number of
slgnaturas within that IS.day period; and
IIHEREAS, the additional IS.day period should continue to bo used to correct
Insurrtc\enc\es In the original petition, but only If the original petition
contains the required minimum number of signatures; and
IIHEREAS, It Is In the public Interest to clarify the Iowa City Charter In
order to avoid any further confusion and make the procoss easier for both the
City and the public; and
IIHEREAS, certain portions of the Iowa City Charter, namely Sections 7.03(A)
and 7.04(A) should be amended to reflect this clarlftcatlon, and avoid any
confusion as to the propor Initiative and roferendum procedures.

codified as follows:
(A) Number of slgnaturos. Initiative and referendum petitions must be signed
by qualified electors equal In number to at least twenty.flve porcent of
the number of persons who voted In tho last regular City election, but
such signatures shall be no fewer than two thousand five hundred qualified
electors. Any potltlon that does not, on Its face, contain the mlntmum
required signatures defined horeln shall be deemed Insufficient for filing
under this Artlclo, and no supplementary petition shall bo permitted.

receiVing a copy of such certlflcato. Such supplementary petition shall
comply with the requirements of subsections Band C of Section 7.03.
lIlthln fifteen days after a supplementary petition Is ftled, the CIty

The city of Iowa City brouqht an action in September of
1999 aqainst Hubert Yeqqy charqinq him with violatinq a
city ordinance concerninq nuiaancea. The city ordinance
declarea certain condition. are nuiaances. A qeneral
penalty proviaion dechrea any failure to perform any act
required by city ordinance is a misdemeanor punishable by a
fine of one hundred dollars or impriaonment not to exceed
thirty days. Code of Ordinances of Iowa City 5 1-9
(1988). The city code a180 provide. any ordinance
violation i. a municipal infraction. Code of Ordinances of
Iowa City 5 1-21. Yeqqy waa accu..d of committinq a
municipal infraction by allowinq junk or aalvaqe materials
to be collected and to remain upon hi. property. See Code
of Ordinance. of Iowa City 5 24-101(a). The city souqht a
civil penalty of thirty dollars plus coats and tho removal
of tho junk and salvage materiala. The charqe wa. tried to
a judicial maqiatrate who found Yoqqy guilty of the

municipal infraction. Thl magiatrate fined Yeggy thirty
dollan and ordlred him to remove thl junk and uhagl
materiala from thl property.
Yeggy appealed to the district court, and the appeal
was heard by a d1atrict uaoc iate judge. The court
affirmld the judgmlnt and imposition of a finl but found
the magistrate did not have jurisdiction or authority to
order the nuisance be abated. The court concluded the city
did not havo the power to give mag1atratea, through
municipal infractions, tho.e powers to abate given to the
district court under Iowa Code chapter 657.
The city filed a motion to roconlider with the district
court. In denying the motion, the court noted that cauaing
a public or common-law nuisance is an aggravated
misdemeanor under Iowa Code aection 657.3 and, therefore,
it could not be made a municipal infraction. ~ Iowa Code
5 364.22(3). See allo Iowa Code 5 602.6405 (judicial
magistrate has no jurisdiction over aggravated
misdemeanors). The court further noted abatemlnt might
cost more than the $2000 civil limitation on a magistrate's
jurisdiction. ill Iowa Code 55 631.1(1), 631.2(1). We
granted the plaintiff'a petition for writ of certiorari.
. A writ of certiorari shall be granted when a court
exceeds ita proper jurisdiction or otherwise acts
illegally. Iowa R. Ch. P. 306. IllegaUty exista when

Acts ch. 99. The act provides that magistrates have

from creatinq a municipal infraction 'if the violation i. a
felony, an aqqravated miademeanor, or a .erioul mi.demeanor
under state law or if the violation i. a limple miademeanor
under chapten 687 throuqh 647.. 1987 Iowa Acta ch. 99,
S 4 (codified at Iowa Code S 364.22(3)(Supp. 19871).
The city had authority to define a nuil4nce by
ordinance and to provide that a violation of ita nui.ance
ordinance is a municipal infraction. Cities have authority
under Iowa Code section 364.1 to inve.tiqate, to declare,
and to seek abatement of nuisances. City of Cedar Falls v.
Flett, 330 N.W.2d 2S1, 255 (Iowa 1983)1 Town of Grundy
Center v. Marion, 231 Iowa 42S, 433, 1 N.W.2d 677, 681
(1942). Cities now may provide that a violation of an
ordinance is a municipal infraction. Iowa Code
S 364.22(2).
It 11 true that a city cannot create a municipal
infraction if the violation is an aqqf4vated misdemeanor
under state law. Iowa Code S 364.22(3). However, causinq
a nuisance i. an aqqravated m1ldemeanor under state law
only 'where no other punishment therefor 11 specially
provided,' Iowa Code S 657.3, ~ Jasper County v.
Sparham, 12S Iowa 464, 466, 101 N.W, 134 (1904). The
statutory .cheme allows cities to provide othor penalties
for violatinq a nuiaance ordinance, and, thus, section
364.22(3) did not limit the city'S authority.

Rochester Avenua.
The Water Division workers did excavate a large hole on the south
side of Rochester Avenue near the west proparty line of the lara
property at M260S. The excavation was entirely within the City
right-of-way ..,.th.r. 1S over 10 f..t from the curb to the
str..t sid. of the sid.walk.
Th. .xcayatlon was n.c.ssary to make a new 6-lnCh valv.d
Interconn.ctlon to the axlstlng 12-lnch water main. fhe new 6-
Inch wat.r main for St. Ihomas Court was construct.d by boring
ben.ath Roch.ster Av.nue from north to south.
The .xcavatlon was start.d on. Friday morning on April 13 but the
work was stopped at 1:00 p.m. Dy a downpour. The work.rs put
f.nclng and barricades around the dirt pile and left the site
until Monday. The workars th.n div.rted to fire hydrant
flushing, Insp.ctlon and maintenance, which is a Job that can be
dona during or following a heavy rain. On Monday, April 16, the
crew returned and flnish.d the Job.
Wo know tho dirt pllos aro not lovoly to look at. Evory day of
the week, from the time frost comes out of the ground tn the
spring until frost raturns In the following wlntar, the Water

Thoro is a situation in Iowa City which is not only upsotting
mysolt and my tamily, but also tho tamilios ot at loast suvon othor
housoholds~ This situation is on Haytiold Rd. . . but it is not
duo to tho sowago construction thot is taking placo. . . it doos,
howover, have to do with our streotl this situation is about the
NO PARKING SIGNS.
Tho signs (Which say "No Parking Anytimo" on tho north sido
on the stroot), were put up due to the parking problems that the
City High - West High tootball games producod. I am not questioning
that something should bo done, because during tho gamss the trattic
situation is protty hectic, (there was a concorn that an omorgency
vohiclo could not get through, with parking on both sides ot ths
streat) -. But to put up signs that last the entire year is not
only ridiculous, it is completely wrong.
Betore I get into a tew possible altornatives to this problom,
I want you (tho council) to underatand why a "yes" majority vote
came about in the tirst place when a petition was sent around the
neighborhood, it is simply because the people who signed the potition
woro led to the conclusion (trom the potition and trom tho 'petitioner')
that "No Parking" signs were only going to bo usod tor tho tour
