minors to cigarottos and tobacco products, Wo havo includod a
"Fact Shoot" and a ratlonalo for our proposal in ardor to givo
soma background as to why wo tool this is an important onough
mattor to bring to tho CouncIl's attontion.
As tho ordinance's sponsor, we ~~uld like to introduce
oursolvos. Wo aro a group at modical studonts horo at tho
univorsity of Iowa intorostod in promoting hoa1th in tho Iowa
City and Coralvillo aroas primarily through oducation. Wo call
oursolvos D.O.C., short tor "Doctoro Ought to Caro." For tho last
throo yoars wo havo organizod small groupo at modica1 studonts to
visit local olomontary schools and givo talks on nutrition, tho
dangors of smOking and chowing tobacco and on tho importanco ot
oxorciso. Each yoar wo work in conjunction with tho Amorican
Cancor socioty to promoto tho Groat Amorican Smokoout. In
addition, oach Fall wo sponsor a 5Km road raco, tho "D.O.C.
Dash." Anothor projoct ot ours has boon to run studios both in
1989 and 1990 to dotormino tho oaso with which minors can buy
cigarottos in Iowa City and Coralvi110. Tho mothods and rosu1ts
of oach at thoso otudios aro providod in tho study roports,

Tho Stato Law is not being onforcod. Our community's children
havo nearly free access to cigarottes. D.O.C. has tried to
encourago local businossos to abido by tho low through lottor
writing. Wo will continuo to do this. 1I0wovor, wo fool this is a
crisis which calls for community action to achiovo roal chango.
A rocont public opinion survey conductod in Codar Rapids,
Iowa, showed that 70 porcont folt tho solo of tobacco products
should bo as striotly contro1lod as alcohol. 84 percont agreed
that cigarotto vonding machinos should bo oliminatod from places
whoro toenagors gathor. 87 porcont agreed that merchants who solI
tobacco to thODO under age should be fined.' C10arly there is a
gap botweon tho intont of Iowa Law and public opinion on the one
hand, and the roality of froB youth access to cigarettos on tho
othor. Action at 0 local level is neoded to begin to closo this
gap.

inform local rotailors of tho current Iowa state law on thio

a proposod ordinance.
3, Organizo a coalition of community organizations in favor
of municipal action in Iowa Citr and Coralvillo aimed at
restricting toonage accoss to c garottes. D.O.C. has written
soveral Johnson County organizationo, In our 10tters wo have
providod information on tho problom of smoking in minors and have
enclosed 0 proposod ordinance for prosentation to the Iowa City
and Coralville City Councils, Wo have asked oach of these

documontod nnd ora woll known. Ono-fourth of nIl rogu1ar
cigarotto smokors dio of cigarotto-rolatod disoaso. At a rocont
national mooting, an associato diroctor of tho Alcohol, Drug
Abuso and Montal 1I0alth Administration IADAMIIA), tho foromost
fodoral agoncy concornod with drug abuso, statod that 1000 doaths
por day woro duo to tobacco, comparod to 350 por day duo to
alcohol and 15-30 por day duo to cocaino nnd horoino.' The
Surgoon Gonoral has doclarod cigarotto smokinq to bo "tho sinqlo

supply by incroasing complianco with oxisting Iowa law. Survoys
porformod by D.O.C. in the Iowa City/Coralvil10 aroas rovoaled
almost no offectivo rostriction of accoss to cigarettos for this
ago group, dospite Iowa stato law to tho contrary.
A rocont survey performed in Cedar Rapids showed that public
opinion is strongly in support of restricting youth accoss to
cigarettes. 70 percent of those surveyed folt tho solo of tobacco

II. Ctgposed ordin~:
Section 1: Employees of business establishments with permits
to seli tobacco must read city regulations and state Law (Sec.
98.2) concerning the sale of cigarettes and tobacco products and
sign an affadavit that (s)ho understands and will uphold the
regulation. Affadavits signod by each employee engaged in the
Bolo of tobacco products must be kept on the premises of the
business establishmont, ready for inspection by law enforcement
officials.
Section 2: a. No person shall sellar dispense any
cigarottos or tobacco product, cigaretto paper or cigarette
wrappor through tho use of a vending machine, except in
locations whoro accoss to minors is restricted, such as
r~gtgrlg~, bgglnggg gfflggg nnd tnvorng/~r8, whorg nlcoho11c
bevoragos are offored for consumption.

(specified in Section 5) shall be assessod on both the owner of

Soction 4: Tobacco salo pormit holdors aro roquirod to
display thoir pormit and tho following warning or its oquivalent
opon1y and in proximity to cigaretto displays: "You must be 18
yoars of ago to purchase cigarottos or othor tobacco products.
Proof of age requirod by State Law." The minimum dimonsions of
thoso signs shall be 6 inchos by 8 inchos.
Soction 51 Any holdor of a retail tobacco Balas pormit who
fnils to comply with Sections 1-5 shall bo finod $JOO.OO and the

minors In this second study, 54 of the 56 stores revisited (96~) wcre guilty of selling

products can be purchased by anyone whO has the money.
The Board of the 1ACCH supoorts your effort. to combat thl' prOblem
and we have some suggestIons that mIght make the adoption of the
ordInance more lIkely. The man. power necessary to as.ure that the
affadavlts are SIgned will be costlv and the signIng of the document Is
not likely to enhance complIance wIth the ordInance, As far as the
dIstrIbution of coupons, thIS may be very dIfficult to control because
coupons are delivered routInely In newspapers. Does this moan that
coupon Inserts WIth tobacco advertlsement8 WIll not be allowed In the
City? If so, that probably wIll not pas8 through the City government,
How about banning cIgarette machInes In the CIty attogether, as was
recently suggested by the Surgeon General? That might have a
POSSlbllllty of being adopted In Iowa CIty.

tAll those who support the following proposed
ordinance pleoso sign the attached page.
Section 1: Employees of busineso establishments with permits
to sell tobacco must read City regulationo and State Low (Sec.
98.2) concerning the sole of cigarettes and tobacco products and
sign on affadavit that (slhe undorstands and will uphold the
regulation. Affadavits signed by each employee engaged in the
sole of tobacco prOducts must be kept on the premises of the
business eotablishment, roady for inopection by low enforcoment
officials,
Section 2: o. No peroon shall sellar dispense any
cigarettes or tebaeeo product, cigarette paper or cigarette
wrappor through the use of 0 vending machine, except in
locations where access to minors is reotricted, such as
factories, business offices and taverns/bars, where alcoholic
boverages ore offered for consumption.
b. Penaltios for violation of oection 20
(specified in Section 5) sholl bo assessed on both tho owner of
the property where the vending machine is located and the owner
of the machine,
Section 3: No person sholl sell cigarettes to persons undor
the age of 18 years who has a note from on adult requeoting such
o sole.
Section 4: Tobacco sole permit holders ore required to
display their permit and the following warning or its equivalent
openly and in proximity to cigarette displays I "You must be 18
yoars of age to purchase cigarettos or other tobacco products.
Proof of age required by State Law." The minimum dimensions of
these signs sholl be 6 inches by 8 inches.
Section 5: Any holder of 0 retail tobacco soles permit who
foils to comply with Sections 1-5 sholl be fined $300.00 and the
suspension of their retail tobacco soles permit for seven (7)
days for the first violation I for thirty days for tho second
violation I for sixty days for the third violation and revocation
of the retail tobacco soles permit for the fourth violation.

As a homeownor and resident of the North Side, I have the fol-
lowing concerns about permit parking for our neighborhood I
1. Does this elim1nato the problem of conge8tion and lack
of parking for rosidents in the area, or simply move
tho problem e1sewhore7 I'm inclined to think that many
of the commuters will lIut use the lots where olle must
pay, but will just find other area8 of town where they
can park for free and simply get up a little earlier
and walk a little further. We'll not ollminato the
problem, only move It to another part of town.
2. I am mas t concerned about what is to bo done about
visitorsl housogue8ts, pooplo who have organizations
and moet ngs in their homos periodically. Would we
each bo allowed to buy so many pormits so our guests
could park in our neighborhood or would we only be
allowed to have guosts and visltor8 on woek-ends and
evenings 71

5. As I wnlk into work each day and see all the commuters
roll into town and fight for parking spets on and around
Gilbert and Linn, I have noticed that many of the people
parking here arc not students, but are business people,
University faculty and staff, and Mercy employees. The
city has its ramps, but perhaps the city needs to put
more pressure on the University and Mercy to provide
more and cheaper parking for their people (I don't know
if ~Iercy employees have to pay, I know their pnrking has
been reduced beCAuse of their current building project).

Mr. Atkins, Ms. Franklin, and Mr. Tom Scott:
I reprosont Ralph Krall, who is the ownor of approximatoly 185
acres of land located within the City Limits abutting the un-
paved portion of Scott Iloulevard located in Section 1. Ilia pro-
perty is abutted to the South by property owned by the Smith
Brothers, and on the West by property primarily owned by ACT.
Mr. Krall is interested in either developing this property for
residential dwelling purposes, or selling the property to devol-
opers with that goal, but the property is not now serviced by
municipal water or sewer. Until those services are provided,
the development of this property is limited.
Wo hope that thore is Dome method by which the City can coop-
erate in making these services available to this property in-
cluding, if necessary, condemnation of necessary easement
rights-of-way. We understand that the City staff has been con-
cerned about the lack of existing building lots within this area
of the City. If so, the extension of the requested utilities to
this property would serve a public purpose, as well as enhancing
the value of Mr, Krall's proporty for dovelopmental purposos.
