CONCERNING SUPPLEHENTARY peTITIONS FOR INITIATIVE AND REFERENDUH PROCEDURES, AND
ALSO CLARIFYING HINIHUH NUHBER OF SIGNATURES REQUIRED FOR TIlE INITIAL PCTlTlONS,
IIIIEREAS, the current Charter provides that supplementary fetlt Ions for
refurendum and Inlthltve procedures must be ftled with the City C erk within IS
days of receiving a certificate of Insufficiency from the City Clerk; and
IIIIEREAS, the Charter provisions are deSigned to allow supplementary petitions
only when the original petition had the minimum required signatures attached
thereto, but was not des Igned to perml t garnering the minimum number of
signatures within that IS.day porlod; and
IIIfEREAS, the additional IS.day period should continue to be used to correct
Insufftclencles In the original petition, but only If the original pelttlon
contains the required minimum number of signatures; and
IIIIEREAS, It Is In the public Interest to clarify the Iowa City Charter In
order to avoid any further confusion and make the process easier for both the
City and the public; and
III1EREAS, certain porltons of the Iowa City Charter, namely Sections 7.03(A)
and T .04(A) should be amended to reflect this clarification, and avoid any
confusion as to the proper Initiative and referendum procedures.
NOli, TIIEREFORE, BE IT ORDAINED BY TIlE CITY COUNCIL OF TIlE CITY OF IOIlA CITY,

SECTION I. ClIARTER Atl~!illHEIil. Seclton 7.03(AI of the Iowa City Code of
Ordinances Is hereby repealed and a new section adopted In lieu thereof, to be
codified as follows:
(A) Number of signatures. Initiative and referendum petitions must be signed
by qualified electors equal In number to at least twenty. five percent of
the number of persons who voted In the last regular City election, but
such signatures shall be no fewer than two thousand five hundred qualified
electors. Any petition that does not, on Its face, contain the minimum
required signatures defined herein shall be deemed Insufficient for filing
under this Article, and no supplementary petition shall be permitted.
SECTION II. CIIARTER AHENOHE~I. Seclton 7.04(A) of the Iowa City Code of
Ordinances Is hereby repealed and a new section adopted In lieu thereof, to be
codified as follows:
(A) Certificate of City Clerk; amendment. IIlthln twenty days aftor a petition

petitioners files I notice of Intention to amend the original petition,
such notlco to be (tied with the City Clerk within two days Irter
receiving I copy of the certlrtclte. Ind the retltlOner 11so files a
supplementary petition upon additional papers w thin fifteen days after
receiving a copy of such certificate. Such supplementary petition shall
comply with the requ I rements of subsectlons Band C of Sect Ion 7.03,
Within (trteen days after a supplemenhry petition Is (tied, the City
Clerk shall compleLe a certificate as to the sufficiency of the petition,
as amended and supplemented, and shall prompt ly send a copy of such
certificate to the petitioners by registered mall, as In the case of an

sufficient, or If the petition or amended petition Is certified
Insufficient and one or more of the petitioners do not request Council

SECT(DN III. SE'lEBABILlij. If any of the provisions of this Ordinance are for
any reason declared tllegal or void, then the lawful provisions of this Ordinance
which are severable from said unlawful grovlslons, shall be and remain In full
force and effect, the same as tr the rdlnance conhlned no tllega1 or void
provls Ions.
SEkIJON IV. ~EPE~lEB. All ordinances and parts of ordinances In conflict with
the provisions of this Ordinance are hereby repealed.
~ V. EF((t!JVE DATE. This Charter Amendment Ordinance shall bo In full
force and effect from the time of rtnal passage and publication of this
Ordinance, as by law rrovlded, unless within thirty (30) days of publication of
the ordinance a petl Ion Is signed by eligible electors of the City equal In
number to ten percent of the persons who voted at the last preceding regular city
election, and said petition Is filed with the Council, In which case tho Council
shall submit the amending ordinance to the voters at a city election.
