based upon the difference of 30% of Ihe tenant's annual Income end the renl chargod
by the landlord which cannot exceed a delermlnod lair markel ront. Vouchers provide
asslstanco of tho dillorence botween 30% of tho ten ani's annual Income up to a
predetermined paymonl slandard, tho tonanl paying Ihe remalndor, Additionally, the City
owns and manages 62 unlls 01 public housing,

2. Houslna Rehabilltallon. Approximately $300,000 IS annually allocated to the Housing
Rehabilitation Program from the federal Communtly Development BloCk Grant program,
This program provides assistance through low In Ie rest loans, delerred loans and grants
to Income eligible households, Approximately 100 housoholds are assisted on an
annual basis, Projects Include comprehensive rehab, paint and siding, emergency
repair, weatherization and resldenllal accessibility Improvoments, Tho City also assists
owners 01 rental proporty with repalrs through the federally funded rental rehabllltallon
program, Approximately $80,000 Is spent annually with a similar amount being created
through the leveraging 01 the private funds,
3, I:fuman Services, There are more than 30 non.profit organlzallons In Iowa City, Johnson
County and the United Way human servlco network, A variety 01 servlcos are provided
ranging from home health care and shared housing for alderly end physically disabled
residents to crisis Intervenllon and emergency housing placement The City allocates
more than $200,000 ennually, 01 which $90,000 In CDBG lunds are utilized, The United
Way and Johnson County contribute over $1,8 million to support these agencies, These
organlzetlons are prolesslonally staffed with Indlvlduels that are highly tralnod In medical,
socfal caro, but also experlencod In the development and managoment 01 a variety 01
other programs, Decent, safe and affordable housing Is certainly a primary concern 01
these social service professionals lor their clients,

Income households In Iowa City. In eveluallng the Increasing noeds, Iho 'odoral disinvestment,

find Itsell, over the long /Un, conlronted with othor relaled housing Issues. These will Include
the Importance of housing 10 encourage our growing senior population to be able 10 malnlaln
an Independent existence. Additionally, our neighboring communities need to be approached
as 10 how they can share In provfdlng housing opportunltlos wllh the necessary local public
servfces support. This will allow persons 01 low and modorate Income 10 soek out and secure
housing and other economic opportunities In these communities, These are complex Issues
and Ihe Initiation 01 a comprehensive housing policy closely tied to our community's social
servfce network I believe Is critical, II we are to be eble to withstand Iho continuing decline In
fedoral policy support In the lace ot a growing nallonal need,

Your lotter inquires as to whethor Horcy Hospital wishos
to initiato an amendment to tho Iowa City Zoning Ordinanco to
accolDlllodate heliports in a co Zone, In our opinion, no
ordinanco amondmont is required in this case. Heroy Hospital
does not intend to ostablish a heliport as an indopendent use.
The hospital intends only to havo its existing emergency
medical tacility accessiblo to patients via emergoncy medical
sorvico helicopters. Tho landing area to bo constructed at
the hospital would provide an additional means tor tho
delivery ot patients nooding caro, and would ba in addition to
tho sur taco ambulanco tacilities alroady available at the
hospital. Tho landing area would bo an intogral part ot tho
hospital, and, in our opinion, is a pormittod uso in a CO-I
zone undor the existing Zoning Ordinanco.
We havo carotully reviowed tho City Attorney's opinion ot
August 16, 1990, particularly in rogard to its conclusion that
a holiport would not bo pormittod undor stato and local law as
an accossory uso, apparontly in any zono in Iowa City. The
opinion do~s not addross tho issuo as to whothor an omorgoncy
Dlodical sorvice holicoptor accoss at Horcy Hospital is a part
ot tho principal uso ot tho property, and thorotoro a

provision of access by air to medical servicos at the
hospital, Tho hospital does not intend to become a trauma
center, but the hospital does need a SI/1tt and etticient means
tor patients ot Hercy Hospital physicians to be deliverod to
the hospital in emergency situations, Hercy Hospital is
required to provide emergency medical services under rules ot
the IOl/a Department ot Inspection and Appeals [IV IOl/a
Administrative Code, 481-51,28(1358)), and in order to
maintain its participation in the Hedicare proqram [P,L. 99-
272 59121). The American Hospital ABBociation has de tined
"Emerqency Care System" as tOUCI/SI
The term emergency care system denotes a community
or regional netl/ork ot services that provide tor
detection and reporting ot medical emergencios,
Initial care at the scene, transportation and care
en route to a medical tacility, and care of the
patient until he is discharged, reterred, or

Emergency ambulance services are an essential element of
tho emorgoncy care system, and hospital facilities for tho
receipt ot emergoncy patients are an ossential elemont of the
hospital omergency dopartmont. As such, hospital facilities
for the receipt of emergoncy patients servo the primary use of
tho hospital property.
Even it it is dotinitivoly determined that tho proposod
Hercy IIospital holicoptor landing area is not a principal or
primary hospital usa, we disagroo with tho City Attornoy's
opinion that such a facility could not be maintainod as an
accessory use undor the oxisting Zoning Ordinanco.
It should be noted that the Zoning Ordinance (1) does not
contain any definition ot holiport, (2) does not specifically
prohibit heliports in any zoning district; and (3) does not
even attempt to detino all accossory uses. Section 36-4 (a) (3)
genorally defines all accessory use as one which is
subordinate in area, extent and purpose to the principal
building use, contributes to the comfort, convenience or
necessities of the occupants of the principal use, and (excopt
for parking) is located on the same lot or across a streot,
alley or railroad right-of-way trom the principal uso.
Section 36-56 providos that acceasory uses "customarily
incidental to and commonly aseociated with a fermitted use"
shall be permitted (subject to certain roqu roments), and
provides that acccll80ry UllCll "w includo tho follolling".
(Emphasis added), The section than describes spocific usos
for specitic zoning districts, and providos in Section 36-
56(d) (2) that in C districts "thore may be any accossory uso".
The tact that Section 36-56 does not prohibit any spocific uso
leads to tho conclusion that it is moant to be pormissivo,
subjoct only to a case by caso detormination as to whether a
use, other than those specitically described, is accessory to
the principal use of the property. We believe that surfaco
emergency ambulance faoilitioe and emorgency modioal servico
helicopter tacilities are both "oustomarily incidontal to and
oommonly associatod with" hospitalS. For examplo, Horoy
IIospitlll surveyed 127 hospitals in IOlla on August 14, 1990.

the City, \Ie have advloed Horcy Hospital ot the necessary

In February, 1990, Horcy Hospital lias intormod by
otticials ot the City'S Planning and Pr09ram Development start
that the proposed air access facility at the hospital \las an

\lith tho City ot IO\la City over a long period of yoars, and

After the September 4, 1990 Council meeting I Invited Sulo Wlltalo ond
Jock Kennedy to meet and discuss their comments regarding stormwater
runoff through the Idyllwlld Subdivision. Although Jack wos unable to
meet with us, he commented that I would be In good hands discussing the
topic with Sulo.
Sulo showed me his celculatlons ond explained the basis 01 his findings.
The primary difference between his colculatlons ond the developer's Is
the method used to calculote runoff. The developer's engineer used the
simplified trlongular hydrograph method. predicting e peak 100-yeer flow
of IB9 ch, whereos Sulo used the SCS TR-20 program thot predicts the
100-year peak flow to be somewhere between 282 cfs and 393 cfs, Both
methods predict grealer flows thon the rational formula IIBS chI which
the City uses to design mosl projects ond requires as 0 minimum for the
design of lubdlvlslonl. Sulo argues that thll drainage area II too
lorge 10 ule the retlanal formula. Chuck feels that the developer'l
flow prediction I are adequale Ilnce they are grealer than those
predicted by the rational formula. The City has used the rational
formula for many years with greal luccess and at least one publication
states that the rational formula Is accurate for areas up 10 200 acres.
The area In question Is 99 acras.
Sulo elso recommended maintaining an emergency IplllwllY discharging Into
a dralnageway as was orlglnolly proposed across the Seydel/White
property. I also Ihlnk Ihls II 0 good Idea ond have Instructed MMS to
direct the spillway dllcharge 10 the north ditch 01 Taft Speedwoy or
another drolnagewoy approved by the City.

the Iowa DeDartment of Elder Affairs for distribution to Area Aoencles on

Dear Mayor and City Council members:
I have some concerns about Iowa City's bicycle lanes. It
appears that the City has abandonod the few lanes that are
available to the ravages of time and weather. I bike downtown from
the east side and have found the lanes on Jefferson street to be

fough, poorly marked and often coverod by sand and or garbage.
These lanos are not safe and I have observed that many bikers do
not use them. If Iowa City Is committod to keeping its residenta
safe and to encouraging conaervation practices it would seem

prUdent and urgent that moro bike lanes be created and those lanos
already in place, maintained.
I would also like to request that there be a curb entrance
made, for bicycles, into the Glendale Road area. There is
currently a sidewalk from Firat Avonue to Heather Circle
but no eaey acceas to this aidewalk for a cyclist. Also,
the sidewalk has shifted so that it is nearly imposaible to get
through on a bicycle. It ia clear that many people use this
entrance because the grass is stripped away from constant uae,
Would It be possible for the City to smooth down the curb by this
entrance and to make the sldowalk lovel?
Iowa City is a progresoive community and has many wonderful
attributes but its efforta to Bccomodate bicycle traffic and oafety

loud partiee, and quiet thinga down around our neighborhood.
These calla usually como very early in the morning, often
times when I'm sure you are dealing with many similar calls'.
Every time we'vo oalled, the I.e. police have respondod with
what saams to bo tho right amount thoroughnoos and rastraint,
The job' almost always gots done, and our family can get back
to sleep. We roly so muoh on the police at these times when

Sidors also testifiod that thoro was anothor structuro, namoly: a
tin ahod Quonsot typo hut, on tho sito whoro tho scale houao was
placodl and at tho time of trial in 1989 it was still thoro. Tho
scalo houso is 8till, as of 1989, sitting whoro it was movod
originally. Yocum was told it could sit thoro until he moved it
