The City Manager shall examlno the appllcalion, and shall grant or deny said pormlt
based upon the following standards:

Intorlere with the privacy, salety, socurlty, eonvenlenoo and tranqulllly ollhe rosldenls or
Inhabltanls 01 the oroa.
(b) Whether tho proposod stroet, alloy, sidewalk, pork, roadway or public way can
accommodalo tho group or usa, based bolh on group slzo and on health and sanltallon
faclllUos, wholhor available or to be pruvldild by iippliciiiil.
(c) Whelher the proposed use or acUvlty Is compatible wllh tho normal activity 01 tho
proposed public way or park allhe requeslod limo or date.
(d) Wholhor the appllcaUon demonstrales the applicant has the moans, planning and
coordination te hold the proposed evont, considering tho Ume 01 day, location, public
laclllUes avallablo, tralllc conlrol, parking requlremenls and any monllorlng roqulred to
proleel tho public hoalth and salety.

shall grantlho permll.

(d) Rovlew by Council 01 Grant or Denial. Upon receipt 01 tho wrlllon grant or donlal 01 a
permit pursuant 10 this Division, the City Council may, upon Its own motion, determine thai
It shall revlow the City Manager's decision. II a majorlty 01 the Council dolermlnes Ihal
the action should be set aside, the Council may set aside the aeUon 01 the City Manager.
The Council may grant or deny tho permit. lithe Council takos no action within ton (10)
days alter Iho pormllls denied or granted. the Clly Managor's action shall sland as IInal.
Soctlon 31,146. Appeals.
(a) Any party aggrlevod by the City Manager's decision 10 grant er deny a pormlt under this
DIvision 2 may appoallhe dotermlnatlon 10 tho City Council II, within ten (10) days alter
Iho decision, Ihe party files a wrlllon noUco 01 appeal with tho City Clerk. In such ovent,
a hearing shall be hold by the City Council allts next rogularly scheduled meeting.
(b) Upon such hearlng, the City Council may, based upon the standards enumorated herein,
reverse, affirm or modify In any regard tho City Manager's decision.
Soctlon 31,147. Rovocatlon.

public calamity, riot or other emergency, the public safely requlros such rovocatlon.
DIVISION 3. COMMERICAL USE OF SIDEWALKS IN COMMERICAL ZONES
Soc.31'148. Pormll for Commercial Use,
(a) Sldowalk Days. Tho Clly Managor Is aulhorlzed 10 Issue no mere Ihan two permlls In any
one calendar year to businesses or business organlzallons for Iho temporary use of
sldowalks lor commercial salos In eommerelally zoned dlsltlcts. Such permits shall be
limited to Ihe temporary usa 01 sidewalks abulllng said businesses or business
organization, and shall be limited to no moro than two days for any ono permit. All othor
commercial use 01 public rlght.of.way shall be prohibited unless such use Is authorized
by Iho City Councll, by resolution.
(b) It shall bo unlawful for any buslnosses or business organization to uso tho public
sidewalks In commercially zoned dlslrlcls for commorclal salos promotions wllhout first
having obtained a permit Irom Ihe City Manager, as prevlded In Ihls Division 3.
Soctlon 31,149. Pormll Proceduro and Standards for Issuaneo.
Tho permit application and Issuance procoduros setlorth In Division 2, Article VI, shall
govern the permit roqulroments ollhls Division 3.
Soctlon 31,150. Pormlt Provisions Shall not Apply to Peddlers or Solicitors.
Tho pormlt provisions of Ihls Division shall not apply 10 peddlers or solicitors, as doflned
In Chapter 26 01 the Iowa Clly Code 01 Ordlnaneos.'
