Mr. Oakes' September 12. 1990 letter (copy ettached' centers around the following two topics, First. paragraph two of my April 20, 1990 letter stating that "neceslary. the City will allllt In condemnation of 0 storm sewer easement to the Iowa River: and second. the existing and proposed drainage routes for the 67 acres northwest of the subdivision. The letter also questions why stormwater management WOl not required when tho church property was davalapad, With regerd to paragraph two of my letter. the topic of condemnation WOl dlscumd at on April 12. 1990 meeting between the developer. his engineers. the Public Works Director end Engineering stoff, My letter echoes comments mode at that meeting. The Intent of the word "eulst" was that stoff will. " neceuary. recommend that Council commence condemnation proceedings, The word "alllstll was III defined since everyone present was familiar with these proceedings and understands the limits of steff authority, The City Attorney's office has advised that the letter does not and cannot commit the City Council In this matter. With regard to drainage from the 67 acres. there Is no doubt that this area drains onto the Idyllwlld property, This fact Is obvious from a site Inspection and Is also confirmed by the drainage designation on the uses topographical map. Mr. Oakes's partially correct In that low flows from the 67 ecres hove been physically diverted away from his property to flow south elong the east ditch of Callbrlll Court townrd the culvert under Tart Speedway, Most of this water appears to either soak Into the sandy ditch bottom or flow back onto the Idyllwlld property. A ' limited amount may be conveyed by the culvert. but since the culvert Is obstructed. It Is difficult to assess how much water. If any. Is actually conveyed, During heavy rains. runoff from the 67 acres spills frealy onto the Idyllwlld property, Since this property lacks defined drainage. the water spreads out on the land with a portion of It being absorbed by the sandy solis. Water which Is not absorbed Is attenuated before discharging onto downstream properties. Herein lies the basis of the drainage problem for the subdivision. For many years the Idyllwlld property has acted 01 0 buffer protecting downstream properties from runoff from the 67 acres, When this area Is developed It will no longer buffer the flows, Without this bulfer. there ore no dralnageways on downstream properties capable of receiving this flow. hence 0 direct route to the river Is needed, This Is e unique situation not previously encountered In the City of Iowa City. The degree of attenuation accomplished by the required storm water storage Is not adequate to allow discharge Into existing downstream dralnageways.
