Sometimos a building is oroctod in a mannor which cauoos drainago problomo to tho proporty on which it oits, but mora of ton it io noighboring properties that aro affoctod by oxcesoivo drainago onto thoir proporty, In such a caao, conflict botwoon tho two proporty ownors is inovitablo. Socond, thore is public concorn about ovorloading sawago nystomo, both storm anJ oanitary, whoro runoff can infiltrato and ovorload tho lattor. In Iowa, tho courts doal with tho tirBt problem by application of what io callod a modifiod oivil lnw rule, oCton roforrod to ao tho natural flow theory. The modifiod oivil law rulo holds that tho sorviont ostnto (gonorally tho proporty at a lowor olovation or tho proporty onto which oourco water will naturally flow) muot, accept water from the dominant ostate, which is tho upland proporty.
