The meeting was called to order al 12:38 p.m. at the Iowa City Public Ubrary, Meeting Room A, Donner

1990, lolnt Retirement Board meellng. Unanimous approval.
2. A motion was mado by Beckler snd aeconded by Wright to give Firefighter Nato Hopkins temporary
disability statu, and reimburse 192 hours 01 sick leave duo to an on.tho.lob Injury. Unanimous decision.

3. W1nkelhake had beon contacted by James Martinek, altorney lor Police Olflcer Robert Stika, requesting
the Item regarding Police Officer Robert Stika's retirement date being retroactive to tho old law of 66-
2/3% retirement versus current law 0160% retirement for an on,the'lob Inlury, be delayed to a later date.
Hennessey atated that she had researched the retroactive Issue and the one case she had lound stated
that the effective date 01 retirement was either the date olappllcallon or the date the Board rules, which
was lell up to the discretion 01 each Board. this Board', adopted rules of proceduro was the lollowlng
day aller the Board rules, Hennessey stated that II a law was to be applied retroactlvo, It would be
spelled out In the statute; lilt I, silent, It " presumed not to be retroactive. Hennossey said she would
do more research on retroactive application olstalules.
4. Request lor temporary disability and reimbursement 01160 hours 01 sick leave for Police Officer Kevin
Borg: Berg had been Injured on duty February 1989. He was scheduled for back surgery September
12, 1990. He was prevlous~ on light duty and has recently beon restrlctod to lour hours light duty doing
compuler entry and working In the dispatch cenler. A motion was mado by Johnson to placo Berg on
temporary disability status and reimburse the requostod 160 hours 01 sick leave. Allison secondod.

stated there was a need to deliver some
recreational services to those areas where the
city is creaUnq alot ot density, and the
trail system, ot which this park would be a
part, is in response to that.

qreen space, Willis stated he was in tavor ot
the park, but opposed the use ot parkland
acquisition tunds. He stated the money could
be tound somewhere else, l.e, City budqet,
Watson stated the commission could recommend
matchinq CDBG tundinq trom the C.I,P. budqet,
it the Rivertront Commission did not receive
any CDBG tunds. statt could request $18,000
in the C,I.P, budqet, which request would be
prioritized along with other C.I.P. projects.

Watson stated this issue involves dedication
ot parkland to the City tor neiqhborhood open
space. The Planninq and Zoning Commission
moved to approve the developer's rezoninq
request subject to the dedication ot six acres
tor open space, qivinq the developer broad
discretion on its location, The developer is
propos!nq to dedicate six (6) acres, which
would be a water detention area. lie stated
the commission needed to make a recommendation
to the City Council as to whether the
commission wants to accept these six (6)
acres. The Planninq & Zoninq Commission has
endorsed acceptinq this tract.
Rockwell stated the six acre tract was tairly
close to the Willow Creek Park wator detention
area. Planninq statt recommended that the

questions. He stated there is a need to
develop park planninq principles that would
apply to subdivisions,
