Airport, When the Fltzgarralds purchased their property In the
late 19405, the airport was already In existence and operating,
Besides the Plaintiffs' home, they operate a mobile home court on
the land In Issue, Prior to the airport zoning ordinance
(effective 19841, the Fltzgarralds operated the mobile home court

County Board of Adjustment for permission to build a motel on

wero subsequently ruled Invalid by the Iowa District Court, In
tho meantime, the FAA approved the municipal ordinance and doomed

condomnation proceedings.

The FAA has promulgated regulations for the sate opueation
of airports and air traffic. In doing so, it has limited the use
to which people, who reside near airports, may make of their
property. These regulations clearly provide ter the safety et
porsona who occupy land near airports as well as ter the pilots

In short, the Fltzgarralds purchased their property when the

They began their business as mobile home court operators prior to

to continue that use up to the present time. They are able to
continue that use Into the Indetinite future, They have not
intended or attempted to change the use of their property since
the enactment of the airport zoning ordinance. The ordinance(s)
have not had an effect on their property and have not placed any
more restrictions on their land than was already in place by the
FAA.

COflCLUS IONS OF LAW
A mAndAmus actIon Is A recognIzed vehIcle to compel
condamnAtlon proceedIngs when there has been a taking of prIvate
proparty for public use without compensating the owners. Hammer
v County of IdAl 231 N.W. 2d 896, 902 (Iolla 1975). The "taking"
doctrine Is based on the constitutional principle that government
cannot take private property for public use wIthout paying just
compensation, Iowa Const" art, I, Section 18.

Plaintiffs aro not losing their "vested rights" by virtue of tho
zoning rogulations. There has boen no taking of the substantial
use and enjoymvnt of tho property by tho muniCIpality. As such,
the zoning ordinance is not so oppressivo that it results in a
'taking'. Soe Woodbury County 5011 Conservation Dlst. v Ortner,
279 N,W. 2d 276 (Iowa 1979). A property owner does not
necessarily have a remody for compensation if a zoning regulation
merely deprives the owner of the most beneficial use of his or
her property, Kempf v City of Iowa City, 402 N.W. 2d 393 (Iowa
1987). While there are occasions where frustration of
investment-backed expectations may amount to a 'taking', there Is
no evidence ot any such expectation In the case at bar. See
Aglns v City of Tlburon, 447 U.S, 255 (198). Zoning
restrictions, when justlflablo under the police power, validly
enacted and not unreasonable, are generally held not to be a
"taking" of the property for public use without compenaatlon.
Stone v City of Wilton, 331 N.W. 2d 398, 402 (Iowa 1983). The
court concludes the airport zoning ordinances in Issue are a
valid exercise of police power by Iowa City and Johnson County

Improvement prolecllor consideration by lOOT. The pro/ect's princlpalleatures Include the
addition 01 a flfth lane on the north sldo 01 tho existing pavemenL This Improvement would
extend Irom tho Orchard Streetlntersecllon weslto tho access point shared by Carousel Molors
and others. This fllth lane would allow lor Iho middle portion of the highway 10 be developod as
storage lanes lor lell turning vehicles. This typo 01 slorageneft turning should accommodato
easier access to the proportlos ll11d at tho samo time not disrupt the normal flow oltralllc.

I heard a request for input from senior citizens in our
town regarding the recent problem and confullion aboll~

neighborhood.

reduced.
3. A parking policy to respond to Ihe problem thai

their propenles. which Is our streetscape.
