In the late 1970s, the Fltzgarralds applied to the County Board of Adjustment for permission to build a motel on tholr property. Their request was denied. They have not I . I' The FAA has promulgated regulations for the sate opueation of airports and air traffic. In doing so, it has limited the use to which people, who reside near airports, may make of their property. These regulations clearly provide ter the safety et porsona who occupy land near airports as well as ter the pilots ii 'i I, ; . and passengers who are flying and/or taking otf from municipal Ai rports. In short, the Fltzgarralds purchased their property when the .,1 ,.: I i , J airport was in existence and situated immediately next to them, They began their business as mobile home court operators prior to the enactment ot the airport zoning ordinance and have boen able I I I , , I- I I , to continue that use up to the present time. They are able to continue that use Into the Indetinite future, They have not intended or attempted to change the use of their property since the enactment of the airport zoning ordinance. Hammer v County of IdAl 231 N.W. 2d 896, 902 (Iolla 1975). The "taking" doctrine Is based on the constitutional principle that government cannot take private property for public use wIthout paying just compensation, Iowa Const" art, I, Section 18. The Issue In this case Is whethor or not the municipality's promulgation of the airport zoning ordinance In 1984 And/or the amondmont to It In 1990 takes Fltzgarralds' property for public use without just componsatlon, As noted In the court's Findings of Fact, thoro havo boen fow, If any, rostrlctlons placed on Fltzgarralds' proporty by the municipality because the property was already regulatod under FAA rulos and rogulations.
