Tho mooting was adjourned, J If It; .L - rl . l,t] n , ' , . 1'\ ' ' MINUTES IOWA CITY APPEALS BOARO THURSOAY, NOVEMBER 29, 1990 IOWA CITY RECREATION BUILOING - ROOM A MEMBERS PRESENT: Robert Carlson, Tom Werderttch, Marcte Roggow, John Roffman MEMBERS ABSENT: Jack Barrows STAFF PRESENT: Rtchard Frantz, Ruth Baker OTHERS PRESENT: Ruth Swtsher CALL TO ORDER: Secretary Frantz called the meettng to order at B:35 a,m. 119 1/2 EAST COLLEGE STREET: Ruth Swfsher, owner of 119 1/2 East COllege Street, was appealing the dectston of the Ftre Marshall and Senior Buildfng Inspector tn which they concurred that a second exit ts required for the third floor of this butldlng. Swisher presented a sketch of the third floor, stating the square footage ts 2,053 and that there I, a 4' wtde ftre escape present plus the one set of stairs, which enters Into the hallway. Roggow questioned how the prOblem had come to the attentton of the Cfty. Frantz reported that four to ftve months ago, Paul Moore came to the City Inspection Office to obtain an electrtcal permtt and It was then discovered that a bulldtng permft had not been Issued for the remodeling project. Upon Inspection, It was discovered there were not two separate exits from the thtrd floor as required by the City Butldfng Code. Swisher presented a copy of a page of the Appendtx from the Cfty of Burltngton Butlding Code whfch Indfcated fire escapes are considered separato exits. Frantz responded by sayfng the Appendfx Is not part of the Iowa City Building Code and, therefore, a ffre escape is not recognized as a separate extt, MOTION: Chafrperson Carlson called for a motion, Roffman moved that SWTSher be allowed to use the space on the thtrd floor as proposed. Roggow seconded the motfon, The motion fafled unanimous lv, ~TIO~: Carlson made a motion to deny Swtsher's appeal due to the fact t at the Iowa Ctty Butldtng Code does not recognize a fire escape as a separate exit.
