Although I understand that It wasn't enough. It wasn't adequaoo. I don't know where W& stand at this point In time. Larson/ Are W& going to ask the court to order him to fix the ravine. Boothroy / Two things. To Ctase filling and doing whaoover be Is doing and the oUter thing Is to bring It In to compliance with our grading and excavaUng ordinance In oorms of geWng a plan to fix the mess. Kubby / So, Is this an environmental Infraction based on a ptr day fine, ptr week or one sbot. BooUtroy / We lust Issued the one fine. It had It's Impact on Chuck because It did get him In the sam. day and I know that be was oorrlbly unhappy about the. Kubby / He had plenty of warning and InformaUon on what he needed to do. BooUtroy / I was tied up all day today so I haven't had a chance to talk to DIck and I don't know what mlght have happtned today. Horow/ But W& are Inspecting It dally? Boothroy / Not dally but W& have taken taken photographs and W& will look atlton weekly. Horow/llust want to know when things drag out like this. I question along with Karen, when do wo hit him again. . BooUtroy / Wo can bit him again. I think the.Ute preliminary pleadIng Is this week. Tuesday or Thursday. We will have trial set within Ute next two WHks or so. I guess W& will see what happtns at that point. I don't know. I am not recommending U1at we go ahead and file another ticket at this point for S 1000. But W& could. Larson/ Has he done anything Illegal In the kinds of things he has put In there also. BooUtroy / I am not sure about that. We don't know the quality of the matbrla! and totally what has boon put In there unless W& have had somebody go out and take a look at It. Larson/I am all for punishing pooplo who do Utlngsllke that but I am really more Intbrestod In goWng It cleaned up. Boothroy. I think what wo would like to see happtn Is that he has, even under the grading ptrmit, the right to flllll you do It proptrly. So, what W& will want to see Is that It Is stabilized, not only In tbrms of I I 1 ; I. , I I I , I n 1:1 ./ '/ 5 " .2b pag~ 2 lbt surfact but In terms of lbe edge lbatlt creates along his property lint Wllb lbost propertits to lb. west In olber words, With lbose properties that are down from the ravine Wllb blm. And there are some things he can do to do Ulal Larson/ Then the unknown thing Is, that I would like us to look a~ Is what he put In there. Whether W9 have any legal remedies If he has put In things that shouldn't be used as flU. Horow/ Don't W9 bave soli bearing Instruments lbat W9 can go down. this Is a prectdent and I want to set What W9 are going to do. What are the steps that wo take the next time tbls happens somewhere else. F~/It Is possible to bore Into lbat material to get samples but that Is a hit and miss type U1Jng. Also It Is dllflcult to draw the line of oxacUy what elevation that our ordinance comes Into effect Are the materials below that Immune from the regulations or not Those are questions that. Larsonl Rick, surely It Is Illegal to dump old refrigerators and things out there, rlgbt F~/I believe so. Larsonl That Is what she Is saying h. has done, Is dump old appliance down lb. ravine. Boolbroy lOur photographs don'tsbow any refrigerators but maybe from the other stde, her stde. Tou could we It from the SltHt side. Larson/ She may be able to give you some particular knowledge that could help us. Because lbat to me Is What Is really ugly Is throWing lunk down there. Isis one thing to have bad fill earthen material that may be able to get a judgement about what Is bad. But If he Is dumping old appliances In there, lbatls outrageous. Boolllroy I Bofore wo Issued a ticke~ wo asked him to fence It and. He was claiming that other people wore dumping Without his knowledge. So W9 ask him to put a rope around It or put a fenee around It so he could conltol It But that doesn't seem to have worked out this has got him to our orrlce the sarne day that we Issued the ticket I know he was quite shook up abouttht $1000 fine. Larson/I am lust wanting to know wtlat our powm are and to know what staff Is doing. I just want Information at this polnl If It Is the sense of council that wo should go look and find out If there are appliances and there are, cite him for that dllferentially. So the contract basically bolng a boiler plate, Idontilles the owner and lbe tenan~ lbe residence ot the tenant and the amounts ot lbe contract ren~ wbat we pay In lbe tenants portion. Atklnsl A question for Dana. It seems that those U1at I see, I don't pretend to see all the contractual agreements, that the city aUy's office signs off as to the form of the contract Isn't there something we stamp at the bQUom of those, Dana. Christianson I I don't know - U1at as a general rule most every contract U1at Involves the city Is revlew~ by the city aUy's offlce. Primarily for form simply because the content depends so heavily upon U1e staff person that presents It But I don't know U U1ese, since they are so prollfle, U we have a chance to sign off on those or not Nov/AII oUlor things are reviewed? At.kIns/l want to ask that question a little further. I am not so sure we could say all because we do authorIZe out division people to enter Into purchase agreements, wllIch Is a form of contrac~ within a certain amount of money. I forget exactiy what tho policy Is. Kubby IIf It Is over that amount than they ban to. AWns/1 think It Is IIkea division bead can.S1000 can be spent by a division head on that dlv. hoad's signature. That Is without the department director- Those purchase orders are the form of a contract But I doubt very mucb wheUler they go beyond the dlv. head. I know the city atty's offlce doesn't see those. McD/But on normal procedure, a contract as a contract Is reviewed by U1e city aUy's ofllce and then goes out from there, correct AWnsl Yes. For example, a much larger contrac~ for a very specified kind of service. For example, I can authorize a contract for up to $25,000 on my slgnature.that Is without your approval and when they get up In to that kind of money they almost Invariably that ends up In the city aUy's ofllce before I sign off on that thing.
