RESOLUTION TO ISSUE DANCING PERMIT
BE IT RESOLVED BY THE CITY COUNCIL OF IOWA CITY, IOWA, that a Dancing Permit as
provided by law is hereby granted to the following named person and at the following
described locations upon his filing an application, having-endorsed thereon the certificates of
the proper city officials as to having complied with all regulations and ordinances, and having
a valid beer, liquor, or wine license/permit, to wit:

WATER MAIN AND PAVING IMPROVEMENTS FOR HICKORY HILL RIDGE SUBDIVISION
WHEREAS, the Engineering Division has certified that the following
improvements have been completed in accordance with the plans and
specifications of the City of Icwa City,
Sanitary sewer, stom sewer, and water main improvements for Hickory
Hill Ridge Subdivision as constructed by Maxwell Construction Inc. of
Iowa City, Iowa.
Paving improvements for Hickory Hill Ridge Subdivision as constructed by

Dear Honorable Mayor and Counoilpersons:
I hereby certify that the construction of the sanitary sewer, storm sewer, water
main and paving improvements for Hickory Hill Ridge Subdivision has been
completed in substantial accordance with the plans and specifications of the
Engineering Division of the City of Iowa City. The required maintenance bonds
are on file in the City Clerk's office for the sanitary sewer, storm sewer and
water main constructed by Maxwell Construction, Inc. of Iowa City, Iowa, and
paving improvements construoted by Metro Pavers, Inc, of Iowa City, Iowa.
I hereby recommend that the above-referenced improvements be accepted by the City
of Iowa City.

WHEREAS, the Engineering Division has recommended that the improvements
covering the Oakland Cemetery Retaining Wall Rehabilitation Project as
included in a contract between the City of Iowa City and McComas-Lacina
Construction Co., Inc. of Iowa City, Iowa, dated September 3, 1991, be
accepted and
WHEREAS, the performance and payment bond has been filed in the City
Clerk's office,
NOW, THEREFORE, BE lT RESOLVED by the City Council of Iowa City, Iowa,

RESOLUTION NO. 92-198
RESOLUTION RELEASING AN EXISTING AND ACCEPTING A NEW STORM
SEWER AND DRAINAGE EASEMENT LOCATED ON THE COMMON LOT LINE
OF LOTS 177 AND 178 OF PEPPERWOOD ADDITION, PART 9, AND
AUTHORIZING EXECUTION OF NEW EASEMENT AGREEMENT.
WHEREAS, by Resolution No. 89-288, the final plat and subdivision for Pepperwood Addition,
Part 9, were accepted and approved by the City of Iowa City, Iowa on the 19th day of December,
1989; and
WHEREAS, all streets and easements as shown on the final plat for Pepperwood Addition, Part
9, were accepted by the City of Iowa City, Iowa; and
WHEREAS, one particular easement as shown on the final plat for Pepperwood Addition, Part
9, and accepted by the City of Iowa City, Iowa, Is a 15' storm sewer and drainage easement
("Existing Easement") centered on the common lot line of Lots 177 and 178 of Pepperwood
Addition, Part 9; and
WHEREAS, the Owner of both Lots 177 and 178 of Pepperwood Addition, Part 9, has begun
building houses on the lots and has encroached Into the Existing Easement by approximately 10"
with the construction of one of the houses; and
WHEREAS, said Owner acknowledges his error and requests that the City release the Existing
Easement and accept a new 15' storm sewer and drainage easement, the location of which
includes a width of 8.5' on Lot 177, Pepperwood Addition, Part 9, and a width of 6.5' on Lot 178,
Pepperwood Addition, Part 9; and
WHEREAS, said Owner has prepared a plat, which is attached as Exhibit A and Incorporated by
reference herein, which shows the new easement and its location thereof on Lots 177 and 178,
Pepperwood Addition, Part 9, and has agreed to enter into a new Easement Agreement, which
shall accurately reflect the new easement location; and
WHEREAS, it Is In the public interest to release the Existing Easement, accept the new
easement, and enter into a new Easement Agreement.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY,
IOWA, that:
1. The City Council finds It Is In the public interest to release the Existing Easement, to
accept the new location of the easement, and to enter Into the new Easement Agreement,
attached hereto, which Is hereby approved as to form and content.
2, The City Council directs the City Clerk to certify this Resolution for recordation In the
Johnson County Recorder's Olilce, together with the attached Easement Agreement and
Exhibit A, said recording costs to be paid by the Owner of Lots 177 and 178, Pepperwood
Addition, Part 9,

PERMANENT STORM SEWER ANO DRAINAGEWAY EASEMENT AGREEMENT
THIS AGREEMENT, made and entered into by and between Jason Lee and Misty Lee, husband
and wife ("Owner"), and the City of Iowa City, Iowa, a municipal corporation, ("City").
In consideretion of their mutual promises herein, Owner and City agree as follows:
The Owner hereby grants and conveys to the City a permanent easement for the purpose of
excavating for and the installation, replacement, maintenance, and use of such separate storm
sewer line, pipes, mains, conduit and such above-ground storm water runoff or drainage ways
(hereinafter collectively referred to as the "lines") as the City shall, from time to time, elect
to use for the conveyance of storm water, and all necessary appliances and fittings for use
in connection with said pipelines, together with adequate protection thereof and also a right-
of.way with right of ingress and egress thereto, over, through, and across the permanent
easement area as shown and described on Exhibit "A" attached hereto and by this reference
made a part hereof (hereafter "Easement Area").
The Owner further grants to the City the following rights in connection with the above use:
1. The right of grading said Easement Area for the full width thereof, and the right to
extend the cuts and fills for such grading into and on said lend along and outside of
said line, to such extent as the City may find reasonably necessary.

2. The right, from time to time, to trim and cut down and clear away all trees and brush
on the Easement Area which now or hereafter, in the opinion of the City, may be a
hazard to said Easement Area, or which may interfere in any manner with the City's
exercise of its rights herein.
The City shall promptly backfill any trench made by it, and repair any damages caused by the
City within the Easement Area. The City shall indemnify Owner against unreasonable loss or
damage which occurs as a result of the City's negligent acts or omissions in the exercise of
its easement rights herein. Except as expressly provided in this Easement Agreement, the
City shall have no responsibility for maintaining the Easement Area.
The Owner reserves the right to use said Easement Area for purposes which will not interfere
with the City's full enjoyment of its rights hereby granted; provided, that the Owner shall not
erect or construct any building or other structures; plant any trees; drill or operate any well;
construct any reservoirs or other obstructions on said Easement Area: and will not diminish
or add to the ground cover over said Easement Area. In addition, Owner may construct a
fence over or upon the Easement Area, but only after submittal to the City of a schematic
design and prior written approval of the City Engineer,
The Owner hereby covenents with the City that Owner is lawfully seized and possessed of
the real estate above described, and that it has good and lawful right to convey the Easement
herein,
The provisions hereof shall inure to the benefit of and bind the successors and assigns of the
respective parties hereto: shall be deemed to apply to and run with the land and with the title
to the land; and shall be recorded in the Johnson County Recorder's Office,

RESOLUTION RELEASING AN EXISTING EASEMENT AND ACCEPTING AND AUTHORIZ-
ING EXECUTION OF A NEW STORM SEWER, DRAINAGE AND SANITARY SEWER
EASEMENT LOCATED ADJACENT TO LOT 11, BLOCK 1, CHAUTAUQUA HEIGHTS,
WHEREAS, Ordinance 88.3398 vacated Loos Street, an unimproved rlght.of.way extending between Black
Springs Circle and Rocky Shore Drive; and
WHEREAS, the City did retain an unspecified easement for maintenance of storm sewers, drainage and public
sanitary sewers; and
WHEREAS, the property owner at 208 Rocky Shore Drive desires to make an addition to an existing structure,
which would encroach upon the existing easement; and
WHEREAS, said Owner requests that the City release the existing easement and accept a new storm sewer,
drainage and sanitary sewer easement ("New Easement"), which would decrease the width of the existing
easement by 10,01 feet; and
WHEREAS, said Owner has prepared a plat, which Is attached as Exhibit A and incorporated by reference
herein, which shows the New Easement and Its location, and has agreed to enter Into a new Easement
Agreement, attached hereto and incorporated by reference herein.

RESOLUTION APPROVING THE PRELIMINARY AND FINAL PLATS OF
WESTPORT PLAZA SUBDIVISION, IOWA CITY, IOWA.
WHEREAS, the owner, Wal-Mart Stores, Inc., has filed with the City Clerk, the preliminary and
final plats of Westport Plaza Subdivision, Iowa City, Johnson County, Iowa, and
WHEREAS, said subdivision Is located on the following-described real estate located In Iowa City,
Johnson County, Iowa, to wit:
Commencing at the Southeast Comer of the Southwest Quarter 01 Section 16,
Township 79 North, Range 6 West 01 the Fifth Principal Meridian; Thence
NOO'51 '23'E (an assumed bearing) along the east line of said Southwest Quarter,
230.00 leet to the Point 01 Beginning; Thence S89042'40'W along the north line
of a parcel conveyed to the City of Iowa City, Iowa by Warranty Deed, recorded

IOWA, that said preliminary and final plats and subdivision located on the above-descrlbed real

maintenance and access easements among and between the subsequent property owners for
access to existing private sanitary sewer, storm sewer, and water mains, which shall first be
approved by the City Attorney.
BE IT FURTHER RESOLVED that the Mayor and City Clerk of the City of Iowa City, Iowa are
hereby authorized and directed, after approval by the City Attorney, to execute any legal
documents relating to said subdivision and to certify the approval of this resolution, which shall
be affixed to the preliminary and final plats after passage and approval by law; and the
owner/subdivider shall record the legal documents and the plat at the office of the County

WHEREAS, the owner, Frantz Construction Company, Inc" has filed with the City Clerk of the
City of Iowa City, Iowa, the final plat of Mount Prospect Addition, Part V, Iowa City, Johnson
County, Iowa; and
WHEREAS, said subdivision is located on the following-described real estate in Iowa City,
Johnson County, Iowa, to wit:
Commencing at the northeast corner of the northwest quarter of Section 23,
Township 79 North, Range 6 West of the Fifth Principal Meridian; thence

Department have examined the proposed final plat and subdivision, and have recommended
approval, subject to approval of an Ancillary Agreement attached hereto; and
WHEREAS, said final plat and subdivision were examined by the Planning and Zoning
Commission, which recommended that said final plat and subdivision be accepted and
approved subject to approval of said Ancillary Agreement dealing with a possible regional
storm water detention facility; and
WHEREAS, It is in the public interest to permit this subdivision to go forward while the City
considers a regional approach to storm water management, and the attached Ancillary
Agreement serves to protect the City's interest, as weil as those of the Subdivider; and

WHEREAS, a dedication has been made to the public, and the subdivision has been made with
the free consent and in accordance with the desires of the owners and proprietors; and
WHEREAS, said final plat and subdivision are found to conform with Chapter 409A, Code of
Iowa, (1991) and all other local and state requirements.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY,
IOWA that:
1. The final plat and subdivision located on the above-described real estate be and the
same are hereby approved.
2. The attached Ancillary Agreement between Frantz Construction, Inc. and the City of
Iowa City, Iowa concerning Stormwater Management Obligations for Mt. Prospect
Addition, Parts V - VIII is hereby approved as to form and content,
3. The Mayor and City Clerk are hereby authorized to execute said Ancillary Agreement,
for recordation by the City, at City expense,
4. The Mayor and City Clerk of the City of Iowa City, Iowa, are further authorized and
directed to execute all legal documents, upon the approval of the City Attorney,
relating to said subdivision, and to certify a copy of this resolution to the Office of the
Johnson County Recorder.

ANALYSIS:
The preliminary plat for Mt. Prospect Addlllon, Parts V and VI, a 13.2 acre tract of land subdivided
Into 41 single-family residential lots, was recommended for approval by the Planning & Zoning
Commission on February 20, 1992. The City Council approved the preliminary plat on March 3,
1992. The applicant now requests approval of the final plat of MI. Prospect Addition, Part V, a
25-lot, approximate 7,G acre tract of land located along the north and south sides of Lakeside
Drive extended. The final plat for Part V, as submitted, Is In general compliance wllh the

approved preliminary plat for this development. Issues raised at the time the preliminary plat was
reviewed are discussed in the following analysis. Plat discrepancies and deficiencies are noted
at the end of this report,
Stormwater Management: Preliminary plat approval was conditioned on a dry bottom
stormwater basin storage facility being designed and constructed, as required by City ordinance,
to serve various parts of the subdivision as they receive final plat approval. The preliminary plat
noted that, notwithstanding this requirement, the developer and the City may agree, subject to
the approval of the Director of Public Works, to allow the construction (or payment In lieu of such
construction) of alternative forms of stormwater management to serve the subdivision. The final
plat for Mount Prospect Addition Part V also notes this agreement.
The Initiative to consider alternative forms of stormwater management for the area Is due to the
City's concern for protecting wetland ecology south of the proposed development. Instead of
Incremental construction of stormwater basins to serve individual developments, the Public Works
Department Is considering a more reglonai approach to stormwater management In this area,
Due to the recent receipt of the Sycamore Street Trunk Sewer Wetland Study, a copy of which
Is Included In Commissioners' meeting packets, the most suitable approach for stormwater
management In the area has not been determined. Staff, therefore, recommends that
construction of the stormwater management facility approved on the preliminary plat be deferred
until June, 1993, Instead, the developer should front the cost of constructing this basin. Once
the appropriate approach for stormwater management for the area has been Identified, the
payment made in lieu of constructing the detention facility will be reimbursed to the developer or
the funds will be used toward construction of an area-wide facility located south of the subject
development. The legal documents for the development should be amended to reflect these
alternatives,
Sanitary Sewer: The subject parcel (Part V) Is part of a larger tract of land that was conditionally
rezoned from ID-RS, Interim Development Single-Family Residential, to RS-5, Low Density Single-
Family Residential on November 26, 1991. The rezoning was conditioned on the subject tract
having sanitary sewer service available and on the developer obtaining the rights necessary to
extend Lakeside Drive to construct Lakeside Drive through the tract at collector street standards.
The developer has obtained these rights. The conditional zoning agreement permits the
developer to secure approval of the final subdivision plat and commence Installation of the
subdivision Improvements and secure building permits when a municipal sanitary sewer
construction contract Is approved and executed by the City. Construction of the sanitary trunk
sewer Is tentatively expected to occur this June,
The developer has obtained sanitary sewer easement rights along the west and north property
lines of Grant Wood School. Commensurate with Installation of Improvements for Mount
Prospect, Part V, the developer should Install the sanitary sewer line within these easements.
The City will reimburse the developer the cost of this installation. The Commission will recall that
Installation of this sanitary sewer line will relieve surcharging problems for existing residential
development located north of Mount Prospect Part VI.
It Is expected that, with Improvements to Sycamore Street, an eight foot wide sidewalk will be
Installed along the east side of Sycamore Street. The developer should delay Installation of
sidewalks along Sycamore Street until that roadway Is Improved, Instead, the developer should

pay the upfront cost of installing half of the width of the eight foot wide sidewalk. The cost of
additional future Improvements to Sycamore Street (paving, storm sewers) should also be paid
up front. The legal documents should reflecl these provisions.
The 12-lnch water main illustrated on the preliminary plat on the south side of Lakeside Drive
should be relocated to the north side of said road. The construction documents should reflect
this. The developer will be expected to pay the equivalent of a 6-lnch water line along lakeside
Drive and the equivalent of one-half of a 6-inch water line along Sycamore Street.

Staff recommends that consideration of the final plat of Mt. Prospect Addition, Part V, be deferred
but that, upon resolution of the deficiencies and discrepancies listed below, the plat be approved

DEFICIENCIES AND DISCREPANCIES:
1. The legal description should be checked for accuracy and corrected.
2. The easement on the east side of Lot 244 should be Identified as a storm sewer and
drainage easement.

WHEREAS, notice of public hearing on the plans, specifications, form of contract

NOW, THEREFORE, BE IT RESOLVED BY TIlE COUNCIL OF THE CI'fY OF IOWA CITY, IOWA:
1. That the plans, specifications, form of contract, and estimate of
cost for the above-named project are hereby approved.

The Mayor announced that this was the time for meeting on
the matter of the authorization of a Loan Agreement and issuance
of $75,000 of General Obligation Capital Loan Notes in order to
provide funds to pay costs of. funding of facilities for youth
social services, a general corporate purpose; and that notice of
the proposed action and the right to petition for an election had
been published as provided by Sections 384.24, 384.24A, 384.25 and
384.26, of the city Code of Iowa; and, the Mayor then asked the
Clerk whether any petition had been filed in the Clerk's Office,
as contemplated in Section 384.26 of the city Code of Iowa, and
the Clerk reported that no such petition had been filed,
requesting that the question of the authorization of the Loan
Agreement and issuing said Notes be submitted to the qualified
electors of the City.
Whereupon the Mayor declared the hearing on the issuance of
said bonds to be closed.

WHEREAS, pursuant to notice published as required by law,
this Council has held a public meeting and hearing upon the
proposal to institute proceedings for the authorization of a Loan
Agreement and the issuance of $75,000 General Obligation capital
Loan Notes, Series 1992, for the purpose of paying costs of
funding of facilities for youth social services, and no petition
was filed calling for a referendum thereon. The following action
is now considered to be in the best interests of the city and
residents thereof:

proceedings and takes additional action for the authorization of a
Loan Agreement and issuance in the manner required by law of
$75,000 General Obligation Capital Loan Notes, Series 1992, to
evidence the obligation thereof for the foregoing purpose.
Section 2. The Clerk is authorized and directed to proceed
on behalf of the City with the negotiation of terms of a Loan
Agreement and the issuance of General Obligation Capital Loan
Notes, Series 1992, eVidencing the City'S obligations to a
principal amount of $75,000, to select a date for the final
approval thereof, to cause to be prepared such notice and sale
information as may appear appropriate, to publish and distribute

The following is a summary outline of plans to raise $40,000 from private sources to apply
to the purchase of the Youth Center Expansion at 422 Iowa Avenue, These funds will be
matched by 1994 CDBG funds and applied to the $75,000 loan and balloon payment
negotiated between Iowa City and Iowa State Bank. This outline is intended to fuifillthe
initial requirement that UA Y submit a fundraising plan by July of 1992. Progress reports
. on this plan's implementation will be submitted in January and June of 1993 as a means
for monitoring UA Y's fund raising efforts. The initial elements of this plan were presented
to CCN on June 24, 1992.

United Action for Youth will coordinate its fundraising through the Youth Services
Foundation, which was organized by UAY, Mayor's Youth Employment Program, and
Youth Homes, Inc. for the purposes of conducting and coordinating fundraising on behalf
of the three youth service agencies,
1. Elements of fundraising for the Youth Center Expansion will be included as part of the
YSF capital campaign. YSF is meeting over the summer to plan and determine a timeline
for its capital campaign, This timeline will be completed by 9/30/92

2. In general terms, we are seeking to raise $20,000 from contributions from local groups
and individuais and $20,000 from foundations. Foundation proposals are being especially
developed as "challenge" grants.
3, Service Clubs: We will be presenting proposals.to Rotary, Lions, Kiwanis, Sertoma,
Pilot, and Optimist clubs coupled with speaking presentations to each of those groups,
Letters will be sent at the end of Juiy with presentations from August until December. We
expect to raise $4,000-$5,000 from these contributions, pledged and paid prior to July,
1993.
4. Key Individuals: UA Y has several past key contributors who will be solicited this year
for a major donation. We expect $4,000-$5,000 to be pledged and paid by July, 1993.
5, Fundralslng Events: UAY will use its Hospice Road Race money for part of the
$40,000 match, Our goal this year is for $1,500 from this source, We also plan one
major benefit concert in spring of 93 to generate $1,000,
6, Youth Services Foundation: YSF will be asked to pledge $7,500 paid before July,
1993 to be applied to the Youth Center Expansion, Additional funds will be sought from

some of these foundations.

9/30/92; Peg McElroy Fraser and Jim will meet with staff of the trust in July. The
trust is in process of revising its strategic plan with a likely focus on at-risk youth

@ Gannett- $5,000- will be sought in a community grant prepared this fall in
consultation with Press Citizen.
8. .Other fundraising opportunities will likely occur throughout this effort. As we become
aware of possibilities with good potential, we will incorporate them into the plan, and

FINANCING FOR PURCHASE OF PROPERTY AT 422 IOWA AVENUE, IOWA
CITY, IOWA.
WHEREAS, United Action for Youth ("UAY") is a not-for-profit corporation, dedicated to
providing services for youth social programs; and
WHEREAS, UA Y desires to purchase property known as 422 Iowa Avenue in Iowa City, Iowa,
which is adjacent to UA Y's current facility on Iowa Avenue; and
WHEREAS, the City of Iowa City wishes to assist UA Y in this purchase, while simultaneously
securing City's interest in repayment of a loan by way of a mortgage.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY,
IOWA, THAT:
1. The attached agreement between United Action for Youth and City of Iowa City is
hereby approved as to form and content.
2. The City Attorney's Office is hereby directed to prepare and secure appropriate
signatures on the promissory note and mortgage, and other appropriate documents in
preparation for reviewing closing documents and for consummation of the loan and
mortgage.
3. The Mayor and City Clerk are hereby authorized to execute the agreement between
United Action for Youth and City of Iowa City securing partial financing for purchase
of property at 422 Iowa Avenue, Iowa City, Iowa, attached hereto and incorporated
by reference herein.
4. The City Clerk is hereby authorized to record this Agreement, together with a certified
copy of the resolution, simultaneously with the promissory note and mortgage, in the
Johnson County Recorder's Office, at City expense.

SECURING PARTIAL FINANCING FOR PURCHASE OF PROPERTY
AT 422 IOWA AVENUE, IOWA CITY, IOWA
WHEREAS, United Action for Youth ("UAY") is a not-for-profit corporation, dedicated to
providing services for youth social programs; and
WHEREAS, UA Y desires to purchase property known as 422 Iowa Avenue in Iowa City, Iowa,
which is adjacent to UA Y's current facility on Iowa Avenue; and
WHEREAS, the City of Iowa City wishes to assist UA Y in this purchase, while simultaneously
securing City's interest in repayment of a loan by way of a mortgage.
NOW, THEREFORE, in consideration of their mutual promises herein, the City of Iowa City
("City") and UA Y hereby agree as follows:
1.
City agrees to loan $75,000 to UAY, to be used for the purchase of property known
as 422 Iowa Avenue, Iowa City, Johnson County, Iowa ("Property"), to be repaid to
City by UA Y at the end of a 12-month period commencing with this Agreement, or no
later than July 31,1993. City agrees to loan said $75,000 to UAY, at an interest rate
of 5.8% per annum.
2.
City agrees to provide this $75,000 loan/funding to UA Y at the time of UA Y's closing
on the purchase of the Property, to be made payable to UA Y and/or seller, whichever
UA Y elects, and to be made payable in the form of a check.
3.
UAY agrees to accept said $75,000 loan as partial financing for the purchase of the
Property, and to execute a promissory note payable to the City of Iowa City of the fuil
sum of $75,000, plus interest at the rate of 5.8% per annum. UAY further promises
to repay this full amount to the City, plus interest, at the end of the 12.month period
commencing with the execution of this Agreement, or no later than July 31, 1993.

UA Y agrees to secure this Note with a mortgage, for the benefit of the City, thereby
securing repayment of the $75,000 loan to the City. City agrees to accept said
mortgage, as security and collateral for repayment of the $75,000 loan. UA Y and City
further agree that said promissory note and mortgage shall be by way of separate
document, and shall be recorded simultaneousiy with this Agreement and a certified
copy of the resolution authorizing execution of the agreement, all said documents to
be recorded in the Johnson County Recorder's Office, at City expense.
5. Prior to closing, UAY agrees to provide to City, for City's review and approval, all
necessary and appropriate documents, including but not limited to abstracts of title for
the Property, a title opinion, transfer documents such as a warranty deed, and any
other closing documents relevant to UA Y's purchase of said Property.

WHEREAS, a regular program of transit capital equipment replacement is necessary to ensure
the provision of public transit service; and
WHEREAS, FTA Section 9 capital funds are not available in sufficient amounts for transit
capital purchases which are required in FY92.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY

1. The City Manager is authorized to act as signatory in behalf of the City on all joint
participation agreement documents with the Iowa DOT.

WHEREAS, on April 19, 1989, the owner of property located at2118 "F" Street executed
two liens (life lien and depreciating lien) in the total amount of $22,000 for value received by
way of a comprehensive rehabiiitation loan; and
WHEREAS, the Depreciating Lien provided that the principal of said note would be forgiven
in the event of death of the signa tor of the note and the Life Lien was to be paid back upon
sale of the property; and
WHEREAS, $3,300 of the Depreciating Lien was forgiven and the existing principal of said
note is $7,700, which should be forgiven according to the terms of the recorded note; and
WHEREAS, $11,000, which is the full amount of the Life Lien was paid in full on June 18,

tion Program; and

WHEREAS, the City of Iowa City has established and provided funds for a public library
operated by the Iowa City Public Library Board of Trustees; and
WHEREAS, Chapter 358B.18 of the Code of Iowa (1991) allows Johnson County Board of
Supervisors to contract with a city library, in order to provide services to residents of
unincorporated areas; and
WHEREAS, Johnson County wishes to provide the residents of unincorporated Johnson
County the opportunity to participate in the facilities and programs offered by the Iowa City
Public Library; and
WHEREAS, the Iowa City Library Board of Trustees, Johnson County Board of Supervisors,
and the City Council for the City of Iowa City have negotiated a new agreement, in order to
govern the provision of such services.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY,
IOWA, AS FOLLOWS:
1. It is in the public interest to enter into the attached agreement, and thereby govern the
provision of services, as set out in the agreement.

B. All services of the Iowa City Pubiic Library will be provided to all residents of
Johnson County who reside outside the corporate iimits of any city within
Johnson County, said Library services to be on the same terms and conditions
as those provided the residents of the City.
II. DURATION AND TERMINATION
The term of this Agreement shali commence July 1, 1993 (Fiscal Year 1994) for a period
of one (1) year, and shall be renewed automatically for succeeding terms of one year
each ("Contract Year"), unless written notice to the contrary Is given no later than March
1 by Johnson County or Iowa City. Such notice may be given by personal deiivery to the
Iowa City Mayor or Johnson County Chair, or by regular mali to said officials. Unless
terminated as provided herein, "Contract Year" shali run concurrently with the appropriate
budgetary fiscal year for Iowa City and Johnson County, as provided by law.
III. COMPENSATION
A. Johnson County shall pay to Iowa City each Contract Year a portion of the real

generally accepted accounting practices. Iowa City and Board of Trustees further

inspection during ordinary business hours, upon reasonable notice by the County.
IV, BUDGET PROCEDURE
The City Council for Iowa City shall determine and approve an annual operating budget
for the Library, after preparation and recommendation by the Library Board of Trustees,
More specifically, Iowa City, Board of Trustees and Johnson County agree as follows:

Contemporaneous with the Library Board's submittal of a proposed Library budget
to the City Manager, the Library Board shall furnish a copy to the County.

On or before January 15 of each year, Iowa City shall transmit to Johnson County

AGREEMENT FOR LIBRARY SERVICE TO RURAL JOHNSON COUNTY
This Agreement is made and entered Into by and between the City of Iowa City, Iowa, a municipal
corporation, the Iowa City Library Board of Trustees and Johnson County, Iowa, a governmental
subdivision.
WHEREAS, the City of Iowa ity ("Iowa City") has established and rovlded funds for a public
library operated by the Iowa CI Public Library Board of Trustees' and
WHEREAS, Chapter 3588.18 of the ode of Iowa (1991) all ws the Johnson County Board of

Supervisors ("Johnson County") to con act with a city, library for residents of unincorporated
areas; and
WHEREAS, Johnson County wishes to prov e t residents of unincorporated Johnson County
the opportunity to participate in the f Iitles an programs offered by the Iowa City Public
Library.
NOW, THEREFORE, it is he by agreed by and betwee the City of Iowa City, the Iowa City
Library Board of Trustee and Johnson County as follows:

The meeting was called to order at 8: 1 0 a.m.
Members discussed City/County proposals for a draft contract for City library services to
residents of unincorporated areas of the county.
Members agreed to recommend to their respective bodies:
1.
That the County pay a portion of the library budget allocation of orooertv taxes, rather
than of the total budget.
2.
That the circulation percentage attributed to rural residents be averaged over three
fiscal years to determine the County share of the library budget. This percentage will
be based on total circulation, which includes the state-funded Open Access. If this
program were discontinued, the county's percentage of circulation would increase.
The county understands this risk and is willing to take it.

3.
That a member of the Library Board of Trustees be a current resident of unincorporated
Johnson County and be appointed by the Mayor after approval by the Board of
Supervisors.
Duffy and Lacina agreed to recommend to the Supervisors that the County increase its
FY1993 allocation to $210,000,
The Library Board will request that the City provide the rest of the library's requested amount
(approx. $15,500) from fines and fees, which will exceed projected income for this year.
The June 24 meeting was canceled by mutual agreement.
Gentry and White will draft a new contract incorporating the agreed changes. They will meet
on June 24. They will send copies to members of City Council, Board of Supervisors, and
Library Board when the contract is done.

WHEREAS. City Council has informally proposed that the Kirkwood Avenue
Reconstruction Project include the following street paving
improvements* :
1. 37 foot width from Gilbert Street to approximately 100 feet east
of Gilbert Street. This segment of Kirkwood Avenue is to be
designated as three lanes.
2, 31 foot width from approximately 195 feet east of Gilbert Street
to the east terminus of the project near Franklin Street.
Within this segment of Kirkwood Avenue, three lanes will be
designated in the vicinity of the intersections with Dodge
Street. Keokuk Street and Summit Street,

RESOLUTION AUTHORIZING EXECUTION OF AN AGREEMENT IN CONSIDERATION OF THE
LOCATION OF PUBLIC STREETS IN NORTHEAST IOWA CITY BETWEEN THE CITY OF IOWA
CITY, IOWA AND AMERICAN COLLEGE TESTING
WHEREAS, American College Testing of Iowa City, Iowa (" ACT"j and the City of Iowa City, Iowa, a
municipal corporation I"City") have agreed to certain considerations with respect to the location of public
streets, to be constructed sometime in the future in northeast Iowa ity; and
WHEREAS, ACT WI hes to proceed with a long-range master pi for propSrlY they now own in northeast
Iowa City; and
WHEREAS, the location f public streets in the vicinity of th ACT property will impact said master plan; and
WHEREAS, it is in the publi interest of the City of Iowa ty to protect the public heaith, safety, and welfare
of its citizens concerning the ocation of public street n northeast Iowa City; and
WHEREAS, one method of pro cting the citizen safety and welfare is to enter into an agreement for
location of public streets in north ast Iowa City, hich agreement will also protect property values as well
as public safety,
NOW, THEREFORE, BE IT RESOLVE
CITY COUNCIL OF THE CITY OF IOWA CITY, IOWA, THAT:
1, City Council finds it is in the b t interest of the City of Iowa City to protect public safety as to
location of future public street i northeast Iowa City, and to enter into an agreement with ACT, a
major property owner in nort ast owa City, which agreement shall include matters such as location
of public streets, alignment costs, neconomic remnants and excess vacated right-of-way,

RESOLUTION NO, 92-209
RESOLUTION ON UNCLASSIFIED SALARIES AND COMPENSATION FOR
FISCAL YEAR 1993 FOR THE CITY ATTORNEY,
WHEREAS, the City of Iowa City, Iowa, employs certain personnel subject solely to the action
of the City Council referred to as unclassified personnel; and
WHEREAS, it is necessary to establish salaries for the said unclassified personnel.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY,
IOWA, that the following positions shall receive as salary compensation that amount which
is set forth in lieu of all other fees and compensation as otherwise provided by law, and where
said employee shall receive or collect any fees or other compensation from others for services
as such employee, the same shall be paid to the City Treasury,
BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY, IOWA, that
the following salaries are hereby established for the following persons effective July 4, 1992:
