Dear Charlie and Members of the Board:
An application has been submitted to Johnson County by Pleasant Valley, Inc. to rezone one
acre of a 54-acre tract from A 1, Rural District, to RS, Suburban Residential. This property is
located in Fringe Area 6, approximately 1 Y, miles south of Iowa City on the southeast corner
of the Nursery Lane and Sand Road intersection.
At its July 16, 1992. meeting, the Planning and Zoning Commission recommended, by a vote
of 5-0. that the City Council forward a comment to the County Board of Supervisors finding
that the request to rezone the one.acre tract from A 1 to RS is consistent with the mutually
agreed upon Fringe Area Policy for Area 6. Although the policy for Fringe Area 6 states that
agricultural use is preferred, the Commission determined that in this case, 1) where only one
acre of land is at issue, 2) a residence already exists on the site, 3) no increase in population,
and consequently no demand for additional services is anticipated, 41110 l1ijW roads, grading
or natural areas are involved, and 51 all utilities are currently in place, the proposed rezoning
in all practicality does not appear to contravene the policy for Fringe Area 6.
Council agreed with the recommendation from the Planning and Zoning Commission, and,
therefore, respectfully forwards a comment to the Board that the' requested rezoning of the
subject one.acre tract from A 1 to RS is consistent with the mutually agreed upon Fringe Area
Policy for Area 6.

CZ-9228. Pleasant Valley, Inc. Rezoning Request
Arie Kroeze, Pleasant Valley, Inc., has filed an application with Johnson County to rezone 1.0 acre of
a 54-acre tract from A 1, Rural District, to RS, Suburban Residential. This property is located in Fringe
Area 6, approximately 1 y" miles south of Iowa City in the southeast quadrant of the Nursery Lane and
Sand Road intersection. Pleasant Valley Golf Course is located north of the one-acre site, and the
Pleasant Valley nursery warehouse is located immediately south of the request property.
An existing residence is located on the request property. Because the residence was on property
which was part of agricultural land holdings of more than 40 acres when it was constructed, it was
exempt from County rezoning requirements. The applicant proposes to rezone an acre of land with
the existing house to RS, then follow up with a subdivision splitting the one-acre residential lot from
54 acres of Pleasant Valley nursery property. The minimum lot size required by Johnson County in
the RS zone for a single-family residence using a septic system is 40,000 square feet. The subject
lot contains 43,560 square feet [1.0 acrel, and is not located within either the Sand Road right-of-way
or the City-owned Nursery Lane right-of-way.
The policy for Fringe Area 6 states that agricultural use is preferred. Residential uses for farm family
purposes will be considered depending on soil and site conditions, Development of existing residential
zoning should be Iimit~d hy the capacity to provide municipal services. In this case, however, 1)
where only one acre of land is at issue, 2) a residence already exists on the site, 3) no increase in
population, and consoquently no demand for additional services is anticipated, 4) no new roads,
grading or natural areas are involved, and 5) all utilities are currently in place, the proposed rezoning
in all practicality does not appear to contravene the policy for Fringe Area 6.
STAFF RECOMMENDATION:
Staff recommends that the City Council forward a comment to the County Board of Supervisors findin9
that the request to rezone the one-acre tract from A 1 to RS is consistent with the mutually agreed
upon Fringe Area Policy for Area 6.
