1. CALL TO ORDER

Chairperson Bailey called the meeting to order at 6:01 p.m. There were no alternates present. It was
moved by Ricketts and seconded by O'Donnell to approve the meeting minutes of April 19, 2006. The
motion carried unanimously. Bailey set the date of the next JCCOG Urbanized Area Policy Board
meeting for Wednesday, August 30, 2006. Bailey stated the meeting would begin at 6:00 p.m. at a
location to be determined.
2. PUBLIC DISCUSSION
There was no public discussion.
3. PRESENTATION ON SILURIAN/DEVONIAN AQUIFER STUDY FINAL REPORT.

Davidson stated that the Cities of Coralville, Iowa City, North Liberty, and Solon; Johnson County; and
the University of Iowa had participated in the funding of a study of the Silurian/Devonian aquifer, along
with the U.S. Geological Survey and the Iowa Department of Natural Resources. Davidson stated the
study had been completed. Davidson introduced Bob Buchmiller of the U.S. Geological Survey.
Buchmiller stated that the two rock formations which formed the Silurian aquifer and the Devonian
aquifer acted together and that is why they had been considered together in the study. Buchmiller
provided a summary of the study findings. Buchmiller stated that there had been a concern that more
water was being extracted from the aquifer than enters the aquifer. Buchmiller stated the study
determined that this was not the case; that only around 30% of what enters is being extracted.
Buchmiller stated that the forecast of the aquifer's status looked good in terms of accommodating the
projected growth of Johnson County. Buchmiller stated that drought could be an issue with shallow
wells and that water conservation would be encouraged during drought times.
4. UPDATE ON JOHNSON COUNTY CONSORTIUM ON SUCCESSFUL AGING.
Severson summarized activities in Johnson County involving the American Association of Retired
Persons and outlined upcoming activities. Severson stated that the Johnson County Consortium on
Successful Aging requested that JCCOG recognize the effort to make Johnson County a livable place
where persons can age successfully, encouraged members to attend future work groups; and hoped
that JCCOG would be open to receiving the reports of the consortium and the reports of the work
groups. Bailey and Stutsman asked that this item be scheduled for discussion at a future JCCOG
board meeting.
5. TRANSPORTATION PLANNING.

a. Amendments to the JCCOG Arterial Street Plan reoardino Foreveroreen Road extensions east to
County Road W-66 (Dubuque Street) and west to Half Moon Avenue. Bailey stated that the two
proposed arterial street extensions would be considered separately and voted on separately and
asked Yapp to begin with the extension of Forevergreen Road to the west.
Yapp stated the Arterial Street Plan is a federally-mandated document for the metropolitan area,
governed by the Urbanized Area Policy Board. Yapp stated it is important to plan for arterial streets on

the metropolitan level, because they are used by residents of all cities and unincorporated areas.
Yapp said planning ahead for arterial streets is an important part of land use and infrastructure
planning.
Yapp described the proposed JCCOG Arterial Street Plan amendment which had been received from
the City of Tiffin to extend Forevergreen Road between Jasper Avenue and Half Moon Avenue. Bailey
opened the public hearing at 6:16 p.m. There were no comments. Bailey closed the public hearing at
6:16 p.m. Vanderhoef asked the status of Tiffin's desire to extend Ireland Avenue to U.S. Highway 6.
Yapp stated this was not currently programmed for construction although property had been acquired
for the extension. Elliott asked if the two arterial street amendments involving Forevergreen Road
could be constructed independently. Davidson replied yes.
It was moved by Champion and seconded by Ricketts to approve the amendment to the JCCOG
Arterial Street Plan to extend Forevergreen Road between Jasper Avenue and Half Moon Avenue.
The motion carried unanimously.
Yapp provided an explanation of the proposed Forevergreen Road arterial street extension between
12th Avenue extended and Dubuque Street, which had been proposed by the Cities of Coralville and
North Liberty. Yapp said the City of Coralville had hired EarthTech Consultants to evaluate a number
of road design factors including environmental features, property lines, habitat and topography in the
context of alternative alignments for Forevergreen Road. Yapp said each directly-affected property
owner had received a copy of the report. The JCCOG Transportation Technical Advisory Committee
recommended deferral of the decision to add Forevergreen Road between 1 ih Avenue and Dubuque
Street to the JCCOG Arterial Street Plan.

Correia asked what would happen if the proposed arterial street plan amendment was not approved.
Yapp replied Coralville land use documents could reflect the proposed street extension but that state
or federal funds could not be used for its construction. Correia asked the status of the extension of
Oakdale Boulevard to Dubuque Street. Weihe replied that it was not currently funded for construction
and the property was in unincorporated Johnson County. O'Donnell stated that the issues he had
heard concerning the Forevergreen Road extension between 1 ih Avenue and Dubuque Street
involved the process not being inclusive, not whether or not this area was going to grow. Bailey stated
that it was likely that the Board would vote to defer the proposed extension but that she wanted to give
the opportunity for persons who were present to speak. Bailey opened the public hearing at 6:24 p.m.
Paul Mort stated he was employed by Simmons Perrine and was representing the Davidsons. Mort
stated his clients had an issue with the process that had been followed by the City of Coralville. Mort
stated that the study area needed to be expanded and that the needs of residents in the area had not
been considered. Mort provided Board members with a summary of documents that he said shows
how the process for the recommended alignment was flawed. Mort stated residents should have the
opportunity for input on proposed alignments and not just provide comments on alignments which
have already been developed. Morf stated developers had been considered in the process but not
residents. Morf stated the proposed alignment would negatively impact the Davidsons. Morf
recommended a new engineering firm be hired to perform a subsequent study.
Linda Westfall of Pembrokeshire Drive stated she was attending to support the connection of Oakdale
Boulevard to Dubuque Street.
Barbara Beaumont of Naples Avenue stated that she understood the need for the new road but did
not like the recommended alignment. Beaumont stated the process had been flawed in determining
the recommended alignment.
Kurt Moore of Dubuque Street stated it was currently very difficult to get onto Dubuque Street from his
property.

Darrell Granner of Stoney Point stated he wanted to be able to participate in the decision making.
Granner stated he and his neighbors did not know anything about this issue a few weeks ago and felt
they had not been adequately represented in the decision-making process.

Herb Loops of North Liberty Road stated he was asked to comment on the recommended alignment
after it had already been set. Loops stated development of the Scanlon farm is driving the discussion.
Brad Houser of Johnson Way stated he was a developer/realtor and that when he has to develop
property he is required to do a lot of prep work which has not been done in terms of evaluating the
proposed arterial street amendment. Houser stated Dubuque Street and North Liberty Road cannot
accommodate additional traffic safely. Houser stated developers are driving the decision and that the
planning process had been flawed.
Jim Lundahl of River Heights stated Dubuque Street cannot handle additional traffic.
Carol Spaziani of Iowa City stated a transit connection to North Liberty is needed to reduce Dubuque
Street traffic.
Janna Wessels of Cedar Drive stated it was difficult to get onto Dubuque Street and that a traffic study
should not be done in the summer when counts are low but in the fall when traffic increases.
Janet Lestner of Spring Valley stated Dubuque Street cannot accommodate additional traffic.
Tom Langdon of Locust Ridge Road stated bicycle safety was a concern on Dubuque Street and deer
were a safety problem.
Denise Bushnell of North Liberty Road stated North Liberty Road was hazardous for her children and
that an additional traffic study was needed.
Mark Hamer of Iowa City stated he owned property on Dubuque Street which he would be developing.
Hamer stated a citizen committee was needed as part of the process to determine the arterial street
alignment.

David Chef of County Down Lane stated the arterial street issue is related to development and
annexation issues and that both need to be taken into consideration. Chef stated the Board should not
defer the issue but should reject the entire process as being flawed.
Colleen Godlenski of North Liberty Road stated they have known about the issue for a couple of
years. Godlenski stated Coralville representatives asked them to select a preferred alignment and that
they did not wish to select any alignment but were pressured into selecting an alignment by Coralville.
Godlenski stated the EarthTech report was full of inaccuracies.
Bailey declared the public hearing closed at 7:12 p.m.
It was moved by Vanderhoef and seconded by Stutsman to continue the hearing until the next JCCOG
Urbanized Area Policy Board meeting. After discussion, the motion carried unanimously.
Sullivan stated he wanted to know more about development plans in the area. Vanderhoef stated that
north-south arterial streets needed to be more clearly identified. Stutsman stated there needed to be a
regional planning process for the entire county. Champion stated that she concurred with comments
that the planning process had been flawed and that there was a need for a process which included
better public input. Wozniak stated he felt that the process should be started all over. Wozniak stated
he was not certain the Davidsons new home had been considered. Wozniak stated all except one
property owner did not like the proposed alignment of the arterial street extension and that the process
needed to be fixed.

It was moved by Elliott and seconded by Herwig to defer action on the proposed JCCOG Arterial
Street Plan amendment to extend Forevergreen Road between 1 ih Avenue and Dubuque Street.
Weihe stated he concurred with deferring the issue and not voting it down. Correia stated she felt
there was an existing traffic issue which needed to be dealt with. Davidson stated he wished to clarify
that the JCCOG board's jurisdiction was over the arterial street plan amendment and not any
development projects in the area. Davidson stated that the proposed road was a critical element for
future urban development in the area by the City of North Liberty and the City of Coralville, and that it
would involve extension of municipal sanitary sewer and extension of municipal water service.

Bailey called for a vote on the motion and the motion carried unanimously.

Davidson suggested inviting representatives from the City of Coralville and the City of North Liberty to
the August 30 JCCOG Urbanized Area Policy Board meeting to present development plans for the
area of the proposed arterial street extension. Stutsman stated she felt the County should be included
in terms of their development plans for the area. The Board concurred with this action for the August
30 meeting. Correia stated she felt strongly that the existing EarthTech study should not be used for
decision making. Herwig stated that the City of Coralville should be allowed to explain the context of
the EarthTech study. Herwig said he knew that many property owners were contacted in the
development of the Forevergreen Road study, and Coralville staff should be able to explain the
process they went through. Bailey stated it was necessary to start the process over. Wozniak stated
he felt it would be good to see the overall development plans for the area. Vanderhoef asked if a
large-format map could be produced for the August 30 meeting and Yapp stated he would attempt to
do so.
Bailey called for a 1 O-minute break.
b. Consider amendments to the FY07-FY10 JCCOG TIP. Neumann presented projects proposed to
be added to the FY07-10 JCCOG TIP including rehabilitating wheelchair lifts for 14 transit vehicles
and replacing the hoist lift for paratransit vehicles. Neumann stated both were Iowa City projects and
they had not been included in the TIP when it was approved in April. Bailey declared the public
hearing open at 7:40 p.m. There were no comments. Bailey declared the public hearing closed at
7:40 p.m. It was moved by Correia and seconded by Weihe to approve the proposed amendments.
Ricketts asked for clarification that eventually wheelchair lifts would be replaced with ramps on
paratransit vehicles. Neumann replied yes. The motion carried unanimously.

c. Update on Cedar Rapids-Coralville/Iowa Citv-Amana Colonies passenaer rail study. Davidson
provided a summary of the status of the ongoing passenger rail service study. Davidson stated that
the final report was likely to be released through the City of Cedar Rapids 15-in-5 committee later in
the summer.
d. Update on recent activities. Davidson asked if there were any comments or questions on the
recent activities of the JCCOG Transportation Planning Division. There were no comments.
6. ADMINISTRATION
a. Discuss ioint emeraencv response communications center. Davidson reviewed the discussion at
the April JCCOG Urbanized Area Policy Board meeting on proceeding with evaluation of a joint
emergency response communication system for Johnson County. Steve Atkins, City of Iowa City City
Manager, was present and reviewed a draft budget he prepared for a joint emergency response
communications center. Atkins stated he used operating expenses from the existing City of Iowa City
and Johnson County emergency response communications centers to determine projected operating
expenses. Atkins stated the summary of major capital equipment came from the GeoComm study.
Atkins stated the summary of capital equipment assumed everything recommended in the GeoComm
study should be implemented. Atkins stated a new building and a fifth tower were not included. Atkins
stated the budget proposal included 1,000 new radios for all emergency response entities in Johnson
County.
Atkins stated that the proposal assumed Johnson County would fund equipment for the rural fire
districts. Atkins raised the issue of a two-county system which would include Linn County. Atkins
stated the City of Iowa City would fund their share through general revenue funding and debt service
and assumed the County would do so as well. Atkins stated the 911 surcharge and the local
emergency management fund (countywide levy) were other possibilities for financing. Atkins stated
the proposed system would be FCC compliant.

Elliott asked how other entities besides the City of Iowa City and Johnson County would provide
funding. Atkins replied through contractual arrangements. Atkins stated the expense for individual
radios was considerable. Champion asked what was the current use of the 911 surcharge funds. Iowa
City Fire Chief Andy Rocca from the audience stated that the 911 Board had determined that it would

go to public response answering points. Weihe stated he liked the idea of a countywide financing
mechanism. Atkins stated he believed the current 911 surcharge was $0.45 per phone line and it
could go as high as $1.00. Atkins stated there were private entities that would provide towers and then
lease space to other entities.
Bailey stated the next step was to form a subcommittee. Sullivan asked if a consultant should be hired
at the present time. Bailey stated that it was not recommended the consultant be hired yet. Sullivan
stated that the construction of towers should be coordinated with the construction of a new National
Guard building. Correia stated that the construction of towers should be coordinated with Linn County.
Champion asked if a single system including Linn County would be cheaper, and Atkins replied he
was not sure.
Bailey appointed the following subcommittee members: herself, Pat Harney from Johnson County,
Henry Herwig from Coralville, Jim Wozniak or his designee from North Liberty, Andy Rocca from Iowa
City, Sam Hargadine from Iowa City, Lonnie Pulkrabek from Johnson County, Steve Spenler from
Johnson County, and Barry Bedford from Coralville. Elliott stated he would also like to serve on the
subcommittee, but it was not essential. Davidson stated subcommittee members should provide him
with a day of the week and time of day that was convenient to meet, and he would attempt to set up
the first meeting in July. Bailey stated the subcommittee would meet monthly until all issues were
resolved. Sullivan stated all of the rural fire district representatives he had spoken with hoped that the
joint communications system would happen.
b. Discuss keq reqistration ordinance for Johnson County. Bailey introduced Iowa City Police Chief
Sam Hargadine. Hargadine stated he was present because Sheriff Pulkrabek could not attend the
meeting. Hargadine reviewed the proposed countywide keg registration ordinance and stated the goal
was to reduce high-risk alcohol use. Hargadine stated all surrounding states have passed keg
registration laws and several entities in Iowa have passed keg registration laws. Hargadine reviewed
how the proposed law would assist law enforcement entities. Elliott asked if bars would have a
problem with the proposed ordinance. Hargadine replied he did not believe so and that the proposed
'--- ""-- ordinance would impact retail outlets, not bars. Correia asked if a countywide ordinance would be
implemented, and Hargadine replied that is what was proposed. Weihe asked if the proposed
ordinance would impact sales of kegs to businesses with liquor licenses. Hargadine replied no, it
would impact those who distribute alcohol without a liquor license. Herwig asked about the likelihood
of a state law being enacted. Hargadine replied that it had been close to being approved, but a
statewide law was not approved.
Stutsman stated she would not want to proceed without advice from the COLUlty Attorney. Stutsman
stated she did not wish to speak for the County Attorney, but stated she believed the County Attorney
preferred to have individual municipalities enact keg registration laws. Sullivan stated he would not
want the County Board of Supervisors to consider such a law without it being endorsed by the
municipalities through individual resolutions. Weihe stated this was possible, but that the County
should provide a proposed ordinance. Stutsman stated that she believed the County Attorney would
want municipalities to adopt their own ordinances. Sullivan stated that Story County implemented a
countywide keg registration ordinance that included Ames. Stutsman stated she would accept the
advice of the Johnson County Attorney. Herwig stated that the County Attorney should talk to
individual City Attorneys before the matter was considered further. Bailey stated the next step was for
the County Board of Supervisors to discuss the issue.

The JCCOG Joint Emergency Response Communications Center Subcommittee has met once
already and will be meeting twice in September. Committee members are:

The JCCOG attorney has determined that the subcommittee meetings do not need to be open

issues among subcommittee members. The subcommittee will attempt to conclude its activities
and have its recommendations to the JCCOG Urbanized Area Policy Board by the end of the
calendar year.

Re: Agenda item 3(b): Update on mobile household hazardous waste collection unit
The Iowa City Landfill and Recycling Center recently purchased a mobile hazardous waste
collection trailer that allows the landfill to collect household hazardous wastes at any location in
the landfill service area. The service area includes all of Johnson County and the communities
of Riverside and Kalona in Washington County. The landfill also uses the 16' trailer to collect
hazardous wastes from small businesses in the service area.

The landfill held their first mobile household hazardous waste collection event on June 17 at
Longfellow School in Iowa City. The event, which targeted the Longfellow Neighborhood only,
was held from 9:00 a.m. - noon on that Saturday morning. The event was advertised in the
neighborhood newsletter and through direct mailings to neighborhood residents. The landfill did
require that each household make an appointment to participate in the event.
The landfill scheduled 30 appointments and had an additional 10 households show up without
an appointment for a total of 40 households served in 3 hours. The neighborhood and school
provided 8 volunteers for the event. These volunteers helped with traffic control, paint
collection, and helped conduct a survey prepared by the landfill. There were 2 landfill staff
people on hand to accept materials and pack the material for transportation back to the landfill's
permanent household hazardous waste collection facility.
The results of the survey conducted at the event indicated that 75% of the waste materials were
generated from households cleaning out their house while 15% of the waste materials were
inherited from someone else. A large majority (88%) of those surveyed said they would be
willing to pay a small fee for the mobile collection service. 17 of the 40 households had used the
permanent household hazardous waste collection facility at the landfill.
Most of the waste collected (57%) was latex paint. Oil based paints made up 25% with the
remaining 18% being made up of materials such as batteries, light tubes, auto fluids, and
poisons. The average weight per household was over 94 pounds of hazardous materials.
The landfill does not have any events scheduled at this time but they do plan on offering their
new service to all of the communities in their service area as well as other neighborhoods and
rural subdivisions. The landfill will soon be providing information to each community as to how
to set up such an event. If anyone has any questions regarding the service you can contact

Agenda Item No. 3(c): Update on Johnson County Consortium on Successful Aging
The Consortium along with MRP and the University of Iowa Center on Aging are hosting a
planning session with Elinor Ginzel of the MRP's Livable Community Initiative. The date is
September 19th from 3:00 to 5:00 P.M. at the Medical Education and Research Facility on the
University west side campus.
The planning process will begin with Elinor providing a definition of a livable community and
discussing how Johnson County can serve as a national example of a livable community for
older adults. Then the group will be asked to provide insights on how to keep Johnson County a
great place for persons to age successfully. There will be four subgroups - health care, housing,
transportation, and leisure/education.

The City of Iowa City will be applying for an ICAAP grant for a grade-separation project at the
Iowa Interstate Railroad/First Avenue railroad crossing in east Iowa City. The project will elevate
the Iowa Interstate Railroad (and lower First Avenue) to create a railroad overpass. The
application for ICAAP funds is predicated on the fact that this project will eliminate a high
number of idling vehicles and motorists taking long detours through adjacent residential
neighborhoods when trains block First Avenue. Other concerns with the existing at-grade
crossing include junior high school student safety and the lack of nearby alternative emergency
vehicle routes when First Avenue is blocked.

The JCCOG Long Range Multimodal Transportation Plan supports projects that reduce
congestion, improve traffic flow, and reduce cut-through traffic on residential streets. Please

WHEREAS, the Iowa Department of Transportation administers the federal Iowa Clean Air
Attainment Program (ICAAP), the purpose of which is to fund improvements which reduce vehicle
emissions; and
WHEREAS, the City of Iowa City is making application to said program for a grade-separation
project for the Iowa Interstate Railroad I First Avenue crossing; and
WHEREAS, a requirement of the grant application is a resolution declaring conformance with the
JCCOG Long Range rylultimodal Transportation Plan; and
WHEREAS, The City of Iowa City's application and proposed project conforms with the JCCOG
Long Range Multimodal Transportation Plan by reducing congestion and delay, and increasing the
efficiency of the First Avenue corridor.

Transportation Improvement Program (TIP) - Iowa DOT projects
After reviewing the State Transportation Improvement Program earlier this month, I learned
that Iowa DOT had altered some of their projects that are included in the JCCOG TIP. These
changes included minor adjustments such as placing some projects into a different funding
category; finalizing state funding amounts; and removing one project due to it being outside
the JCCOG planning area. No new projects have been added, and none of the locally-
determined Surface Transportation Program and Transportation Enhancement Program
projects have been altered. All of these projects have been through the local public
notification process earlier this year, and are going through the State public notification
process this month.
- The funding pages from the JCCOG TIP are attached; specific changes include:

Two Interstate 380 projects, a bridge deck overlay at 1-80, and a bridge deck
overlay at US HWY 6, have been reclassified from Interstate Maintenance
projects to Highway Bridge Rehabilitation projects.
The Highway 1 bridge rehabilitation project for the bridge over 1-80 has been
reclassified from a National Highway System project to a Highway Bridge
Rehabilitation project, and the project cost has increased from $700,000 to
$877,000, with $702,000 in federal aid.
$2,005,000 in state funds are shown in FY09 for the Coralville 12th Ave to 22"d
Avenue project in the Demonstration Project category (these funds had previously
been included in the Highway Bridge Replacement category).

The project cost for the FY07 portion of the Interstate 80 paving project was
incorrectly listed in an earlier version of the TIP as being $26,247,000. The
current amount is $10,247,000 for the project total, including $9,222,000 in
Interstate Maintenance funds.

The Interstate 80 bridge deck overlay project 2.2 miles east of Iowa City has been
moved out of the JCCOG TIP because it is outside the JCCOG planning area.
We will amend the JCCOG TIP accordingly. No JCCOG Board action is required.

Re: Agenda item 4(c): Iowa Highway 1 improvement project
Iowa DOT has notified us of an improvement project for Highway 1 North. This is not the former
"Super 2" project that was proposed several years ago, nor does it include the Solon bypass. It
is a project intended to address some existing issues with the highway within current budget
realities.
In general, the reconstruction of Highway 1 between Iowa City and Solon will improve the
surface of the roadway, add paved shoulders, improve some key intersections, and improve
drainage. Initial ground survey work has begun for development of design plans. The project is
currently scheduled for construction in FY 2009.
Project elements include:
The paved surface will be 36 feet wide (2 lanes @ 12', 2 shoulders @ 6')
Shoulders will be 8' in width (6' pavement and 2' granular surface)
Improved drainage will be constructed along 100% of the project on both sides of the
roadway
There are no proposed changes to the Highway 1 alignment
Approximately 90 entrances will be widened to a minimum width of 20'
General restructuring/retrofitting of several key intersections to improve safety.

passenger rail study
The passenger rail service study that we have been working on with Cedar Rapids is wrapping
up. A third draft report is currently being reviewed by the project principals and the railroads. We
anticipate the final report being ready for public release in early September. This will be done
through the Cedar Rapids Chamber of Commerce 15-in-5 Committee.
We are excited about some opportunities for excursion-type services on both ends of the
corridor which could be implemented fairly quickly. We will also have a solid plan for future
larger-scale strategies which can be accomplished if it is a priority for the Corridor and special
earmark funding can be secured.

Re: Agenda Item 4(e): Update on 1-80 six-lane reconstruction project
The 1-80 six-lane reconstruction project has begun this year with the ongoing shoulder
strengthening and westbound pavement improvements which were recently completed. These
improvements are intended to allow traffic to be shifted over to the westbound lanes while the
eastbound lanes are being reconstructed. This project is now programmed by Iowa DOT as a
five-year project with the following approximate schedule:
1. 06 - Ongoing shoulder strengthening and westbound pavement improvements;
prepare ITS strategies
2. 07 - Coral Ridge Avenue to river; construct median lanes
3. 08 - Coral Ridge Avenue to river; work on existing lanes
4. 09 - River to Iowa Highway 1; construct median lanes
5. 10 - River to Iowa Highway 1; work on existing lanes and interchanges
We have a committee meeting with Iowa DOT to specifically address aesthetic enhancements
to the corridor as an element of the project. Our efforts are focusing on the median barrier,
plantings in the corridor, and using color on the bridge structures. We have also asked Iowa
DOT to consider quiet pavement technology for this project. Federal regulations do not allow
noise barrier walls to be constructed with federal funds along the interstate system in locations
where the highway predates the residential dwellings, so none will be considered with this
project.
I will continue to keep you updated as we receive information from Iowa DOT.

meeting on June 28. At that meeting you deferred action on this item and continued the public
hearing to August 30.

At the August 30 meeting we have four specific items on the agenda pertaining to this matter.
As requested, the City of Coralville, City of North Liberty, and Johnson County will present their
adopted land use plans for this area. I believe this is important to establish the context for
considering the extension of Forevergreen Road. This area is presently unincorporated and
under the jurisdiction of Johnson County. However, it is within the two-mile extraterritorial area
of Coralville and North Liberty. State law gives Coralville and North Liberty certain rights for the
consideration of development projects in this area. This matter has been further defined by a
28E agreement that establishes the future annexation area in this vicinity between' Coralville
and North Liberty.
The second item will be a presentation of the corridor study which has identified an approximate
alignment for the extension of Forevergreen Road east of 12th Avenue. I believe there is some
misunderstanding about the precision of this alignment. What is under consideration is not a
specific engineered alignment for the construction of the road. That will require additional design
work which will be completed when the road is under consideration for construction. This would
be completed by either the City of Coralville or the City of North Liberty, depending on where the
road is located. JCCOG's jurisdiction in this matter is to determine if it is appropriate for this
arterial street extension to be shown in our plan, and establish an approximate alignment.
The third and fourth agenda items are for the Board to identify how you wish to proceed with
your decision-making process, and to take additional public comments if you wish.
This has been a difficult issue for many Board members to deal with because it involves arterial
street planning, over which JCCOG has ultimate authority in accordance with Federal law; and
land use planning, which is conducted at the municipal level. Municipalities are understandably
concerned about their authority over land use planning being infringed upon. However, in this
matter there is no way to draw a hard and fast line between arterial street planning and land use
planning. There are clearly land use issues and traffic issues which must be taken into
consideration in considering the arterial street extension proposal. Hopefully the presentations
of land use plans by Coralville and North Liberty will be helpful.
I would also reiterate from the memo you received from John Yapp at the last meeting that the
JCCOG Arterial Street Plan does not program streets for construction, require that a street be
constructed, or require any change in the use of a particular piece of property. Once a proposed
arterial street is established in the JCCQG Arterial Street Plan, it is then up to the jurisdiction
which has authority to determine when the street is to be constructed, design the street, and
have it constructed. JCCOG's only authority in these matters pertains to the use of federal funds
for constructing an arterial street. If federal funds are proposed for an arterial street construction
project, the JCCOG Urbanized Area Policy Board controls the programming document, the
JCCOG TIP, which determines in what year construction is programmed.
There were two other issues raised repeatedly at the June 28 public hearing. One pertains to
the Scanlon Farms property which is in Coralville's growth area. JCCOG does not control the
development of the Scanlon Farms property. The Scanlon Farms property can be developed off
the existing arterial streets of Dubuque Street and North Liberty Road. The proposed extension
of Forevergreen Road would extend through the Scanlon Farms property, but the Scanlon
Farms property can be annexed, rezoned, platted, and construction commenced without any
action by the JCCOG Urbanized Area Policy Board.
There were also several comments pertaining to the adequacy of Dubuque Street north of Iowa
City. The issues identified with Dubuque Street north of Iowa City are typical for arterial streets
in a developing area. When does the "country road" become inadequate to the point where
reconstruction to an urban city street needs to occur? As I stated at your June 28 meeting,
increased urbanization in this area will increase the pressure for improvements to Dubuque
Street in order to resolve the issues identified by speakers at the last meeting. These
improvements will include curb and gutter, storm sewer, sidewalks, pedestrian crosswalks, curb
ramps, turn lanes, and signalized intersections.
