ORDINANCE NO, 92-3547
AN ORDINANCE AMENDING CHAPTER 36, ENTITLED
"ZONING ORDINANCE" OF THE CODE DF ORDINANCES OF
IOWA CITY, IOWA, TO PERMIT DRY GRAIN MILLING AND
pnOCESSING AS A PROVISIONAL USE WITHIN THE I,',
GENERAL INDUSTRIAL ZONE,
WHEREAS, the 1,1, General Industrial Zone is Intended to
provide areas zoned for the development of most types of
industries; and
WHEREAS, grain milling and processing is currentiy
excluded from permitted uses in the I,' zone; and
WHEREAS, provided that regulations regarding the control
and abatement of dust and emissions are met, dry grain
milling and processing can be compatibie with other uses
allowed in the I,' zone; and
WHEREAS, provided that regulations regarding the control
and abatement of dust and emissions are met, the impact of
dry grain milling and processing, if any, on surrounding land
uses should be no greater than other industries currently
permitted in the I.' zone,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COUNCIL OF THE CITY OF IOWA CiTY, IOWA:
SECTION I. AMENDMENTS,
1. Section 36'271bll51 of the Code of Ordinances shall be
amended by deleting said Section and inserting In lieu
thereof the foiiowing:
Section 36,27(b1l51, Permitted uses
151 Manufacture, processing and packaging of food and
kindred products lexcept stockyards and slaughter houses,
and grain milling and processing not regulated as a
provisionai use under Sec, 36-271c1l311,
2, Section 36,27 of the Code of Ordinances is amended by
adding the foiiowing new subsection (cIl31:
131 Manufacture, processing, and packaging of
consumer food products which require grain milling and
processing and which are classified under the foiiowing
industrial ciassificatlons: Flour and Other Grain Mill
Products 120411, Cereal Breakfast Food 120431, and
Prepared Flour Mixes and Doughs (20451 (Standard
Industrial Ciasslficatlon Manual, Superintendent of
Documents, U,S, Government Printing Officel, These
uses are permitted provided:
a, Aii manufacturing, processing, storing, and
packaging be conducted within completely enciosed
buildings,
b, All transferring of raw materia is and finished
products between modes of transportation and grain
milling and processing operations be conducted
within completely enclosed buildings, by pneumatic
tubes, or by sealed containers,
c, Prior to issuance of a certificate of occupancy,
the grain milling and processing operation shaii
submit to the building official documentation
demonstrating that the Appiication and Permit to
Instaii or Alter Equipment or Control Equipment has
been approved by the Iowa Department of Natural

Resources, if such a permit Is required by the Iowa
Oepartment of Natural Resources,
SECTION II, REPEALER, Ail ordinances and parts of
ordinances in confiict with the provisions of this Ordinance
are hereby repealed,
SECTiON III, SEVERABiLITY, If any section, provision or
part of the Ordinance shail be adjudged to be invaiid or
unconstitutional, such adjudication shail not affect the
validity of the Ordinance as a whole or any section, provision
or part thereof not adjudged invaiid or unconstitutlonai,
SECTiON IV, EFFECTIVE DATE, This Ordinance shail be in
effect after its final passage, approval and pubiication, as
provided by law,

AN ORDINANCE AMENDING CHAPTER 23, ENTITLED
"MOTOR VEHICLES AND TRAFFIC," OF THE CODE OF
ORDINANCES OF THE CITY OF IOWA CITY, IOWA TO
CREATE SCHOOL SPEED ZONES ON CERTAIN STREETS IN
IOWA CITY, AND TO DECLARE THE SPEED LIMIT FOR
VEHICLES IN SUCH ZONES,
BE IT ORDAINED BY THE CITY COUNCIL OF IOWA CITV,
IOWA
SECTION 1, That Chapter 23, "Motor Vehicles and
Traffic," of the Code of Ordinances of the City of Iowa City,
Iowa, be, and the same is hereby amended by repealing
Subsection 23,188(bl, and enacting in lieu thereof a new
subsection to be codified the same to read as follows:
Sec, 23.1881bl, The following shall be the maximum
allowable speed for any vehicles except as otherwise
modified in this chapter,
(1 I Twentv 120) miles per hour in any business district,
121 Twenty 120) miles per hour in any school speed
zone.
131 Twenty,five 1261 miles per hour in any residence
district,
(41 Forty,five (451 miles per hour in any suburban area,
15) Fifteen 1151 miles per hour in any public park,
161 Ten 1101 miles per hour in any alley or other public
place not specifically mentioned in this section,
SECTION 2, That Chapter 23, "Motor Vehicies and
Traffic," of the Code of Ordinances of the City of Iowa City,
Iowa, be, and the same is hereby amended by enacting a
new section to be codified as Section 23'189A, to read as
follows:
Sec, 23.1 BBA, School Speed Zones, Upon the basis of a
traffic investigation, school speed zones on the following
streets are established in which the maximum speed limit
shall be twenty 1201 miles per hour from 8:00 a,m, through
5:00 p,m, on Monday through Friday of each week after
the City Traffic Engineer has established signs to designate
the zones,

or part thereof not adjudged invalid or unconstitutional,
SECTION 6, EFFECTIVE DATE, This Ordinance shall be in

required by law,

Re: Authority for the City to Establish Lower Speed Limits
Dear Don:
I understand a question has been raised whether the City of Iowa City has authority to
establish lower speed limits in school zones, based on a traffic and engineering study,
As I read Section 321,290, Code of Iowa (1991). the City has authority to do so, The second
unnumbered paragraph reads as follows:
"Whenever the council in any city shall determine upon the basis of an
engineering and traffic investigation that any speed limit hereinbefore set forth
is greater or less than is reasonable or safe under the conditions found to exist
at any intersection or other place or upon any part of the city street system,
except primary road extensions, said council shall determine and adopt by
ordinance such higher or lower speed limits as it deems reasonable and safe
thereat. Such speed limit shall be effective upon proper and appropriate signs
giving notice thereof are erected at such intersections or other place or part of
the street,"
