Dear Charlie and Members of the Board:
An application has been submitted to Johnson County by Arie Kroeze to rezone 1.95 acres
of a 2.28 acre tract from AI, Rural District, to RS, Suburban Residential. This property is
located in Fringe Area 6, approximately 1 Y, miles south of Iowa City at 4274 Nursery Lane.
At its August 20, 1992, meeting, the Planning and Zoning Commission recommended, bya
vote of 5-0, that the City Council forward a comment to the County Board of Supervisors
finding that the request to rezone the 1.95 acre parcel, with an existing residential use, from,
A 1 to RS is consistent with the mutually agreed upon Fringe Area Policy for Area 6. Although
the policy for Fringe Area 6 states that agricultural use is preferred, the Commission
determined that in this case, 1) where only 1.95 acres of land are at Issue, 2) a residence
already exists on the site, 31 no increase in population and consequently no demand for
additional services is anticipated, 4) no new roads, grading or natural areas are involved, and
5) all utilities are currently in place, the proposed rezoning in all practicality does not appear
to contravene the policy for Fringe Area 6.

therefore, respectfully forwards a comment to the Board that the requested rezoning of the

not a County Road or a platted City street. Nursery Lane is City-owned property acquired
through condemnation for the public purpose of providing emergency access to the City's
South Sewage Treatment Plant, acquiring a sanitary sewer line easement, and providing
emergency access to the park, when it is developed on the sewage treatment plant site.
Under Iowa law, Arie Kroeze will continue to have access rights to his residential property.

Re: CZ-9231. Arie Kroeze Rezoning Request
Arie Kroeze has filed an application with Johnson County to rezone a 1.95 acre parcel of a
2,28 acre tract from AI, Rural District, to RS, Suburban Residential. This property is located
in Fringe Area 6, approximately one and one-half miles south of Iowa City at 4274 Nursery
Lane, The request property is located in the south portion of Pleasant Valley Golf Course on
the north side of Nursery Lane.
An existing residence Is located on the request property, The minimum lot size required by
Johnson County in the RS zone for a single-family residence using a septic system is 40,000
square feet. The subject lot contains 84,942 [1.95 acres], and no portion of the lot is located
in the City-owned Nursery Lane right-of-way.
The policy for Fringe Area 6 states that agricultural use is preferred. Residential uses for farm
family purposes will be considered depending on soil and site conditions. Development of
existing residential zoning should be limited by the capacity to provide municipal services. In
this case, however, 1) where only 1.95 acres of land are at issue, 2) a residence already
exists on the site, 3) no increase in population, and consequently no demand for additional
services is anticipated, 4) no new roads, grading or natural areas are involved, and 5) all
utilities are currently in place, the proposed rezoning in all practicality does not appear to
contravene the policy for Fringe Area 6.
It should be noted that Nursery Lane is not a County road or a platted City street. Nursery

STAFF RECOMMENDATION:
