Re: Grimm's Orthopedic Supply
You have ail by now received correspondence from Grimm's Orthopedic concerning the
requirements for trees and other related land use regulations on their property at 1840 S, Gilbert
Sires!. I have discusssd this matter with the Housing and Inspection Services staff, and svidenlly
this has been an ongoing Issue since March. We have on file a site plan approved by ille
Building Inspector at the time of construction, On that site plan, and at the lime of approval, ail
pertinent ordinances were applied, Thess included zoning, parking, tree placement, stc, While
there appears to be resistance In fulfilling ths obligations of the site plan and the fact that the
property has changed hands, the sits plan Is an obligation on ths property whether It be with the
original ownsr or the new owner, The new property owner could submit a new site plan for
conslderallon; howsver, please kesp In mind that all pertlnsnt rsgulatlons remain appilcable, such
as tree requirements,
The question was aiso raised as to the appeal process on the part of the current owner, It Is my
understanding that at the time of the bUilding Inspection site plan approval, there Is a process for
appeal to the Board of Adjustment. This Is long since past, and the property has changed hands,
In the letter, othsr properties were Identified with respsct to their fulfiilmsnt of City regulations.
The HIS Inspection staff has contacted those properties for compilance, and will pursue
compliance,
It continues to be our intention to pursue this matter, and if necessary, the appropriate citation
will be issued,

Re: Lexington Avenue
As you will recall, we distributed a letter to Lexington Avsnue rssidents requesting their
comments concerning the proposed installation of speed bumps. We have received telsphons
inquiries from ssven individuals, four are opposed to ths speed humps, two in support, and
one favoring the cul-de-sac, Some of the support indicated a desire for higher speed humps,
which we are discouraging, whils another wanted fewer. Chuck had further conversations
with folks along Lexington Avenus and the neighbors convened a meeting the other svsning,
We undsrstand there was no conssnsus at that meeting, In a follow-up conversation, Chuck
also learned the neighbors were going to again reconvene to decide whether they could corns
to some agreemsn!. Chuck has offered to provide reasonable staff support and attend
meetings if necessary, He did indicate to them we need to know soon. It doss appear the
neighbors are divided ovsr this issue, and some interest in the cul-de-sac is presen!. We
simply have to wait and see,

We have not yet received the state funding for the tire collection pilot program, We expect ths
money wilhln the next couple of weeks, In the meantime Floyde and Brad are putling together
a plan to collect tires throughoutlhe County, Problems have come up in the tire markel area.
Rosebar Tire Shredding of Vinton, which Iowa City currently deals wilh, is having financial
problems and may soon be out of business, Other options are being explored,

Recently, I noticed In your City Council minutes a discussion of our proposed 20 mph speed limit
In school zones, As you may know, a group of school district administrators and citizens have
expressed concerns about speed regulations In and around our schools. As we discussed the
various Issues associated with speed control, one proposal was to determine whether we could
lower the speed limit In and around our schools, You may also recall earlier correspondence
which mentioned It was Important II we are going to pursue such a polley, that the other cities
within the Iowa City School District should also pursue a similar policy on speed limits,
With the Initiation of our ordinance, questions have arisen whether we could legally undertake
such a speed reduction, The purpose of this letter Is to outline for you our general thinking wllh
respect to the 20 mph In school zones.
In the motor vehicle code a school district is dellned as the 'territory contiguous to and including
a highway for a distance of 200 feet In either direction from a school house In a city',
Furthermore in the code, the law states that the 'lawful speed except as hereinbefore or
hereinafter modilled' would be 25 mph In any residence or school district Upon review, it would
appear that it Is a hard and fast rule to have a 25 mph speed limit In a school district. However,
In the code, there was language that discusses special restrictions. It Indicates Ihat 'whenever
the council in any city shall determine upon the basis of an engineering and traffic Investigallon',
the 'council shall determine and adopt by ordinance such higher or lower speed limit as It deems
reasonable and safe', We have Interpreted the law to mean that following some analysis which
Is not clearly spelled out, we would be able to undertake speed controls we believe to be
'reasonable and safe', We believe we have altered our speed Ilmlt In school zones In compliance
with the code, We have allempted to Identify to the greatest extent possible only collector and
arterial streets to be subject to the reduced speed, We would also stay within the definition of
a school district and the engineering and traffic Invesllgallon would be more than merely speed
studies, gap studies, volumes, etc, It was our determination we woutd be able to proceed
following an Invesllgatlon that Indicated during certain times 01 the day due to the Volumes of
traffic and speeds which are occurrlng,lt conflicts with the pedestrian, school children movements
to and from and, therefore, It would be deemed 'reasonable and safe' for us 10 exercise further
restrictions,

Hollywood Blvd. Traffic Concerns
A subcommittee of the Grantwood Neighborhood Association residing on Hollywood Boulevard has formed
to explore the options available to alleviate current traffic problems experienced on their street. Speed,
'nolse and volume of traffic are the primary concerns, A substantial amount of the traffic is generated out
of Lakeslda Apartments. The apartments currentiy have only two pOints of egress; dlrectiy onto Hollywood
Boulevard and onto Lakeside Drive by means of a privately owned frontage road parallel to Highway 6.
Jim Brachtel, Traffic Engineer, and Kevin Ross, Crime Prevention Officer, and I met with approximately 20
residents of Hollywood Boulevard on August 13, 1992, to discuss alternatives, The following actions were
recommended of staff and the residents as a result ollhe mseting:
.t Two speed limit signs (25 mph) should be installed at the eastern end of the strest, suitable for
viewing by Lakeside Apartment residents traveling westbound, and one sign located east of
Sycamore facing eastbound tralfic, The Installation has occurred,
.t Residents were encouraged to continue efforts to notify the pOlice department when conslstentiy
Identified vshlclss are obsarved exceeding the speed timit.
.t Residents were encouraged to maintain a 25 mph speed timlt when they drive on the slreet.
.t The Grantwood Neighborhood Association agreed to meet with management of Lakeside
Apartments to express their concerns and explore solutions In which the apartmenls would be
willing to cooperate. A meellng will be scheduled for mld,September.
.t Stall will continue to explore the pOSSibility of closing off the Hollywood Boulevard egress from
Lakeside Apartments and determine alternative locations lor driveways serving the apartments.
Members of the Grantwood Neighborhood Assoclallon approached City Council on August 20 to express
their concerning regarding the Installation of a trafllc signal at the Intersection of Lakeside and Highway 6,
As development occurs, particularly off 01 Lakeside Drive (Mt. Prospect Park Additlon), the concern is that
traffic may be backed up soulh 01 Highway 6 (heading north on Lakeside) causing Increased usage of
Hollywood Boulevard by Lakeside Apartment residents. '
As these opllons are evaluated and\or Implemented and additional meetings of the subcommiltee occur,

In order to involve nsighborhood associations as well as unorganized areas of the city In the
curbsids recycling program, we have initiated an education process that will oommence within the
week,
The following Is a list of school locations that we have lined up for the curbside education
program mselings:
Mark Twain Elementary. Septsmber 9
Horace Mann Elementary. September 13
West High School. September 14
Lincoln Elemsntary . September 23
South East Junior High School. Septsmber 30
These sites should cover a majority of the city; more sites may bs included if nsed be, it may
becoms obvious that there is limited Intersst in such a program as we proceed, we will adjust our
plan accordingly In that event.
The workshop will Include:
. Review of Iowa City Curbside recycling brochure
. Video on curbside recycling program
. Question/answer session about the curbside program
. Distribution and review of Johnson County Recyclying and Waste Reduction Guide
. Displays on precycling and recycling
The Environmental Advocates have also been Integrated Into this program, They will hand out
flyers In each mesling area, discuss ths general concept or precycllng, and supsrvlse their
precycllng display,

the proposed schedule for the United Way/Johnson County/Iowa City/Coralville Joint Human '
Services Funding Hearings. A Iialnlng session is available so that new panel members may
become familiar with the budget packet and continuing members may sharpen their skills. We
hope you will plan to attend, All meetings will be held at the Department of Human Services, 911
North Govemor Street. Please note that we have had to modify the hearing schedule because
of the Thanksgiving holiday. Hearing 1 will be held on Monday, November 23; all
other Hearings and the Training SessIon will be held on Thursdays. You will
receive further notice regarding this schedule In mid-November. We look forward to working with
the experience of our continuing members and the enthusiasm of our new members. Any United

RE: Crime Prevsntion Activities
DATE: 31 August 1992
Activities in the Crime Prevention office for the month of July
and August included numerous tours from summer camps, schools, and
special programs. A total of 85 children and 15 adults from 6
differsnt groups were shown the inner workings of the police
department.
The City of Coralville requested our presence at their July 4th
parade, All four law enforcement authorities had cars and
representativss leading the parade, and it seemed to be a big hit.
MECCA's Project S.A.F,E continues, we had 2 sector meetings during
the last 2 months, and I also assisted MECCA at the Johnson County'
Fair at MECCA's informational booth.
Both mall associations asked that I give short presentations at their
merchant 's meetings, Sycamore Mall's focus was on emergency
planning. This was in rssponse to the bomb threat that was recsived
by Von Maur, Old Capital Mall asked that I give a short
presentation on shop lifting, and this was in conjunction with mall
security and the administrative office.
Several meetings were held with the ad hoc Downtown Association
committee concsrned with the general atmosphere on the walking plaza.
I have worked with traffic engineering to make sure signs are in place
on the plaza (re: bikes and psts), and I have also contactsd Boulder,
CO. and Santa Cruz, CA. police departmsnts to see how they handlsd
the problems on the walking malls in their cities, I have not been
informed regarding ths next meeting dats.
I assisted Younksrs with their "Kindsrprintll program, This is a homs
use child identification kit which includes a place for a photograph,
physical description, and fingerprints. This Is done at hams by the
child and parent.
Neighborhood Watch Is getting geared up. I have attended two
fallow-up meetings In already-established areas, and have been
contacted by 12 psrsons to get new programs going in other areas.
Kevin Ross returned for his last two wesks as a police officsr, The
week we shared together proved to bs very productive, About a dozsn

new CALL-A-COP messages were recorded, and they will be put
together and added to our already existing messages. Also two public
service announcements were put together for later use. These
segments will be given to local radio stations for play, and advertise
CALL-A-COP and Neighborhood Watch. Apparently a last minute
request csme in for an officer to speak to the University of Iowa
football team. I was never notified of this request, and Captain
Harney asked that Officer Ross attend in my absence.
In August I attended the National Crims Prevention Institute in
Louisville, KY. This was a great opportunity! I feel much. more
confident now when I speak to Neighborhood Watch groups about
physical security, about organization in the Crime Prevention office,
what is happening in this field, and what else the Iowa City Polics
Department can do in crime prevention. I met many interesting people
from various fields and different parts of the world, and also heard
numerous new ideas in the areas of crime prevention/community
relations. Hopefully, some of these may be put to use in the future.

On August 24,1992 at about 8:00 a,m. I parked In the parkIng ramp on the south sIde 01
the Old CapItal Mall, When I returned to my car at 10:30 a,m, I notIced a tIcket lor 5,00
chargIng me with "no parking thIs level", At the tlme I parked I dJdn't notice any 01 the "no
parking this level" sIgns that are hangIng Irom the cellJng, nor was there a sIgn on the
gate admIttIng cars Into the parkIng ramp. When I questIoned the attendent I was relerred
to Joe Fowler at the ParkIng office. Mr, Fowler informed me that the fIrst three levels of
the Capltai parking ramp are closed from 6 a,m. to 10 a,m.lor approxImately 30 days at the
request of two merchants associatIons, the Downtown Assoclatlon and the Old Capital
AssocIatIon, The concern of these two groups seems to be that there Is not enough open
parkIng for "customers". I have a problem with thIs.
Sears, K-mart, Target, and Walgreens have all got "prIvate" parkJng lots for theIr
customers, These were constructed at theIr own expense, My question Is when dId the
"public" parkIng ramp that Is located next to the Old Capital Center become a prIvate
parkIng lot? To my knowledge this parking ramp was built wIth public funds. These lunds
were collected In the form 01 taxes from everyone in Iowa City, maYbe even In the Natlon
if matchIng lederal funds were attaIned, My poInt Is thls, the parkIng ramp was closed on

pmicipmt in the Rebuild Iewa Coalition. The Rebuild
Iewa Coalition is an organization CCIlj,Xlsed of
approxinatel y 23 various groups and organizations
concerned aOOut the state of lewa' s declining vertioal
infrastructure, , , . ie systen of p.ililic buildings. A
recent 1M! State University survey has indicated a need
to repair or replace an approxinate 3,2 "billion dollars
in public facilities in the state of lIMa.
The Rebuild leMa Coalition believes that lewa' s current
law requiring a 60% super rrajority to pass bond
referendlDl15 is undem:x::ratic and places unreasonable
obstacles to infrastructure replir and replacarent.
Ie;jislation has been proposed in the lIMa Ie;jislature
which would help correct this restrictive super rrajority
requirarent, IbJse File 2479 am Senate File 2369
are SUWrted by the ReI:uild Iaa Coalitioo. Currently
Iewa law prescribes that property taxes be use:! to
finance public projects such as schools, fire stations
and libraries. The proposed legislation would change
leMa law by adding a property taxi incare surtax option
for financing the lxlnds. If this option is chosen by a
local entity, then the profOsed referendum would be
decided by a llI3jority vote (50% + 1%). Bond issues
finance:! by straight property tax would continue to be
decided uJ.Xln by a 60% vote,

or nove to, ccmnuni.ties or a state that does not invest in its public
buildings.
o It is shortsighted to think that by not investing in our public facilities,
we are saving n'Oney. Ignoring the need for nEW structures and the
nalntenance of existing structures dces not save rroney, it increases costs
in the long run,
o ICMa'S public long term debt is extrerely lcw,., .anong the lowest of the 50
states, If we are wise, we will invest prefer sums in our public

of voters to analyze the implications of long term debt is easier in this

ACTIVITIES REPORT
SUMMER 1992
Listed below is a brief summary of each project and some updates on happenings within tha
division, Pictures of the projects are on display in the Civic Center lobby,
Two honors since our last report. First, our city has been chosen by the IDNR for a 1992
Iowa Energy Leadership Award recogni2ing our innovativeness in energy efficiency. Our
thanks go to Energy Coordinator/City Architect Jim Schoenfelder for his work, Our second
honor goes to Denny Gannon and Ed Engroft for winning the Math Counts Corporate
, Challenge on February 27th, Denny and Ed were teamed up with two teachers from
Northwest Junior High, The teams, from businesses and schools, competed in a game show
style contest involving math Questions, Other teams competing were from Shoemaker &
Haaland Engineers, Shive,Hattery Engineers & Architects, Mid-States Construction, VinWinkle
& Jacob Engineering, Iowa State Bank, Rockwsll, and Iowa City Schools math teachers, The
game was held to help publici2e Math Counts competition for junior high school students
which was held at West High the following Saturday,
On August 31, our new drafter, Barbara Meredith, will start work, replacing Craig Berger who
left to pursue employment with an engineering firm in Cedar Rapids, Barbara comes to us
from Thomas & Betts Corp, and has over 20 years drafting experisnce, We look forward to
her arrival.

This project will involve remodeling the lower level of the Civic Center east wing to create
more space for H,I,S., the City Attorney's office and Document Services, This work will also
include extension of the sprinkler system for fire protection. Total estimated cost is
$300,000,
Lobbv Information Dssk
This project will involvs design and construction of a new expanded ssrvices information desk
in the Civic Center front lobby, Services wili include copy machine, fax machine, ATM, mail
cart, text phons, as well as the traditional information services. Probabls construction cost
will be between $5,000 and $8.000,
Asbestos Abatement
This is a continuing project involving asbestos abatement in the Lower Level Civic Center east
wing and lead abatement in the old Police Department shooting range, The estimated cost
is $19,000,
Landfill Scele House
Plans and spscifications for a new scale house at the Iowa City landfill have been completed,
The new scale houss wili comply with ADA (Americans with Disabilities Acti handicapped

requirements, Formal bids were solicited and rejectsd bscause they were far above the
estimate, It is anticipated City crews, in cooperation with certain subcontrectors, will
construct this facility, The estimated cost is $35,000,
Chauncev Swan Parking
Dssign of the Chauncey Swan parking facility is complete and bids will be received September
10, Construction of the $4 million facility is expected to be complsts by October of 1993,
Citv Park Eauioment Building
Concept design has begun for a new joint services building for Parks and Forsstry at City Park,
The facility will house offices, maintenance equipment and materials, employee services,
painting, and paint matsrials, This facility will centralize similar smaller spaces scattersd
around the city as well as providing new indoor storage for some equipment currently storsd
outside. No cost estimate is available at present.
Plum Street Pavina
This project reconstructed Plum Strset between Highland Avenue and Keokuk Street. The old
pavement had deteriorated beyond the point at which it could be rspaired by an asphalt
overlay. This ,project also involved storm sewer improvements and sidewalk repair; a new
aspact for one of our projects, Since the sidewalks in this area were in poor condition, we
created an opportunity where the property owners could send us a chsck and our contractor
would fix thsir sidewalk, This allowed property owners to take advantage of the low price
associated with volume work and freed them from the headaches of arranging for a contractor
to corns in and do the work, The level of participation exceeded 90%,
Melrose Avsnue Pavina Imorovemsnts
Advance planning and coordination has bpgun between the City and the University of Iowa
Hospitals and Clinics rsgarding recon~truction of Melrose Avenue and construction of the one
million square foot Eye Institute dnd associated 900 car parking facility, We have coordinated
efforts to shift ths widening of Melrose Avenue to the north onto University property betwesn
Hawkins Drive and South Grand so that the south curb line of a four lans facility would remain
at its present location through this segmsnt. We are also working to design a joint storm
sewer system, and construction will be coordinatsd with the Melrose Avenue Bridge
Replacement to prevsnt closing the street twics,
Melrose Avenue Bridae Reolacement Proiect
Final design by NNW, Inc, is underway, The design will provids for a new bridge with four
lanes resulting in a vehicular surfacs width of fifty (50) fset along with eight (8) foot wide
sidewalks and will include the rsconstruction of Melrose Avsnue from Olive Court in University
Heights to just east of Hawkins Drive. Ths paving within University Heights will provide a
transition to the existing paving width (36') and within Iowa City the paving will be four lanes
(47'), Sidewalks adjacent to Melrose Avenue will bs constructed at a width of eight (8) feet
along the north side and four (4) feet along the south side, The prsliminary estimate for

construction is $1,250,000, Federal funding 'is sxpected to contribute $650,000 of the
construction cost,
It is anticipated that construction will begin in spring or summer of 1993 and will be complete
in twelve to fifteen months, Construction will be staged so that one lane of traffic in each
direction and at least one sidswalk will remain open at all times except the lest couple of
months of construction when Melrose Avenue will be closed to vehiculer traffic while the
installation of utilities and the removal and replacement of the Mslrose Avenue pavement are
completed. The bridge will bs opsn to pedestrian traffic at all times. Project discussion and
coordination have bsgun and will continue as necessary with the University of Iowa and
University Heights,
South Svcamore Sanitarv Trunk Sewer
This sewer is designed to serve the southeast portion of Iowa City and will be funded by tap.

$559,964,80, However, construction has not started because of difficulties obtaining
easements, We hope to begin construction in October,
North Dodoe Water Tank
Ths North Dodge watsr tank has bsen empty for about a year now, dus to need for repairs
and repainting, Since this tank has lead bassd paint on the outside, renovation may prove to
be less cost'effective than building a nsw tank, Bids for renovation will be received on
September 8th and a decision to renovate or rebuild will be made Soon aftsr,
FY92 landfill Exoansion Proiscl
The weather changed just soon enough last fall to preclude completion of this projsct bsfore
winter, However, enough of the work was complete and IDNR approval was receivsd so that
ths new area could be opened for waste disposal over ths winter, In the spring, final grading
and landscaping was completed and the leachate lagoon liner was installed,
landfill Trse Planting
In an effort to reduce erosion, surface water infiltration and wind, and to improve the
appearance of the landfill, nsarly 25,000 poplar trees wsre planted on and around thslandfill,
The sites on the landfill cap will be instrumented to determine the impact of the trees on soil
moisturs and infiltration,
landfilllnvsstioation and Other Landfill Consultant Work
To met all of the Stats requirsments for planning and investigation at the landfill, Shive.
Hattery Engineers and Architects of Iowa City was hired, In May they began the field work
which consisted of soil borings and a few groundwater monitoring wslls and one leachate
monitoring well, Using information gathersd during this and prsvious work at the landfill, they
have prepared a hydrogeologic investigation report, a hydrologic monitoring system plan and
a leachate control system plan, These documents are currently under review, Once any
necessary revisions are made, they will bs submitted to the IDNR for approval.

of groundwater contamination and the preparation of a closure/post closure plan,
FY92 Storm Sewer Imorovements Project
Construction is about half finished for two storm sewer projects which have been bid
together. The Perk Road Storm Sewer will collect storm water from Park Road and Magowan
Street and convey it to the Iowa Rivsr via Granada Court, Manor Drive, and Lower City Park,
Granada Court and Menor Drive will be reconstructed in the process to allow for installation
of the sswer and to improve drainage of these streets which tend to pond water,
The Ridgs Street Storm Sewsr collects storm water from Ridge Street and Brookwood Drive
and conveys it to ths ditch along Highway 6. This projsct alleviates flooding in the street and
yards along Ridge Street and prevents erosion from the overland flow that now occurs,
The Ridge Street Project is complsts except for surface restoration and ths Park Road Project
is under construction and scheduled for completion in September, The total cost of these two
projects is $375,000,

Plans are being prepared for grading of embankment fill along the alley between North
Governor Street and North Summit Street. This work will stabilize the embankment and
alleviate some ha2ardous conditions associated with that fill. Construction is scheduled for
this fall and is expected to cost about $20,000.
Lafavette Street Sanitarv Sewer Reoair Proiect
The rerouting of a collapsed sanitary sewer in Lafayette Street near Capitol Street was
completed in December, Tschiggfrie Excavating of Dubuque was awarded the contract for
$35,143.75 on November 26,1991, and completed the job for $32,OIS.S0 three wesks
later, The cost savings wers achieved by rsdesigning a spscial drop manhole in the field
during construction,
Oakland Cemeterv Rstainine Wall Rshabilitation Proiect
This project involved the reconstruction of the retaining wall along Oakland Cemetery and was
completed in May, Ths total construction cost was $110.919,60. This project was das;gned
by NNW, Inc, and was nominated for an Historic Preservation award,
Evans Street Sridee Reca;r Proiect
Construction began May IS, and was essentially com plated July 2S, However, when
installing the steel railing, heat from the welding caused cracks to develop in three of the
concrete posts, The contractor has removed and replaced the cracked posts, Construction
costs amounted to $123, 723,SS,

1992 Maintenance and Reoeir Proiect . Caoitol and DubuQue Street ParkinQ Ramos
Six (6) bids were received May 19 and City Council awarded the project to Northwast
Waterproofing & Restoration Co,lnc, of Rock Island, Illinois, Northwest Waterproofing's base
bid was $153,734,75; the estimate was $215,000,00, Since the low bid was considerably
less than the estimate, four (4) add altsrnates were included with the project, The contractor
startsd work May 26, and finished July 31. The final cost of maintenance and repair work
totaled $240,501.10,
Colleoe Strset Bridoe Deck and Sidewalk Rehabilitation Proiect
This project involves the repair of the College Street bridge deck with a dense concrete
overlay and possibly total removal and replacement of parts of ths bridge sidewalk, The
repairs are being performed at this time so that the bridge will not require maintenance soon
after the Chauncsy Swan parking facility is opened, The dssign is currently being performed
by NNW, Inc. of Iowa City. Construction is anticipatsd for Spring of 1993 before the
completion of the Chauncey Swan PaT king Ramp, Construction costs are estimated to be
$300,000.
Burlinoton Street Bridos Collision Damaoe Reoair Proiect
On May 31, the Burlington Street bridge serving east-bound traffic over the Iowa River
incurred some damage when a truck drove up onto the concrete barrier rail at the southwest
corner of the bridge, The collision damaged the concrets barrier rail and the aluminum railing
which is located on top of the barrier rail. Repair plans and specifications have been
completed by Shive. Hattery Engineers and Architects of Iowa City, This project was bid
informally, The low bid was submitted by Schmidt Construction Co" Inc. of Winfield, Iowa,
for $6,860.00, Repairs will be completsd by Octobar 30, 1992. It is intended that all costs
associated with this project will be reimbursed by the trucking company who caused the
damage,
Dubuoue Street Parkino Ramo Lobbv Enclosure Proiect
This project involves the installation of a window and door on both lobbies of the top level of
the Dubuque Street Parking Ramp, It is necessary to enclose the lobbies to 'prevent water and
ice from getting in the stairwslls. This project was bid informally, Thslow bid was submitted
by Selzer-Werdsritsch of Iowa City for $6,775,00; work will be completed by Octobar 16,
1992.

Hiahwav 6 Intersection Imorovements
This projsct consists of construction of right.turn lanes on Highway 6 at Gilbert Strest and
construction of left and right.turn lanes on Highway 6 at Lakeside Drive/Industrial Park Road,
Construction includes curb and gutter, storm sewer and traffic signals. The cost estimate is
$335,000 with state'providsd V-STEP funds totaling $122,000, A fall 1992 construction
schedule is possible.
Burlinaton/Gilbert Intersection Imorovements
Initially this project entailed addition of left-turn lanes to the north and south legs of Gilbert
Street and the east leg of Burlington Street (a lefHurn lane already exists on the west Isg ,of
Burlington Street). Upon further discussion with the Iowa DOT, replacement of the Burlington
Street bridge over Ralston Creek is being investigated by the City and may be added to the
scope of this project. The structural capacity of this bridge has deterioratsd beyond the point
which can be sconomically repaired, The scope and construction schedule of this project is
still being rsviewsd anu will require coordination with the Chauncey Swan Parking Ramp
Project,
Railroad Crossina Grade/Sianalization Imorovements
We continue to work with the railroads and the Iowa DOT to ensure that railroad crossings
within the City are in good repair and ensure motorist safety.

A, Private applicator draft ordinance
On Thursday, August 27, 1992, I met with the staff who have graciously agrsed to help msln this
process, The group agreed to proceed with two ordinances: private applicator ordinance, and
profssslonal applicator ordlnancs, We spent considsrable tlms reviewing the UI Law School's
drafts; and after much discussion, decided to recommend, for both ordinances, adoption of one
notification sign, rather than a pre.applicatlon sign and a post-application sign, Also, since large
tracts of land will have different slgnage needs for private appllcators, we accommodated these
needs by different size and placement requiremsnts,
I highlight ths following, for your Information:
1, "Private applicator" Includss aovernmentalsntities, but excludes state, "Private applicator"
Is defined very broadly, and will Include all governmsntal subdivisions (clty, county and school
district), but will not Include the University or State of Iowa, Rssearch shows It would be vsry
questionable If the City attempted to rsgulate the University,
2, "Private applicator" Includss aoll courses and parks, "Private applicator" Is defined to
Include large tracls of land, Including golf courses, parks and other large campuses, Since the
BW' x 11" signs, placed svery 50 fest, would bs overly burdensoms to large tracts and not
necsssarlly produce greater notlcs, we rscommend larger signs be used for tracls two acres or
more, with spacing intervals of 300 feet.

3, Ordinance Triqqsred by Broadcast Application, In determining the "threshold level" for
triggering the requirements of the Private Applicator Ordinance, the group settled on a definition
of "broadcast" application, rather than spot application. It was the consensus of the group that
trying to narrow down the threshold to "cubic area," "square foot area," or "gallonags" carried with
it mors problems than it solved. It is therefore the group's recommendation to regulate broadcast
application, as opposed to "spot" application of targeted plants.
This means that if you were to apply "weed and feed," for example I to your entire back yard, your
activitiss would fall under the Private Applicator Ordinance. In contrast, spraying ons or two
dandelions with a hand sprayer would not likely trigger the ordinance.
4. City Provides Sions for Uniformity, The group recommends ths City provide these
notification signs, at a small fee to cover the cost of the sign. Ths signs can be distributed by the
City, or could be placed for sale at other convenient outiets, For property under two acres, we
recommsnd standard size paper of 8%" x 11 ". This sign would bs easier to read from a distance
than the prsvious 6" x 8" signs. For tracts two acres or more, we recommend the size of a
standard real estats sign. Both would have black, block Istters on fluorescent pink background,
with a logo banning entry to the property.
5, Ordinance On Iv Covers Outdoor Application, The dsfinition of "pssticldes," taken directiy
from state law, covers broadcast application of Insecticides. Tho group wants to point out that
this Private Applicator Ordinance is designed to control outdoor envlronments, not the interiors
of buildings or structures, Thus, application of pesticides to the outsids or foundation of a house
or building would be covered by this Private Applicator Ordinance.
6. One Notification Slqn Serves Both Advancs and Post-Appfication Purposes, The group
recommendsd streamlining the slgnage, and to simply uss one sign-for both advance and post-
notification purposes, This will eliminate cost, confusion, and also eliminate wondering whether
ths private applicator has the "right sign," Sines one notification sign will be used, it wllllncluds
the dats of application, will be placed 24 hours In advance, and will bs removed 24 hours after
application.
7, Water Source Restriction Chanqed, Since many homes in Iowa City back up to creeks,
ths group recommends that pesticide application be restricted to no closer than top of bank (as
opposed to 30 feet), No one could come up with a source to justify the "no closer than 30 feet"
requirement, so we agreed to drop It.
8, Wind Spesd Clarllled, In taking State of Iowa certification tests In order for City Forestry
staff to be able to use pesticides, ths State guidelines provide that application at wind speeds Is
preferred at less than 5 mph, but Is not to be undertaken at wind speeds greater than 10
mph. This state guidance Is now Incorporated Into the ordinance,
9, ~. The group rscommends farms be exempted, since the thrust of this Private
Applicator Ordinance Is to educats and regulats the urban applicator,
10, Loqo, The universally accepted logo of "banning a pedestrian" comes as close to an
appropriate logo as we could find, The group did not recommend skull and crossbones because
inappropriate, There are no "universally accepted" signs specific to caution against entry onto

11, Name of Applicator. The law school draft Initially Included the private applicator's name
or business name on the notification sign, togsther with street address and telephone numbsr,
The staff group recommended against this, in order to avoid unnecsssary privacy concerns and
"nsighborhood wars,"
12, Pesticide Delinition. The definition of pesticides remains the same as the former version
of the commercial ordinance, This means, for both the private and commercial applicator, that
garden and lawn care products which have, for example, wsed killers In them are covered In this
private applicator ordinance. However, the products ordinarily used to enrich the soil are not
covered under state law, or under this ordinance - becauss they are organic 'plant growth
regulators." These organic maUers exempt from this ordinance Include: _ compost -peat _
manure - bone meal- blood meal- ash - epsom salts - topsoil - 8-12 growth stimulator -nitrogen _
miracle grow,
B. Commercial ApPlicator Draft Ordinance
1, Scope and Purpose, This language has been tlghtensd with regard to health and safety
concerns, Also, we have added languags to stress that this ordlnancs Is intended to educate
citizens of Iowa City, Iowa on the safe use of pesticides,
2, Definitions, The definitions remain basically unchanged, with the exception of "water
source" already explained above In the private applicator ordinance, I did add a definition for
"application;" since in rsadlng through the ordinance drafts I all the language ussd "application of
pesticides" as the "jumping off point," but we had not yet dsfinsd It,

4, Contract reoulremsnts, We have streamlined the contract provlslons, and deletsd the
limitation of a contract to one year, Ws received numerous objections to this restriction, Since
the point of this ordinance Is to educats and this can be accomplished with ths revlssd contract
requirements and disclosure statemsnt, ths group bslleves additional regulation of the contract
goes beyond the Council's Intsnt.
5, Commercial Reaistrv, This section was deleted as serving no partiCUlar purpose because
duplicative of state law, State law already has stringent licensing, certification and regulation
requirements for commercial applicators, Iowa City citizens already have the right to contact the
Iowa Department of Natural Resources (DNR), and determine all licensed, certified and/or
registered commsrclal applicators In the state or In this area, The phone number for obtaining
such Information Is (515)
It was also the staff group's concern that ws wsrs adding another layer of rsgulatlon, without
obtaining any bsnefit from the local commsrclal registry - sspeclally since "listing of persons to
be notified" Is deleted, More Importanlly, the commercial registry would have required additional
staff time and additional money for both the City Clsrk and the commercial applicators, with 1I1l1e
public benefit.
6, Disclosure Statement. I have changed "readily available" with regard to the layperson's
description of pesllcide effects and dangers [to be provided by the commercial applicator to the
customer] to the language "reasonably available," This means that the disclosure statement will
require ths commercial applicator to make a reasonable work effort to prepare a layperson's
descrlpllon of the pesticides bslng ussd, and their ellects and possible dangers, If the
commercial applicator can do this with a reasonable amount of effort, the commercial applicator
will be required to do so, This Change lightens up the requlremsnt on the commercial applicator,

7, Disclosure StatemenWJarninq. Since there is so little consensus ;n the community,
indeed in the nation, as to the ssverity of the "adverse effects" of pesticide uss, I have delsted
the statement on "results of various studies" contained in the University of Iowa Law School's
drafts. I am simply not comfortable, at this juncture, with recommending to the City Councti that
we adopt a legislative fact, or adopt a specitic, detailed statement, where there Is iack of
consensus on the subjsct.
Moreovsr, the staff group agrees the "empirical data" Is stili subject to much dsbate, Since it was
the group's charge to draft an ordinance to educate citizens and avoid mistaken applications, we
believe the present commercial ordinance does that, without engaging in unending debate.
8. Door Slons. This section was deleted as duplicativs and "overkill" in light of the 24-hour,

SECTION I. The Code of Ordinances of the City of Iowa City, Iowa is hereby amended by
adopting the following:
Section 34-88 Scope and Purpose
a, Scope
This ordinance, to be known as the "Iowa City Private Application of Pesticides
Ordlnance," is intended to assist in educating the citizenry of Iowa City, Iowa on the safe
application of pesticldss, as well as to regulate private application of pesticides, which
pesticides are controlled by the State of Iowa Land Stewardship provisions, This
ordinance regulates application of psstlcldes to vegetation of any sort within the City
limits, except that property owned by the State of Iowa,
b, Purpose
The City Council for the City of Iowa City finds that In order to protect the health, safety
and welfare of the citizens of Iowa City, Iowa, the City Council hereby adopts this
ordinance concerning private application of pesticides to outdoor vegetation, In light of
the Clly Council's purpose and scope herein, the City Council makes the following
legislative findings of fact:

1, Exposure to pssticldes registered with the Iowa Dspartment of Agriculture and
Stewardship for use on vegetation within the City of Iowa City, Iowa may result in
adverse effects to human and animal life and health, and to the overall health and
safety of the outdoor envlronmsnt.
2. Pesticides used on vegetation may adversely affect the quality of Iowa City's drinking
water,
3. Advance and post-application notice of the application of pesticides can reduce the
risk of direct exposure to those chemicals, and thereby assist In reducing the risk of
adverse effects from such chemicals.

4. Wind may cause pesticides to drift to neighboring property or into the local water
supply, which condition should reasonably be avoided In order to protect the safety,
heallh and welfare of the citizens of Iowa City.

5, Iowa state law permits a city to exercise any powers or perform any functions under
home rule which the city deems necessary, In order to protect the safety, health and
welfare of Its citizens; and said home rule extends to the exercise of powers also
undertaken by the State where, as here, not pre-empted by State law,
6. Iowa law encourages cities to protect local groundwater supplies with laws that are
more stringent that state law, so long as local law Is not inconsistent with state law.
Section 34-89 Definlllons
a. "Property" shall mean any lot, lots, tract or parcel of land within the jurisdlctionalllmlls of
the City of Iowa City I Iowa,
b. "Pesticide" shall mean any substance or mixture of substances that must be reglstsred with
the Iowa Department of Agriculture and Land Stewardship under Chapter 206, Code of
Iowa (1991) and which Is (a) intended for preventing, destroying, repelling, or mitigating

directly or indirectly any Insects, rodents, nematodes, fungi, weeds and other forms of
plant or animal life or viruses, except viruses on or In living persons, which the Secretary
of Agriculture shall declare to be a pest, or (b) Intended for use as a plant growth
regulator, defoliant, or desiccant. [See, 206,2(1), Code of Iowa (1991)], "Pesticide" shall
Include insecticide, nematicide, funglclde, herbiclde, plant growth regulator and defoliant.
c. "Plant growth regulator" means any substance or mixture of substances intended, through
physiological action, for accelerating or retarding the rate of growth or rate of maturation
or for otherwise altering the bshavlor of ornamental or crops plants or the produce
thereof, but shall not include substances to the extent that they are intended as plant
nutrients, trace elements, nutritional chemicals, plant Inoculants, and soli amendments.
[Sec. 206.2(3), Code of Iowa (1991)J,
d, "Defoliant" shall mean any substance or mixture of substances Intended to cause leaves
or foliage to drop from a plant.
e. "Desiccant" shall mean any substance or mixture of substances Intended to artificially
accelerate the drying of plant tissue,
f. "Private applicator" shall mean any person, entity or governmental subdivision who applies
or causes another to apply an appllcallon of pesticides In an outdoor environment, or
who causes the emission of a pesllclde Into the outdoor environment, whether said
application or emission is by spraying, mlsllng, fogging, dusting I dragging, spreading or
othsr means.
g, "Applications" Include all outdoor broadcast application of pesticides to any propsrty as
herein deflned, and Is not intended to govern spot appllcallons,
h. "Farm" shall have the same meaning as that set forth In the Iowa City Zoning Ordinance,
Chapter 36, Iowa City Code of Ordinances.

I. 'Water source" shall mean any discernible open body of water, including but not limited
to ponds, streams, creeks, rivers, reservoirs, lakes and wells.
Section 34,90 Notice to Public: Pre- and post- application slqns
A. Notification Sign Requirements for Property Less Than Two Acres
The following provisions of'thls Section A shall apply to all applications by private
applicators to property which is less than two (2) acres.
1, Notification Siqns
a, Private applicators shall obtain from the City [or other deSignated source]
notification signs, which signs shall be of a material that Is rain-resistant for at
least forty-eight (48) hours, which shall be the size of a standard lelterof 8.5" x
11", and which shall bs known as "notification signs," Said notification signs
shall have black, block lelters at least 3/8" In helght, on a fluorescent pink
background,
b, Notification signs shall provide the date of expected appticatlon of pesticides on
the property, and shall ssrve to give the public advance, 24.hour notice of
application; and shall further serve to give post.appllcation notice to the public,
for at least 24 hours aller application,
c, Notification signs shall Include, at a minimum, the words: "This property
chemically treated with pesticides on
date." At the center of
the sign shall be a visual, universally recognized logo at least four (4) Inches In
diameter, showing entrance onto the treated property Is banned,

2. Advance Notice Requirements
a. At least twenty-four (24) hours prior to application of pesticides on the property,
the private applicator shall place the notification signs on the property to be
treated, thereby informing the public of said application.
b. The private applicator shall placs the nolification signs, in advance, along the
front and rear peripheries of the property to be treated, at Intervals no greater
than fifty (50) feet, and no further than two (2) feet Inside the property line or
sidewalk, The signs shall project at least twelve (12) Inches above the grassllne.
c. If application of pesticides is delayed due to changes in weather or other
reason, the private applicator shall Insure that the signs are changed to reflect
the changed date on which the application Is to occur.
3, Post-aoolication Notice ReQuirements
a. After applying pesticides to the property, a private applicator shall leave the
notification signs in place, which signs Inform the public that pesticides have
been applied to the property. The signs shall remain on the property for at least
twenty.four (24) hours after application of pesticides, and shall remain In the
same spacing Intervals as noted herein, Section 2(b),
b. The private applicator shall rsmovs the notification signs twenty.four (24) hours
after application of pesticides, and the private applicator must remove said
notification signs no later than seventy-two (72) hours atler application,
S. Notification signa - Property Two Acres or Larger
The following provisions of this Section S shall apply to all applications by private
applicators to property which Is two (2) acres or greater.

Section 34.91 Restricllon of Pesticide Application
a, Applications of psstlclde Is preferred at wind speeds no greater than 5 miles per hour, but
In no event shall a private applicator apply pesticides outdoors when the wind speed Is
greater than ten (10) miles per hour,
b, No private applicator shall apply pesticides wllhln or Into a water source; however, If the
water source has defined banks, application shall In no event be closer to the water
source than top of bank,
Section 34.92 Waivers and Exsmptlons to Notice ReQulrsmenls
a, The requirements of Section 34.90 on notification signs and 34,91 on restriction of
pesticides appllcallon may be waived If the City determines, to a reasonable certalnly, that

pesticides must be applied to prevent a life-threatening situatlon, to prevent serious
physical injury to persons, or to prevent substantial and male rial injury to property,
b. The City may exempt a private epplicator from the notice requirements of Section 34-90
if the property is so Isolated that public access Is restricted, other than residents of the
property, and where there is no substantial risk of wind or water drift of pesticldss to
properties other than the private applicator's own property, In event of exemption, the City
Forester shall maintain a written record of said exemption, on 'file in City code
enforcement records.
c. Farms are exempt from the provisions of this ordinance.
Ssction 34.93 Penalties
Violation of this ordinance shall be deemsd a simple misdemeanor, a municipal infraction and
an envlronmentallnfracllon, Said enforcement provisions shall be deemed cumulative in
nature, and the City's election of one enforcement provision shall not preclude the City from
pursuing another,
SECTION III. REPEALER, All ordinances or parts of ordinances In conflict with the provisions
of this Ordinance are hereby repealed,
SECTION IV, SEVERABILITY, II any of the provisions of this Ordinance are for any reason
declared illegal or void, then the lawful provisions of this Ordinance are deemed severable and
shall remain in full force and effect.

psrson or corporation, licensed in ths State of Iowa as a commsrcial applicator to
engage in the business of applying pesticides to the property of another, whethsr by
spraying, misting, fogging, dusting, dragging, spreading or other means, for monstary
compensetion undsr Chapter 206, Cads of Iowa (1991) and Sections 206-21-45,lowa
Administrative Code (1992),

3, A description or diagram of the property to be treated, such as a plat showing the
lot or metes and bounds description, together with a diagram of all water sources
locatod on the customer's property, and including any water sources tsn (10) feet
outside ths customer's propsrty,
4. A schedule stating the sstimated datss on which the commercial applicator will
apply pssticides to the customer's property during the contract.
5, The commercial applicator's assurance that ths commercial applicator will provide
at Isast twenty-four (24) hours oral or written notice to the customer prior to each
pesticids application,
6. A provision stating whethsr it shall bs the customsr's or the commercial
applicator's responsibility to place notification signs on the customer's property
twenty-four (24) hours in advancs of application,
7, A copy of ths disclosure statement rsquired in Section 34.80 hersin,
8. A provision stating it is understood that at any time prior to ths application of
pesticides, the Customer may request the commercial applicator not apply any

9, The contract will be updated in the event the commercial applicator plans to apply
new or additional pesticides, at least twenty-four (24) hours prior to the additional

10, The commercial applicator shall provide updated health, safety or snvironmsntal
information about any pssticidss being used on Customer's property, shall do so
within a rsasonable time aftsr such information becomes available, and shall do
so before the nsxt application,
11. The contract required by this section may be entered into as a separate
agreement, or as part of any other agresment ordinarily used by the commercial
applicator,

a, The commsrcial applicator must provide a public disclosure statement with each
contract under Section 34-79 above,
b. The public disclosure statement shall contain the following:
1. A list of the trade name(s) of each pesticide which the commercial applicator
intends to apply to the Customer's property, and the vegetation problem(s) being
targetsd,
2, A copy of the label for sach pesticide Iistsd in paragraph 1 abovs, and a
layperson's description of the effscts of the Pesticides, if rsasonably available,
3, A description of the potential hsalth and environmental effects of each of ths
pesticides used, and information about the msdical treatment of health problsms
caused by exposure to sach pesticids.
4, A description of ths method of application to be ussd for sach pssticids Iistsd in
paragraph 1 above,

A, Notification Signs; Advance and Post-Application Notice Purposes
1. Notification Sicns
a. Commercial applicators shall provide each customsr with notification signs,
which signs shall be of a material that is rain-resistsnt for at least fOrly-eight
(48) hours, which shall be the size of a standard letter of 8,5" x 1''', and
which shall bs known as "notification signs." Said notification sigQs shall
have black, block letters at least 3/8" in height, on a fluorescent pink
background. All commercial applicators shall supply such notification signs
to the customsr in sufficisnt quantitiss to meet the requiremsnts of this
Section.
b, Notification signs shall provide the dats of expected application of pesticidss
on the property, and shall serve to give the public advance, 24-hour notice of
application; and shall furthsr serve to give post-application notice to the
public, for at Isast 24 hours after application,
c, Notification signs shall include, at a minimum, the words: "This property
chemically trsated with pesticidss on
date," Said signs
shall also inciuds the commercial applicator's nams or business nams, street

2, Advance Notice Reouirements
a, At least twsnty-four (24) hours prior to application of pesticides on the
propsrty, ths customer shall place or cause to be placed the notification signs
on the property to be treated, thereby informing ths public of said application,
b, The customer shall place or cause to be placsd the notification signs, in
advancs, along the front and rear periphsries of ths propsrty to be trsated, at
intervals no greater than fifty (50) fset, and no further than two (21 feet inside
the property line or sidewalk, Ths signs shall project at least twelve (12)
inches above the grassline.
c, If application of pesticides is dslayed due to changss in weather or othsr
reason, the customer shall insure that the signs are changsd to reflect the
changsd date on which the application is to occur,
3, Post-aoolication Notics Reauirements
a. After applying pesticides to the property, a commercial applicator shalllsavs
the notification signs in place, w~lich signs inform the public that pesticides
havs been applied to the property, The signs shall remain on the property for
at least twenty-four (24) hours after application of pssticides, and shall
remain in the same spacing intervals as noted hers in in Ssction 2(b).
b. The customer shall remove or cause to be removed the notification signs
twsnty-four (241 hours aftsr application of pesticides, and the customer must
remove said notification signs no later than seventy-two (72) hours after
application.

Section 34-82 Restriction of Pesticide Aoolication
a, 'Applications of pesticids is preferred at wind speeds no greater than 5 milss psr hour,
but in no event shall a commercial applicator apply pesticides outdoors whsn ths wind
spsed is greater than ten (10) miles per hour,
b, No commercial applicator shall apply pesticides within or into a water source; however,
if the water source has defined banks such as a cresk, application shali in no event be
closer to the water sourcs than ths top of bank,
Ssction 34-83 Waivers and Exsmotions to Notice Reouirsments
a, The requirements of Ssction 34-81 on notification signs, Section 34-82 on restrictions
and Section 34-79 on contracts may be waived if the City determines, to a reasonable
certainty, that pesticides must be applied to prevsnt a life-threatening situation, to
prevent serious physical injury to persons, or to prsvent substantial and material injury
to propsrty,
b, The City may exempt a customer from the notice requiremsnts of Section 34-81 for
owner-occupied property if the property is so isolated that public access is rsstricted,
othsr than rssidents of the property, and whsre there is no substantial risk of wind or '
water drift of pssticidss to propsrties other than the customsr's own property, In event
of sxemption, the City Forester shall maintain a written record of said exemption, on
file in City cods enforcsment records, This exemption shall not be available to
propertiss being leased, or to property whsre tsnants reside,
Section 34-84 Penalties
Violation of this ordinancs shall be deemed a simple misdemeanor, a municipal infraction
and an snvironmsntal infraction, Said enforcement provisions shall be deemed cumulative

declared illegal or void, then the lawful provisions of this Ordinance are deemed severabls and
shall remain in full force and effect.
SECTION V. EFFECTIVE DATE, This Ordinancs shall be in full fares and effect from and after
its final passags, approval and publication, as provided by law,

You will recall ws received a federal grant to pursus purchases of singls-family homes in our
community, We brisfed you on this issue a few wseks ago in executive session, We
currently have psnding three purchase agrsements. Unfortunately, the HUD offices have
taken an extraordinary amount of time to review all of our documentation. For sxample, we
have a title opinion on a particular piece of property; however, under HUD regulations they
must also do their own titls opinion, and so it goes with respect to their regulations. In the
meantims, the property owners ars awaiting closing on thsir former homss,' and in most
instances have purchased new homes. In order to expedits this process so that our local
citizenry are not punished due to HUD delays, I have authorizsd our Dspartment of HIS and
Financs Departmsnt to pursue closure through the use of our reserve funds, This should be
a vsry temporary bridge bstween the recsipt of ths fedsral monies and the closure on the
property, The risk ws have sslected to take would be that if ths federal government for any
reason would chooss to back out of this program, ws would own the homes, Our assessment
of the risk is that it is worth taking and that we would have the value in ths home purchassd
as an asset. At the very Isast we could again turn around and sell the propsrty and recover
our funds,
I have attemptsd to provids you a brief ovsrvlew of a vsry complex fedsral program and the
City's involvement. It doss appear to be in the community's best interest, particularly the
property owners whose homes ws have agrsed to purchase, to pursue this matter in this
fashion,

My wife and I own property on Valley Ave. and we both oppose
the removal of street parking on the East side of Valley.
Street park ing was elim inated ea rlier th is summer from Newton
Road and now to completely eliminate parking on Valley would just
about do away with ,street parking anywhere in the neighborhood.
Private lots would have people at their mercy.
l~e feel most of the traffic problems on Valley could be eliminated
with better traffic control markings and police enforcements of those
controls. Presently vehicles parking on either side of the alley ,
running between Valley and Lincoln extend out into the alley right
of way. This makes it e1\tremely difficult for vehiclSl to e1\it from
the (1] ley onto Valley. I\lso the No Parkinl! From Ilere To Corner sign
at the intersection of Newton anel Villlny is ignored thus creating a
traffic ha7.ard at this intersecti.on. YellOl~ painted curbs and signs
posted that violators vehicles woulil be to\~ec1 away shoulc1 be installed
and then enforced.
The a lley that extenc1s both East anil West from Valley is used as a
street. Stan signs should be installer] where both sections of the
alley intersects wi th Valley. Thl! alley between Valley and LinCOln
is only 12 Ft. wide, but it is a rare occasion when I fail to not
see an illegallv narked vehicle in this allev. Vehicles found

they are creating a traffic hazard.
LinCOln Ave. is restrictec1 to parking only on the East side of the
street. Since the construction of the three new apartment buildings
on the street, often vehicles are pllrked in the No Parking zone on the
West side of the street. But the biggest joke is the posting of the
No "';,rkinl! sir,ns on the burden,]" ill. the Norl:h onrl of r,incoln lIVe.

The Iowa City Water Division recently completed the first phase of
a water testing program for lead and copper in the drinking water.
The results are in and our community's water passed the test.
The Environmental Protection Agency and Iowa Department of Natural
Resources has identified lead in drinking water supplies as a
health priority. All public water supplies are required to sample
water at a target group of consumer's taps to measure the lead and
coppe r content.
The Water Division contacted over 60 individual home owners to
participate in the sampling program. The first phase is complete
and we passed. The program consists of two sampling phases. The
next phase which will be complete by Jan 1, 1993, consists of re-
sampling the individual homes.
We want to acknowledge and commend those consumers who participated
in this program. It was a unique program that required an
extraordi nary effort on thei r part to coord i nate wi th the Water
Division.
The Water Di vi s i o~ ,has conducted routine samp ling for lead at the
water plant conducted a more extensive residential sampl ing program
in 1988. The lead content of all the samples was at a safe level.
The current 'action level(s)' for lead and copper are 0.015 parts
per million and 1.3 parts per million, respectively.
Enclosed are two pamphlets that outl ine that issue of lead in
drinking water and the environment. The Iowa City Water Division
is pleased to announce the successful efforts we are taking to
provide safe drinking water.
As new drinking water standards continue to change we are committed
to cont i nui ng efforts necessary to prov i de safe dri nk i ng water.

Once again the University is sponsoring a rock concert
on University property.
Last year the Iowa City Police Department could not
(or would not) do anything to quiet down the LOUD NOISE
from the concert since it was University sponsored and
on University porperty. This noise continued until
well into the night.
Is the University subject to the same city ordinances
as other citizens of Iowa City or are they selective
on to what they will consider following?
Is it necessary for the good citizens of Iowa City to
be subjected to this type of irresponsible behavior
f~om the University since we have this noise ordinance
already written and in force?
Why can't this concert either be cancelled or put into
a building (or out of town) so that the music (noise)
can be controlled?
