(1) CONSIDER A MOTION SETTING A PUBLIC HEARING FOR JULY 2 REGARDING AMENDMENTS TO THE FY02 AND FY03 ANNUAL ACTION PLAN BUDGETS, THAT ARE SUB-PARTS OF IOWA CITY'S 2001-2006 CONSOLIDATED PLAN {CITY STEPS) AS AMENDED, AUTHORIZING THE CITY MANAGER TO SUBMIT SAID AMENDMENTS AND ALL NECESSARY DOCUMENTS TO THE U.S. DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT, AND DESIGNATING THE CITY MANAGER AS THE AUTHORIZED CHIEF EXECUTIVE OFFICER FOR THE CONSOLIDATED PLAN. Comment: At their May 16 and May 29 meetings, the Housing and Community Development Commission made recommendations to the Council that would change the allocation of FY02 and FY03 Community Development Block Grant and HOME Investment Partnership program funds. A public hearing is required by the U.S. Department of Housing and Urban Development. A memorandum showing the proposed budget amendments will be included in the July 2 Council packet. June 11, 2002 City of Iowa City Parle 3 (2) CONSIDER A MOTION SETrING A PUBLIC HEARING FOR JULY 2 ON ORDINANCES ADOPTING THE 2000 EDITIONS OF THE INTERNATIONAL BUILDING CODE, INTERNATIONAL FIRE CODE, UNIFORM PLUMBING CODE, INTERNATIONAL MECHANICAL CODE, AMENDING CONTRACTOR LICENSING REQUIREMENTS, AND AMENDING THE APPEALS SECTIONS OF THE CODES. Comment: A public hearing is required when adopting a nationally- recognized standard code or portions of such a code. The Board of Appeals is recommending adopting such Codes as amended, as well as the Licensing and Appeals amendments. The Licensing amendment will require licensing of fire alarm and fire sprinkler installation contractors. e. Resolutions. o,~ - ~oo (1) CONSIDER A RESOLUTION APPROVING AN AMENDMENT TO THE PROCEDURAL RULES OF THE IOWA CITY BOARD OF ADJUSTMENT. Comment: The Board of Adjustment unanimously approved the amendment at their meeting on April 9, 2002. The Rules Committee has reviewed the proposed amendment and also recommends adoption (see minutes included on this agenda). ~- ,Jol (2) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST A LICENSE AGREEMENT FOR THE TEMPORARY USE OF PUBLIC RIGHT- OF-WAY BETWEEN THE CITY OF IOWA CITY, DEAN OAKES, AND KLDP, INC., D/B/A ONE TWENTY SlX FOR A SIDEWALK CAFI~. Comment: Dean Oakes, as landowner, and KLDP, Inc., d/b/a One Twenty Six, seek a renewal of a license agreement for temporary use of public right-of-way at 126 E. Washington St., Iowa City, Iowa for a sidewalk caf6. City staff and Design Review have reviewed the plans and specifications and required submittals and recommend approval of said agreement. , c,~ ~o,~ (3) CONSIDER A RESOLUTION NAMING DEPOSITORIES. Comment: Change the name of a depository and the location listings of the home and local offices for this depository. In August 2001 Firstar Bank, N.A. and U.S. Bank National Association merged. This name change was effective April 1, 2002, at our local institution. The home office location for U.S. Bank N.A. is Minneapolis, Minnesota and our local bank is in Iowa City, Iowa. June 11, 2002 City of Iowa Cit~, Parle 4 ~- ~o5 (4) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST TO THE RELEASE OF LIEN REGARDING A PROMISSORY NOTE AND A MORTGAGE FOR THE PROPERTY LOCATED AT 15 NORTH LUCAS STREET, IOWA CITY, IOWA. Comment: The owner of the property located at 15 North Lucas Street received assistance through the City's Housing Rehabilitation Program totaling $282. The financing was in the form of a conditional occupancy loan. The loan has been paid off; thus the lien can now be released. ,~.o~- (5) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST TO THE RELEASE OF LIEN REGARDING A MORTGAGE FOR THE PROPERTY LOCATED AT 1702 CALIFORNIA AVENUE, IOWA CITY, IOWA. On March 10, 1998, the Council passed Resolution No. 98-80 to convey a single family home at 1702 California Avenue to a qualified Iow-income family through the Tenant-to-Ownership Program. The City loaned the buyers $22,180, which was secured by a mortgage. The family is now moving and sold the house to another income eligible family. The buyers have paid the City the full amount due on the loan, and the City needs to release the mortgage as a result. The buyers also signed a Resale Agreement, and because they have complied with the requirements of said agreement, the City needs to release them from it as well. -- ,~o 5 (6) CONSIDER A RESOLUTION ACCEPTING THE WORK FOR THE LONGFELLOW/TWAIN PEDESTRIAN TUNNEL PROJECT. June 11, 2002 Cit}/of Iowa Cit~/ Parle 5 o$-~o~/ (8) CONSIDER A RESOLUTION AMENDING THE FY2003-2006 CAPITAL IMPROVEMENT PROJECT PLAN TO PROVIDE FINANCING FOR THE PENINSULA AFFORDABLE HOUSING PROJECT. Comment: The Peninsula Affordable Housing Project is a joint project between the Greater Iowa City Housing Fellowship (GICHF) and the Iowa City Housing Authority (ICHA). The GICHF will act as the project developer for 16 affordable housing units. When complete, the GICHF will transfer ownership on a 9-unit multi-family building to the ICHA. The permanent financing for this project is a combination of resources (state home grant) of $759,190, City HOME loan of $623,467, ICHA equity of $171,202 and General Obligation (GO) bond financing of $656,000. The GO bond will be repaid through the cash flow of the project and not through the City General Fund. To access the State of Iowa HOME Grant funds the Iowa Department of Economic Development is requiring a resolution from the City regarding the GO bond funding. f. Correspondence. [UNTIL 8 PM] Public Discussion will be continued, if necessary, prior to "City Council Information" item. ITEM NO. 5. PLANNING AND ZONING MATTERS. a. Consider a motion setting a public hearing for July 2 on an ordinance changing the zoning designation from Neighborhood Conservation, RNC-20, to Sensitive Areas Overlay-Neighborhood Conservation, OSA/RNC-20 for 0.41 acres of property located at 341 North Riverside Drive. (REZ02-00004) Comment: In a letter to the City Council dated May 9, the applicant requested expedited consideration. It is anticipated the Planning and Zoning Commission will make a recommendation on this item at either their June 6 or June 20 meeting. b. A public hearing on an ordinance amending the Sensitive Areas Ordinance to regulate isolated wetlands. Comment: At its May 2 meeting, by a vote of 7-0, the Planning and Zoning Commission recommended approval of the proposed amendments. If approved, the Sensitive Areas Ordinance as amended would regulate isolated wetlands in a manner consistent with regulation before the decision of the U.S. Supreme Court in Solid Waste Agency of Northern Cook County v. U.S. Army Corps of Engineers in January 2001. Correspondence and staff response included in Council packet. ,~_f~_.¢__.~ ~ c. A public hearing on an ordinance changing the zoning designation from Low Density Multi-Family Residential, RM-12, to Sensitive Areas Overlay-Low Density Multi-Family Residential, SAO-RM-12, for Lot 2 of First and Rochester subdivision, Part 1, a 38,041 square-foot property located west of First Avenue, north of Rochester Street. (REZ02-00003) Comment: At its May 2 meeting, by a vote of 6-0, the Planning and Zoning Commission recommended approval of the proposed rezoning. Staff recommended approval on April 18. Approval will allow the construction of a 12-unit multifamily building on this property that contains steep and critical slopes. June 11, 2002 City of Iowa Cit~/ Parle 7 d. Consider an ordinance to amend Section 14-6K-2 of the Zoning Ordinance, Floodplain Management, in order to remove the requirement for fill beyond the area of a structure, update various definitions and references, and to acknowledge the new Flood Insurance Rate Map (FIRM). (Second Consideration) Comment: These amendments will remove the requirement that yard areas surrounding a structure be filled when construction occurs in the flood plain. These amendments will also update definitions to make them consistent with State and Federal regulations as well as make reference to the updated Flood Insurance Rate Map. At its April 4, 2002 meeting, by a vote of 7-0, the Planning and Zoning Commission recommended approval of these amendments. Staff recommended approval in a memorandum dated March 20, 2002. Action: ITEM NO. 6. PUBLIC HEARING ON RESOLUTION APPROVING A PURCHASE AGREEMENT WITH UNITED ACTION FOR YOUTH FOR CONDOMINIUM UNIT 1-C IN TOWER PLACE AND PARKING AND THE DISPOSITION OF SAID PROPERTY IN ACCORDANCE THEREWITH. Comment: Tower Place and Parking includes commercial space which has been marketed for sale to the general public. The City has negotiated a real estate contract - installments with United Action for Youth which requires City Council approval. The purchase agreement is included in the Council packet. Action: ACQUISITION OF PROPERTY RIGHTS FOR THE D~IE RO.aO SANITARY SEWER PROJECT. Comment: The City of Iowa City must acquire right-of-way, fee title, permanent easements and/or temporary construction easements to construct the Dane Rd. Sanitary Sewer Project. This public hearing provides interested parties the opportunity to present their views on the project and the proposed acquisition of property rights. The project includes construction of a sanitary sewer system to serve the south Mormon Trek Boulevard area and the development west of Highway 218. a. PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR CONSTRUCTION OF THE CITY OF IOWA CITY FIRE STATION 3 ADDITION AND RENOVATION PROJECT, ESTABLISHING AMOUNT OF BID SECURITY TO ACCOMPANY EACH BID, DIRECTING CITY CLERK TO PUBLISH ADVERTISEMENT FOR BIDS, AND FIXING TIME AND PLACE FOR RECEIPT OF BIDS. Comment: This project will involve expanding an outlying fire station located at 2001 Lower Muscatine Road. The expansion will contain shower and toilet facilities, a workout space, storage, and a dormitory. CONSIDER A RESOLUTION APPROVING Action: ITEM NO. 9. PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR CONSTRUCTION OF THE IOWA CITY LANDFILL FY02 CELL CONSTRUCTION PROJECT, ESTABLISHING AMOUNT OF BID SECURITY TO ACCOMPANY EACH BID, DIRECTING CITY CLERK TO PUBLISH ADVERTISEMENT FOR BIDS, AND FIXING TIME AND PLACE FOR RECEIPT OF BIDS. Comment: This project will include constructing an additional cell on the west half of the landfill. This new cell will be constructed in accordance with all federal and state regulations. A $300.00 CIVIL PENALTY AGAINST THE OLD MARKET PLACE, 1963 BROADWAY STREET, PURSUANT TO IOWA CODE SECTION 453A.22(2). Comment: This hearing is the time designated for the Council to consider whether a Resolution should be adopted assessing the $300.00 civil penalty authorized by Iowa Code section 453A.22(2) against The Old Market Place, 1963 Broadway Street. Section 453A.22(2) provides that, after a hearing, a $300.00 civil penalty will be assessed to a retail cigarette permit holder when and if that permit holder's employee is convicted of or pleads guilty to selling or providing tobacco to a minor. As a part of the hearing, the Council will be provided with information establishing an employee of permit holder The Old Market Place was convicted of or pled guilty to a charge of selling or providing tobacco to a minor. The permit holder's representative will then have the opportunity to provide the Council with information s/he deems appropriate. The Council will then decide whether to assess the requested civil penalty and, if it decides to do so, will adopt an appropriate Resolution. Comment: This hearing is the time designated for the Council to consider whether a Resolution should be adopted assessing the $300.00 civil penalty authorized by Iowa Code section 453A.22(2) against The Sanctuary Restaurant & Pub, 405 S. Gilbert Street. CONSIDER AN ORDINANCE AMENDING THE CITY CODE TITLE 10, "PUBLIC WAYS," CHAPTER 3, "COMMERCIAL USE OF SIDEWALKS," SECTION 3, "USE OF SIDEWALK CAFES" TO ALLOW SIDEWALK CAFES TO OPERATE UNTIL 12:00 MIDNIGHT. (SECOND CONSIDERATION) Comment: Currently sidewalk cafes that possess a liquor license must operate between the hours of 7:00 AM and 10:00 PM, while sidewalk cafes that do not serve liquor operate from 7:00 AM to 12:00 midnight. At their work session of May 6, a majority of Council indicated a desire to expand the hours of operation for establishment possessing a liquor license to match those not serving. This ordinance would allow all sidewalk cafes to serve until 12:00 midnight, and provides a sunset clause for the ordinance to be reviewed in December 2003.
