Dear Mayor McDonald:
On June 20, 1991, the Department of Economic Development awarded to
the city of Iowa city and Procter & Gamble Manufacturing Company a
CEBA forgivable loan in the amount of $250,000. It is our
understanding based on the company's letter of October 5, 1992,
that Procter & Gamble has indefinitely postponed the CEBA project
and, therefore, have decided to relinquish the CEBA award. As a
result, the Department has withdrawn the $250,000 CEBA award so
that the funds can be utilized in other Department projects.
The Department wishes to emphasize that this action does not impact
adversely on the city or the Business in any way, nor does it
preclude any future CEBA applications the city or the Business may
wish to submit.
We do appreciate the importance of this project to both the city of
Iowa city and the state of Iowa and the efforts that have been made
to accomplish the City's and the Business' goals.

Or to whoever this letter may concern. Every time I get my bill
from the city of Iowa City - I get a little more irate. I tried
the curbside recycling only to find half of what I had put out
for some reason they couldn't pick up and left in laying out
of the container With an attached note. Then I went in and
reread the green recycling literature they had proVided, and
found part of it was my fault for not reading the directions
correctly.
My bitch is: after going to Sears and spending money for a
recycling container - all hepped up to do my civic duty and
cooperate, if on Saturday I need to make a trip to the
recycling place where they provide bins for tin cans, cardboard,
paper, plastic, etc., then I may as well take the whole lot
to the very handy one-place disposal.
I then resent being charged $4.50 on my bill for recycling
services that I never use. Times are hard - $4.50 to me can be
spent in a more profitable way - one that will give me something
for the money spent. I called the City of Iowa City and was
told that it was a mandatory charge - and if I were to complain
I should complain to the City Council.
For those that the recycling charge is a Viable way to dispose
of their clutter - fine - but for those of us that find alternatives
a better way should be able to do so without being charged a
fee for something we never use. Lets face it the curbside
service can't be too successful. As I drive down Prairie Du Chein
I have yet to see a recycling container on the curb on our garbage
day.
I would hope this letter would reach an individual with some
knowledge of the problem and that I can expect to hear from
somebody.

Dear City Counoil Members,
I watohed the City Counoil meeting on TV and deoided to write
you about my thoughts conoerning the Pesticide Ordiances.
I found it hard to believe that the lawn care oompanies and
applioatore would carryon like they did. Everyone knows and
has known for years that pesti,oides are dangerous. I felt
insulted that they aotually thought the publio was that stupid.
Insulted that they oarried on about the inconvience of prior
notifioation and the oost of larger signs...also all that balony
about unneoessary regulations and eduoation...surprised they
did not suggest a task force to study the problem and in many
years report baok.
It is oommon knowledge that pestioides are not good for humans,
animals, drinking water. We all know this and we all know the
fewer pesticidee used-the better.
I believe it is only oommon sense to have larger signs and bright
oolored ones...at the beggining of the property line and at the
end of it...plus 24 hr before and after notification. This way
will at least help those of us who want no oontaot with any form
of pestioides,.
The Press Citizen headline of "LAWN CARE v. HEALTH~...... said
it all. I prefer HEALTH and urge all of you to pass the proposed
ordianoes.

Dear Ms. Law:
This letter is to respond to your concerns re9arding "trick or treating"
on Halloween which happens to fall on Saturday this year. As you know,
it has been the City's practice during the past years to allow trick or
treating on Halloween during designated hours. However, the Parks and
Recreation Director and the Police Chief confer, and they also coordinate
the time with the City of Coralville before the recommendation is made to
the City Council.
I spoke with the Police Chief who informed me that having trick or treating
on Saturday this year should pose no out-of-the-ordinary problems. The
football game starts early in the afternoon and most people will have left
Iowa City by dusk. Most of the problems encountered by celebrating in the
downtown area will be later in the evening after the designated hours for
trick or treatin9. He added that Friday evening would be the time when
most officers will be busy with pre-football game celebrations and with
the added traffic caused by people coming into Iowa City for the game.

Dear Ms. Novick:
I am writing to support the proposed Iowa City air quality
ordinance, which would hold the city air quality standard or
raise it, as discussed in conjunction with the passage of the
grain milling ordinance. I missed the first reading due to
'vacation but I understand there is an issue as to who should
monitor the readings. Generally we de not find many human beings
so ethioal as to turn themselves in for infractions, and I think
it is imperative that the readings be monitored by some outside
source.
In the discussion of good and bad odors, please do not lose touch
with the reality that any odor represents particulate matter in
the air. The number of asthma cases in the United States has
risen 70% in the past ten years, and the national death asthma
rate has risen 30% since 1980, especially among children. While
air pollution is only one factor in this, air quality is
something over which we have some local control. Thus I urge you
to require that air quality in Iowa City is stringently
monitored, with fines that cannot be written offas a minor
expense in doing business,
While I am not personally bothered by lawn chemicals, I also
think our neighbors who are allergic to them need an opportunity
to be notified that an area they frequent has been or will be
sprayed,
For many of us, the quality of our air is more than an aesthetic
issue,

ACTION:
Pursuant to Section 23.30 of the Municipal Code of Iowa City, the City Traffic Engineer will direct
, the Installation of protected left turn signal indications for north. and southbound traffic on Mormon
Trek Blvd. at its Intersection with Melrose Avenue. This acllon will take place after October 28,
1992.
COMMENT:
This action Is being taken In recognition of the Increased amount of traffic generally using the
Intersecllon of Mormon Trek and Melrose Avenue. In particular, the amount of left turning traffic
when compared to the conflicting through traffic for both north. and southbound vehicles In the
Intersecllon has now reached a magnitude at which It Is appropriate to provide a protected
signalized phase for that traffic movement. The necessary devices and materials will be
purchased from the Traffic Engineering Division's maintenance budget.

Night, September 29th and although I attended as an observer, I had
to comment.

1. There was true hate in the room. You, as a Counoil
Member, have a difficult task trying to compromise with people who
come hating each other. This to too bad.
2. II great deal of misinformation from both sides was given
in regard to vocabulary, data presented, and oonclusions drawn.
People can and should have opinions, but neither side of an issue"
should exaggerate or misuse the faots.
3. I saw very little "ProActive" disoussion. The Ordinanc'~
cOlltains very little "ProActive" solutions to the problems at hand.
Y"u are probably saying "OK Wise Guy" give me some ProActive
suggestions! I will defer to my experience in Agrioulture and do
just that:
Where is the City Council's "Best Lawn of the Year Award" for:
1. No lawn clipping plan.
2. Les's oost to maintain.
3. Lowest water usage.
4. Best year around color.
5, Best use of IPM.

ordinances. I believc thatthcy scrvc most ofthc purposcs which tilCY werc intcnded to servc. I havc a
special intcrcst in thc ordinanccs because I 'VIote the original ordinance drafts as a student in the
University of Iowa Legal Clinic. I had intended not to be involvcd in the debate ovcr thc ordinances
because I thought that you IVould rcccive plcnty of commcnts and information from both proponents and
opponents of the ordinancc and I believed that I had made my contribution by writing the drafts and
accompanying memos. Howevcr, after reading the current proposed ordinances and listening to tile
comments at the public hearing last week I decided that I would like to make a few comments.
I encourage you to put back into the ordinance the restrictions on applying pesticides within a certain
distance of a water source. The current provisions, section 34-91 (b) of the private applicator ordinance
and section 34-82 (b) ofthe commercial applicator ordinance, only require that pesticides not be applied
to the top of a baak of a water source. While the restriction on application within 30 fect of a water
source, as written in the previous ordinance draft, may be an excessive distance, a study of runoff of
pesticides from grass covered surfaces supports a restriction on the application of pesticides within a lesser
distance from a water source. Michael Agnew, a horticultnrist with the Iowa State University Extension
Service informed me that a stndy by T.L. Watschke at the University of Indiana on runoff of pesticides
from grass surfaces demonstrates that the amount of runoff of pesticides from grass into adjacent watcr
sources depends on how dense the grass is. For example, there is minimnm nmolT from golf courses
where the turf is very dense. However, runolT from a less dense lawn is grcater.
Mr. Agnew suggested that the city only allow pesticides that arc mcant to be used near water to be
applied within 10 or 15 feet of a water source. The application of such pesticides wonld be pcrmittcd as
part of an intcgratcd pest management progmm (IPM). Mr. Agnew also stated that this restriction should
be applied to surfaccs adjaccnt to storm sewers. Pesticides may also enter storm sewers through sidewalks
which olTer no resistance to the movement of pesticides. The only difficulty with such a prohibition is that
while some pesticide labels indicate that the pesticide should not be used near water, those pesticides that
may be most suited for use nemwater arc not so labeled. 1l may, however, ~ possible using EPA
information to construct a list of pesticides with the qualities that make thcm most suited to use nc.1r watcr
and list those as the only pesticides thatthc city will allow to be applied within a certain distance of a
watcr supply.
A valid complaint which lawn carc company rcprcscutatives raised at the public hc.1ring on the
ordinanccs is that the privatc npplicator ordinance docs nothing to educate property owners or residcnts
about the herbicidcs or other pesticides which they apply to their property. To extend the educational
intent of the ordinancc to private applicators, the ordinaucc could require that merchants which sell
pesticides make available to their customers pamphlets on the proper application ofpesticidcs to minimize
the danger of causing pollution. The lown State Extension Service publishes a series of pamphlets on
usiug pesticides on lawus, These pamphlets arc available at the University Library Government
Documeuts sectiou. The EP A pamphlello which a number of lawu cme company representatives rcferrcd
at the public hcaring ma)' bc another means to inform privatc applicators. Mcrchants should also provide
private applicators with information about alternative non-pesticide methods of pest control.

city thcn you should atlcast scnd a mailing to all city rcsidcnts infonning thcm of thcir right undcr statc
law to be notified of pesticide application. Thc mailing should list thc namcs of all applicators operating
in Iowa City to whom thc statc law applics or, at thc vcry (cast. thc DNR number whcre they can call to
obtain that information (I believc that peoplc should be ablc to obtain thc namcs of applicators through
thc DNR's 800 number).
I cncouragc you to rctain thc largcr size notification signs and thc prc-notification requircmcnt. Thc
currcnt signs arc oftcn not casily visiblc from a distance and nmy not be easily undcrstood by childrcn.
Thc largcr signs would solvc both of tllCse problcms. Whilc thc prc-notification requircmcnt may be an
inconvcnicnce to thc applicator, it providcs a public hcalth bencfit by warning peoplc who may havc
rcason to stay clcnr of nn arca whcrc pesticidcs arc to be spraycd.
[ am conccrncd that thcrc is no provision for providing infonnntion to tcnants of a property whcrc
pesticidcs arc npplicd. (belicvc thnt whcn Pnul Papak and I mct with city officials wc decidcd that tcnant
information would be addrcssed in thc prcvious drnft tllfough thc city rcgistry of pesticidc npplicators
through which tcnants could obtnin infornmtion in thc snmc manncr as othcr city rcsidcnts. Since you
appem to havc decided not to crcntc n rcgistry [ believc it is importnnt to havc n mcans for tcnants to find
out about pesticidcs applied to thc property whcrc thcy Iivc. In thc casc oflandlords who usc thc scrviccs
of n commcrcial applicntor this could be accomplished by mnking a copy of thc disclosurc statcmcnt
avnilablc to tcnants. Landlords who apply pesticidcs privatcly should be rcquired to providc tcnants with
at lcast a statcmcnt contnining thc namcs ofthc pesticidcs npplicd to thc property as requircd at section
34.80 (b) (I) ofthc commcrcial applicntor ordinancc.

was to bring some perspective to the disctUsslons regarding what Is known and not kno~
about the public health risks of lawn chC!!lllica1 application,
In the months following that meet:dng, I have followed with Interest the public
debate in your area regarding tbls Importtant public health Issue. My concern now Is that
the debate has shifted from a discussion cof scientific and medical facts bearing on the
question of public health protectloD, to SFPeclal interest politics driven by pseudo
scientific rhetoric, The people of Iowa City will not be well.served if this or any other
policy decision Is based on rhetoric rathe:r than fact,
'-" I The following facts about lawn ClIIl'll chemical use and public health should not be
lost as your policy. makers move forward::
1. .MiSll.M of lawn care chemic:als continues to be the major publlc health
concern in this area. Publilt exposure to these chemicals is dependent on
the skill and integrity of thlllSe applying them. Ucenslng requirements,
ongoing training of appllcanors, and regulatory monitoring are the most
efficient and proven successful approaches to minimizing potential
exposure and subsequent pulbllc health risk associated with these practices.
Fully supported programs lIlIong these lines should be a top priority.
Proper use of lawn care ch1emlcals has not been shown to be a public
health problem,
2, Contrary to much of the rhetoric that has found Its way into the Iowa City
debate on this subject, appropriate use of lawn care chemicals has not been
shown to be a measurable risk factor for cancer, birth defects, immune
system problems, nervous system problems or any other major category of
disease In people, In addition, although exhaustive studies have not been
done on the effects of lawn care chemicals on pets, those data that are
available are reassuring In that precautions effective In protecting human
health appear to be protective of pet health as well.

While much energy, resources and emotion have been Invested in the debate

understand what their investment is likely to buy them, Unfortunately, from an
ordinance based largely on posting of signs, the return in terms of public health
protection will likely be mlnlmal.

SUMMARY
1) Environmental Advocates filed Consumer Protection Complaints
on September 7, 1990 against ChemLawn, Spring Green, and All
American Turf Beauty, Inc.
2) The complaints were investigated.
3) Basis cooperating in making suggested advertising changes no
further action was taken. None of the three companies were
prosecuted, fined or required to sign Consent Decrees.
4) Out of the dozens of customer and advertising pieces produced
by All American in five years time only two caused any concern
to the Attorney General. The Attorney General felt that a
total of three statements had not been sUfficiently
substantiated in the brochures. The Attorney General
clarified the parameters of substantiated versus
unsubstantiated representations (clarification didn't exist
previously). All American signed a compliance and settlement
agreement that said we would not use those three statements in
future advertising unless we substantiated them. A copy of
the agreement and pertinent correspondence is attached.
5) Ironically an "ORGANIC" company (Ecological Products, Ltd.)
was also investigated. This is the type of company
recommended by organizations like Environmental Advocates as
a safer alternative. My guess is that Section 34-80 Item 5,
in the Commercial Pesticide Ordinance requiring information
about alternative methods is also referring to "ORGANIC"
companies. This company was required to sign a consent decree
filed in the Iowa District Court. A copy is attached.

Per our recent conversations and negotiations, I believe that the
Declaration of Compliance and Settlement, as attached hereto, represents a
document which is satisfactory to ths Farm Division of the Iowa Attorney
General's Office end All American 1'urf Beauty, to settle recent Interactions
between the raferenced pal.ties. The enclosed daclnrution, once executed by both
parties, Is Intended to satisfy the requirements for a formal settlement
agreement, as refel'enced in correspondence dated Januury 14, 1991 from you to
Daryle L. Johnson, President of All American Turf Beuuty.
Your latter to Doryle Juhnson dated December 20, 1990 concerning
advertiSing of All American Turf Deauty has been the topic of ongoiog discussion
relative to representatioos which may be made 10 All Amel'ican Turf Beauty
advel'Llsements which the Farm Division considers substnntiuted, and thus not
miSleading. Likewise, cel.tain proposed representations have been classified as
nnsubstantiated by you on behalf of the Farm Division, which would constitute
misleading advertiSing In violation of Iowa Code ~714,lG (1991).

As discussed, the third representation ahove would only be subject to
ecrlltiny in the event lawn care services provided by All American 'I'U1'f Ilenllty
were not, on an actual performance basis, demonstl'Bbly effective in produCing
good turfs.
Based upnn our discussinns, it is my understanding that an unsubstantiated
claim would include either of the fOllowing representations:
1. A representation to the effect that: "application of pesticides
to lawns is beneficial fur th.e environment',
2. A representation to the effect that: 'All American Turf
Beauty lawn care services are good for the environment'.
It is my understanding that the second representation stnted immediately
ahove would be determined to be unsubstantillted hy the Fnrm Division, due to
the fact that lawn care service provided by All American Turf Beauty includes,
as a cumponent of that sel'vice, the applicotion of pesticides. You have
iadicated there Is insufficient substantiation to support the claim thnt pesticide
applications are good for the environment. Since the lawn care service cUI'renUy
provided hy All Americnn Turf Beauty inciudes such pesticide applications to
turf, a "blanket" statement similar to item two Immediately above would
constitute a misleading statement until such time that sufficient substantiatlun
exists on the environmental benefits of pesticide use.

DECLARATION OF COMPLIANCE AND SETTLEMENT
THIS DECLARATION is entered into by and between: All American Turf
Beauty, Inc., an Iowa corporation with e prlaclpal place of business at 311
DeSoto Road, P.O. Box 260, Van Meter, Iowa 50261-0260 ("All American Turf");
and the Farm Division of the Iowa Attorney General's Office, Iowa Depertment
of Justice, located at Executive Hills East, 1223 East Court Avenue, Des Moines,
Iowa 50319 ("Farm Division").
WHEREAS, in response to a complaint received fl'om an environmental
organization in Iowa City, the Farm Division has investigated the advertisements
of All American Turf pureuant to the procedures established under Iowa Code
mU6 (1991),
WHEREAS, the nature of this Investigation and interactions. between said
parties nre summarized os follows:
1. Correspondence dated October 10, 1990 wes eent to, All: American
Turf by the Farm Division reporting the complaint received by Farm
Division and requesting certain detailed information from ,All
American Turf.
2. All American Turf promptly responded to the Farm Division by
supplying all requested materials, information and documents relative
to the business operations of All Americen 'l'urf.
3. Correspondence dated December 20, 1990 was sent to AI' American
Turf by the Farm Division reporting that the Farm Division had
concluded its investigation and indicating '.hat the Farm Division hnd
determined that particular repreeentatione contained in 1989 and 1990
All American Turf advertising had not been sufficiently substantiated
to avoid characterization of such representations as misleading to
Iown consumers, to wit:
a. "Theee products eelectlvely control weed and insects,
and when properly used pose no unreasonable health or
safety danger to pets or the environment."
b. "'rhe products once pl'operly diluted and used according
to label directions ore classified ns slightly toxic 01'
pracUcally nontoxic to people, pets and the
environment. "
c. Unsubstantiated representations that either directly or
Impliedly state that pesticides benefit the environment,
4. Correspondence dated December 28, 1990 was sent to the
Farm Division by All American Turf Indicating: (I)
disagreement with the Farm Dlvlsion'e determinations that
particular statements in 1989 and 1990 advertising brochures
of All American Turf were misleading, (II) concern that the
determinations of the Farm Division will fut.ther distort public
perceptions that over-emphaelze damages and under-emphaelze

benefits to the environment and public health of professional
luwn care service; and (iil) the aSSUI'ances of All American
Turf to abide by all laws and legal decisions and to cooperate
with the Farm Division in making suggested changes in the
advertising materials of All American 'ful'f.
6. Correspondence dated Jennary 14, 1991 was sent to All
American Turf by the Farm Division requesting copies of all
1991 advertising materials of All Amet'icun Turf for the
purpose of determining compliance with the suggested
revieions.
6. All American 'rurf provided the Farm Division with all 1991
advertising materials of All Americen Turf as requested; the
Farm Division approved of all changes and did not determine
that objectionable representations or claims were contained in
the revised advertising matel'ials.
NOW THEREFORE, in consideration of the premises and to allow the
parties to declare Pl'esent compliance of All American Turf with the provisions
of Iowa Code ~714.l6 (1991), and to provide further assurances, the pertlee agree
as follows:
1. All American Turf, along with other corporate entities, affillates,
divisions, subsidiaries, proprietorships, partnerships, or other business
organizations of All Amel'icen Turf, hereby agree that no advertising
within Iowa of the services provided by All American Turf wlll
. contain representations which are the same or similar to those
stated above which have been determined by the Farm Division to
constitute unsubstantiated claims, until such time that All American
Turf can demonstrate that a reasonable besis for making such claims
exlste in accordance with Iowa Code ~714.16(2)(a) (1991).
2. The Farm Division accepts this assurance of All American Turf on
behalf of the Iowa Department of Justice and all other state
officials specifically referenced in Iowa Code ~714.16 (1991).
3, The assurances made by All American Turf fully and finally resolve
t~e investigation conducted by the Farm Divleion of all matters
relating to the advertising of All Amel'lcan 'I'urf, as contemplated
herein.

4. The Farm Division has reviewed the 1991 advertising of All
American Turf and has agreed that the matel'ials al'e satisfactory
and do not constitute a violation of Iowu Code ~714.16 (1991).
6. If All American Turf complies with the assurnnces contained herein,
no fUI'ther ection will be initiated by the Fal'm D1vieion, nor
penalties imposed against All Americnn 'I'm'f with respect to
repreeentations made in advertising of All American Turf as
contemplated herein.

6. All American Turf egrees that a breach of any of the terms of this
Declaration may constitute a violation of luwe Code ~714.16 (1991).
In the event a violation is evidenced, Farm Division is entitled to
pursue all remedies available under the referenced statute.
The parties hereto have executed this Declaration of Compllance and
Settlement as of the 16th day of Aprll, 1991.

Huch discussion has centered on the "Right to Know" of, pesticide
applications and the Use of a central registry. The Iowa Alliance
ftupports a public registry. Citizens on the re9istry would receive
notificatlon of pesticide application on abutting or adjacent
property prior to the application of pesticides. It IS my
understanding that Borne people felt this registry could be
administered by the commercial lawn care companies within the city.
This is not be feasible.

A third party entity is necessary to administer a local registry.
A conflict of interest would exist if a conunercialltor hire
licensed applicator were the "keeper of the records" and this would
be of great Concern to the publi~. The same conflict Ot interest
would exist if the Iowa City Environmental Advocates maintained the
registry. Nstionwide a few citiea have registries and administer
this for the benuflt and weltare of theIr citizens, but it is not
without cost to the municipality.
However, the Alliance does support the concept of a sb.lewide
te9istry that would be administered by the Department of
AgriCUlture/Regulatory DIVision which would allow all Iowans the
opportunity to receive that courtesy.
There also eXists the conce!n of liabIlity expooure the city would
have if an incident would occur and notification was not given to
the plaintiff. Thc legal system already protects the individual
and allows for a civil suit La be riled when application is made to
a wrong lawn, This addreopuu the luue ham A property damage
standpoint.
The All1am;e also support:. the Implementation of e!vll penalty
authority within the Department of Agriculture for applicators who
are in violation of state law concerning tho URe and application of
peuticides on a state level. This doos not currently exist. We
would ask that Iowa City consIder support of this as well.

pesticide application to lawns as their notice to refrain hOlll
trespassing for the 24 hour period. Thus I suggest you consider
this as your discussion progresses.
I also understand from Linda Gentry that the draft for "larger and
brighter" signs will not be available until a later date. As the
councll discusses this issue and if they determine that the
national standard is not acceptable for Iowa City, I would like to
point out that an 8" x 11" sign will be very difficult to maintain
In an upright position and that possibly a G" x G" or ?II x ?" sign
would accomplish the same notification gOlls Ind still be able to
withstand the wInd and weather condItions that exist in Iowa.
COnsumer studies also show that gold or yellow with black lettering
are also the most highly recognized color combination for qaution
and thill ls something the counell might want to consider in

assuring COnstituent safety.
In addition, the ceunci,l has recognized the conGumer UGe of
pesticides end misht consider language that would GUggest
homeowners also post signs on 4 voluntary basis and ask that ret~il
businesses consider making these types oC signs available for the
public to purehQce.
YOur ooncern for the Ilright to 'know" by consumers is indicative of
your responsIble attitude for your constituents. Education is the
key to any issue and my association is willing to work with YOIl in
any way to better educate the public concerning the use of
pesticides, Integrated pest management, and the dispooal of unusod
producte .

that would investigate a means of educating the consumers,
customers, and interested citizens In Iowa Olty about pesticides.
This task force should Inolude working with the local extenlllon
service to provide up to date, non-biased information that will

Dear Council Members,
The citizens who have joined me in signing their names
to this letter would like to address the serious
problem of leaf pickup in the Woodlawn historic district
of Iowa City.
In the past individual homeowners in the district had
burned most of the large amount of leaves in their drive-
ways. Since the city passed the "no burning" ordinance
we were led 'to believe that our leaves would be picked up
along with the rest of the city. We are now told that
the trucks are too large to maneuver our drive. I do
not beleive the city truck is as large as say a UPS truck
that seems to maneuver with no problems.
This problem has become serious and would appreciate some
redre ss,
