RESOLUTION ADOPTING THE IOWA CITY HISTORIC PRESERVATION PLAN, WHEREAS, the City contracted with Svendsen Tyler, Inc, to prepare the Iowa City Historic Preservation Plan under the direction of the Iowa City Historic Preservation Commission; and WHEREAS, the Iowa City Historic Preservation Plan sets forth policies to guide Iowa City In Identifying, protecting and properly developing its historic resources; and WHEREAS, the Plan Incorporates the concerns and suggestions of citizens raised at numerous public meetings as well as the results of a survey of residents In older neighborhoods and interviews with community and neighborhood leaders; and WHEREAS, the Iowa City Historic Preservation Commission has recommended that the City Council adopt the Iowa City Historic Preservation Plan; and WHEREAS, the City Council finds that adoption of said Plan is in the public Interest. NOW, THEREFORE, BE IT RESOLVED BYTHE CITY COUNCIL OFTHE CITY OF IOWA CITY, IOWA, that the Iowa City Historic Preservation Plan Is hereby adopted as a guide to assist Iowa City In identifying, protecting and properly developing its historic resources. Vice Chair-:Pq Design Review Committee From: Re: Incorporating Components of the Iowa City Historic Plan into the Iowa City Comprehensive Plan At its October 19, 1992, meeting, the Design Review Committee reviewed the proposal to amend the Iowa City Comprehensive Plan by incorporating the Executive Summary and the Neighborhood Strategies components of the Iowa City Historic Preservation Plan. The Committee focused its attention on the Downtown Neighborhood section of the Neighborhood Strategies. As a result of the Design Review Committee's discussion of the Downtown Neighborhood section. the Committee, by a vote of 6-0, approved a motion stating that: The Design Review Committee would enjoy working with the Historic Preservation Commission and downtown property owners regarding the implementation of Objective 4 of the Downtown Neighborhood section of the proposed Iowa City Historic Preservation Plan. The Design Review Committee agrees with the proposed Historic Preservation Plan regarding the need to "adopt a set of design guidelines which conserve the scale, rhythm, mass and variety of the Downtown's streetscapes." The Committee also agrees with the need to assign the administrative responsibilities of these new design guidelines with either a new separate design review body or with the Historic Preservation Commission. It is hoped that the four newest members of the Design Review Committee would be appointed members of the successor design review body, They are fresh, energetic, very interested and extremely telented. As 30-year residents on Melrose Court, we are very interested in what happens to the area south of Melrose Avenue, We are in favor of seeing it preseverved as a historical area. We are allare of a coUple of homes on Melrose Avenue already on the National Registry and believe that there are several more homes that should be preserved. Therefore, lie lIQuId like to see Iowa City "affirm" with the University (and the University Hospital COmplex) that Melrose Avenue be the southern boundary of the University as stated in Version A (Objective 3) . Also, "lOll-intensity commercial Use of property south of Melrose Avenue to generate minimal traffic" lias referred to in Version A (Objective 4). Our comment: the traffic on Melrose has become increasingly bad during our years here and will become a lot worse in years to come with new hospital construction near by. Old Feed store Associates objects to the inclusioft of;their building at 330 E. Court street in Iowa city in any Histort8 Preservation Plan. We make this objection because we do not wish to be subject to any design review regulations by any board or commission and staff of the city. Dear Mayor and council: We further object to the adoption of this plan at this time without the enactment or at least the sUbmission of the regulations which will be fastened on the property owners. We probably would object no matter what the regulations are but certainly we are in no position at this time to evaluate the regulations and their application if we can't see them. It has been said that this adopting this Historic preservation Plan is like the adoption of the comprehensive Plan and then going forward and rezoning of property pursuant to the plan. This is not the same thing. The zoning regulations do not subject the property owner to a "Design Review committee" or some such similar animal which will tell us in one form or another what we can do with our property not as to use but as to aesthetics or what some people consider aesthetics. At the time, we purchased the building under a lease option, the city of Iowa city was discussing the demolition of the building. without any funding from any governmental agency or help from any quarter, except conventional bank financing, we put money, time and effort into remodeling the building. No one I I , , ~ 31/3 - . ~. helped us then. No one was anxious to tell us how to design the building when it was a mess. Now this plan proposes that people who have no financial stake in this property be able to control our use. We object to this kind of control over our property and to the Historic Preservation Plan. RATING THE IOWA CITY HISTORIC PRESERVATION PLAN EXECUTIVE SUMMARY AND NEIGHBORHOOD STRATEGIES. However, I recently have become aware thato .you w111 be cons1der1ng an amendment to the Comprehensive Zon1ng Plan to 1ncorporate the Iowa C1ty Historic Preservat10n Plan. I w1sh to express my total and unalterable opposition to the pol1c1es and concepts expressed 1n the Iowa City H1stor1c Preservat10n Plan. Oear Counc11 Member: More specif1cally, I am totally and unalterably opposed to any plan or ord1nance that would require approval by a commission before I make any changes on my home or property that would normally requ1re a build1ng permit. Moreover, I am totally opposed to any plan or ord1nance that would requ1re me to obtain any "certif1cate of appropr1ateness" before I could make any changes in the exter10r of any bu1lding I own or changes 1n the landscaping around that bu1ld1ng. I feel as a property owner it is solely my prerogat1ve to dec1de what changes I may wish to make in the exter10r of any bu1lding I own, and even more so to dec1de what changes I may w1sh to make in landscap1ng around that bU1lding. To 1mpose a requ1rement that I get perm1ssion for any changes I may w1sh to make 1n a bu1lding I own or the landscap1ng around 1t 1s, I feel, a . gross invas10n of my rights as a property owner and w111 adversely . affect the use and value of my property. . To adopt the pol1cles and concepts 1ncluded 1n the Iowa C1ty H1storic '. Preservation Plan would be a dangerous precedent for the counc11 to carry out. Th'at is, the counc11 would be try1ng to legislate aesthet1c tastes and values which have noth1ng to do with the safety, health, or welfare of the c1tizens of th1s commun1ty. Moreover, 1t would open up . the potential for significant lit1gat10n. For example, if any attempt were ever made to Impose the restrictions outl1ned 1n the H1storic Preservat10n Plan on any property t~at I own, I would use every means avallable at my disposal to f1ght this. In summary, [ would urge the council to not amend the Comprehensive Zon1ng Plan. to incorporate the Iowa City Histor1c Preservat10n Plan. I feel very strongly that this 1s an unwarranted and unreasonable invas10n of ind1v1dual property r1ghts and is an attempt by the city and the counc11 to leg1slature subject1ve tastes and aesthet1c values, s~~ John Kammermeyer, M.O.
