Dear Council Member:
I am enclosing copies of two letters that I have sent to individuals at
the University of Iowa this past year. The first of these was sent in
May 1992 following the band concert on the University of Iowa campus the
evening of Tuesday, May 5, 1992. At that time the volume at which the
band music was played was outrageously loud, and indeed made it so that
I was not able to get to sleep until after midnight. There were so many
complaints concerning this that there was an article in the Press
Citizen and the University of Iowa issued an apology to residents of the
west side of Iowa City.
However, it appears that the University, and in specific Dean Jones,
learned nothing from the experience last May b~cause another band
concert was held on the evening of Saturday, September 19, and indeed
the volume of the music was, if anything, louder than the concert in
May. I will not repeat all of the information in the letter that I sent
to Dean Jones in September, but needless to say the volume was again
outrageous and totally unacceptable. It totally interfered with my
evening plans, and the noise intrusion was so severe that the floor in
my house was Vibrating to the bass frequencies from the band playing
across the river. It appears that the University really does not care
at all about the inpact that this noise pollution has on individuals
living on the west side of the river. Based on my telephone
conversation with Dean Jones the evening of September 19, he felt that
the problem was only a mild bother or inconvenience and that he was
planning to allow bands to play like this in the future. His position
was that citizens living on the west side of the river, like myself,
would just have to tolerate this occasional intrusion of noise. He also
took the position that the noise pollution was no worse than the P.A.
system during the football games. I have lived at my present location
since childhood, for the better part of the last forty years, and I can
assure you that it is ludicrous to compare the three hours of band
music, played so loud that you cannot escape the noise anywhere in your
home and your f1 oor is vi brat i ng, with the occasi onal fa i nt noi se of the
PA system from the football stadium.
BaSically in summary, it appears to me that Dean Jones in particular,
and the UniverSity in general, does not give a darn for the well-being
of the citizens on the west side of Iowa City and plans to SUbject us to
this horrendous noise pollution again in the future. To me this
situation is just unacceptable and I would encourage the City Council
and the city of Iowa City to do whatever they can to try and protect the
health and well-being of citizens living on t~e west side. I think it
would be appropriate for the city to put a great deal of pressure on the

University to tone down and reduce the volume of future band concerts
played in the open. If this does not succeed in solving the problem,
then I would encourage the city to contact our representatives in the
state legislature to ask them to intervene and curtail outdoor band
activities on the University campus so that there is some semblance of
compliance with the Iowa City noise ordinance.
I can assure you that I, as well as neighbors in the area on Ferson
Avenue, are not just extremely upset but are outraged that the
University would allow a second band concert to be performed at or above
the volume of the one in May and moreover, obviously does not care about
the tremendous impact that this has on citizens living on the west side
of Iowa City.
Something has to be done concerning this matter, and I urge you to do
whatever appears to be necessary in order to try and protect the
physical and mental health of the citizens on the west side of Iowa
City.

Dear Mr. Fuhrmeister:
I am sending you this letter to express my extreme anger and displeasure
at the extremely loud band musIc performed on the University of Iowa
campus on the evening of Tuesday, May 5, 1992. The volume at which this
band music was played was outrageous and disturhed thousands of individ-
uals. I live on the south end of Ferson Avenue. west of the Interna-
tional center, and it sounded as If the band was playing right in my
yard. In spite of closing all of my windows. the noise was so loud that
I was totally unable to sleep. Instead of turning In at about 10:30 as
1 normally do, I was unable to get any sleep until midnight when the
band stopped playing.
I called the Iowa City Police Department and, of course. they sai1 they
could do nothing about it since the band was playing on University prop-
erty. I was told to call Campus Security. I called Campus Security and
was told they were sorry, but there was nothing that they could do. and
that I should call you back Wednesday to voice my complaInt. [did try
and call back to speak to you on Wednesday, Thursday and Friday, May 6,
7, and 8th, but each time was told that you were eIther busy on the
phone, busy in a meeting, or unavailable. The fact that I was told that
Campus Security could do nothing concerning the problem on Tuesday
night, when I called, is almost unbelievable to me and reflects a total
disregard for the rights and welfare of private citizens here in Iowa
City. If things had been handled correctly, Campus Security should have
moved in Immediately and shut the volume down on the band. Also the
fact that I was totally unable to speak to anyone, such as yourself, over
the next three days by phone, and was constantly put off, also was very
upsetting and disturbing.
Having grown up in Iowa City and havIng lived here most of my life, I
have generally been a strong supporter of the UnIversity. But after
this experience J must state that my positIve feelIngs for the
UniversIty of Iowa were severely compromised. I grew up livIng on
Ferson Avenue, and except for a ten year perIod when I was elsewhere for
my medical training, J have lived on Ferson Avenue. Over the past forty
years living on Ferson Avenue I have never experienced anything like

It Is all very well and good for the University to be "terribly sorry"
as reported In the Iowa City Press Citizen, but this really does not ad-
dress the problem and Issues. The fact of the matter Is that, when a
band such as this behaved in a totally Irresponsible manner, Campus
Security should have been able to Immediately move In and solve the
problem, namely reducing the volume of the hand. The fact that thou-
sands of Individuals were adversely Impacted by the outrageous behavior
of the band, and the fact that hundreds of these individuals complained
to Campus Security to no avail, since Campus Security was totally unre-
spons I ve to the problem, to me is tot a 11 y unacceptable. I strongl y re-
commend that decisions be made now so that this sort of situation can
never occur again.

I am sending you this letter to reinforce my extreme anger and outrage
that the University of 10~la would allo~1 another hand concert similar to
the one held In May 1992, with the volume, H anything, turned up
louder. I had assumed after the apology Issued by your ofrtce last
sprIng that the problem was solved and that your office was responsive
to the concerns and well being of the citizens of 10\1a City. I have now
found out that nothIng could be further from the truth.
The volume at wh ich lhe band pI ayed on Sa t.urday, Sepl.emher I g, was
louder a t my house than the one tha I. pI aye!! Tuesday, flay ~. The impact
on me and my evenIng was Incredible. The volume of rock music was' so
loud that even with all of my wIndows and doors Ughtlyclosed I lias
unable to listen to my televIsIon or \~atch a VCR without havIng the
music interfere with my helng ahle 1;0 listen t.o the audio. MOl'eover,
Ilhen J took a shower I was able to dIstinctly hear the music through the
walls of my house, even with the water' runnIng. The entire floor In my
house was Vibrating from the hase frequencies just as if one had a
ster'eo in my home turned Ull to a high level. This Incret1lhle sounrl in-
trusion continued for apprOXimately three hours I/lthout interruption.
It was so barl that I brIefly left home to get away from ft, since the
only place in my home that I was not Impacted signlrlcantly hy the band
Sound wa sIn the corner of my ba sement, heh Inri the fur'nace. 'n other
words, the sound po 11 ullon wa s so severe tha t I was unah 1 e to conrluc t
any of my evening activities without constantly havIng the rock band
musIc Impinging in my ears and I/lthout haVing the entire floor of my
house vIbratIng. ThIs Is totally unacceptable and represents total and
callous dIsregard for the needs and welfare of myself and thousands of
other cItizens on the west sIde of Iowa CIty. It also represents total
disregard and flounting of the wishes of the citizens of 100~a City as

citizens of Iowa City, hollow and worthless. Moreover, your comparison
of thl'ee hours of a rock band playing at an ungodly decibel level which
interfered with my listening to my television In my own home anrl causell

for the hetter part of forty years, J have heen home on many occasions
when there were home foolhall games and I can assure you that the occa-

the evening of Septemher Ig. To suggest that the noise from the foot-
hall game Is as bad or worse than t,he noIse from the rock hand Is at
best naIve and ignorant and at worst a callous disregard for the we Hare
and needs of the citizens of the west side of Iowa CIty.
HavIng grown up most of my life in Iowa City and having two degrees from
the University of Iowa I have generally had a warm feeling and
Supportl ve at t itude toward the Un i vel's ity of r owa. However, I am now
seeing that the Unlvers ity, In general, and you and your office in
particular, do not give a darn about the needs, wishes, and welfare of
the citizens of Iowa City and plan to continue, In the future,
SUbjecting us to incredible noise pollution. 1 plan to be sending
copies of thIs letter to rresldent Hunter RaWlings, Mr. William .

Members of the Council:
The Iowa City Area Group of the Sierra Club strongly supports the original version
of Iowa City's proposed ordinances governing the application of lawn care chemicals.
We do not oppose the use of such chemicals, but we note that these chemicals are
potentially dangerous, they pose a serious threat to water quality and wildlife, and
they are not essential for pleasant looking lawns. Furthermore, herbicide application
rates are frequently far higher per acre of urban lawn than they are per acre of
agricultural land.
As such, we feel that there is need for strict regulation of the application of such
chemicals, There is need for strict limitation on the use of such chemicals near
drainageways, including storm drains, and there is a need for prenotification of all
neighbors prior to application of such chemicals, whether by homeowners, lawn care
contractors, or institutional landowners,
We feel that the lawn care industry's counterproposal of door stickers for those who
don't want such chemicals has some merit, but we feel that the responsibility for
placing such stickers should rest with the homeowners who want chemicals, not with
those who don't.
This statement was voted on in our October 21,1992 general meeting, where it passed
unanimously.

Our first FIRST Annual Bicycle ride was a tremendous success thanks, largely, to your
enthusiastic support. We not only raised about $4,000 (to be used for planning the rernaining
segments of the trail through Iowa City), but we also increased public awareness of the need
for the trail. Your enthusiasrn spread frorn one sponsor to the next; 45 sponsors joined up in a
very short tirne, News of the ride spread throughout the community by way of the eye.
catehing posters around town, targeted mailings, and the media. Despite the cold
ternperatures, about 100 people participated in the ride.
Articles about the ride appeared in rnany of the major Iowa newspapers including the Press
Citizen, the Cedar Rapids Gazette, the Daily Iowan, the Add Sheet, and the Bicyclists of Iowa
City and Environrnental Advocates monthly newsletters. I was especially excited that John
Karras featured the FIRST Annual Ride in his weekly Des Moines Sunday Register column.
Please find enclosed a copy of the leaflet that we distributed and a copy of the Daily Iowan
followup article. We are already planning next year's event which rnay be expanded to include
more hikers and joggers.

The FffiST Annual Ride
Friends of the Iowa River Scenic Trail (FIRST) is a local group whose mission
is to develop a continuous, multi-purpose recreational trail along the Iowa River.
Our initial goal is to have a trail from the Coralville Reservoir to the Hawkeye
Marsh (south ofIowa City) with links to Iowa City parks and recreational areas.
Eventually, we would like to extend the trail to connect to the Hoover Nature Trail
in Solon and Columbus Junction.
A project of this magnitude is expensive. The initial stages of creating a trail
(planning and fund raising) are by far the most critical. A solid foundation must
exist before the first inch of stone is laid. Land must be obtained and engineers
must study the plans to determine costs and environmental impact. FffiST is not
trying to raise all of the money for the trail, but it is easier to obtain outside funds if
we can contribute, too.
On Saturday, October 17, FffiST is sponsoring a bike ride to Hills and
Riverside (see rnap) to raise money and awareness of the trail. The ride will begin
at 10:00 a.rn. leaving from JC's Cafe in Coralville. There are several places along
the route where you are welcome to join the ride.
From JC's, we will follow the existing trail along the river, through City Park
and the University campus. You can rneet us at Country Kitchen (the corner of
Gilbert Street and Highway 6 Bypass) at 10:45. From there, we head for Hills. You
can stop for lunch at the Hills Tap or bring your own and have a picnic. You can
return to Iowa City, but the prettiest part of the ride is between Hills and Riverside.

As directed by Section 23-16 of the Municipal Code, this is to advise you of the following
action.
ACTION:
Pursuant to Section 23.234 of the Municipal Coda of Iowa City, the City Traffic Enginear will
direct the installation of NO PARKING ANY TIME in the cul-de-sac of Olympic Court. This
action will take place on or shortly after November 12, 1992.
COMMENT:
This action is being takan at the request of the Iowa City Gymnast and the developer. The
intent of the prohibition is to remove parked cars from the cul-de-sac end of Olympic Court,
thereby providing free flow of traffic in the cul-de-sac.

As directed by Section 23-16 of the Munieipal Code of Iowa City, this is to advise you of the
following action.
ACTION:
Pursuant to Section 23-234 of the Municipal Code of Iowa City, the City Traffic Engineer will
direct the installation of a NO PARKING HERE TO CORNER sign on the east side of
Morningside Drive at a point 40 feet north of the intersection with High Street and will direct
the installation of a NO PARKING CORNER TO HERE at a point 40 feet south of the
intersection with High Street. This installation will take place on or shortly after November
12,1992.
COMMENT:
This action is being taken to improve the flow of traffic at the intersection of High Street with
Morningside Drive. This intersection is located near City High School and parking on streets
in the neighborhoods is intense on school days. The postings noted above are intended to
provide sight distance for vehicles entering Morningside Drive from High Street.
