Re: Z-9013. Requested Amendment of Ordinance No. 90-3483 and the Accompanying
Whispering Meadows Conditional Zoning Agreement.
On November 13, 1990, the City Council approved Ordinance No. 90.3483 and a Conditional
Zoning Agreement when rezoning an approximately 95.61 acre property known as the BJornsen
tract, and subsequentiy as the Whispering Meadows development, from iD-RS, interim
Development-Single-Family Residential Zone, to RS-8, Medium Density Single-Family Residential
Development. The Conditional Zoning Agreement was signed on November 15, 1992.
In-Seauence Development. The rezoning for the Whispering Meadows tract noted that according
to the Comprehensive Plan, the area was designated out-of-sequence, that Is, this area of the
community was not expected to develop until the years 2000-2010. This was due primarily to the
Inadequate sanitary sewer Infrastructure In the South Area of Iowa City. The language of
Ordinance No. 90-3483 and the Conditional Zoning Agreement acknowledges: "The
understanding that this Is out.of-sequence development as It is presentiy defined in the
Comprehensive Plan."
Subsequently, In September 1991, following Council approval to extend a sanitary sewer trunk
line to serve the central portion of the South Area, the Comprehensive Plan was amended to
designate the Central South Area as an In-sequence development area. The Central South Area
includes the western portion of the Whispering Meadows tract. The remainder or eastern portion
of the Whispering Meadows tract was able to be served directly by the Southeast Interceptor
Sewer. In March 1992, the Comprehensive Plan was amended to designate the east portion of
the South Area, which Is coincident In area to the east portion of the Whispering Meadows tract,
as an In-sequence development area. Therefore, the amendment of the Ordinance and
Conditional Zoning Agreement for the Whispering Meadows tract should Include a revision of
Section 1.1) of the Ordinance and Section 4.1) of the Conditional Zoning Agreement to state:
"The understanding that this Is In-sequence development as It Is presentiy defined In the
Comprehensive Plan."
Basement Construction. Due to the wet characteristics of the solis within the tract, the Planning
and Zoning Commission recommended and Council approved a section In the Conditional Zoning
Agreement which prohibited the construction of basements within the Whispering Meadows
development. Condition 4, which Is Included In both the Ordinance and the Agreement, provides
that "the lowest floor level of any structure constructed shall not be lower than the top of the street
curb, measured at the highest point of the lot's street frontage."
C.B. Development, Ltd. has requested that Condition 4 be amended to allow basements to be
constructed In the Whispering Meadows Subdivision subject to certain requirements, These
requirements were ascertained through discussions with the City Public Works Department staff,
who thought that the City should not prohibit basements on lots where a sump pump and
adequate foundation tile were tied into an abutting subsurface drainage system and where no

doors or windows were constructed In residences below the minimum low opening elevations [six
Inches to one foot above the 100 year flood level]. The 100 year flood fevels are based on
surface flooding experienced In this area of Iowa City. The City Public Works Department has
Indicated that the calculations by the applicant's engineer demonstrate that permitting basements
using the proposed subsurface drainage system 1) should not Increase flooding on neighboring
properties, particularly with respect to those properties located along the south portion of Nevada
Avenue, and 2) should provide protection for the homes being constructed In the Whispering
Meadows development. The subsurface drainage system will also help protect the City's sanitary
sewer system from excessive Infiltration.
The attached October 28, 1992, letter from Charles A. Mullen sets forth the applicant's proposed
Conditional Zoning Agreement amendment. With minor modifications, staff concurs with the
proposed amendment and recommends that Ordinance No. 90-3483 and the Conditional Zoning
Agreement be amended accordingly.
STAFF RECOMMENDATION:
Staff recommends that Ordinance No. 90.3483 and the accompanying Conditional Zoning
Agreement be amended by deleting Section 1.1) of the Ordinance and Section 4.1) of the
Agreement in entirety and adopting In lieu thereof the following:
1) The understanding that this Is in-sequence development as It Is presentiy
defined In the Comprehensive Plan.
Staff further recommends that Ordinance No. 90-3483 and the accompanying Conditional Zoning
Agreement be amended by deleting Section 1.4) of the Ordinance and Section 4.4) of the
Agreement In entirety and adopting In lieu thereof the following:
4) Basements may be constructed on lots which are abutted by a subsurface
drainage system provided said basements are equipped with a sump pump
and adequate foundation tile which discharge Into said abutting subsurface
drainage system. The property owner's engineer shall certify that no
structure has an opening to living areas below the minimum low opening
(MLO) elevation listed for each lot on the site grading and erosion control
plan.

Dear Steve,
This letter is being written on behalf of CB Development, Ltd., to request an
amenoment to the, Conditional Zoning Agreement applicable to Whispering ,
Meadows, which Conditional Zoning Agreement was approved by Ordinance No.
90-3483. The amendment requested is to 4) of paragraph 4 of the Conditional
Zoning Agreement dated October 15, 1990. Specifically, CB Development, Ltd.,
would request that the Conditional Zoning Agreement be amended by deleting 4)
of paragraph 4 of the agreement in its entirety and replaced with the following 4):
4) Basements may be constructed on lots which are abutted by a
subsurface drainage system provided said basements are
equipped with a sump pump which discharges into said abutting
subsurface drainage system. No structure shall have an opening
to living areas below the minimum low opening (MLO)

CHANGING THE USE REGULATIONS, WITH CONDITIONS,
OF A CERTAIN 95.61 ACRE PROPERTY, KNOWN AS THE
BJORNSEN TRACT, LOCATED SOUTH OF HIGHWAY 6 AND
WEST OF BON AIRE MOBILE HOMES FROM ID.RS TO RS.8.
WHEREAS, the subject property Is vacant land or land in
agricultural use located In the Interim Development. Single.
,Family Residential (ID.RS) Zone; and
WHEREAS, CB Development, Ltd. as Contract Purchaser,
and Bjornsen Investment Corporation, as legal li1leholder
('Applicant'), are requesting the rezoning ofthe subject' property
to RS-8 10 allow construction of a zero.iol line, duplex and
delached 101 single-family residential development; and
WHEREAS, the subject property Is located in an out-of.
sequonce developmenl area, and contains federally designated

CONDITIONAL ZONING AGREEMENT
THIS AGREEMENT is made by and between the City of Iowa City, Iowa, a Municipal Corporation
(City), Bjornsen Investment Corporation (Owner), and CB Development, Ud., an Iowa Corporation
(Applicant).
WHEREAS, the Applicant has contracted to purchase the subject property, known as the Bjornsen
Tract, and located south of Highway 6 and west of Bon Aire Mobile Homes, in Iowa City, Iowa;
and
WHEREAS, the subject property is vacant land or land in agricultural use located in the Interim
Developmeni - Single-Family Residential (ID-RS) Zone; and
WHEREAS, the Applicant, as Contract Purchaser and the Owner, as legal tille holder are
requesting the rezoning of the subject property to RS.8 to allow construction of zero-lot line,
duplex and detached single-family residential development; and
WHEREAS, the subject property is located In an out-of.sequence development area within the
corporate limits of the City, and contains federally designated wetlands, the applicant has agreed
to limit development of the property known as the Bjomsen Tract, all in accordance with the terms
and conditions set forth herein.
NOW, THEREFORE, the Parties agree as follows:
1. Applicant is contract purchaser and equitable title holder of the property located south of
Highway 6 and west of Bon Aire Mobile Homes, and known as the Bjomsen Tract, which
property is more particuiarly described as, follows:
A part of the E 1/2 of the SE 1/4 of Section 23, and a part of the W 1/2 of the SW
1/4 of Section 24, all in Township 79 North, Range 6 Wes~ of the Fifth Principal
Meridian, Iowa City, Johnson County, Iowa, more particularly described as follows.
Beginning at the Southeast Comer of said Section 23; ThenC$ N 88021'12' E,

to abide by the terms of the Agreement In all respects.

4. In consideration of the City's rezoning of the subject property from ID.RS, Applicant and
Owner agree development and use of the subject property will confonm to the requlre~
ments of the RS.a, Medium Density Single-Family Residential Zone, as well as the
following additional conditions:
1) The understanding that this is out-of-sequence development as it is presently
defined in the Comprehensive Plan,
2) The density limited to five (5) dwelling units per a,cre,
3a} The application by the applicant for a 404 penmil from the Corps of Engineers, and
its issuance if applicable,
3b) The verification by the Corps of Engineers of the delineation of the wetlands,
3c) 'The approval and signoff by the Corps of Engineers or other state or federal
agencies as required prior to approval of final construction plans,
4) The lowest floor level of any structure constructed shall not be lower than the top
of the street curb, measured at the highest point of the lot's street frontage, and
5)' The dedication of the designated wetlands and the installation of a looped
pathway.
5. Applicant and Owner acknowledge that the additional conditions herein are reasonable,
and satisfy public needs which are directly caused by their requested change.
6. Applicant and Owner further acknowledge that In the event the subject property is
transferred, sold, redeveloped, subdivided, divided or split, there shall in no event be
redevelopment that occurs which is not in conformance with the tenms of this Agreement.
7. Parties acknowledge that this Conditional Zoning Agreement shall be deemed to be a
covenant running with the land and with the title to the land; that the Agreement shall,
upon execution, be recorded in the Johnson County Recorder's Office; and that the
Agreement shall, without further recitation, continue to be a covenant running in favor of
the City on each and every portion of the subject property, unless or until released of
record by the City; and shall inure to the benefit and bind all successors, representatives
and assigns in interest of each and every Party hereto.
8. Nothing in this Conditional Zoning Agreement shall be construed to relieve the Appilcant
from complying with all applicable local, state and federal regulations, and both Applicant
and Owner acknowledge same.

ORDINANCE NO. 92-3557
AN ORDINANCE INCREASING IMPOSITION OF THE HOTEL
ANO MOTEL TAX IN ANO FOR THE CITY OF IOWA CITY,
JOHNSON COUNTY, IOWA.
NOW, THEREFORE, BE ITOROAINEO BYTHE CITY COUNCIL
OF THE CITY OF IOWA CITY, IOWA:
SECTION I, HOTEL ANO MOTEL TAX. The hotel and motel
tax now imposed Is hereby Increased to a rate of seven
percent (7%) upon the gross receipts from the renting of
sleeping rooms, apartments, or sleeping quarters in a hotel,
motel, Inn, public lodging house, rooming house, mobile
home which Is tangible personal property, or tourist court, or
in any place where sleeping accommodations are furnished
to transient guests for rent, whether with or without meals,
within the corporate limits of the City of Iowa City, Iowa, all
as authorized In Chapter 422A, Code of Iowa (1992), and
subject to the limitations, restrictions, conditions, provisions,
and penalties contained therein.
SECTION II, IMPLEMENTATION. The City officers are
hereby directed to take such procedural steps as are
necessary to accomplish the increased imposition of the hotel
and motel tax on January 1, 1993.
SECTION III. REPEALER. All ordinances or parts of
ordinances in conflict with the provisions of this Ordinance
are hereby repealed,
SECTION IV. SEVERABILITY. If any of the provisions of this
Ordinance are for any reason declared illegal or void, then the
lawful provisions of this Ordinance are deemed severable and
shall remain in full force and effect.
SECTION V. EFFECTIVE DATE, This Ordinance shall, after
final passage, approval and publication as provided by law,
become effective January 1, 1993.
