ITEM NO.2 - CONSIDER A ORDINANCE AMENDING CHAPTER 34, ENTITLED "VEGETATION," OF THE CODE OF ORDINANCES OF THE CITY OF IOWA CITY, IOWA, BY ADDING A NEW ARTICLE IV, DIVISION I ENTITLED "COMMERCIAL PESTICIDE APPLICATION," WHICH ARTICLE SHALL PROVIDE FOR REGULATINg COMMERCIAL APPLICATION OF PESTICIDES AND PROVIDE FOR THE ENFORCEMENT THEREOF.(second consideration) Revised Comment: Based on discussion with City Council on January 12, 1993, the commercial pesticide application ordinance has been redrafted to include five issues: a larger, bolder and brighter sign; of a size at least 8 1/2 X 11 inches; which must be placed on the property to be treated by the commercial appli93tor prior to treatment; a logo, warning against entry onto the property; and including a city registry of commercial applicators, ~~~ 3/1 'iad.:. Action:.." ADJOURNMENT. Action: - ". #2 Horo/ Yes, I have an apology to make to the citizens of Iowa City, The other night I did not vote my conscience and I do not wish to continue that practice. I've been elected for what I say is what I mean and I apologize for that, I do not intend to vote for this. I feel that this is inconscientual in the overall scheme of things, that they should be directed toward the state and that I will work very, very hard to see that it is implemented more than it is right now at the state level, I feel that we would be an island within a metropolitan area and I don1t think that that helps the public health of everybody altogether, I just apologize for that, Thank you. Court/ Any other discussion? Novick/ Yes, we ,have a letter from somebody that is saying that he plans to put up a 6X6 sign and the Department of Agriculture requirements say the sign may be larger than 4X5 but it must be in that proportion, So, it can not be square, Dean Moore/ So 6X7? Amb/ May I say Mr. Mayor I wish to commend my co-councilor Ms. Horowitz for the courage of her convictions and her ability to do in what her mind is the proper thing according to her conscience and that I have a great deal of respect for anybody who does that, Larson/ Well, I think it is always good when people think and do what they think is right, I don1t have any problem with people ,changing their minds and all that. And I respectfully I have a great deal of respect for the work and energy and thought that evryone on this Council puts into making their decisions. I do think that we have to do something in the area of warning the'public about the possible dangers associated with pesticides and it1s not going to do anything but become a larger issue in the minds of the public over time, I think, and so I hope that we will all keep an open mind and keep looking for ways that we can fulfill our committment to the public without unduly burdening people and I just hope that we can put something together at some point that meets the needs of the majority of the Council and fits in with that everybody thinks would be a good thing to do, I don1t think that it's going to go away. And I don't think that the way to do these kinds of things is to have an initiative where you have a bunch of advertiSing and a bunch of interest trying to pursuade public thru maybe not complete arguments but parts and pieces of the argument and so I hope sometime we'll look at it again but we've spent alot of time on it. We tried our best and couldn't come up with something apparently and I'm saying that I think that we are going to see it again and it's going to be our duty to look prop __~.._._..,..~..~.."'_ _._.....,~.-.u._-_..._..--_......----.-"'""1.!IiI.-~ '--a -, -~,,~.....'\. 'I 1 , I: ~- ~f '.. 1/14/93 #2 Page 2 Larson/ (cont.) and it's going to be our duty to look probably from time to time. Horo/ And or look for a strategy to deal with it. That's what I would like to work on. Kubby/ Like getting people not to use them. To go to the companies that have organic options and that's a way for companies to expand their markets in that area and I didn't think that this thing was a big deal. I mean alot of it, even the comprehensive ordinance, made a lot of common sense and it was the price of doing business when you're using things that have long term environmental and public health effects. But we are going to end up revisiting this, Horo/ Oh, yea. Larson/ I think that if there are any commercial applicators that haven't got the message that the message is that you oughta do more than state law requires. It's good public relations for a certain proportion of this population. It's certainly going to be an issue that the Council is going tO,keep looking at, whether it's this Councilor a different Council. And I just think that a company that got out in the lead and made signs that were really able to be seen and did some more things along those 1 ines would really be helping themselves with a certain percentage of the population and with members of Council. I would encourage them to do so. And we certainly have some very good companies in the area that would like to do that. I hope that other companies do not put them at a competitive dis- advantage by doing as little as they can. Nov/ One of the commercial applicators called me after the Tuesday vote to talk about this ordinance and one of the suggestions that we came up with' on the phone was to put the number of the Department of Agriculture in the phone book along with other emergency numbers so that people could find it easily and call them easily and I suggested that she call the phone book pUblishers and suggest that they do that next time. Larson/ It's in there under state offices. Nov/ Nevertheless Horo/ Not obvi ous, Nov/ ..if you feel it is an emergency you end up calling somebody who can not literally handle it and then they tell you to call the Department of Agriculture. I Those who consider it an emergency should find it there, Larson/ Well, no one can say that we did not put considerable effort into trying to deal with this.,. Court/ I think that this whole process has served a purpose and it has educated the people much more than they were to begin with and it has educated the commer- cial applicators. I think we have seen some of them take the lead along the way already. They've changed materials that they have put on, at least ,. 'I 1 , , ' -- -. 1/14/93 #2 Page 3 Court/ (cont.)the one that I know well, And they have some plans and I think that if the leading companies in town, we've' got 2 or 3 primary ones, will do the things that have been suggested I think just competitively the others will follow along. Larson/ I hope that it works out that way. Novi/ Just hope it does. Court/ We'll know in a few months, Larson! Qual ity Care and Dean Moore will make that extra effort.
