ORDINANCE NO.
ORDINANCE AMENDING CHAPTER 34, ENTITLED 'VEGETATION," CODE OF ORDINANCES OF
THE CITY OF IOWA CITY, IOWA, BY ADDING A NEW ARTICLE IV, DIVISION I ENTITLED
"COMMERCIAL PESTICIDEAPPLlCATION,"WHICHARTICLE SHALL PROVIDE FOR REGULATING
COMMERCIAL APPLICATION OF PESTICIDES AND PROVIDE FOR THE ENFORCEMENT
THEREOF.
SECTION I. The Code of Ordinances of the City of Iowa City, Iowa Is hereby amended by
adopting the following:
Section 34-77 Scope and Purpose
Iowa state law permits a city to exercise any powers or perform any functions under home
rule which the city deems necessary, In order to protect the health, safety and welfare of Its
citizens; and said home rule extends to the exercise of powers also undertaken by the State
where, as here, not pre-empted by State law. The City Council for the City of Iowa City
therefore adopts this ordinance concerning commercial application of pesticides to outdoor
vegetation, In order to protect the health, safety and welfare of the citizens of Iowa City, Iowa.
Section 34-78 DeflnltllJns
a. Application means all outdoor application of pesticides.
b, "Commercial applicator" shall mean a person or corporation, ~N1 Of the employees of a
person or corporation, ~!!ll191!h91I1censed In the State of Iowa as a commercial
applicator to engage In the business of applying pesticides to the property of another,
whether by spraying, misting, fogging, dusting, dragging, spreading or other means, for
monetary compensation under Chapter 206, Code of Iowa (1991) and Sections 206-21-45,
Iowa Administrative Code (1992).

c. "Customer" shall mean a property owner, Including residential, commercial, Industrial, and
governmental subdivision who enters In to a contract with or uses the services of a
licensed commercial applicator for the application of pesticides onto the customer's
property, and shall also Include a person such as an apartment manager, an operator of
a property, a responsible party, together with an agent or representative of any property
owner or business authorized by the property owner or business to enter Into a contract
with a licensed commercial applicator. "Customer" does not Include '~arm," as defined
herein.
d. "Farm" shall have the same meaning as that set forth In the Iowa City Zoning Ordinance,
Chapter 36, Iowa City Code of Ordinances, namely "an area of not less than 10 acres for
which the principal use Is the growing for sale of farm products such as vegetables, fruits,
and grain and their storage on the land. The term '~arm" Includes the necessary
accessory uses and buildings for treating and storing the food produced."
e. "Pesticide" shall mean any substance or mixture of substances that must be registered with
the Iowa Department of Agriculture and Land Stewardship under Chapter 206, Code of
Iowa (1991), exG9ptlng plant growth regulaiGf&; but shall not Include substances to the
extent that they are Intended as plant nutrients, trace elements, nutrlllonal chemicals,
plant Inoculants, and soli amendments.

Section 34.81 Penalties
Violation of this ordinance shall be deemed a simple misdemeanor, a municipal Infraction and
an environmental infraction. Said enforcement provisions shall be deemed cumulative In

nature, and the City's election of one enforcement provision shall not preclude the City from
pursuing another.
SECTION III. REPEALER, All ordinances or parts of ordinances In conflict with the provisions
of this Ordinance are hereby repealed.
SECTION IV. SEVERABILITY. If any of the provisions of this Ordinance are for any reason
declared Illegal or void, then the lawful provisions of this Ordinance are deemed severable and
shall remain In full force and effect.
SECTION V. EFFECTIVE DATE. this Ordinance shall be In full force and effect from and alter
Its final passage, approval and publication, as provided by law.

I am sending you a copy of our new contract forms for 1993,
We also are increasing the size of our signs from 4" x 5" to
6" x 6" as well as changing our colors to black on yello~l. We will
be putting on the same logo and wording the you requested Tuesday
night,
Karen, you should know that we as well as many other lawn care
companys were posting signs long before it was a State law,' We
felt it only fair to our clients, so if a neighbor had a question
they could call us instead of bothering the homeowner.
Naomi, I would hope by nO\~ you would realize we are
professionals and we treat our colleagues as professionals, We
have very good professional relations in our industry. We have all
