RESOLUTION SETTING PUBLIC HEARING ON THE OPERATING BUDGET
ESTIMATE FOR THE FISCAL YEAR JULY 1, 1993, THROUGH JUNE 30, 1994,
AND THE PROPOSED TWO.YEAR FINANCIAL PLAN WHICH INCLUDES THE
CAPITAL IMPROVEMENTS PROGRAM FOR FISCAL YEARS 1994.1995.

RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO
ATTEST THE RELEASE OF A LIEN REGARDING A PROMISSORY NOTE
EXECUTED FOR PROPERTY LOCATED AT 1114 EAST DAVENPORT STREET.
IOWA CITY. IOWA.
WHEREAS. on June 7. 1978 the property owners of 1114 East Davenport Street, Iowa City,
Iowa. executed a Promissory Note to the City of Iowa City in the amount of $5,000 in
exchange for a no-interest, declining balance loan; and
WHEREAS, said Promissory Note created a lien against the subject property; and
WHEREAS. under the terms of the Promissory Note, the Principal of the above-referenced loan
was forgiven on June 7, 1981.
NOW. THEREFORE. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY.
IOWA that the Mayor is authorized to sign and the City Clerk to attest the attached Release
of Lien for recordation. whereby the City does release the affected property from an obligation
of the property owners at 1114 East Davenport Street to pay to the City the principal amount
of $5.000. which obligation was recorded in Book 256, Pages 449-450 of the Johnson
County Recorder's Office.

City in the principal amount of $5,000 represented by a Promissory Note recorded in the
Office of the Johnson County Recorder's Office on June 27, 1978, in Book 256, Pages 449-
450.
This obligation has been satisfied and the property is hereby released, in full, from any liens
or clouds upon title to the above property by reason of said prior recorded documents.

RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO
ATTEST THE RELEASE OF A LIEN REGARDING A PROMISSORY NOTE
EXECUTED FOR PROPERTY LOCATED AT 515 OAKLAND AVENUE, IOWA
CITY, IOWA.
WHEREAS, on August 26, 1985 the property owner of 515 Oakland Avanue, Iowa City,
Iowa, executed a Promissory Note to the City of Iowa City in the amount of $15.400 in
exchange for a no-interest, declining balance 10arl; and
WHEREAS, said Promissory Note created a lien against the subject property; and
WHEREAS, under the terms of the Promissory Note, the Principal of the above-referenced loan
was forgiven on August 26, 1992.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY,
IOWA that the Mayor is authorized to sign and the City Clerk to attest the attached Release
of Lien for recordation, whereby the City does release the affected property from an obligation

RELEASE OF LIEN
The City of Iowa City does hereby release the following property:
Lot Forty-seven (47) in the Subdivision of Oakes' Third Addition to Iowa City,
Iowa, according to the plat thereof recorded in Plat Book 2, page 28, Plat
Records of Johnson County, Iowa, subject to an easement for driveway over
the north five (5) feet of said lot, and also granting an easement for a driveway
over the south five (5) feet of Lot Forty-six (46) of said Subdivision, said
driveway to be for the joint use of the respective owners of said Lots 46 and
47 of said Subdivision and their respective grantees and assigns, in accordance
with the provisions of a written agreement dated April 6, 1948, and recorded
in Book 182, page 464, Recorder's Records of Johnson County, Iowa,
from an obligation of the property owner of 515 Oakland Avenue to the City of Iowa City in
the principal amount of $15.400 represented by a Promissory Note recorded in the Office of
the Johnson County Recorder's Office on August 30,1985, in Book 795, Pages 85-87,
This obligation has been satisfied and the property is hereby released, in full, from any liens

RELEASE OF LIEN
The City of Iowa City does hereby release the following property:
The west 45 feet of the east 126-8/10 feet of the north half approximately 150
feet of Outlot 7 of Iowa City, Iowa, according to the recorded plat thereof,
from en obligation of the property owner of 927 East Davenport Street to the City of Iowa
City in the principal amount of $17,500 represented by a Promissory Note recorded in the
Office of the Johnson County Recorder's Office on January 2,1985, in Book 746, Pages 96-
97.
This obligation has been satisfied and the property is hereby released, in full, from any liens
or clouds upon title to the above property by reason of said prior recorded documents,

WHEREAS, said finel plats and subdivisions are found to conform with Chapter 409A, Code
of Iowa (1991) and all other state and local requirements.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY,
IOWA THAT:
1. The said final plats and subdivisions located on the above.described real estate be and
the same are hereby approved, and the dedication of the streets and easements is
accepted as provided by law.
2. The Mayor and City Clerk of the City of Iowa City, Iowa are hereby authorized and
directed, upon approval by the City Attorney, to execute all legal documents relating
to said subdivisions, and to certify three copies of this resolution, which shall be
affixed to the final plats after passage and approval by law. The owner/subdivider
shall record the legal documents and the plats at the office of the County Recorder of

SPECIAL INFORMATION:
Public utilities:
Public water service will be provided by
a proposed six-inch water line that will
run south along the proposed extension
of Teg Drive to Aber Avenue.
A sanitary sewer line is proposed to
connect with tha southwest interceptor
sewer, which is located adjacent to
Willow Craek.
Public services:
Police, fire and sanitation services will
be provided by tha City.
Transportation:
Accass to lots within this subdivision
will be provided by the proposed exten-
sion of Teg Drive to the south. Three
cul.de-sacs are proposed. Transit ser-
vice is provided to this area by the
Wastwinds and Plaen View routes. Bus
stops are located on Benton Street,
Mormon Trek Boulevard and Sunset
Street.
Physical characteristics:
The site slopas downward from a high
point on tha east to Willow Creek loca-
ted in the western third of the subdivi-
sion. Portions of the property adjacent
to Willow Creek are within the 100
year floodplain.
BACKGROUND:
A preliminary plat of Park West Subdivision, Parts Two-Four, was racently approved by the
City Council. The applicant, K-M, is now requesting final plat approval. Proposed Parts Two-
Four include 39 lots. An approximate 14-acre parcel of open space located to the west of the
proposed subdivisions has been dedicated to the City for use as parkland.
ANALYSIS:
The final plats as submittad are in general compliance with tha approved preliminary plat. Tha
final plats contain minor daficiencies and discrepancies which are Iistad at the end of this
report. Construction plans have not yet been submitted. These must be submitted and must
be approvod by the Public Works Dapartment prior to Council consideration of the final plats.
Legal papars have been submitted and are being reviewed by the City Attorney's Office. The
legal papers should specify that the four-foot wide sidewalks will be built between Lots 28
end 29, and 56 and 56 atthe time that Woodbarry Court and Aburdeen Court are constructed.

STAFF RECOMMENDATION:
Staff recommends that the final plats of Park West Subdivision, Parts Two-Four, be deferred.
Upon resolution of the deficiencies and discrepancies listed below, staff recommends that the
plats be approved subject to staff approval of legel papers and construction plens prior to City
Council consideration of the final plats.
DEFICIENCIES AND DISCREPANCIES:
1. The boundaries of the floodway and the floodplain should be labeled on the final plats.
2. The 1 DO-year flood elevations for Lots 41-50 should be shown on the final plats.
3. All easements in Part Four should be labeled.
4. An additional property pin should be shown at the northwest corner of Lot 40.
5. The plat book and page number should be shown for Part One.
6. Construction plans must be submitted to the Public Works Department.

RESOLUTION APPROVING THE PRELIMINARY AND FINAL PLAT OF COUNTRY
HILLS, JOHNSON COUNTY, IOWA.
WHEREAS, the owner end subdivider, Jane I, Bleck, filed with the City Clerk of Iowa City,
lowe, an application for approval of the preliminary and fine I plat of Country Hills, Johnson
County, lowe; and
WHEREAS, the proposed subdivision is located in Johnson County and within Iowa Cit~'s
two-mile extraterritorial jurisdiction; and
WHEREAS, said subdivision is located on the following-described real estate in Johnson
County, Iowa:
Beginning at the Northeast Corner, of the Northeast Quarter of Section 30,
Township 79 North, Range 6 West of the Fifth Principal Meridian; Thence
SOoo05'05"E, 1323.75 feet; Thence S89010'23"W, 1320.00 feet; Thence
NOoo14'55"W, 1317.38 feet, to the North line of said Northeast Quarter;
Thence N88 0 53'59"E, along said North line 1323.86 feet, to the Point of
Beginning. Said trect of land conteins 40.07 acres, more or less, and is subject

subdivision of Country Hills and recommended that said preliminary and final plat and
subdivision be a~cepted and epproved; and
WHEREAS, the plat end subdivision heve been made in accordance with tha desires of the
owner end proprietor; and
WHEREAS, the preliminary end final plat 3nd subdivision ere found to conform with Chapter
409A, Code of Iowa, and ell other state end local requirements.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY,
IOWA:
1. The preliminary end final plet end subdivision of the above-described real estete be end

2. The Meyor end City Clerk of the City of lowe City, Iowa, ere hereby euthorized end

BACKGROUND:
Dan Black, on behalf of property owner Jane I. Black, requests a three-lot subdivision of a 40-
acre tract located along Highway 1 West approximately one mile southwest of the Highway 218
and Highway 1 Interchange. The primary purpose of the subdivision Is to accomplish a farmstead
split, that is, to separate 1 AO acres of land with an existing farmhouse from the remainder of the
property. Iowa City generally does not review farmstead splits In Johnson County. However,
3A9 acres of the 40.07 acre tract are located on the north side of Highway 1 West, and for all
practical purposes function as a separate tract. It Is the policy of the County, when this type of
situation occurs, to require that the remnant parcel be subdivided from the original tract. Thus,
three lots are involved: the 1 AO acre farmstead, the 3A9 acre remnant north of Highway 1 West
and the remainder of the 40.07 acre parcel. The requested three-lot subdivision is located within
Fringe Area 7 In Johnson County. Therefore, Iowa City review Is required. Because no new
roads are planned, the City considers this to be a minor plat.
ANALYSIS:
The subject 40-acre tract Is zoned RS, Suburban Residential, Although continued agricultural use
Is the preferred use In Area 7, the Fringe Area Agreement policy also states that limited
residential development will be considered In Area 7 where County services can be provided most
effectively. Access for the three proposed lots already exists on Highway 1 West. An existing
residence Is located on Lot 1. Lot 3 Is separated from the rest of the 40.acre tract by Highway
1 West. All utilities are currently In place. Little or no increase In population and consequently
no demand for additional services Is anticipated as a result of the proposed subdivision,
Because this tract drains to Old Man's Creek, the City does not require the submission of a
stormwaler management plan for this subdivision. A grading and erosion control plan Is required
because a blue drainage line Is shown across this property on the USGS map. The applicant has
submitted a letter stating that no grading ',vIII take place as a result of this subdivision.
STAFF RECOMMENDATION:
Staff recommends that the preliminary and final plat of Country Hills Subdivision be approved
subject to a fire rating being established by the applicant's engineer, and submittal of a letter from
the Hills Fire Protection District to the City of Iowa City, and approval of the legal papers by the
City Attorney's Off/ceo

RESOLUTION ACCEPTING THE CONVEYANCE OF APPROXIMATELY 13.98 ACRES
OF LAND BY JOHN AND ALLEGRA DANE TO THE CITY OF IOWA CITY, IOWA, FOR
USE AS PARKLAND AND A STORM WATER DETENTION FACILITY, AND NAMING
SAID TRACT OF LAND 'KIWANIS PARK'.
WHEREAS, Harold John Dane, Jr., a/k/a John Dane and Allegra G. Dane (hereinafter '1he Danes")
have executed a Warranty Deed conveying approximately 13,98 acres of land, legally described
on Exhibit "A" attached hereto, to the City of Iowa City, Iowa, to be used as parkland and a storm
water detention facility for Park West Subdivision Parts J.IV and the surrounding area; and
WHEREAS, the Danes requested that the above,descrlbed land be named "Kiwanis Park"; and
WHEREAS, the Parks and Recreation Commission recommends that the City accept this
conveyance and that the park be named "Kiwanis Park"; and
WHEREAS, It Is In the public Interest to accept said conveyance,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY,
IOWA, THAT:
The City of Iowa City, Iowa, hereby accepts the conveyance of approxlmateiy 13,98 acres
of land, legally described on Exhibit "A" attached hereto, from Harold John Dane, Jr., a/k/a
John Dane and Allegra G, Dane by Warranty Deed dated December 28, 1992, and
recorded on December 30, 1992, In Book 1484, Pages 80-81 of the Johnson County
Recorder's Office,
2. The name of said tract of land shall be "Kiwanis Park",
3. The City Clerk Is hereby authorized and directed to file a certified copy of this Resolution

Dear Council Members:
On behalf of the Iowa City-Old Capitol Kiwanis Club and its Board
of Directors, we wish to add our support to the request by John
Dane to name the land he has donated to the City of Iowa City
"Kiwanis Park".
There are 7S men and women from all walks of life forming the
membership of the Iowa City-Old Capital Kiwanis Club (list
attached). In addition, there are four other clubs serving the
Iowa City community. Kiwanis is an international service
organization with the major emphasis of our activity directed
towards projects that serve and benefit the youth of our
communities. We feel that a new park to serve the children that
live near this area, as well as those who will be moving into
this new subdivision, is another way for Kiwanis to serve this
community.
Our interest, however, is in more than just having a park with
our name on it. The club is interested in making improvements to
the park, possibly in the form of a shelter in memory of long
time Kiwanian Howard Fountain. Our club would be willing to
hold an annual clean up day and help with other projects for the
maintenance and improvement of the park in cooperation with the
Parks Department.
We appreciate this opportunity to serve our community.

WHEREAS, notice of public hearing on the plans, specifications, form of
contract and estimate of cost for the above-named project was published as
rsqnired by law, and the hearing thereon held,
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF IOWA CITY,
IOWA:
1. That the plans, specifications, form of contract, and estimate of cost

RESOLUTION NO,
RESOLUTION OF INTENTTO CONVEY PORTIONS OF VACATED OLD DUBUQUE
ROAD IN IOWA CITY, IOWA TO AMERICAN COLLEGE TESTING, AND SElTING
A PUBLIC HEARING,
WHEREAS, at their December 15, 1992, meeting, the City Council for the City of Iowa City
authorized an Agreement with American College Testing (ACl) regarding ACT's Master
Development Plan and the construction of arterial streets, by Resolution No, 92-325; and
WHEREAS, at their November 10, 1992, meeting, the City Council for the City of Iowa City
vacated portions of Old Dubuque Road right-of-way, by way of Ordinance No. 92-3555; and
WHEREAS, the Agreement between the City and ACT anticipates that the City will convey
whatever property or public easement rights they may have In the Old Dubuque right-of-way to
ACT, and will do so after vacation proceedings as provided by law; and
WHEREAS, the City now wishes to consummate the conveyance of whatever rights are remaining
to the City, and to do so according to state law set forth In Section 364.7, Code of Iowa (1991).
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY,
IOWA:
1. The Council does declare its Intent to convey whatever Interest may remain In the City
over vacated Old Dubuque Road to American College Testing (ACl) as originally agreed
to In the December 15, 1992, Agreement, and as described In Exhibit A attached hereto
and Incorporated by reference herein,
2, A public hearing on said proposal to convey Is hereby set for February 23, 1993, at 7:30
p,m, In the Council Chambers of the Civic Center, located In Iowa City, Iowa, and the City
Clerk Is hereby directed to cause notice of public hearing on the matter to be published,

RESOLUTION NO. 93-31
RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO
ATTEST, AS A CORRECTIVE LEGAL ACTION, THE RELEASE OF A SANITARY SEWER
EASEMENT LOCATED IN WINDSOR HEIGHTS SIXTH ADDITION, IOWA CITY, IOWA.
WHEREAS, on June 21, 1983, the City Council of the City of Iowa City, Iowa, approved the final
plat of Windsor Heights Sixth Addition, Iowa City, Iowa; and
WHEREAS, as part of the subdivision proceedings, the City executed a document purporting to
vacate and convey an existing sanitary sewer easement, legally described on Exhibit "A" attached
hereto, to the owner of said Subdivision, Windsor Land Corporation, In exchange for the
dedication of a new sanitary sewer easement; and
WHEREAS, Windsor Land Corporation executed a Sanitary Sewer Easement granting the City
a new easement which is recorded In Book 649, Pages 430,431 of the Johnson County
Recorder's Office; and
WHEREAS, the City's vacation and conveyance of the above.described existing sanitary sewer
easement was not accompanied by a formal resolution and, therefore, was procedurally Incorrect;
and
WHEREAS, the attached Release will remove the clouds on the titles to property located In
Windsor Heights Sixth Addition by properly releasing the above,descrlbed easement.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY,
IOWA, THAT:
The Mayor is hereby authorized to sign and the City Clerk to attest the attached Release
of Sanitary Sewer Easement.
2. The City Clerk Is hereby authorized and directed to certify a copy of this Resolution for
recordation In the Johnson County Recorder's Office together with the attached Release.
