A RESOLUTION SETfING A PUBLIC HEARING ON PLANS, SPECIFICATIONS,
FORM OF CONTRACT AND ESTIMATE OF COST FOR THE CONSTRUCTION OF
THE KIRKWOOD AVENUE RECONSTRUCfION PROJEct
DIRECTING CI'rY CLERK 1D PUBLISH NOTICE OF SAID HEARING, AND DIRECfING
THE CITY ENGINEER TO PLACE SAID PLANS ON FILE FOR PUBLIC INSPECTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY, IOWA:
1. That a public hearing on the plans, specifications, form of contract, and
estimate of cost for the construction of the above-named project is to be
held on the 2nd day of March, 1993, at 7:30 p.m. in the Council Chambers,
Civic Center, Iowa City, Iowa.
2. That the City Clerk is hereby authorized and directed to publish notice
of the public hearing for the above-named proposal in a newspaper published
at least once weekly and having a gcneral circulation in the City, not less
than four (4) nor more than twenty (20) days before said hearing.
3. That the copy of the plans, specifications, form of contract, and estimate
qf cost for the construction of the above-named project is hereby ordered
placed on file by the City Engineer in the office of the City Clerk for
public inspection.

RESOLUTION APPROVING THE VOLUNTARY ANNEXATION OF AN APPROXI.
MATE 19.18 ACRE TRACT OF LAND LOCATED SOUTH AND EAST OF THE
INTERSECTION OF SUNSET STREET AND HIGHWAY 1.
WHEREAS, John and Allagra Dane own an approximate 19.18 acre tract of land located south
and east of tha intersection of Sunset Street and Highway 1; and
WHEREAS, John and Allagra Dane have requested annexation of their land into the City of
Iowa City; and
WHEREAS, this tract is contiguous to the corporate limits of the City; and
WHEREAS, the City can provide municipal services to this land; and
WHEREAS, pursuant to Iowa Code ~368. 7, notice of the application for annexation was sent
by certified mail to the Johnson County Board of Supervisors and the East Central Iowa
Council of Govarnments; ann
WHEREAS, the Johnson County Board of Supervisors and the East Central Iowa Council of
Governments have expressed no objections to the proposed annexation.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY,
IOWA THAT:
1. The following'described land shall be voluntarily annexed to the City of Iowa City,

Way Line of Iowa Primary Road No.1, which is the POINT OF BEGINNING;

Section 21, 826.66 feet, to the Northeast Corner of the Northwest Quarter of
said Northwest Quarter of Section 21; Thence SOl 047'41 "W, along the East
Line of said Northwest Quarter, 583.50 feet, to its intersection with the

RE: Airport Relocation Feasibility Study
On February 16, 1993, the Airport Commission conducted a public
hearing to receive information concerning the above referenced
study. The study was designed to determine the aviation
requirements of the Iowa City/Johnson County area and to provide
suggestions for implementing those requirements.
Three options for utilizing the present site were discussed.
Option 1 would be based on the current runway configuration.
options 2 and 3 would require construction of a new runway. (See
attached drawing for Option 3)

The Runway Protection Zone and the Obstacle Free Zone for the new
runway in Option 3 would impact commercial development in the
proposed Dane annexation. The northwest end of the runway would
need to be located further west than shown on the attached drawing
to avoid conflict with the current Walmart development. This would
shift the Runway Protection Zone to the west and increase the
impact on the proposed annexation property. Option 3 would require
purchasing some of this property.
The Commission voted to recommend to the city Council that Option
3 in the Feasibility study for developing the present site is not
a viable option. The option was one of the most expensive proposals
and would not significantly enhance the safety or utility of the
Airport.
Comments were made concerning allowing any further development in
the vicinity of the Airport until a decision is made concerning how
to proceed with the Airport Master Plan. Residential and
commercial encroachments are a major factor in considering an
alternative site for the Airport. If the Airport remains at the
present location, additional development near the Airport would
increase safety concerns and limit future options.

and Runways 17.35 and 12.30 would be closed

WHEREAS, the owner, Bruce Glasgow, filed with the City Clerk the final plat of First and
Rochaster Commercial Subdivision, Part Ona, Iowa City, Johnson County, Iowa; and

WHEREAS, a dadicatlon has been made to the public, and the subdivision has baen made with
the free consent and in accordance with the desires of the owners and proprietors; and
WHEREAS, said final plat and subdivision are found to conform with Chapter 409A, Code of
Iowa (1991) and all other state and local requirements.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY,
IOWA, THAT:
1. The final plat and subdivision located on the above.described real estate be and the
same are hereby approved, and the dedication of the streets and easements is
accepted as provided by law.
2. The Mayor and City Clerk of the City of Iowa City, Iowa, are hereby authorized and
directed, upon approval by the City Attorney, to execute all legal documents relating
to said subdivision, and to certify a copy of this resolution, which shall be affixed to
the final plat after passage and approval by law. The owner/subdivider shall record the
legal documents and the plat at the office of the County Recorder of Johnson County,

CONSTRUCTION, INC. AND THE CITY OF IOWA CITY, IOWA CONCERNING
STORMWATER MANAGEMENT OBLIGATIONS FOR MT. PROSPECT ADDITION,
PARTS VNIII.
WHEREAS, on July 7, 1992, lhe City Council approved an Ancillary Agreement Between Frantz
Construction, Inc. and the City of Iowa City, Iowa Concerning Stormwater Management
Obligations for Mt. Prospect Addition, Paris V-VIII (hereinafter "Ancillary Agreement") wherein the
Parties agreed to transfer Frantz's stormwater management obligation from Mt. Prospect Addition,
Part V to Mt. Prospect Addition, Parts VI.Vlllln order to allow the City to Investigate the possibility
of constructing a regional stormwater management facility In Mt. Prospect development area; and
WHEREAS, Section 2 of said Agreement required the City to conclude its Investigation of a
regional stormwater management facility and make a decision on the possible regional
stormwater management facility no later than the final plat of Mr. Prospect Part VI or January 1,
1993, whichever was earlier; and
WHEREAS, the City has not concluded Its Investigation of a regional stormwater management
facility; and
WHEREAS, It Is In the public Interest to permit the City to complete Its Investigation and thereby
achieve an overall regional solution to the stormwater management control In the area; and
WHEREAS, the Amended Ancillary Agreement axtends the deadline for making a decision on the
possible regional stormwater management facility.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY,
IOWA, THAT:
1, It Is In the public Interest to execute the Amended Ancillary Agreement to extend the
deadline for the City to make a decision regarding a possible regional stormwater
management facility,
2. The Mayor is hereby authorized to execute and the City Clerk to attest the Amended
Ancillary Agreement, a copy of which Is attached hereto.
3. The City Clerk Is authorized to certify a copy of this Resolution for recordation, along with
the Amended Ancillary Agreement, In the Office of the Johnson County Recorder.

FOR MT. PROSPECT ADDITION, PARTS V-VIII
This Agreement Is made by and between the City of Iowa City, Iowa, a Municipal Corporation
(herelnafter'1he City") and Frantz Construction Company, Inc., an Iowa Corporation (hereinafter
"Frantz").
WHEREAS, on July 7,1992, the City Council approved an Ancillary Agreemeni Between Frantz
Construction, Inc. and the City of Iowa City, Iowa Concerning Stormwater Management
Obligations for Ml. Prospect Addition, Parts V-VIII (hereinafter "Ancillary Agreement") wherein the
Parties agreed to transfer Frantz's stormwater management obligation from Ml. Prospect Addition,
Part V to Ml. Prospect Addition, Parts VI-VIII In order to allow the City to Investigate the possibility
of constructing a regional stormwater management facility In Mt. Prospect development area; and
WHEREAS, Section 2 of said Agreement required the City to conclude its Investigation of a
regional stormwater management facility and make a decision on the possible regional
stormwater management facility no later than the final plat of Mr. Prospect Part VI or January 1,
1993, whichever was earlier; and
WHEREAS, the City has not concluded Its Investigation of a regional stormwater management
facility; and
WHEREAS, It Is In the public Interest to permit the City to complete Its Investigation and thereby
achieve an overall raglonal solution to the stormwater management control In the area; and

WHEREAS, the Parties now wish to amend the Ancillary Agreement to extend the deadline for
making a decision on the possible regional stormwater management facility.
NOW THEREFORE, THE PARTIES AGREE AS FOllOWS:
1. The Parties acknowledge that the original Ancillary Agreement required the City to
conclude Its Investigation of a regional stormwatar management facility, and to make a
decision on the possible regional stormwater management facility within a reasonable
time, and no later than the final plat of Ml. Prospect Part VI or January 1, 1993, which
ever was earlier.
2. The Parties acknowledge that the City has not yet completed Its Investigation of the
possible regional stormwater management facility and Is, therefore, not In a position to
make a decision on the possible regional stormwater management facility at this time.
3. The original Ancillary Agreement dated July 7, 1992, and recorded In Book 1117, Pages
232-235 of the Johnson County Recorder's Office shall be and Is hereby amended by
deleting the first paragraph of Section 2 of said Agreement In Its entirety and Inserting In
lieu thereof the following:
2. In consideration for Frantz's agreement to transfer this obligation from Mt.
Prospect Addition, Part V to Parts VI.VIII, City agrees to conclude its Investigation

4. The Parties acknowledge that this Amended Ancillary Agreement shall be deemed to be
a covenant running with the land and with the title to the land. The Parties further
acknowledge that this Agreement shall Inure to the benefit of and bind all successors,
representatives and assigns of the Parties. .
5. The Parties agree that nothing In this Amended Ancillary Agreement In any way alters,
amends or modifies the original Ancillary Agreement except as set forth above.
6. The Parties agree that the extension of the City's deadline for making a decision
regarding the possible regional stormwater management facility does not In any way
adversely affect the City's Interests.
7, The Parties agree that the City shall record this Amended Ancillary Agreement in the
Johnson County Recorder's Office.

RESOLUTION NO. 93-36
RESOLUTION GRANTING TEMPORARY USE OF A PORTION OF THE DUBUQUE
STREET RIGHT-OF.WAY AND AUTHORIZING THE EXECUTION OF AN
AGREEMENT FOR TEMPORARY USE OF PUBLIC RIGHT-OF.WAY BETWEEN
THE CITY OF IOWA CITY AND THE FIRST NATIONAL BANK OF IOWA CITY.
WHEREAS, the First National Bank of Iowa City ("First National") has undertaken the
construction of new banking facilities adjacent to the existing building located in the south
one-half of Block 66, Original Town, bounded by Dubuque, Washington, Linn Streets end Iowa
Avenue; and
WHEREAS, First National is ready to commence remodaling of the existing building, and
wishes to secure the construction site against pedestrian and vehicular traffic, while providing
for the removal of demolition materials so as not to interfere with public safety; and
WHEREAS, the City of Iowa City ("City") acknowledges First National's need to temporarily
permit the bank to occupy a portion of the Dubuque Street right-of-way, in order to remodel
the existing facility located on or near the property line fronting public streets; and
WHEREAS, First National and City also acknowledge the City's need to assure a safe
construction site at a properly safe distance from traffic, so as not to impede traffic or
endanger lives or property; and
WHEREAS, Section 364.12, Code of Iowa (1991) provides that streets and alleys mey be
temporarily closed by resolution; and
WHEREAS, an Agreement for the Use of Public Right-of-Way setting forth certain conditions
has been prepared, and is attached to this Resolution.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY,
IOWA, THAT:
1. It is in the public interest to protect public rights.of-way and traffic safety while, at the
same time, eccommodating construction on private property, end City and First
National acknowledge same.
2. The Agreament for Temporary Use of Public Right-of-Way Between the City of Iowa
City and the First National Bank of Iowa City concerning City right-of-way on Dubuque
Street ebutting the bank building property in Block 66, Original Town, which
Agreement is attachad hereto and incorporatad by reference herein, is hereby approved
as to form and content, and the Mayor and City Clark are hereby authorized to execute
and attest the Agreement for and on behalf of the City of Iowa City, for recordation
in the Johnson County Recorder's Office,

AGREEMENT FOR TEMPORARY USE OF PUBLIC RIGHT-OF-WAY
BETWEEN THE CITY OF IOWA CITY AND THE FIRST NATIONAL BANK OF IOWA CITY
This Agreement Is made between The First National Bank of Iowa City ("First National") and the
City of Iowa City, a municipal corporation ("City").
WHEREAS, the First National Bank ("First National") has undertaken the construction of new
banking facilities adjacent to the existing building located In the south one-half of Block 66,
Original Town, bounded by Dubuque, Washington, Linn Streets and Iowa Avenue; and
WHEREAS, First National Is ready to commence remodeling of the existing building, and wishes
to secure the construction site against pedestrian and vehicular traffic, while providing for the
removal of demolition materials so as not to Interfere with public safety; and
WHEREAS, City and First National acknowledge the need to temporarily permit First National to
occupy a portion of the Dubuque Street rlght.of-way, In order to remodel the existing facility
which Is located on or near the property line fronting a public street; and
WHEREAS, the parties acknowledge the City's need to assure a safe construction site at a
properly safe distance from traffic, so as not to Impede traffic or endanger lives or property; and
WHEREAS, the City agrees to temporarily close certain street rlght.of.way to accommodate said
construction, as set out below.
NOW, In mutual consideration of the promises herein, City and First National agree as follows:
1. The City agrees to temporarily close the following street rlghts-of.way:
The public sidewalk along Dubuque Street adjacent to First National Bank building for the
\ purpose of constructing a covered walkway, together with the parking area along the east
side 01 Dubuque Street adjacent to the bank building as necessary to remove demolition
materials and deliver construction materials and equipment (hereafter "remporary
Easement Area").
2. First National agrees a covered walkway will be constructed and placed as required by
the City'S Building Inspection Division.
3. First National agrees all vehicles and equipment using the Temporary Easement Area
shall be located off the travelled portion of the roadway and lurther agrees to reimburse
the City's Parking Dlvlslcn lor the revenue Irom lost use 01 the parking meters In the
Temporary Easement Area.
4. First National agrees to provide and keep In place and In good working condition slgnage
necessary to
a. Reroute pedestrians.
b. Provide advance warning.
c. Provide lor the orderly and predictable movement 01 traffic.
All slgnage shall be In accordance with the Federal Highway Administration Manual on
Uniform Traffic Control Devices.

5. After construcUon Is completed, First NaUonal further agrees to restore all of the
Temporary Easement Area to Its pre.construcUon condlUon, and to do so to the City's
saUsfactlon.
6. Parties agree this Agreement shall be In effect for a period not to exceed eight (8) months
beginning with the date of this Agreement and ending upon substantial compleUon of First
NaUonal's remodeling herein.
7. In the event of breach of this Agreement, City may, at Its discreUon, elect to give noUce
to First NaUonal to remove all construcUon equipment and/or obstructions from the City
right-of-way hereabove described, as provided In Section 364.12, Code of Iowa (1991);
and In the event First NaUonal does not comply with the Ume period designated in the
NoUce to Remove, City may elect to remove, or direct removal, of the equipment and/or
any other obstrucUons from the right-of-way, and to assess the cost of such removal
against First NaUonal's property, as provided by law.
8. First NaUonal agrees to Indemnify, defend and hold the City harmless against any and all
claims arising out of this Agreement, Including any claims and/or liability which the City
may Incur as a result of its decision to permit temporary use of Its right-of-way. First
NaUonal further agrees to carry Class II liability Insurance In minimum amounts of
$500,000 each occurrence, $1,000,000 aggregate bodily Injury, $250,000 aggregate
property damage with contractualllabllily coverage Included. First National shall furnish
a certificate of Insurance of said Insurance satisfactory to the City.
9. First NaUonal agrees to assume responsibility for any and all property losses, personal
Injuries and damage claims arising out of Its use of the street right-of-way Incurred by
reason of the negligence of First NaUonal or Its agents or employees.

WHEREAS, the Iowa Community Economic Betterment Account (CEBA) program provides loans
to cities to promote economic development and create long.term employment opportunities; and
WHEREAS, It is In the public interest to use State funding to encourage economic development
in Iowa City, Iowa; and
WHEREAS, the City of Iowa City desires to apply for and obtain $300,000 in CEBA funding from
the Iowa Department of Economic Development In the form of a forgivable loan, In order to assist
In the expansion of the Millard Refrigerated Services facility In Iowa City, Iowa, by Iowa Processed

Financial Assistance for Iowa Processed Meats Inc.
Iowa Processed Meats Inc. has selected to locate a facility in Iowa City contingent upon the
company receiving Community Economic Betterment Account (CEBA) funding. Iowa
Processed Meats Inc. requests that the City submit an application for a $300,000 forgivable
loan from the State's CEBA program. Adoption of the resolution on the agenda authorizes the
submission of a CEBA application with the City as the applicant and the business as Iowa
Processed Meats Inc. A copy of the application is enclosed in the council packet. The
following summarizes information from the application regarding the proposed operation.
The Company & Project
Iowa Processed Meats Inc. lIPM) is a newly formed company that would be operating a
specialized ham processing operation in Iowa City. IPM would lease space in the Millard
Refrigerated Services bUilding which is located in BDllndustrial Park. In addition, Millard
Refrigerated Services would provide a personal guarantee of $300,000 as security for the
forgivable loan IPM is requesting,
Through the use of specialized equipment, IPM would be producing high quality hams from
pork carcasses which would be shipped in by truck or rail. The hams are considered high
quality because they would not contain the injection of a water/chemical solution that results
in a lower grade ham and a reduced shelf life (The contents of traditional hams can apparently
contain as much as 50% water and chemicalsl.
Iowa Processed Meats Inc, would be leasing over 52,000 square feet from Millard
Refrigerated Services. Ten thousand square feet would be in the form of an addition to the
Millard building, and the other 42,000 square feet would consist of remodelled space in the
existing Millard bUilding. The improvements and additions for the proposed facility are
estimated to cost approximetely $2,2 million, and the proposed operation would include
approximately $3.5 million in machinery & equipment,
The operation expects to employ 150 workers after two years and would offer an average
wage rate of $7.75 per hour plus fringe benefits, Ninety.five percent of the company's total

operating expenditures would be spant within the state, while nearly ninety-five percent of
the company's sales would take place outside the state.
Flnanclel Assistance
Iowa Processed Meats Inc. has considered locating the proposed facility at either the Iowa
City site or e site outside the state. IPM considers financial assistance important to the
success of the project.
The CEBA application requires local financial participation in the project. Local financial
assistance for this project includes reduced electricity rates for five years from Iowa-Illinois
Gas & Electric Company, partial property tax exemption authorized by city ordinance, and jobs
training funds through the Iowa Industrial New Jobs Training Program (part of the funding for
the jobs training program comes from property taxes from the increased value of the building,
machinery and equipment!.
Iowa Processed Meats Inc. requests that the City submit an application for a $300,000
forgivable loan from the State's Community Economic Betterment Account (CEBA). Adoption
of the resolution for the CEBA application on the agenda would accomplish this. City staff
would then continue to work with the company, ICAD, and the State to complete the
necessary actions to locate the facility in Iowa City.

business. Iowa Processed Meats. Inc. was formed to fill a niche in the processed
meat industry. That niche was brought about by consumer demands for e higher
quelity, healthier product that was lower in fst/sodium; uniform in shape; he~
less preservatives, yet a long shelf life. Articles in Meat Processors Magezine,
Processed Prepared Foods, and National Provisioner have focused on the high
market demand for thiscype of processed prouuct by consumers.

I am writing on behalf of Iowa Processed Meats, Inc" who is currently
reviewing locating a 50,000 sq. ft. food processing operation in the mid-west.
They are giving strong consideration to locating at the Millard Refrigerated
Services' facility in Iowa City.
Millard is prepared to make a commitment to proceed forward with this
project by constructing and equipping the new facility depending upon favorable
approval from the State for the request for a forgivable loan of $300,000.00
under CEBA.
A formal commitment of funds from Millard will be forwarded to the
State upon approval for CEBA funding.

City Incentives: the City onowa City can apply on your behalf for a Community
l'Jconomic Betterment AccounL (CEBA) as well as various state incentive programs.
'l'he city also allows for a partial property tax exemption for industrial property.
Basod on an estimated assessed value of $1.1 million fol' the value added t.o the
proposed site (only the building value is included) and a millage rate of
approximately $30.00/$1,000 assessed value, the total amounL of tax abated over
the 6-year abatement period would be approximaLely $74,250. (See Attaelnnent A
for more detail,)
Job 'l'ralning Program: based on plant construction of $1.1 million, new
equipment installation at $4 million, and a workforce of150 @ $7 per hour, the total
dollars available for the 280B ConLract would be $495,000.00 with $338,807.50
actual job training dollars available. 'l'ms program would be administered Lhrough
Kirkwood Community College.
Gas & Electric Custs: Iowa-ll1inois' Gas nnd Electric Company based elecLric
billing Cl'i\culalions on electrical usage of 1,726,000 kWh accumulated over a 6-
month period. The plaut operates 2.shifts, five days per week. A separate electrical
metor is to be installed for the added load and the load qualifies for billing on Large
Industrial Electric Ral.e No. 41. The company will be responsiblo for the
transformer (rental from Iowa-Illinois Gas & Electric is possible) and elecLric cables
and the conduit. ElecLric demand is estimated to be 760kW and 65 percent of tho

Using Ule above parameters, they estimated the annual electrIc b1ll for tile 20,000
sq. ft. expansion to be $210.571.48 or 5.09 cents per kilowatt hour. See
Attachment B.
Natural Gas billing calculations were made based on a given natural gas load of
1,891,000 cubic feet accumulated over a 5.month period, /\gain, metering will
be separate from that of the existing plant. Billing was calculated under
Commercial and Industrial Gas Rate No. 70 .- a firm [non-Interruptible) rate.
Using the above parameters, they estimate annual natural gas billing for the
20,000 sq. ft. expansion to be $19,641.97 or 42.43 cents per thermo Please note
Ulut gas market condItions playa Significant role in the price of natural gas, so
these prices will fluctuate monthly. See Attachment C for a copy of the gas
calculations.
Water and Sewage: We received the following calculations from the City of Iowa
City regarding your criteria for water and sewage:

New Jobs ,Training Program (260 E/F) This innovative job training program
was 'established ten years ago by th Iowa Legislature and has distributed
over 150 million dollars to over 60 businesses that have either expanded or
located in Iowa, resulting in the c eat ion of over 47,000 new jobs.
Each contract is funded by the sale of tax exempt and/or taxable certificates
and repaid OVer 10 years through th diversion of property taxes from the

Within the limits of the available unding, the training dollars ,can be used
to pay any direct training expenses such as instructional development,
employee pre-screening and assessme t co~tsl instructor salaries, travel and
housingl employee travel and hOU$in expenses, either domestic or
international; training materials a d equipment. Up to 50% of the training
dollars may also be used to pay up 0 501. of the new employees gross wages
for a reasonable on-the-job train in period. Pinancial assistance may also
be available through Kirkwood's Dis ocated Worker Center and the local JTPA
office.
We would encourage you to enter int a preliminary contract as soon as
possible in order to capture sny ne employees that you ~i11 be hiring. We
have to have an approved preliminar contract in place before a new employee
is hired in order for that employee to benefit from the proceeds of the
contract and for that employees wit holding to be eligible as part of the
repayment income stream. The Kirkw od board of directors meets twice a
month. We need to have signed cont acts in hand one week prior to those
meetings. A contract can be prepar d with a few days lead time.
A preliminery'contract is a non-bin ing agreement. The only financial
obligation being committed to by th company is payment of our legal expenses
in preparing the contract if they c oose not to go to e final contract for
,
some reason. This amounts to only everal hundred dollars.
A preliminary contract sets the off cia1 starting date of the project. All
eligible training can be reimbursed back to the date of the preliminary
contrect regardless of when the fin 1 contract is approved and the bond sales
proceode recoived. 'A preliminary a reement can remain in force for an
indefinite period of time. I have ttached an information sheet describing
hQW the program works and what cons itutes an eligible training expense.

We're very pleased to learn, Millard Refrigerated Services'
Iowa City plant is among the final choices for expansion.
In fOllow-up to the inquiry you received from Jean Mahr
about energy costs, we have reviewed the proposed electric load
and will offer an economic development incentive rate for the
added load. We very much appreciate, the privilege of serving
Millard and wish to make Iowa city even more attractive to them
as a'location for their expansion.

We estimate our Incentive Electri!; Rate will reduce the amount
billed to Millard Refriqerated Services a total of $161.800 over
a five vear period. This special rate will reduce demand charges
on the new load by 75% in Year 1 and Year 2, by 50% in Year 3,
and by 25% in Year 4 and Year 5. Full rates will be in effect
beginning in Year 6. Attachment 1 is a chart which summarizes
the Incentive Rate Proposal and Attachment 2 provides the base
calculation used. Under this incentive program, we estimate
electric costs at the plant will be $.0423 per kWh in Year 1 and
Year 2, $.0437 in Year 3, and $.0451 per kWh in Year 4 and Year
5.
Based on my conversation with Jean Mahr, Millard now wishes
to be billed for electric service as though through one meter.
In all likelihood, this means a second meter will have to be
installed and then totalized with the original meter. That is
acceptable to us and we'll provide the second meter for them.
The bill will then show a breakdown of kWh's for both the old
meter and the new meter. The incentive rate offering discussed
above assumes metered quantities are totalized.
The incentive rate offering proposed is based on added
electric load of 750 kW and monthly electric usage of 344,800
kWh. Obviously, if less electric load is added, the savings will
be less and if more load is added, the savings will be more.

Calculations were made under Large Industrial Rate 41. This
is the current rate at the existing facility. Millard will be
responsible for the transformer (rental from us is possible) and
electric cables and conduit, and a second metering point.
We understand the city of Iowa city allows only a single
main electric disconnect per building. I mention this so that
Millard is aware. We believe it would be beneficial for
Millard's engineers to get together with our engineers and the'
city to discuss electrical system requirements for their plant
addition.
We offer the economic development rate mentioned above with
three caveats. First, the Iowa utilities Board requires us to do
a cost/benefit analysis to ensure the project makes good economic
sense and does not result in unfair competition by competing
companies. This will require Millard to provide details about
the project, the type of product to be processed, and who the
competition is.
Secondly, we would like to discuss ways in which we could
work with Millard to ensure their new facility is energy
efficient. since Millard will be constructing a new facility,
the company is in an excellent position to take advantage of an
energy efficiency program which we offer. We've taken a very
flexible approach in our program and offer monetary assistance in
the 'form of cash rebates for efficiency improvements as well as
technical assistance when appropriate. There are no strings
attached as to what must be done. We simply would like an
opportunity to share ideas and work with Millard to improve the
efficiency of their building.
Finally, we will not stand alone. Our proposal requires the
city of Iowa city to financially participate in the project in
some substantial way.
Again Marty, we are delighted Iowa city is still being
considered for Millard's expansion. We believe our incentive
electric rate proposal affirms our commitment to the project.

PUBLIC HEARING FOR MARCH 16,1993.
WHEREAS, Robin M. Haaland and Jennifer L. Haaland own property located at 2248 Russell
Drive, Iowa City, Iowa; and
WHEREAS, a portion of a five foot wooden fence for the Haalands' lot currently encroaches on
approximately 474 square feet of Clty.owned property located at 2256 Russell Drive, Iowa City,
Iowa; and
WHEREAS, the City wishes to allow the Haalands' to retain their fence while at the same time
protecting a large pine tree that exists In that area,
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY,
IOWA, THAT:
1. The City Council does hereby declare its Intent to convey Its Interest In the property
described below to Robin M. Haaland and Jennifer L. Haaland, subject to a tree
conservation easement and a utility easement:
Beginning at the Northwest Corner of Lot 204, Hollywood Manor Addition, Part
Five, to Iowa City, Iowa, as recorded In Plat Book 13, at Page 16, of the Records
of the Johnson County Recorder's Office; Thence S65'43'04"E, along the North
line of said Lot 204, 127.53 feet to the Northeast Corner of said Lot; Thence
Sl9'32'41'W, along the Easterly line of said Lot, 7.70 feet; Thence N62'19'46'W,

LOCATED AT 1421 WATERFRONT DRIVE TO MOSS FARMS, AN IOWA GENERAL
PARTNERSHIP, AS A CORRECTIVE LEGAL ACTION, AND SElliNG A PUBLIC
HEARING FOR MARCH 16, 1993.
WHEREAS, In August, 1988, the City vacated the Westerly 8 leet of Waterfront Drive; and
WHEREAS, the City did not execute a quit claim deed lor the vacated portion 01 the street which
Is located on the property located at 1421 Waterfront Drive; and
WHEREAS, the City may possess rights as successor In Interest to a lormer territorial road rlght-
ol.way located on 1421 Waterfront Drive; and
WHEREAS, Waterfront Drive approximately covers that rlght-ol-way, It Is not possible to ascertain
the precise location 01 the lormer territorial road and thereby Identify the precise area that may
be subject to the City's rights as successor In Interest; and
WHEREAS, the City's potential Interest In the lormer territorial road rlght.ol.way create$ a cloud
on the title to the property located at 1421 Waterfront Drive.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY,
IOWA, THAT:
1, The City Council does hereby declare Its Intent to convey Its Interest In the property
described on Exhibit "A" attached hereto to Moss Farms, an Iowa General Partnership,
subject to recorded easements.

RESOLUTION OF INTENT TO CONVEY, BY QUIT CLAIM DEED, PORTIONS OF
VACATED OLD DUBUQUE ROAD IN IOWA CITY, IOWA TO AMERICAN
COLLEGE TESTING, AND SETTING A PUBLIC HEARING FOR MARCH 16,
1993.
WHEREAS, at their December 15, 1992, meeting, the City Council for tha City of lowe City
authorized en Agreement with American College Testing (ACT) regerding ACT's Master
Development Plen and the construction of erterial streets, by Resolution No. 92-325; and
WHEREAS, at their November 10, 1992, meating, the City Council for the City of Iowa City
vacated portions of Old Dubuque Road right-of-way, by way of Ordinance No. 92-3555; and
WHEREAS, the Agreement between the City end ACT anticipates that the City will convey
whatever property or public easement rights they may have in the Old Dubuque right-of-way
to ACT, and will do so after vacation proceedings as provided by law; and
WHEREAS, the City now wishes to consummate the conveyance of whatever rights are
remaining to the City, and to do so according to state law set forth in Section 364.7, Code
of Iowa (1991).
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY,
IOWA:
1. The Council does declare its intent to convey whatever interest may remain in the City
over vacated Old Dubuque Road to American College Testing (ACT) es originally
agreed to in the December 15, 1992, Agreement, and as described in Exhibit A
attached hereto and incorporated by reference herein.
2. A public hearing on seid proposal to convey is hereby set for March 16, 1993, at 7:30
p.m. in the Council Chambers of the Civic Center, located in Iowa City, Iowa, and the
City Clerk is hereby directed to cause notice of public hearing on the matter to be
published, as provided by law.
3. The City Attorney is hereby directed to prepare and execute all additional documents,
in preparation for closing and consummation of the convayance.

RESOLUTION CERTIFYING UNPAID SIDEWALK REPAIR CHARGES AND
UNPAID SNOW REMOVAL CHARGES TO JOHNSON COUNTY FOR COLLEC-
TION IN THE SAME MANNER AS A PROPERTY TAX.
WHEREAS, Section 364.12 of the Code of Iowa provides that the City Council may certify unpaid
sidewalk repair and unpaid snow removal charges to Johnson County, for collection In the same
manner as a property tax; and
WHEREAS, there exist unpaid sidewalk repair and unpaid snow removal charges for the owners
and properties, and In the amounts specified In Exhibit A, aUached to this Resolution and by this
reference made a part hereof; and
WHEREAS, the Council finds that the property owners have received a written notice by certified
mall, return receipt requested, of the dale and time for the City Council's consideration of this
resolution, at which time the property owners may appear before the Council and be heard
concerning the unpaid charges.
NOW, THEREFORE, BE IT RESOLVED BYTHE CITY COUNCIL OFTHE CITY OF IOWA CITY,
IOWA:
That the City Clerk Is hereby authorized to certify to Johnson County, Iowa, for collection In the
