That a public hearing on the plans, specifications, form of contract, and estimate of cost for the construction of the above-named project is to be held on the 2nd day of March, 1993, at 7:30 p.m. in the Council Chambers, Civic Center, Iowa City, Iowa. 2. That the City Clerk is hereby authorized and directed to publish notice of the public hearing for the above-named proposal in a newspaper published at least once weekly and having a gcneral circulation in the City, not less than four (4) nor more than twenty (20) days before said hearing. 3. MATE 19.18 ACRE TRACT OF LAND LOCATED SOUTH AND EAST OF THE INTERSECTION OF SUNSET STREET AND HIGHWAY 1. WHEREAS, John and Allagra Dane own an approximate 19.18 acre tract of land located south and east of tha intersection of Sunset Street and Highway 1; and WHEREAS, John and Allagra Dane have requested annexation of their land into the City of Iowa City; and WHEREAS, this tract is contiguous to the corporate limits of the City; and WHEREAS, the City can provide municipal services to this land; and WHEREAS, pursuant to Iowa Code ~368. 7, notice of the application for annexation was sent by certified mail to the Johnson County Board of Supervisors and the East Central Iowa Council of Govarnments; ann WHEREAS, the Johnson County Board of Supervisors and the East Central Iowa Council of Governments have expressed no objections to the proposed annexation. The study was designed to determine the aviation requirements of the Iowa City/Johnson County area and to provide suggestions for implementing those requirements. Three options for utilizing the present site were discussed. Option 1 would be based on the current runway configuration. options 2 and 3 would require construction of a new runway. (See attached drawing for Option 3) \ ! ! l , ! 1 , I " ~ , ,. . , i . i j The Runway Protection Zone and the Obstacle Free Zone for the new runway in Option 3 would impact commercial development in the proposed Dane annexation. The northwest end of the runway would need to be located further west than shown on the attached drawing to avoid conflict with the current Walmart development. This would shift the Runway Protection Zone to the west and increase the impact on the proposed annexation property. Option 3 would require purchasing some of this property. The Commission voted to recommend to the city Council that Option 3 in the Feasibility study for developing the present site is not a viable option. The option was one of the most expensive proposals and would not significantly enhance the safety or utility of the Airport. Comments were made concerning allowing any further development in the vicinity of the Airport until a decision is made concerning how to proceed with the Airport Master Plan. Residential and commercial encroachments are a major factor in considering an alternative site for the Airport. AND THE CITY OF IOWA CITY, IOWA CONCERNING STORMWATER MANAGEMENT OBLIGATIONS FOR MT. PROSPECT ADDITION, PARTS VNIII. WHEREAS, on July 7, 1992, lhe City Council approved an Ancillary Agreement Between Frantz Construction, Inc. and the City of Iowa City, Iowa Concerning Stormwater Management Obligations for Mt. Prospect Addition, Paris V-VIII (hereinafter "Ancillary Agreement") wherein the Parties agreed to transfer Frantz's stormwater management obligation from Mt. Prospect Addition, Part V to Mt. Adoption of the resolution on the agenda authorizes the submission of a CEBA application with the City as the applicant and the business as Iowa Processed Meats Inc. A copy of the application is enclosed in the council packet. The following summarizes information from the application regarding the proposed operation. The Company & Project Iowa Processed Meats Inc. lIPM) is a newly formed company that would be operating a specialized ham processing operation in Iowa City. IPM would lease space in the Millard Refrigerated Services bUilding which is located in BDllndustrial Park. In addition, Millard Refrigerated Services would provide a personal guarantee of $300,000 as security for the forgivable loan IPM is requesting, Through the use of specialized equipment, IPM would be producing high quality hams from pork carcasses which would be shipped in by truck or rail. The hams are considered high quality because they would not contain the injection of a water/chemical solution that results in a lower grade ham and a reduced shelf life (The contents of traditional hams can apparently contain as much as 50% water and chemicalsl. Iowa Processed Meats Inc, would be leasing over 52,000 square feet from Millard Refrigerated Services. Ten thousand square feet would be in the form of an addition to the Millard building, and the other 42,000 square feet would consist of remodelled space in the existing Millard bUilding. Local financial assistance for this project includes reduced electricity rates for five years from Iowa-Illinois Gas & Electric Company, partial property tax exemption authorized by city ordinance, and jobs training funds through the Iowa Industrial New Jobs Training Program (part of the funding for the jobs training program comes from property taxes from the increased value of the building, machinery and equipment!. We have to have an approved preliminar contract in place before a new employee is hired in order for that employee to benefit from the proceeds of the contract and for that employees wit holding to be eligible as part of the repayment income stream. The Kirkw od board of directors meets twice a month. We need to have signed cont acts in hand one week prior to those meetings. A contract can be prepar d with a few days lead time. A preliminery'contract is a non-bin ing agreement. The only financial obligation being committed to by th company is payment of our legal expenses in preparing the contract if they c oose not to go to e final contract for , some reason. This amounts to only everal hundred dollars. A preliminary contract sets the off cia1 starting date of the project. All eligible training can be reimbursed back to the date of the preliminary contrect regardless of when the fin 1 contract is approved and the bond sales proceode recoived. In fOllow-up to the inquiry you received from Jean Mahr about energy costs, we have reviewed the proposed electric load and will offer an economic development incentive rate for the added load. We very much appreciate, the privilege of serving Millard and wish to make Iowa city even more attractive to them as a'location for their expansion. I We estimate our Incentive Electri!; Rate will reduce the amount billed to Millard Refriqerated Services a total of $161.800 over a five vear period. This special rate will reduce demand charges on the new load by 75% in Year 1 and Year 2, by 50% in Year 3, and by 25% in Year 4 and Year 5. Full rates will be in effect beginning in Year 6. Attachment 1 is a chart which summarizes the Incentive Rate Proposal and Attachment 2 provides the base calculation used. Under this incentive program, we estimate electric costs at the plant will be $.0423 per kWh in Year 1 and Year 2, $.0437 in Year 3, and $.0451 per kWh in Year 4 and Year 5. Based on my conversation with Jean Mahr, Millard now wishes to be billed for electric service as though through one meter. In all likelihood, this means a second meter will have to be installed and then totalized with the original meter. That is acceptable to us and we'll provide the second meter for them. The bill will then show a breakdown of kWh's for both the old meter and the new meter. The incentive rate offering discussed above assumes metered quantities are totalized. The incentive rate offering proposed is based on added electric load of 750 kW and monthly electric usage of 344,800 kWh. Millard will be responsible for the transformer (rental from us is possible) and electric cables and conduit, and a second metering point. We understand the city of Iowa city allows only a single main electric disconnect per building. I mention this so that Millard is aware. We believe it would be beneficial for Millard's engineers to get together with our engineers and the' city to discuss electrical system requirements for their plant addition. We offer the economic development rate mentioned above with three caveats. First, the Iowa utilities Board requires us to do a cost/benefit analysis to ensure the project makes good economic sense and does not result in unfair competition by competing companies. This will require Millard to provide details about the project, the type of product to be processed, and who the competition is. Secondly, we would like to discuss ways in which we could work with Millard to ensure their new facility is energy efficient. since Millard will be constructing a new facility, the company is in an excellent position to take advantage of an energy efficiency program which we offer. We've taken a very flexible approach in our program and offer monetary assistance in the 'form of cash rebates for efficiency improvements as well as technical assistance when appropriate. There are no strings attached as to what must be done. We simply would like an opportunity to share ideas and work with Millard to improve the efficiency of their building. Finally, we will not stand alone. Our proposal requires the city of Iowa city to financially participate in the project in some substantial way. Again Marty, we are delighted Iowa city is still being considered for Millard's expansion. We believe our incentive electric rate proposal affirms our commitment to the project. WHEREAS, at their December 15, 1992, meeting, the City Council for tha City of lowe City authorized en Agreement with American College Testing (ACT) regerding ACT's Master Development Plen and the construction of erterial streets, by Resolution No. 92-325; and WHEREAS, at their November 10, 1992, meating, the City Council for the City of Iowa City vacated portions of Old Dubuque Road right-of-way, by way of Ordinance No. 92-3555; and WHEREAS, the Agreement between the City end ACT anticipates that the City will convey whatever property or public easement rights they may have in the Old Dubuque right-of-way to ACT, and will do so after vacation proceedings as provided by law; and WHEREAS, the City now wishes to consummate the conveyance of whatever rights are remaining to the City, and to do so according to state law set forth in Section 364.7, Code of Iowa (1991).
