RESOLUTION AUTHORIZING EXECUTION OF CONSOLIDATED ANNUAL CONTRI-
BUTIONS CONTRACT KC.9033E. PROJECT NO. IA05.E022.017.
WHEREAS, the City of Iowa City (herein called the 'Local Authority') proposes to enter into a
revised contract (herein called the' Annual Contributions Contract') with the United States of
America (herein called the 'Government') with respect to any 'Project' as defined in the Annual
Contributions Contract and which at any time now or hereafter is incorporated under the terms
of such Contract..
BE IT RESOLVED BY THE LOCAL AUTHORITY as follows:
Section 1. The Annual Contributions Contract KC-9033 in substantially the form hereto attached
and marked 'Exhibit A' is hereby approved and accepted both as to form and substance and the
Mayor or Mayor Pro tern is hereby authorized and directed to execute said Contract in four copies
on behalf of the Local Authority. and the City Clerk is authorized and directed to impress and
attest the official seal of the Local Authority on each such counterpart and to forward said
executed counterparts, or any of them. to the Government, together with such other documents
evidencin9 the approval and authorizing the execution thereof as may be required by the
Government.
Section 2. Whenever the following terms are used in this Resolution, the same, unless the context
shall indicate another or different meaning or intent. shall be construed, and are intended to have
meanings as follows:
(1) 'Resolution' shall mean this Resolution,
(2) All other terms used In this Resolution and which are defined in the revised Annual
Contributions Contract shall have the respective meanings ascribed thereto in the revised
Annual Contributions Contract.
Section 3. This Resolution shall take effect Immediately.

HOUSING CERTIFICATE PROGRAM
1.1 DEFINITIONS
A. ACC
E. Cost Amendment - An amendment to the CACC which provides
additional contract or budget authority to cover increased
Program Expenditures to maintain the Program at the number of
units originally approved by HUD.
F. Fiscal Year - The PHA Fiscal Year.

J. Proqram - The PHA's Housing Certificate Program under the CACC.
K. Proqram Receipts - Amounts paid by HUD to the PHA for the Housing
Certificate Program, and any other amounts received by the PHA in
connection with the Program.
L. Proqram Expenditures - Amounts which may be charged against
Program Receipts in accordance with the CACC and HUD
requirements.
M. Pro;ect - A funding increment for the Program. (The project may
be for additional units or for a cost amendment.)
1.2 HOUSING CERTIFICATE PROGRAM
A. Pro;ects in Proqram
1. List of Pro;ects - The Projects in the Program are listed in
Exhibit I and Exhibit II of this CACC Part I.
2. Exhibit I - Exhibit I lists projects funded with amounts
appropriated before Federal Fiscal Year 1988.
3. Exhibit II - Exhibit II lists projects funded with amounts
appropriated in Federal Fiscal Year 1988 and later years.
B. Number of Units (bv number of bedrooms\ - To the maximum extent
feasible, the PHA shall enter into contracts for housing
assistance payments for units under the Program in accordance
with the unit distribution stated in this section. No
substantial deviation, as determined by HUD, from this unit
distribution is allowed without prior HUD approval.

C. PHA Fiscal Year
,1. The first fiscal year for the Program shall begin on JULY 1.
(Enter the effective date for the first project listed in
Exhibit I of the Part I of the CACC. If this date is not
entered before the CACC is signed by the PHA.) The first
fiscal year for the Program shall end on the last day of the
PHA Fiscal Year which ends not less than 12 months, or more
than 23 months, after this date.
2. Thereafter, the fiscal year for the Program shall be the 12
month period ending JUNE 30 of each calendar year. (Enter
the day and month used as the fiscal year ending date for
other section 8 assistance administered by the PHA under an
Annual Contributions Contract with HUD.)
1. 3 TERM
,A. Exhibit I Pro;ects - For all Projects listed in Exhibit I, the
term of the CACC shall end on JUNE 25, 1996. (Insert last date
of CACC term for all Exhibit I projects. If this date is not
entered before the CACC is signed by the PHA, the date may be
entered subsequently by HUD, upon written notice by HUD to the
PHA.)
B. Exhibit II Pro;ects - For each project listed in Exhibit II.
1. Exhibit II states the first date and last date of the ACC
term for the project.
2. The first date of the ACC term for the project shall be the
first day of the month when HUD signs the CACC which adds
the project to the Program, or another date as determined by
HUD.
3. If the first or last date of the ACC term for the project is
not entered before the CACC is signed by the PHA, the date
may be entered subsequently by HUD, upon written notice by
HUD to the PHA.
4. HUD may revise Exhibit II at any time, upon written notice
by HUD to the PHA (a) to add a cost amendment project, or
(b) to remove a project for which the ACC term has expired.

1.4 ANNUAL CONTRIBUTION
A. Payment - HUD shall pay the PHA annual contributions for the
Program in accordance with HUD regulations and requirements.
B. Amount and Purpose of HUD Payments
,1. The annual contribution for the Program shall be the amount
approved by HUD for each fiscal year to cover:
a. The amount of housing assistance payments by the PHA.
b. The amount of PHA fees for Program administration.
2. The amount of the HUD annual contribution may be reduced, as
determined by HUD, by the amount of Program Receipts (such
as interest incomej other than the HUD annual contribution.
C. Maximum Pavrnents for Proqram
1. Annual Limit on Pavments for Proqram
a. Except for payments from the CACC reserve account as
provided in section 1.4.E of this CACC, the HUD annual
contribution for the program under section 1.4.B during
the fiscal year shall not be more than the Maximum
Annual Contribution Commitment for the Program.
b. The Maximum Annual Contribution Commitment for the
Program for each PHA fiscal year shall be'equal to the
sum of the contract authority amounts reserved by HUD
for the projects in the Program. The amount of
contract authority reserved for each project in the
Program is stated in Exhibit I and II of this CACC Part
I (subject to reduction in accordance with section
1.4.0 and section 2.3 of this CACCj. If the first
fiscal year for the program is more than 12 months, the
Maximum Annual Contribution Commitment for the Program
for the first fiscal year may be adjusted in an amount
as determined by HUD the addition of the pro rata
amount applicable to the period in excess of 12 months.

2. Limit on Total Pavments for Proqram - The sum of HUD
payments under section 1.4.B for the Program over the
duration of the CACC (including any payments from the CACC
reserve account as provided in section 1.4.E) shall not be
more than the sum of the budget authority amounts reserved
by HUD the projects in the Program from amounts authorized
and appropriated by Congress.
D. Reduction of Amount Pavab1e - HUD may reduce the amount payable
by HUD for any project or for the Program, and may reduce the
amount of the contract authority or budget authority for any
project, by giving the PHA written notice of reduction in
accordance with section 2.3 of this CACC. The notice by HUD may
include a revision of Exhibit I or II or state the reduction in
the amount of contract authority or budget authority for a
project.
E. CACC Reserve Account - A CACC reserve account shall be
established and maintained by HUD, in an amount as determined by
HUD consistent with its responsibilities under section 8(c) (6) rof
the u.s. Housing Act of 1937. The CACC reserve account may be
used by HUD for payment of any portion of the payment approved by
HUD under section 1.4.B for the fiscal year.
F. Separate ACC - HUD's commitment to make payments for each project
listed in Exhibit II shall constitute a separate ACC.
1. 5 CACC
A. The CACC consists of this CACC Part I (including Exhibits I and
II) and the form ACC Part II prescribed by HUD for the Housing
Certificate Program and Housing Voucher Program, designated as
form HUD 52520E, and dated June 1985. These documents constitute
the whole CACC for the Program.

projects or Program under a previous Annual Contributions Contract
shall be governed by this CACC.

1.4. Annual Contribution.

RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO
ATTEST THE RELEASE OF A LIEN REGARDING A PROMISSORY NOTE
EXECUTED FOR PROPERTY LOCATED AT 431 NORTH LUCAS STREET, IOWA
CITY, IOWA.
WHEREAS, on November 5, 1979, the property owners of 431 North Lucas Street, Iowa City,
Iowa, executed a Promissory Note to the City of Iowa City in the amount of $1,100.00 in
exchange for a no-interest, declining balance loan; and
WHEREAS, said Promissory Note created a lien against the subject property; and
WHEREAS, under the terms of the Promissory Note, the Principal of the above-referenced loan
was forgiven on June 28, 1982.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY,
IOWA that the Mayor is authorized to sign and the City Clerk to attest the attached Release
of Lien for recordation, whereby the City does release the affected property from an obligation
of the property owners at 431 North Lucas Street to pay to the City the principal amount of
$1,100.00, which obligation was recorded in Book 280, Page 230 of the Johnson County
Recorder's Office.

RUSSELL DRIVE TO ROBIN M. HAALAND AND JENNIFER L HAALAND.
WHEREAS, Robin M. Haaland and Jennifer L. Haaland own property located at 2248 Russell
Drive, Iowa City, Iowa; and
WHEREAS, a portion of a five foot wooden fence for the Haalands' lot currently encroaches on
approximately 474 square feet of Clty.owned property located at 225B Russell Drive, Iowa City,
Iowa; and
WHEREAS, the Haalands paid $290.00 to prepare a survey of the property; and
WHEREAS, on February 23, 1993, the City Council adopted and approved Resolution No, 93.3B
declaring Its Intent to convey the property where the Haalands' fence Is currently located,
authorizing public notice of the proposed conveyance, and setting the date and time for public

RESOLUTION NO. 93-61
RESOLUTION AUTHORIZING CONVEYANCE OF THE CITY'S INTEREST IN
PROPERTY LOCATED AT 1421 WATERFRONT DRIVE TO MOSS FARMS, AN IOWA
GENERAL PARTNERSHIP, AS A CORRECTIVE LEGAL ACTION.
WHEREAS, In August, 1988, the City vacated the Westerly 8 feet of Waterfront Drive; and
WHEREAS, the City did not execute a quit claim deed for the vacated portion of the street which
Is located on the property located at 1421 Waterfront Drive; and
WHEREAS, the City may possess rights as successor In Interest to a former territorial road right-
of-way located on 1421 Waterfront Drive; and
WHEREAS, Waterfront Drive approximately covers that rlght-ol-way, It Is not possible to ascertain
the precise location of the former territorial road and thereby Identify the precise area that may
be subject to the City's rights as successor In Interest; and
WHEREAS, the Clty's potential Interest In the former territorial road right-of-way creates a cloud
on the title to the property located at 1421 Waterfront Drive; and
WHEREAS, on February 23, 1993, the City Council adopted and approved Resolution 93-39
declaring Its Intent to convey Its Interest In the property located at 1421 Waterfront Drive,
authorizing public notice of the proposed conveyance, and setting the date and time for public
hearing thereon; and
WHEREAS, following public hearing on the proposed conveyance, the Council finds that It Is in
the public Interest to clear the title to said property.

NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY,
IOWA, THAT:
1. The Mayor and the City Clerk are authorized to execute the attached Quit Claim Deed
conveying the City's Interest In the property legally described on Exhibit uAu attached
hereto, to Moss Farms, an Iowa General Partnership, subject to existing easements.
2, The City Attorney Is authorized to deliver said Quit Claim Deed to Moss Farms, The deed
shall be recorded In the Johnson County Recorder's OHlce at Moss Farms' expense,

RESOLUTION NO. 93-62
RESOLUTION AUTHORIZING CONVEYANCE, BY QUIT CLAIM DEED, OF CERTAIN
PORTIONS OF VACATED OLD DUBUQUE ROAD IN IOWA CITY, IOWA TO
AMERICAN COLLEGE TESTING PROGRAM, INC,
WHEREAS, at their December 15, 1992 meeting, the City Council for the City 01 Iowa City
authorized an Agreement with American College Testing Program, Inc. (ACl) regarding ACT's
Master Development Plan and the construction 01 certain arterial streets, Resolution No. 92-325;
and
WHEREAS, at their November 10, 1992, meeting, the City Council for the City of Iowa City
vacated certain portions 01 Old Dubuque Road rlght-ol-way, by Ordinance No, 92.3555; and
WHEREAS, the Agreement between the City and ACT anticipates that the City will convey
whatever property or public easement rights might remain in the now-vacated Old Dubuque right-
ol-way to ACT, and will do so after vacation proceedings as provided by law; and
WHEREAS, Old Dubuque Road was originally a "county easement," so upon annexation 01 the
area the City only acquired, by operation 01 law, a "public highway easement" over said right-ol.
way; and
WHEREAS, conveyance by quit claim deed shall also clarify chain 01 title over the land underlying
the old highway easement, lor purposes 01 ownership and luture conveyance; and
WHEREAS, the Council did declare Its Intent to convey whatever vestigial property rights remain
In now-vacated Old Dubuque Road to American College Testing Program, Inc" pursuant to
Resolution No, 93,40, dated February 23, 1993 and as provided by law; and
WHEREAS, after publication 01 notice as required by law, and lollowing public hearing, the
Council finds the proposed conveyance 01 whatever vestigial easement rights the City may have
over the now-vacated Old Dubuque Road rlght-ol-way, as set lorth in the quit claim deed and
legal description marked Exhibit A and attached thereto, Is In the best interests 01 the City 01
Iowa City, Iowa.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY,
IOWA, that:
1, In order to consummate the December 1992 Agreement between the City and ACT, the City
now finds it In the public interest to convey to ACT whatever vestigial property interests may

RESOLUTION OF INTENT TO CONVEY CITY.OWNED PROPERTY AT 1830 I
STREET TO A QUALIFIED 8UYER AND SETTING A PUBLIC HEARING FOR
MARCH 30, 1993.
WHEREAS, the City of Iowa City moved a house to City.owned proparty at 1830 I Street and
partially rehabilitatad the house with the intant to sell the property as an affordable homa
pursuant to tha Comprehensive Housing Affordability Strategy; and
WHEREAS, in exchange for the purchaser completing the rehabilitation work on the house,
the City will provide up to $7,000 for materials to be used for the rehabilitation and will
reduce the purchase price by a minimum of $2,000; and
WHEREAS, in conjunction with its intant to sell said property, the City advertised for income-
eligible home buyers; and
WHEREAS, upon review of applications submitted to the City, en income-eligible homebuyer
has been selected to purchase the property at a purchase price of $57,000, subject to
completion of the rehabilitation work and approval by e locellending institution.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY,
IOWA, THAT:
1. The City Council does hereby declare its intent to convey its intarest in the following-
described property to a qualified buyer:
Lot 8 in Block 44, in East Iowa City, Johnson County, Iowa, according
to the plat theraof, recorded in Blk 1, Page 92, Plat Records of Johnson
County, Iowa.
2. A public hearing on said proposal is sat for March 30, 1993, at 7:30 p.m. in the
Council Chambers of the Civic Center located in Iowa City, Iowa, and tha City Clerk

Re: Sale of 1830 I Street
The two.bedroom house, formerly located at 323 Madison Street, which was donated to the City
by the University of Iowa, now resides at 1830 I Street. We have prepared a foundation (a full
basement), put in electrical service, new plumbing and heating systems, and other Items to make
the house weatherproof. We then advertised for low/moderate Income buyers willing to do the
remaining rehab of the property themselves. This rehab includes such things as reshlngllng the
roof, repairing plaster walls, sanding floors, replacing kitchen cabinets and painting the interior
and exterior. Part of the labor of the purchaser wlil be considered as sweat equity and contribute
to the downpayment on the property,
We received 12 applications which were reviewed by a city staff committee, Using pre-established
criteria, three families were selected for Interviews and preliminary credit checks, after which one
family was selected to purchase the property.
After a purchase agreement between the City and the purchaser is signed, the purchaser wlil
complete the rehab of the property. During this time the City wlil continue to hold title to the
property. The City will provide up to $7,000 for needed materials. Upon completion of the rehab
(by August 31, 1993) the property will be sold for $57,000. The purchaser's mortgage will be
approximately $52,000 or less.
