I just completed a drvi ng tour oi the Me! rose Avenue I'lideni ng project. It vou!d be 1
big mistake to not I'liden a portion of this street at this ti me. As far as i know, t'le! rose Avenue
and the IWV road have been the major ent"'j to the vest side of 10'lla City ior more years than
anyone living in IOI-Ia City or University Heights can remember,
It appears to me that a very eifective four lane traffic pattern could be established, By
'1lideni ng onl y that portion oi Me!ro$e irom the '1lest end oi the rail road bridge to the
intersection of Grand Avenue ,lith t1elrose, Ii a one-vay circle 'dere to be made by begi nni ng
one-I-Iay south at the field house south to t1elrose, One-Vlay east on ~lelrose from Grand to
Byington Road, and then the present one-'Nay on Byington Road, This I'lould be simular to the
onel-lay circle around the County Administration Building and also the one-'.-Iay circle on North
Dodge and North Gil bert

On March 4, 1993, Marci Thomas presented her ideas about the
possibility of a neighborhood coalition at the Northside Neighborhood
Board of Directors meeting.
Marci proposed a one-time meeting, possibly sponsored by the
League of Women Voters. (We would like to suggest that Marcia
Klingamen be contacted to coordinate the meeting with the other
neighborhood associations.) The goals of this meeting would be to
define collective vision planning, discuss common concerns, and
share information.
The NNA plans to send a representative(s) to attend this
meeting to explore the possibilities of a neighborhood coalition. No
endorsement or commitment in any way will be made at this time.
The representative(s) will report to a subsequent board meeting
where the proposal could be further discussed.

The undersigned Bed and Breakfasts have been notified that after
March 10, 1993, our garbage service was going to cease because
the City is changing our property classification from residential
to commercial (see enclosed copies of letter dated 2/24/93 from
Floyde Pelkey, Assistant Superintendent of Solid Waste, and
2/25/93 from Dianna Donahue, Customer Service Manager for the
City of Iowa City). We would like to respectfully ask the
Honorable City Council to reconsider this decision based on the
following:

and Breakfast rents up to only two (2) families at a
time. There is usually one to two garbage cans per
week, which is less than many neighbors' garbage.
3. We do not have advertising signs on our properties.
4. Stopping the service would impose a hardship upon the
innkeepers in that our private homes would not receive
garbage pickup.
5. There are many residential businesses in Iowa City
which advertise in a variety of ways, including yellow
pages, business cards, signs, brochures, newspaper
ads, mailing, etc. These businesses include sales of
designer clothes, fabrics, and accessories, art,
costL~e Jewelry, direct sales of cosmetics, household
products, management consultation, tax services,
chiropractic service, and others. Bed and Breakfasts
are only one of many types of business run out of
private homes.
6. Our small businesses catch some of the overflow of
visitors to Iowa City wh,) would otherwise have to, go to
neighboring communities when Iowa City hotels are full.
This provides a service to Iowa City and its economy
since such people's lodging dollars, as well as more of
their shopping and restaurant dollars, stay in Iowa
City rather than going to other communities.

It was brought to our attention that a bed and breakfast business
is being operated from your residence. This changes your property
from residential to commercial. The city of Iowa city does not
provide refuse service to a commercial property. Also, the state
of Iowa requires a 5% sales tax on sewer and solid waste (refuse)
collection when these services are being provided to nonresidential
commercial operations.
The refuse services and charges to this property will end as
explained in the enclosed letter from the Superintendent of Solid
Waste. Your next billing will reflect refuse charges to that date
and the appropriate State of Iowa sales taxes on sewer and refuse
services. We will assess the 5% State of Iowa sales tax on water

Parking Prohibition on Gilbert Street from Highway 6 South to the South City
Limits
As directed by Section 23.16 of the Municipal Code of Iowa City, this Is to advise you of the
following action,
ACTIDN:
Pursuant to Section 23.234 of the Municipal Code of Iowa City, the City Traffic Engineer will
direct the installation of NO PARKING ANYTIME signs on both the east and west sides of
Gilbert Street from its intersection with U.S. Highway 6 south to the south city limits, This
action will take place on or shortly after 18 March 1983.
COMMENT:
The parking prohibition noted above will ensure that Gilbert Street functions as a four-lane
facility, as It was designed. Customers at a recently new commercial enterprise along Gilbert
Street have been using Gilbert Street for parking, The prohibition as noted above will correct
the oversight which occurred when this new facility was constructed.

My family has lived in Iowa City for many years. We were here when Iowa
was still a territory. My family members have included farmers, doctors,
ministers, business people, University professors, and even one of the
University of Iowa Presidents, Dr. Rev. Oliver Spencer. My roots run deep.
The love I have for this town runs deep. I love the land, the trees, the
river. I support Iowa City and the wonderful diversity of the people in it.
I have watched our town grow and change.
Some months ago, I posted deer crossing signs on North Dubuque Street.
I did this after a request for deer signs, which was made well over a year ago
by my family to Mr. Bractel, and then recently by myself to one council
member, was denied, Perhaps I went about it wrong and made some mistakes. I
never intended it to become a "fight" with the city. The deer crossing signs
are a must and I thank you for placing them on North Dubuque Street.

More has to be done, however, as cars speeding along this street are
still slaughtering the deer. Add to the police reports because more deer are
being hit than are being reported, as I have witnessed this. The deer are not
always killed, but flee badly injured into the woods where I'm sure they die
later. Cars stop to check damage, then leave without reporting the accident.
Last week a red. tailed hawk was struck and killed by a car on North Dubuque
Street, a car obviously going too fast, The hawk, so special, so protected by
law, that to pluck a feather from it would be illegal.
I am requesting traffic lights be put up at Foster Road and North
Dubuque Street. This will help slow traffic down and will also benefit the
growing number of people using Foster Road. In addition, I would like to
request wildlife fencing be considered in the area north of Foster Road.
Although deer cross on North Dubuque Street as far south as Kimball Road,
traffic can be slowed by the requested traffic light in that area, If cost
would be the only problem with the wildlife fencing, I would personally
volunteer to be head of the fund raising.
To show respect for our wild brothers and sisters, the deer, is showing
the love for life that lives in our city. Although our city grows, we must
not become callous to those who were here before us. I can stand outside my
home and not be surprised to see deer, to see hawks, or even to see eagles.
What a beautiful town we live in, Let's protect it.

I am writing this letter to you the City Council, with the
opportunity for you to remedy a wrong, If need be, please direct me
to pursue the appropriate Government Official, or Government Agency
to resolve this and to prevent future incidents. It appears to me
that the ci ty bureaucracy needs to exercise control and show power
even I;hen it is contrary to demonstrated community needs! Logic
and good sense does not seem to have a place among the zoning
ordinances ond I hope you find this as disturbing as I do,
Specifically the city has shared the major expenses l;ith me to
make my duplex an affordable, top quality rental, The program was
successful, ond I and my tenants are thankful, The city also helped
the bottom uoit become a class A handicapped unit, and this type
property is In short supply, another successful program, You can't
imagine the shock when that same city ordered me to throw out half
of my renters! You (the city) did and so I sought legal council,
and had four different lawyers at a cost of thousands of (non
productive) dollars advise me to protect myself and my property as
well as the rights of the tenants, I was fined by the city, then
lined by the court and had court costs and Attorney fees on top of
that, I was further ordered to throw out one of my tenants, I read
the paper and see cDuntless articles on the need of affordable
housing, and then experience a city that is interested in control.
My wife and I purchased, upgraded and maintained a duplex at
619 N. Johnson since December 1989, The property on all four sides
of me are multiple use dwellings, My property has a total of three
people livillg in it, the dOlmstairs a single handicapped who has
resided since before I purchased the property, Few properties in
this area have such a low occupancy. At my request, the city placed
a handicapped parking zone in close proximity to the duplex and the
handicapped tenant enjoys the benefit of this zone, even though it

Because of the ci ty I S actions I I l;ill be forced to sell the
propert)' at a substantial loss, A single individual could not
afford the rents required to maintain the prope~ty, A portion of
the eitv monies used to improve the property would have to be
repaid. 'This h'hole situation, I believe, reflects vel')' poorl)' on
our local government,

affordable.

A, At the same time, a swindler who broke the city law
remains unpunished, because of his relative insolvency
and the city does nothing on this issue,

hours to combat the Iowa City Bureaucracy,

letter, The cit), has been involved in spending taxpayer dollars and
inspecting my property on numerous occasions throughout my

communicate and work with each other, what is the average citizen
supposed to do?

or can be in a position to intercede and let sanit)" and good

neighbors,

NOTE: 1 believe 1 have exhausted my "Chain of Command" in, writing

---"1 did not apply for a variance because 1 was advised,by staff
that the property would not qualify. They said the hardship
requirement couldn't be met because the hardship was of the
previous owner's own making. 1 was also advised that 1 would not
qualify for a special exception.
---"City staff consisting of Linda Gentn', Doug Boothroy, and
Honica Hoen were requested to recommend to Planning and Zoning an
amendment to the zoning ordinance allowing to property to be used
as a non-owner occupied accessory apartment, This they refused to
do even though the property to the south is a three unit, tri-plex
rental dwelling, the property to the north has been purchased to
provide housing to students I and the property to the west is a
large multi-family apartment building. Allowing three persons to
occupy the house hardly affects the density of' the neighborhood
only the "purity" of the zoning ordinance is preserved,.

I understand there is confusion regarding trash pick up for some individuals in town. I
believe the enclosed copies of the refuse collection ordinance will be of interest to you.
It appears that all of the parties in question, Rock Williams, Daissey Owen, Clarence
Haverkamp and myself fall in the category of home occupation and since none of us
generate any commercial, agricultural, industrial or institutional waste and are complying

RESOLUTION AUTHORIZING APPUCATlON FOR GRANT MONIES FROM THE
IOWA DEPARTMENT OF ECONOMIC DEVELOPMENT FOR COMMUNITY
ECONOMIC BETTERMENT ACCOUNT (CEBA) FUNDING TO ASSIST IOWA
PROCESSED MEAT, INC. IN THE PURCHASE OF MACHINERY AND EQUIP.
MENT.
WHEREAS, the Iowa Community Economic Betterment Account (CEBAl program provlde~ loans
to cities to promote economic development and create long-term employment opportunities; and
WHEREAS, ~ Is In the public Interest to use State funding to encourage economic development
In Iowa City, Iowa; and
WHEREAS, the City of Iowa City desires to apply for and obtain $300,000 In CEBA funding from
the Iowa Department of Economic Development in the form of a forgivable loan, In order to assist
in the expansion of the Millard Refrigerated Services facility In Iowa City, Iowa, by Iowa Processed
Meat Inc.
NOW, THEREFORE, BE rr RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY,
IOWA, THAT:
1, It Is In the public Interest to encourage economic development by the City of Iowa City,
as applicant, and Iowa Processed Meat, Inc., as the business, applying for CEBA funding.
2. The Mayor and City Clerk are hereby authorized to make formal application for financial
assistance to the Iowa Department of Economic Development for Community Economic
Betterment Account funds In the amount of $300,000,
3, The City Manager Is hereby authorized to take any additional actions required by the
State Department of Economic Development and the CEBA program In order to secure
said funding.
It was moved by Ambrisco and seconded by HcDonald the Resolution be
