AN ORDINANCE AMENDING THE ZONING ORDINANCE BY CONDITIONALLY CHANGING THE
USE REGULATIONS OF APPROXIMATELY 30 ACRES OF LAND GENERALLY LOCATED WEST
OF SYCAMORE STREET AND IMMEDIATELY NORTH OF THE CORPORATE LIMITS FROM 10-
RS, INTERIM DEVELOPMENT SINGLE.FAMIL Y RESIDENTIAL, TO RS-B, MEDIUM DENSITY
SINGLE-FAMILY RESIDENTIAL.
WHEREAS, the applicant Iowa Realty Company, has requested that the City rezone
approximately 30 acres of land generally located west of Sycamore Street and immediately
north of the corporate limits, from ID-RS, Interim Development Single-Family Residential, to
RS-B, Medium Density Single-Family Residential; and
WHEREAS, with the completion of the Sycamore Trunk Sewer, development of the subject
tract is considered to be in,sequence development; and
WHEREAS, Iowa law provides that the City of Iowa City may impose reasonable conditions
on granting the applicants rezoning request, over and above existing regulations. to satisfy
public needs directly caused by the requested change; and
WHEREAS, the applicant has agreed to develop this area in accordance with the terms and
conditions of the Conditional Zoning Agreement. attached hereto and made a part hereof by
this reference; and
WHEREAS, the applicant acknowledges that the terms and conditions contained in the
Conditional Zoning Agreement are reasonable to impose on the land under Iowa Code !414.5
(1991) and satisfy public needs directly caused by the requested zoning change.

SECTION I. APPROVAL. Subject to the terms and conditions of the attached Conditional
Zoning Agreement. as authorized by 1414.5. Code of Iowa (1991). the property described
below is hereby reclassified from its present classification of ID-RS, Interim Development
Single-Family Residential. to RS-a. Medium Density Single-Family Residential.
The' south 30 acres of the following-described property: The east half of the
southwest quarter and the east 5 acres of the west half of the southwest quarter of
Section 23. Township 79 North. Range 6 West of the 5th P.M.
SECTION II. REPEALER. All ordinances and parts of ordinances in conflict with the provisions
of this Ordinance are hereby repealed.
SECTION III. SEVERABILITY. If any section. provision or part of the Ordinance shall be
adjudged to he invalid or unconstitutional. such adjudication shall not affect the validity of t~e
Ordinance as a whole or any section. provision or part thereof not adjudged invalid or
unconstitutional.
SECTION IV. EFFECTIVE DATE. This Ordinance shall be in effect after its final passage,

BACKGROUND:
Iowa Realty Company has submitted an application to rezone 30 acres of land located west
of Sycemore Street and north of the Iowa City corporate limits from ID.RS to RS.8.

ANALYSIS:
Comorehensive Plan, The 1989 Comprehensive Plan update did not envision residential
development in this area of Iowa City until after the year 2000, due to the lack of sanitary
sawer capacity, Consequently, this site was given an interim development zoning
designation. An amendment to the Comprehensive Plan (Resolution No. 91-221)
recommanded that the City extend, via a tap-on fee ordinance, a trunk sewer to serve 315
ecres in south Iowa City, including the subject property. This sewer extension would allow
for development of this area within Phase I of the Plan's residential development sequence.
Construction of the sanitary sewer has begun and should be completed by this summer.
Environmentel Fectors. The Soil Survey of Johnson County, Iowa shows that the subject site
is located in an area of hydric soils. The predominant soil type on the property, Garwin, is a
fully hydric soil with severe limitations for construction of residential structures, according to
the soil survey. As you will recall from discussions regarding the Sycamore Farms Annexation
and Rezoning, hydric soils are an indicator of potential wetland areas. No determination has
yet been made as to whether the subject site contains any jurisdictional wetlands, but a
determination should be made prior to approval of the requested rezoning.
Regardless of the wetlands determination, the presence of hydric soils on the property could
pose problems for construction of houses with basements. A subsurface exploration of this
site prepared for the applicant by Terracon, Inc. found that the water table was generally 2-3
feet below the ground surface. The report states that "due to high groundwater conditions
it is generally not advisable to construct basements." Subsurface conditions could also lead
to increased construction and maintenance costs for roads constructed within the
development. Excerpts from the Terracon report pertinent to basements and roads are
attached.
Zonina. The applicant has requested rezoning to the RS-8 medium density single-family zone.
This zone is consistent with properties east of the subject site, but is more intense than the
RS-5, low density single-family, zoning north of the site. The less dense RS-5 zoning might
be more appropriate for the site given the environmental constraints.
Svcamore Street. Sycamore Street is classified as an arterial street, and is to be improvad
in the future to arterial street standards. The applicants should dedicate right-of-way
sufficient to accommodate this improvement and pay up front the cost of installing a four-foot
sidewalk along the site frontage. '
STAFF RECOMMENDATION:
Staff recommends that the request by Iowa Realty Company, Inc. to rezone the subject parcel
from ID-RS to RS-8 be deferred until a determination is made as to whether the site contains
jurisdictional wetlands and until the City has resolved issues relating to development in and
around environmentally sensitive areas.

~ATER LEVEL OBSERVATIONS
The borings were monitored while drilling and after completion
for the presence and level of groundwater. Water levels
observed in the borings are noted on the boring logs. At these
times, groundwater was observed in all the borings at depths
ranging from approximatelY 0 to 7 feet beloW existing grade.
All the borings were left open for period of approximatelY 4
days after completion and water levels in these borings were
observed at depths of approximatelY 2 to 3 feet below the ground
surface prior to backfilling. These water level observations
provide an approximate indication of the groundwater conditions
existing on the site at the time the borings were drilled.
However, due to the low permeability of the cohesive soils
encountered i11 the borings, longer term monitoring in cased
holes or piezometers, sealed from the influence of surface
water, would be required for a more accurate evaluation of the
groundwater conditions.
It should be recognized that fluctuations of the groundwater
table may occur due to seasonal variations in the amount of
rainfall, runoff and other factors not evident at the time the
borings were performed. Therefore, groundwater levels during
construction or at other times in the life of the structure may
be higher or lower than the levels indicated on the boring logs.
The possibility of grounqwater level fluctuations should be
considered when developing the design and construction plans for
the project.

ANALYSIS AND RECOMMENDATIONS
General
The two primary considerations for construction of residential
structures and pavements on this site include the presence of
relatively soft and compressible soils and the high groundwater
levels observed in the boreholes. For these reasons, it is
recommended that cuts and fills for construction of structures
and roadways be minimized. Fills placed for structures and
roadways could cause significant post-construction settlements.
Additionally, cuts extending near the water table would be
difficult and would probably require dewatering measures and
stabilization using crushed rock, possibly in conjunction with
engineering fabric or geogrid.
\
In addition, maintaining dry conditions in below grade levels of
structures on this site could be difficult, due to the high
groundwater conditions, and it is generally not advisable to v'"
construct basements. Any below grade portions of structures
built on this site should have perimeter foundation drains and
underfloor drain systems. Additionally, any street or roadway
constructed within 4 feet of the groundwater table should be
designed and constructed with a below pavement drainage system,
Recommendations for general site preparation, foundations, and
subsurface drainage systems are provided in the following
sections of this report.

Below Grade Walls and Subsurface Drainaoe

Groundwater levels observed in the boreholes ranged from about
2 to 3 feet. beneath the ground surface, and for this reason it
is generally not advisable to construct full-depth basements on
this site.
Below grade walls should be designed for earth pressures at
least equal to those indicated on the diagram attached to this
report. please note that this earth pressure distribution is
for an "at-rest" condition and assumes no wall rotation. The
recommended design lateral earth pressures do not include a
factor of safety and do not provide for possible hydrostatic
pressure on the walls.
A perforated rigid plastic or metal drain line installed behind
the base of walls extending below adjacent grade is recommended
to prevent hydrostatic loading on the walls and seepage into
below-grade building levels. The invert of a drain line around
a below-grade building area should be at least 12 inches below
the finished subgrade elevation for the interior floor. The
drain line should be sloped to provide positive gravity drainage
and should be surrounded by free-draining granular material
graded, to prevent the intrusion of fines, or an alternative
free-draining granular material encapsulated with suitable
filter fabric. At least a 2-foot wide section of free-draining
granular fill should be used for backfill above the drain line
and adjacent to the wall and should extend to within 2 feet of
final grade, The granular backfill should be capped with
compacted cohesive fill to minimize infiltration of surface
water into the drain system.

Attached is the USDA-SCS "Highly Erodible Land and Wetland Conservation
Determination" for tract T-1744 (S 3/4 SE 1/4 SW 1/4 Sec 23-79-6).
Please determine if a wetlands permit is required. The anticipated use of the
30 Acre tract is the development of approximately 134 lots for single family
dwellings.
The remark on the form is "This tract of land does not contain wetlands. Hydric
(wet) soils are present with high water table. That can pose limitations on land
uses."

Our office reviewed your letter dated February 17, 1993,
concerning the proposed development of a 30 acre tract of
land in Section 23, Township 79 North, Range 6 West, Johnson
County, Iowa.
We determined your project as proposed does not require
a Department of the Army (DA) Section 404 permit. Our
office reviewed the information provided to us. No
indication of discharge of dredged or fill material was
found to occur in waters of the United States (including
wetlands). Therefore, this determination resulted.
Please contact us if your plans change. Changes may
result in your project requiring DA authorization. A
brochure entitled "Caring for the Nations Waters" is
enclosed for your information, which briefly describes the
Corps of Engineers Regulatory Program.
You are advised that this determination for your project
is valid for three years from the date of this letter. If
the project is not completed within this three-year period
or your project plans change, you should contact our office
for another determination.
Although a DA Section 404 permit is not required for the
project as proposed, you must still acquire other applicable
Federal, state and local permits.

I have reviewed the construction plans of the "South Sycamore Sanitary Trunk
Sewer," which includes field generated ISO' wide contour maps, on the south and
east side of this property. I have also personally inspected the property to
ascertain the surface drainage.
The west 1000' drains to a grassed waterway (with a 1% to 2% slope) that runs from
the northwest corner of the property to a point on the south line of the property
350' east of the southwest corner of the property. This grassed waterway flows
south for one mile then west under Sand Road to the Iowa River.

The east 400' drains south to the southeast corner of the property and overflows
into the Sycamore Street ditch. then flows in the ditch south about lOa' to a low
point. There is a farmed waterway that begins 100' south and 100' west of the
southeast property corner that flows southwest to the grassed waterway 1000' south
of the property.
All of this 30 acre property drains south and west, directly to the Iowa River.
I believe that Sycamore Street, at this location, acts as a divide between the
Snider Creek watershed and the watershed that flows directly to the Iowa River.
If Sycamore Street is not the divide, it lies to the east of Sycamore. (The
ground has zero slope from 1000' east of Sycamore Street to 100' west of Sycamore
Street.

We are pleased to provide additional discussion regarding the
observed water levels in the borings at the referenced
development site. Subsurface exploration for this project was
submitted in a report dated January 11, 1993 (Terracon Job No.
06925121), and this previous report should be referred to for
specific details.

The six borings were monitored while drilling, after completion,
and five days after drilling for the presence and level of
groundwater. The water level observations that were taken five
days after drilling were probably more representative of the
groundwater conditions than those readings taken immediately
after drilling. Delayed water level observations ranged from
approximately 2 to 3 feet below the existing ground surface:
For a more definitive evaluation of groundwater levels on the
site, piezometers sealed from the influence of surface water
should be installed and monitored over a period of time.
It should be recognized that fluctuations of the groundwater
table may occur due to seaso1lal variations in the amount of
rainfall, runoff and other factors not evident at the time the

Dear Mayor Courtney and Council Members:
I am writing on behalf of Iowa Realty Co., Inc. to ask the
Council to expedite consideration of Iowa Realty's rezoning request
currently pending before the City. Iowa Realty's hope is to
commence construction of the plat improvements at the earliest
poesible date so that as many houses as possible can be started and
completed in the 1993 construction season. As I am sure all of you
know, the current low mortgage interest rates have made it possible
for buyers to purchase "more home" for their money. We believe
that the interest rates will remain around their current levels for
most of 1993, but as to late 1993 and early 1994, the rates are
more difficult to predict.
Thank you for your time and consideration in this matter. I
will be available for staff or for Council questions concerning
this request at the March 30th Council meeting.

CONDITIONAL ZONING AGREEMENT
THIS AGREEMENT Is made by and between the City of Iowa City, Iowa, a Municipal Corporation

to satisfy public needs directly caused by the requested change; and
WHEREAS, pursuant to the annexation policy of the City's Comprehensive Plan, the proposed
rezoning Is subject to the developer agreeing to pay all of the costs associated with providing
Infrastructure for development of the subject tract; and
WHEREAS, the City wishes to ensure the appropriate allocallon and suitability of neighborhood
open space and the availability of a public school site; and
WHEREAS, Owner acknowledges that certain condlllons and restrictions are appropriate In order

AN ORDINANCE AMENDING CHAPTER 23, ENTITLED
'MOTOR VEHICLES AND TRAFFIC' OF THE CODE OF
ORDINANCES OF THE CITY OF IOWA CITY, IOWA, TO
REVISE AND CLARIFY THE DEFINITION OF COMMERCIAL
VEHICLE.
WHEREAS, the City Council of Iowa City finds that
the current definition of 'commercial vehicle' provided in
Chapter 23 of the Code of Ordinances of the City of Iowa
City, Iowa, is not sUfficlentiy clear and concise to provide
both for even.handed enforcement of said provision as well
as notice to drivers of motor vehicles; and
WHEREAS, it Is in the public interest that
commercial loading zone parking within the Downtown
Commercial District be enforced to provide short-term parking
for commercial vehicles needing access for loading and
unloading.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COUNCIL OF THE CITY OF IOWA CITY, IOWA:
SECTION I. That Chapter 23, 'Motor Vehicles and Traffic'

right sides of the vehicle, The signs shall identify the name
of the commercial entity in letters at least two (2) inches in
height, and clearly legible rrom a distance of ten 110) feet.
Vehicles so marked may park in zones identified for
commercial loading and unloading, for the purpose of loading
or unloading commercial goods and property, or ror providing
required services to commercial enterprises.
SECTION II, EFFECTIVE DATE, This Ordinance shall be
effective after Its passage, approval and publication as
required and provided by law,
SECTION III, REPEALER, All ordinances and parts of
ordinances in conflict with the provisions of this Ordinance
are hereby repealed,
SECTION IV. SEVERABILITY. If any section, provision or
part of this Ordinance shall be adjudged to be Invalid or
unconstitutional, the remaining portions shall be deemed
severable and shall net be affected.

RESOLUTION NO. 93-66
RESOLUTION EXTENDING THE EXPIRATION DATE FOR THE AMENDED
PRELIMINARY PLAT OF HUNTERS RUN SUBDIVISION, PARTS EIGHT AND
NINE.
WHEREAS, on May 3, 1988, the City Council approved the amended preliminary plat for
Hunters Run Subdivision, Parts Four through Nine; and
WHEREAS, Section 32.30 of the Code of Ordinances of the City of Iowa City, Iowa, permits
the City Council to extend the expiration date of preliminary plats upon written request of tha
subdivider; end
WHEREAS, the City Council has received a written request to extend the expiration date of
the amended preliminary plat of Hunters Run Subdivision, Parts Eight and Nine; and
WHEREAS. no additional regulations pertinent to this development have been adopted since
the City Council approved the amended preliminary plat in 1988.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY,
IOWA, THAT:
1. The expiration date of the amended preliminary plat of Hunters Run Subdivision, Parts
Eight end Nine. is hereby extended to November 3, 1994.
