Ambr! Thank you, ~Ir. ~'Iayor. Last evening the city council \Vas
solicited by Mr. Bill Baty who is representing the firsl Ken
"Ducky" Derby to be staged this Saturday morning allJ:OO AM
at the Iowa River. The purpose is to have a fund raiser
sponsored by and for the benefit of Handicare and the Variety
Clubs. Each councilor was asked 10 sponsor a duck. So I will ask
the CiUuera person 10 bring in and get a tight shot of each one
of the city council's persons conlributions and their surrogate
who will be swimming in the Hrst Ken' Ducky" l~rby Saturday
morning. The first 100 ducks that cross the finish line will be
given the opporlunity 10 gain some very wonderful prizes. The
others will be. I guarantee. scooped up and recycled [or next
year's race. They will not be put into the system and help
pollute our planet. We have that pledged. So I will slart with
my council lady on the left, Mrs. Horow. and she will show you
her presentation for the race.
Horow/ This is my sing a ling bell. It has a little bell here and a
bonnet and a Iowa City sticker on the hat. Ilhink illooks
ralher spiffy.
Ambr/ My surrogate is super duck. We practice all day. There Is no
question that he can leap a builcling in a single bound. His
swimming skills need some work. So I have all of my hopes
tied on super duck.
Courtney/ We were looking for a leader in the race so I went with
his honor.HIZZONH. Just so lhe other ones that were behind
would know who they were [allowing. it is the mayor.
Nov/ I don't have any clever words on mine. I have a litlle
decorated duck who is going swimming on Saturday.
Kubby / My duck my be slow as a hare or slow as a turtle. It is a
turtle duck. It has a turtle necklace on it. II has got a lurlle in
the rear so you can identify it from either direction. And it has
a very rancy hairstyle lhat is inspired by my mother in years
past

Courtney /Special presentation. An essay conlest sponsored by the
Iowa City Human l\ights Commission. The purpose was 10
celebrate African American women's hislOI)' through an essay
conlest and to increase awareness of human rights issues. The
essay subject this year was Helen Lemme-A hero For Our Time.
And the jdeas that were presented 10 \Vrite on \Vas how was
this famous civic leader a hero and what lessons can we lead
from here from our daily lives. The students were to research
her life and contributions and what characteristics about her
that made her a hero. Here to help me present lhese awards is
the chair of the Hum<UllUghlS Commission,
I'll call up the three winners of the essay contest. Emily Wines,
Vince Sparrow and Andrew Bunz. Each one will receive a copy
of each of lhese books. We only have one each tonight and stay
here. They \Vant some pictures. And a cerlificate.

Courlney/ lIistoric Preservation Week. May \) .J 5. 1993....we have
Doug Hussell, chair or the lIP Commission to accepllhis one.
Doug I(ussell/ Thank you Mayor Courtney and ladies and gentlemen
of the council. The lIP Commission will co.host a program at
the Johnson County Court House on Wednesday, May 12 in
honor of Historic Preservation Week. Our co.sponsors include
the Johnson County lIisloric Preservation Commission, the
Johnson Counly Historical Society and lhe Friends of Hisloric
Preservation. The program will begin at 4:45 PM on the top
floor of the Johnson County Court House. There will be
refreshmenls. There will be awards given ror rehabilitation or
residences, rehabilitation of commercial or public structures.
This year there will be a special category of awards for
painting of older homes in iowa City which could be a colorful
presentation. Also this year for the I1rsl time the Johnson
County Historic Preservation Commission will present similar
awards for projects in the county outside the city limits. So we
invite all the members of the council and the city
administration to attend. We im1te lhe public to allend. We
begin at 4:45. No admission fee. There will be a good slide
sholl' about some of Ihe more interesting projects in lhis pasl
year in Iowa City. Thank you vel)' much.
Nov/ Doug, while you are here. can I ask you to talk a little bit about
the salvage barn, Are you still planning on a grand opening.
HusseIl/ The salvage barn is a project of the City lIousing Hehab. staff
and the Friends of HP. Their building is built and they are
awaiting only dl}' II'mther to pour a concrete floor. When that
Illomenl arrives they will move the materials which have been
placed in private buildings throughoulthe city for slorage.
They will move them to lhe salvage barn and then a grand
opening dale will be announce. The original date of May 8
apparently will not be mel. An announcement will be made
and there will also be a publication announcing Ihe open hours
of Ihe salvage barn. It is my underslanding thaI it will be
alternate weekends or by appointment. But it will be available
to all Iowa Cilians. For those not aware of this project, this is
essentially a clearing house f()r recycled building parIs.
Woodwork, door knobs. stain glass windows and so jilrlh. I\nd
there will be both a barter and a sale systeml believe to keep
Ihe projecl going. So we eXjx'ct Ihal thai will be done
somelime inlhe monlh of May and that will Ix' an ongoing

a. Consider setting a public hearing for May 11. 1993, on an ordinance
amending the Zoning Ordinance by adopting Section 36.82(d) to permit, on
a case.by.case basis. construction of a slngle.family dwelling on a lot of
record which fails to meet the requirements of the zone for lot area.
Comment: At Its April 15, 1993. meeting, by a vote of 6.0, the Planning and
Zoning Commission recommended approval of a proposal to amend the
ordinance by adding subsection (d) to Section 36-82, Nonconforming Lots.
This ordinance would allow, In cases where a lot of record is contiguous to
and considered part of another property because it is in single ownership, the
Board of Adjustment to grant a special exception to permit a single. family
dwelling and accessory buildings to be erected on the lot of record in spite of
its failure to meet the requirements of the zone for lot area. The granting of
the specific requested exception, however, must result in appropriate,
compatible development with surrounding residential development and must
meet all other requirements of this Chapter, Including setback and frontage
requirements. This recommendation Is consistent with the staff recommenda-
tion.

Comment: At Its April 15, 1993, meeting, by a vote of 6.0, the Planning and
Zoning Commission recommended approval of the requested rezoning and
OPDH plan for Village Green South, Parts Three.Eight, subject to certain
conditions, Although the recommendation Is Inconsistent with the staff
recommendation on this Item. the conditions specified by the Commission
have generally assuaged staff concerns about the density, design, open
space, and environmental considerations of the proposed OPDH plan.

Commission, by a vote of 6-0. recommended approval of the requested
rezoning of the Windsor Ridge 5.59 acre tract from County RS to RS.5 with
the clear understanding that all of the costs associated with providing
Infrastructure for development of the subject tract will be paid by the
developer, and subject to 1) City Development Board approval of the
annexation of the original 240 acre Windsor Ridge tract, 2) City Development
Board approval of the requested 5.59 acre annexation, and 3) the developer
dedicating .127 acre of open space In addition to and incorporated as part of
the 6.9 acres of open space required of the original 240 acre Windsor Ridge
tract; the location of the open space shall be negotiated with the City of Iowa
City. This recommendation Is consistent with the staff recommendation
included in a report dated March 4, 1993. No comments were received by
the Council at the April 13, 1993, public hearing on this item.

changing the use regulations for a 30 acre parcel located west of Sycamore
Street and immediately north of the corporate limits, from ID,RS to RS-8.
Medium Density Single-Family Residential. (REZ 93-0001) (Passed and

Comment: At Its March 4, 1993. meeting. the Planning and Zoning
Commission, by a vote of 6-0, recommended that the subject application be
approved, subject to the following conditions: 1) restrictions regarding when
and how basements could be provided. 2) developer agreeing to provide
$7,500 to be used for parkland/open space acquisition In the Wetherby Park
neighborhood. as defined in the proposed Neighborhood Open Space Plan, and
3) the developer agreeing to dedicate right-of-way sufficient to accommodate
the upgrade of Sycamore Street to arterial street standards. This recommen-
dation Is generally consistent with the staff recommendation included in the
staff report dated February 18, 1993. Comments regarding this proposal were
received by the Council at the March 30, 1993. public hearing.

ITEM NO.7. PUBLIC HEARING ON PLANS, SPECIFICATIONS. FORM OF CONTRACT AND
ESTIMATE OF COST FOR CONSTRUCTION OF THE FY93 STORM & SANITARY
SEWER PROJECT.
Comment: This project Involves sanitary sewer work at three locations and repair
of a collapsed storm sewer. Sanitary sewer work will relieve surcharging at
Dunuggan Court, Klneton Green, and the north end of Pine Street. Storm sewer
work will remedy overflow and erosion problems at Ellis Avenue alley. Total
estimated cost of this project is $152,688.00.

Tom Mllelleri I am here representing the Senior Center Commission
and to talk to you abollt the Senior Center. First or all as I am
sllre you all recall that the Commission \\'as at your budget
hearing \\'ilh a proposal to add a slafI' person. You chose not to
fund this request and I am here to apologize to YOIl folks and
all of our Center users in Iowa City and Johnson County for our
inability to persuade you to add this stafr. Our primary goal
Ihis coming year is to help you to overcome this reluctance.
Ambr/ I would like to accept Mr. Mueller's apology.
Muelleri We currently have t\\'o staff members coordinating 500
volunteers. 500 Volunteers. Thai is a lot of human contact for
ollr staff and they are under a lot of pressure to handle thaI
contact salisfactorily. These volunteers are both our e..'\perts
inputting on our programs and also our users of this exper1ise.
Our plan is to have a re\\'arding satisfying experience Jc)r our
users to help Ihem reel needed and \\'anted. To have an
important role in the success of the center and to give them an
excellent opportunity to fulf'jll their needs to socializing. We
think this is \\'hat you have in mind {c)r the Center. The only
problem is \\'e have 200 addilional people thai have signed up
to be volunteers but \\'e do not have the addilional staff person
to coordinate Jell' them. So they are on a \\'ailing list. We need
that extra staff person. So much for thaI. Another item that
has been or concern at the Cenler. as you all kno\\', is parking.
And \\'e have discussed this and \\'e will be approaching YOll
soon with a plan to help make reasonable parking available to
users of the Center when the new ramp is completed. We also
invite YOIl all to come to the Center. We solicit your conmll'nts
and concerns. The Cenler of the Ilse of anyone 55 years or
older. Perhaps. hopefully, some day some or you \\'ill be
eligible to use it. Please do. ;\s in all endeavors we kno\\' you
want us 10 strive to be the be'st. You have allY questions abut
what 1 have said. I \\'ill be more thall happy 10 ans\\'er them.

Kubby / I knoll' that we are trying to immitigate problems for ccrtain
property owners. This is a large amount of money and so my
question comes from are the issucs that are creating thcse
pockets of problems a design consideration in terms of cithcr
our sewer systems or how houscs are placed on lots or how Jots
are graded and that this kind of thing can be prevented In the
future.
Fosse/ What it is Is a result of a uncxpectedly high amount of ground
water gelling into the sewer by means of infiltration or people
connecting their footing tiles to the sewer system. What we are
doing now to prevent this from happening in future
subdivisions in wet areas is we do require tile systems to outlet
the sump pumps, too. So there is an alternative to discharging
into your yard or the sanitmy sClI'er. So we hope to head this
problem off in the fut ure.

Kubby/ 1 have Ihree items. One is that on April 28 il is Take Your
Daughters To Work Day. It's purpose is to get parents to
support-or guardians to take Iheir daughters, ages 9-15, to
Iheir work places so that they can receive a positive reception
[rom people in their parent's work place and make sure lhal
girls growing up now know thaI I here are options oul there in
Ihe work place. So I encourage people 10 lake their daughlers
to work wit h lhem.
Secondly, I recently found out that the request for proposals
for Houser's Household Wasle Collection Sites are going to be
due in mid-June and we had been told thai Cedar Hapids was
going 10 apply for one and [ heard thai they are not going t. So
Jwould be inlerested in Iowa City applying to be a collection
site and to find out if alllhis stuff that I have heard is indeed
true and what it would take.
Horow/ You mean a collection site of a disposal site.
Kubby/ Collection site. One of the 15 slates-Household Hazardous
Waste Collection Site. So instead of having a hazardous
household Day once evel)' five years or however often we can
afford it, 11 can be an ongoing program and since, on the staff'
level, there has been a discussion about having a staffed drop
off site, we might be able to combine these things since we will
have a staff person if we go to that on site to lake our regular
household residential waste. The possibilities for hazardous
household waste also. So I would like us 10 explore this idea.
See what it takes. What the responsibilities are. What the
costs are. Since there is no one in our region lhat is going to be
doing this I think we should look into it. We are talking about
doing it ourselves anyway and how-wl1<1t constitutes a region
according to this opportunity,
Laslly, I saw a notice jn the paper that the Farmer's Market is
going to be starting up which I am very excited about. And I
have heard a lot or people make comments about I~lr111er'S
Market could have been in Iheir normal placl' last year because
of our delayed conslructionwith llw parking lot. So there are
going to be two Sl'Clsons at Chauncl'y Swan. So I was wondering
if there was a way 10 make il a liltle more comrortabil' or a
little dilTl~rent atmospl1l're al Chauncey Swan. It is hotter
there.

judges. I gel to be a judge along with three at her people. [am

separately but only for two years and the mayor's authority to
appoint everybody has gone. So the city council has the
authority to appoint the city clerk, the city attorney and the
city manager.

home grounds. I heard a lot about it avcr thc last ycar or so.

safety signs around all of our elemental)' schools. / you recall
they read 20 MPH between 8:()0 AM and 5:00 PM Monday
through Friday. I think that is not only an overkill but / don',
rcally think that it is effective. / don't think it is working. If
any of you have driven pasl a school at JO o'clock in the
morning. / don't have a stop watch with me bUlnobody but
nobody is paying any attention to that 20 MPH. In my own
private observation from olher school districts, not only in
Iowa but elsewherc, it appcars that the most effective way to
slow that traffic down is to have the specd limit post cd when
children are present and have a blinking yellow light.

that this systcm is nol working. What it is doing. / think. is
alienating a lot of our good citizcns who drive, / don't
understand why they have to slow down to 20 MPH when il Is

committee. Bull really would like to see it re-addressed again.

are doing some speed checks al different school sites. And
then maybe putting at one of lhe school sites that we have data
noll', for the same kind of week. Like no special events in town
or whatever. Putting one system up and see if the stats are
different from the equivalent time rrame to see if that really is
effective instead of changing a whole system and then changing
back to something else. One of the things that was of real
concern to the committee is doing experimentation. Being
consistent at every school and to changing lhings all of the
time, So maybe if we are going 10 do a change to do it in one
place and keep lhal experimentation to a minimum to see ir
your ideas is elleclive.

In that respect it is working. 1 know 1 recognize t hose signs
more than-as being there and that there is a school coming up.
Your right. It is not working as rar as the actual speed coming
down to 20. I think it has decreased overall speeds somewhat.
It is more the awareness of what is in lhe area. Especially
those who aren't familiar with the area that are just passing
through.
Ambr/ No. The whole idea is to get that mOlorist to slow down
because if a child happens to darl in front of him or her they
can stop. But if they are doing 30-35 MPH they can't do it. It
is very hard to gel yourself in a position to brake in time. Does

family or support system to get help somewhere else, Because
this is a loan I think this is a real good balancing or people's
needs and will help people get inlo housing and bring a lit lie
bit more stability. A little more control to their lives, Increase
their self esteem and create more sense of community in our
neighborhoods. So I am very much in favor of doing this
program. We did it on a short term basis last year with some
block grant funds and I think it was very successrul and I like
seeing it on a larger scale,

other housing programs as our housing needs change over time.

said last night it appears thaI our whole program or assisled
housing is skewed so much ror the renter. That is lhe reason
this program appealed to me, That we are talking about
putting people in the homes that they are going to be able to
own for themselves. Add to our lax base and also free up an
additional renlal property if somebody could move out of the
assisted housing program into their own ownership. So, in
order to get something started on this, I will agree to vote in
the affirmative for Naomi's amendmenl because it isn'l killing

Which way we were going. The amendment requires a simple
majority which is in this case 3 onlhe l1nal vote. On the
resolution requires the normal 4 votes. So. This lhing is almost
too close to call/elr me. [ have got arguments on both sides on
this. late night [ finally came down on one side because I
thought there was more involved in this Jand acquisition
towards buying residences that would be then turned into
assisted housing and taken off the tax rolls. [was convinced
today that that wasn't the primal)' reason for the land
acquisition money. II was to move houses to and to then resell
them which left them on the property tax rolls. Leaving the
$15,400 or whalever is in there does get the program started. I
think we can do some monitoring there and see hall' things go.
Hopefully we can put inlo place some more lower cost housing
in the nl'xt year or so Ihat we will have some demand tell' this.
I think the demands out there now is such that lhis really
doesn't do whole 101.

Comment: Certain parks and recreation fees, particularly those dealing with the
reservation, rental and use of facilities, must be adopted by ordinance, and
specifically delineated in said ordinance. Only certain fees within Section 32.1.65
are being recommended for adjustment. Other fees, primarily those for
participation In structured recreation activities, are adopted through the normal
budget process.

Fee Increases are needed at this time In order to reduce the need for a property
tax increase to support these activities. All fees have been voted upon and

Helling! The FCC is making rules now based on the J 992 legislation
which will presumably be aimed at requiring the cablc
companies to restructure some of their peripheral services or
the peripheral charges like installaUon charges to more closely
reflect the actual cost. So if there is any profit or any cost over
and above the actual cost of tlle company in that installation
fee that might bc for maintenance, some of that fle.xibility is
probably going to bc taken away for the companies.
Shaffer! Althe Ume that we began to write the RFP that particular
item tlmt you are discussing was put in by the consultant. The
FCC had not passed the rulcs that Dale is talking about so there
was no other lower cost tier tImt now exists in Iowa City. Of the
just the access channels cmd broadcast channels for the $10.00.
So that is the additional factor, too.
Kubby! Although, what is it, $10.00. For some people who might
want to follow local government that have a night job and can't
come or have lots of kids cmd can't afford child care. $10.00
buys a lot of potatoes cmd that people need to make those
choices if you are going to choose food. Then I want them to
have access to local government through public access and it is
the only way to keep this in is to add some kind of a
maintenance fee sentence in there, thai would be acceptable to
me becausc I want people to have 111e option for as low as cost
as possible to have just that spectrum on their dial.
Ambr! Nothing is free. I agree with what I hope is the majority.
There should be some cost attached to this because it isn't just
sometIling that is an absolute right of a privilege. It is another
amenity. And you pay for it or you don't. I don't think it is
fall' to layoff all of the charges on the people who are paying
tImt 5% fee. I just think there is an imbalance there.
Nov! What is the current installation rate.
Shaffer! About $45,00 depending upon what needs to be done. If
you are talking underground it is more. It costs more for
underground because they have to do the trenching. So I think
it varies $45 to maybe $60.00.

to see how well the company is to come half way on this or

discussions about that today trying to sort out. The state has
the J1ber network that they are building now or the fiber trunk
that is being built and apparently that would provide,
hopefully, assuming that the state legislature allows the
localities to tap into that at some point in time, would pr0\1de
the mechanism or the conduit for V<lrious school distlicts to
interconnect. And there is a term for it. They will provide for
one point of access wmun each county. And then we could
work from that or the school districts could work from that.
Horow/That reminds me because on page ii The city expects the
rebuilding including the replacement of old cable, electronic
and passive devices. I wondered whether the word fiber optic.
Does this system-is it possible to have this system inlerface
with fiber optic at some point along the way.
Shaffer! Oh, most definitely, yes.

Shaffer! We can put it in but 1 Illink it is a given. The rebuild is
going to be fiber tmnked. It will not be libered to the house.
It will be fibered to the curb. The only reason it ls not going to
be fjbered to the house is that nobody is doing rebuilds like
that at this point in time because of expense. This is too
e.;xpensive to do, It will be fi bel' trunked and it wiII certainly
give us the ability to connect with, if as Dale says the state
legislature which is debating this particular item right now, the
ability to tap into the state fiber optics or any other local (U'ea

schools could connect and/or whether or not other local
jurisdictions as they franchise with their own companies can

strategy than anything else. We are asking them to provide a
lot of infol11lation and propose a lot of things that they would
do and I think it is to our advantage to have them propose also
within what time frame in terms of a franchise- the length of
the franchise that they could do that in.
Horow/ We are asking for an awful lot of information in here. lli we,
it is our responsibility then to have our staff check to see
whether or not that they are telJing the truth. Or is this what
the consultant does. Or how do we know what they are
handing us is really the truth.

going to be acting as a quasi judicial body at some later point.
Ambr/ Just to refresh my mind. The present franchise expires Aril
of '94 so the company wants this work to be handled before
that. At what point does the city council have there input.
Shaffer/ the city council can have their input at any point in time
that they want. The process is stated in your resolution. We
won't really know what the cable company is going to have to
say until we get their proposal. It won't be for at least 60 days.
And they could come in and ask for an extension of that if they
needed it and as it has been noted there is a lot being asked of
in there. This is not. If you look at the RFPs in Cedar Rapids or
Waterloo or olher cities tImt have recently gone through the
franchising have given their cable companies this is far more
extensive. So they may come in and ask for an extension in
which case there might be an additional 30 days if the council
so granted it. At that point in time we will begin to have some
idea of what the cable companies are willing to offer. Council
could certainly take a kx)k althat and begin to give us
comments at any point about what they feel about the
proposal. We will have 30 days to look at that by law and
evaluate it. It is not a whole lot of time so we will have to
work pretty fhst in 30 days to get a response back. It will be
the colUlcil's-only with the council's permission that anything is
accepted or whatever at that point in terms of ihe proposal.
Kubby! They have GO days, they might ask for an extension and then
we have 30 days. After our 30 days, is that when a final
decision is made or do we go hack and forth a few more times
yet.

have some rather deep seated philosophical differences with
one of the paragraphs that is on the code that I think is more of

the UBC text I will accept in total because I think it is in the
best interest for the health and safety of all of our cilizens to
who will be subject to this. So I will vote for this and for the
passage.

Kubby/ yes I do. we lJad some correspondence from someone
yesterday asking that we also add something else to it so that a
contractor would have to have a contractor's registered number
that Uley get from the state. I didn't talk to Patrick Hughs, the
person who left it with us. He left a message on my machine
tlmt gave us some information in terms of nllmber of permits
and people who have contractor registmtion numbers and he
said that there were 7] permits issued in lvlarch and only four
of the permits had registered numbers associated with them.
That people aren't registering with the state or they are not
getting their number or something. And that three of these
were tIle same person. So there was really just two people who
had registered contractor numbers. I am not quite sure what
that means but I was asked to pass this information on. I am
interested in exploring this. I asked some questions today and
learned that Cedar Hapids, Dubuque, Davenport and Des Moines
all use this in their UlJC and the pUI})ose of finding or obtaining
that reglstratJon contractor number is to make sure that people
who are employees aren't for purposes of insurance being
considered subcontractors and therefore no workman's compo is
being paid to these people. So I cUll interested in this. I don't
know if other people are interested in this or if they have other
questions. But since this is second consideration we would have
another chance. I guess I want to put this up as an amendment
to add this in especially since it doesn't seem like it would be a
big deal for our dep1. to check the computerized list that we
could get on a monthly basis from the state.

assume this is for Johnson County, not necessarily for Iowa

information yet. There is some work we have to do.
Nov/ I read it. There are contractors there who are not in Iowa City
but there is nothing 10 prevent a contractor who has an address
in Coralville or North liberty or whatever 10 come into Iowa
City and build something.

Kubby/ Even from Des Moines. J mean like Iowa Realties based in
Des Moines and we just passed mld adopted sometIling for
them t do. So it is not a way to e.,clude out of town builders
but to just insure that if people really are employees,
contractors, or subcontractors that they are not treated as
subcontTactors and they are protected.
Horow! Is there a reciprocal agreement.
Courtney/It is all right for them to be treated as subcontTactors.
That happens all of the time.
Kubby / If they are. but if they are employees of a carpenter or an
employee of a general contractor they should follow the laws in
terms of workers compo This is a way of making sme that that
happens. If they are indeed legitimate subcontractors, of
com'se, they should carry their own insmance. That makes
total sense to me.
Horow/ I would be interested in the reciprocal agreements we have
with for instance like Cedar Rapids. Because if they are
registered there and our contractors and subcontractors work
in Cedm' Rapids what do we do for those contractors mld
subcontractors in Cedar Rapids that work dOlm here.

lvlay schedule is to be altered somewhat. We canceled the
informaJ session of May 10.
Have an early start on May 11 at 6:30.
We are to have a special meeting on 21st for some budget
amendments. 8 o'clock in the morning. Very short.
The 24th informal is to be canceJed for sure. The 25th looks
like it will be unless we have some short zoning items to hit or
something that jtt~t can't be avoided.
Horow/ Cml we have a May 3rd, 7 o'clock.
