Kubby / I knoll' that we are trying to immitigate problems for ccrtain property owners. This is a large amount of money and so my question comes from are the issucs that are creating thcse pockets of problems a design consideration in terms of cithcr our sewer systems or how houscs are placed on lots or how Jots are graded and that this kind of thing can be prevented In the future. Fosse/ What it is Is a result of a uncxpectedly high amount of ground water gelling into the sewer by means of infiltration or people connecting their footing tiles to the sewer system. What we are doing now to prevent this from happening in future subdivisions in wet areas is we do require tile systems to outlet the sump pumps, too. So there is an alternative to discharging into your yard or the sanitmy sClI'er. So we hope to head this problem off in the fut ure. Kubby/ 1 have Ihree items. One is that on April 28 il is Take Your Daughters To Work Day. It's purpose is to get parents to support-or guardians to take Iheir daughters, ages 9-15, to Iheir work places so that they can receive a positive reception [rom people in their parent's work place and make sure lhal girls growing up now know thaI I here are options oul there in Ihe work place. So I encourage people 10 lake their daughlers to work wit h lhem. Secondly, I recently found out that the request for proposals for Houser's Household Wasle Collection Sites are going to be due in mid-June and we had been told thai Cedar Hapids was going 10 apply for one and [ heard thai they are not going t. So Jwould be inlerested in Iowa City applying to be a collection site and to find out if alllhis stuff that I have heard is indeed true and what it would take. Horow/ You mean a collection site of a disposal site. Kubby/ Collection site. One of the 15 slates-Household Hazardous Waste Collection Site. So instead of having a hazardous household Day once evel)' five years or however often we can afford it, 11 can be an ongoing program and since, on the staff' level, there has been a discussion about having a staffed drop off site, we might be able to combine these things since we will have a staff person if we go to that on site to lake our regular household residential waste. The possibilities for hazardous household waste also. So I would like us 10 explore this idea. See what it takes. What the responsibilities are. What the costs are. Since there is no one in our region lhat is going to be doing this I think we should look into it. We are talking about doing it ourselves anyway and how-wl1<1t constitutes a region according to this opportunity, Laslly, I saw a notice jn the paper that the Farmer's Market is going to be starting up which I am very excited about. And I have heard a lot or people make comments about I~lr111er'S Market could have been in Iheir normal placl' last year because of our delayed conslructionwith llw parking lot. So there are going to be two Sl'Clsons at Chauncl'y Swan. So I was wondering if there was a way 10 make il a liltle more comrortabil' or a little dilTl~rent atmospl1l're al Chauncey Swan. A Wtle more motivating ror people to go to that spol. It just has got a different atmosphere lhere than by lhe creek. Atkins/ Sure. I will ask Joyce about it. Kubby/ What can we do to encourage people who go to the P/I{ Commission to get permits to be musicians to ped mall to see if they can be down there, Atkins/ Joyce arranges those lhings. Kubby! And encourage people to let Ihem know thai that might be a spot thai would be good for them as weB as the whole atmosphere. Atkinsi 1 will ask. Kubbyi ThaI is alII had. Courtney i [ would be interested in monitoring the cost of that though. I don't know if I would want to spend any money to doil. Kubby / 1 don', know. Since it was kind of our-because of decisions that we made or whalever circumstances that the Farmer's Market is in that spot lill' two years instead of one year. I- Courtney/ I am stillnol interesled in spending any money to do it. That is my opinion. Kubby / I am saying that [ would be interested in spending a small amount of money in doing lhal. Courtney/ ! already get enough comments about the low cost of lhe permit from the people who play property tax dollars. Nov/ Okay. I wenl to Horace Mann School on Friday afternoon and participated in a panel discussion on the environmenl and particularly on cleaning up lIickory Hill Park. So [ think we have some interested young pmple who are volunteering and helping cleanup lhe city and I congratulale them. So the city council has the authority to appoint the city clerk, the city attorney and the city manager. Courtney/ Gooc!. That was a long battle J()r them. Tlmt is myoId home grounds. I heard a lot about it avcr thc last ycar or so. Any thing else. Ambr/ Darrel, I would likc 10 revisit the area again of the school safety signs around all of our elemental)' schools. / you recall they read 20 MPH between 8:()0 AM and 5:00 PM Monday through Friday. I think that is not only an overkill but / don', rcally think that it is effective. / don't think it is working. If any of you have driven pasl a school at JO o'clock in the morning. / don't have a stop watch with me bUlnobody but nobody is paying any attention to that 20 MPH. In my own private observation from olher school districts, not only in Iowa but elsewherc, it appcars that the most effective way to slow that traffic down is to have the specd limit post cd when children are present and have a blinking yellow light. EveJ)'body has got other opinions but / can just tell youlolks that this systcm is nol working. What it is doing. / think. is alienating a lot of our good citizcns who drive, / don't understand why they have to slow down to 20 MPH when il Is obvious when no childrcn are in view. / think classes lakc up around 8:30 to 8:45. Thcy have recess. Usually they are on thc campus that is fenccd. Thcy all takc lunch on the campus and the only time Ihcy arc visiblc is whenever they are Icaving thc ]ilCility which is clOSing time. So I don'l think what we have is worth a hoot. I would like 10 see something changcd. I know when we lalked about Ihe yellow blinking si/lns thc idea or cost came into it. Weill really don'l know how much is involved in that cost but to me Ilhink it would bc worth illo make something Ihat is really elTcclive 10 slow down that driver IJl~'ausc this systcm doesn'l do it, We don't havc enough patrol cars 10 post somcbody at every school sitc in the land. .lust isn'l practical to do Ihat. So, Ihrough long discussions on the school safety commit lee that we had at thaI time this is kind of the one that we settled on and the individual schools safely committee seemed 10 be very pleased with it. J think that is the whole idea. Yellow is a caution. And if it is blinking, you will, But there are a lot of people lhat will travel through any given school district in any given state that aren'l aware of what the statutes are in any stale thai you are suppose to know. And I Jook upon those blinking lights as helping me be aware of what the law is. And eve!)' place I have seen lhem Karen, the drivers pay attention to them. They really do slow down. Kubby! I wouldn't be comJ(mable changing whal we are doing until we can get a meeting with the schools. Ambr/ I don't expect this 10 go out tomorrow, I respect the work thai our councilor representatives have done on lhat committee. Bull really would like to see it re-addressed again. Kubby/ Ivlaybe we could get some statislics over how many tickets are doing some speed checks al different school sites. And then maybe putting at one of lhe school sites that we have data noll', for the same kind of week. Like no special events in town or whatever. Putting one system up and see if the stats are different from the equivalent time rrame to see if that really is effective instead of changing a whole system and then changing back to something else. One of the things that was of real concern to the committee is doing experimentation. Being consistent at every school and to changing lhings all of the time, So maybe if we are going 10 do a change to do it in one place and keep lhal experimentation to a minimum to see ir your ideas is elleclive. Ambr/ If' the idea or lhe cost- To me I think Ihe only Ihing thai really works is yellow blinking lighl. Kubby/ The only discussion we had about taking this outlast nighl was the dirnmlly with there being no lrarric ronlrols along Kirkwood for pedeslrians to cross Kirkwood. Jl'you arc on the north side or Kirkwood and you want 10 go towards the Mall you have to cross the streel sometime if you want to slay on lhe sidewalk and so we are going 10 need 10 figure out pedestrian access across Kirkwood. lIorow/ Right. There is a sidewalk from Summit all the way down to Hrst Ave. I am sure there was. Kubby/ In front of the curve. lIorow/ Even in front or the curve. But Ihe ract or the matter is the bus stop, heading east, is on lhe south side of Kirkwood righl there at Summit. So there is a need for people to cross. The problem is is there is not cross walk, And there is a lot of pedestrians on Kirkwood. Kubby/ I guess I didn't realize there is a sidewalk all the way down. lIorow/ Yeah, there is. Court ney; I wiII vote for t his but I am going to express some reservations. A little more control to their lives, Increase their self esteem and create more sense of community in our neighborhoods. So I am very much in favor of doing this program. We did it on a short term basis last year with some block grant funds and I think it was very successrul and I like seeing it on a larger scale, Nov/ Where did I\'e do this last year. Kubby/ $3,000 last year JJlrough block grant moneys through the program statement last year at this time. Nov/ And that $3,000 was loaned to one person. Kubby/ It was a smaller amount. It was three different people at $1,000 per person. Nov/ So then $15,000 could be loaned as $],000 per person. Kubby/ It could. The program, as in the statement, is lor $3,000 and that is a fine amount. It is a small investment on our part that allows a person to have a large investment 011 that part in gaining equity that they then get to keep. The $3,000 leverages a lot and we get it back. That is the beautiful thing about iI. That we can perpetuate this progmm or put it into other housing programs as our housing needs change over time. HorDlv/ I, too, appreciate the time that CCN has spent on this. I, too, disagree with the philosophy on this. I don't think this is going to create more housing, I think you are just going to rearrange the chairs on the deck here, Andl feel rathcr that the program for land acquisition fbr afklJ'Clable housing, not land acquisition for rental, I think that is probably more important on to what this city needs right now. r would hale to lhink that someone feels that I am excluding peoplc from being able to live in Iowa City. That is lhe reason this program appealed to me, That we are talking about putting people in the homes that they are going to be able to own for themselves. Add to our lax base and also free up an additional renlal property if somebody could move out of the assisted housing program into their own ownership. So, in order to get something started on this, I will agree to vote in the affirmative for Naomi's amendmenl because it isn'l killing the programentireJy and it is gh1ng them a good start [ think. So I will vote for it.for the amendmenl. Courtney/ I checked with my parliamentarian leam over here. Which way we were going. The amendment requires a simple majority which is in this case 3 onlhe l1nal vote. On the resolution requires the normal 4 votes. So. This lhing is almost too close to call/elr me. [ have got arguments on both sides on this. late night [ finally came down on one side because I thought there was more involved in this Jand acquisition towards buying residences that would be then turned into assisted housing and taken off the tax rolls. [was convinced today that that wasn't the primal)' reason for the land acquisition money. II was to move houses to and to then resell them which left them on the property tax rolls. Leaving the $15,400 or whalever is in there does get the program started. I think we can do some monitoring there and see hall' things go. Hopefully we can put inlo place some more lower cost housing in the nl'xt year or so Ihat we will have some demand tell' this. I think the demands out there now is such that lhis really doesn't do whole 101. Nov/ There are always buyers standing in line fell' those houses. Kubby/ WIK'n you talk abut get the program started. Horow/l would like to say that this has been one of the best processes that I have ever seen. I\'laybe it was because I took part in it. But I 11lOroughly enjoyed going around 10 the different groups and talking about this because people truly have not realized the potential we have with the access channels. On the educational as well as the public. And stimulating not only this city and the various public or elected bodies in this city. But also other towns and I hope that we are used as a precedence for the region in terms of how thaI this- Novl Excellent idea. Have we copied it that we could send to the other towns in this region. Have we extra copies of the proposal that we could send to the other towns in this regjon so they \\@ know what our proposal. Kubby I I think they are kind of waiting for us to vote on this to see what we decide to do. Harm-vi I would ask, Dale, did the comments lhat we made last night were they incorporated into this proposal. Hellingl Yeah, if you like, I will Just address them as they were talked about. The first one was to simply in one section to add a request for the reason why outages occurred in 1992. And that certainly is something we can add and we will do lhat. The second one was regarding the use of the kiosk and the way that the request is put forth lhose kiosks would become property of the city and we could llse whatever applicatJon we saw fit at whalever time that might be appropriate. Kubbyl So we don't need to change any language at all. Helling/ No. The issue of free access channels simply for the cots of installation. Drew and I discussed that today am! Drew if you could come up. Drew is going to atlempl to contact our consultant because they were the ones that put that in and I don't know if' you were able 10 do that or not. Drew Shaffer/ No. I was not able to. I did call but she was out of town today so I did not get a response JJ'om her. My suggestion is if lhat bothers anybody on the council that that could be taken out. Kubby/ Oh no, I want to keep it. ThaI is very very important. -- .....----,..... - P"T;''1........ -.- ~ -"ti" "~i!J' ", f.2,: .(;j ,r ,,'.,' '.":,,,': ?'..'.:",'D:,;",.:.'1~(,':)Er":,',:;j; .::',.' ~ '-," ;:::~::' :>, :'.' :', #21 page 2 Nov/ My comment was can they have something else. Could I call them and say I want [ree public access chm1lJels and I will pay you [or HIlO. Shaffer! Yes. Kubby / That is Hne. It is an obligation on the cable company's part to provide public access. So I fecI fine that people wouldn't have to pay for that. And if they want a separate channel that is the menu of choice. Nov/ So they would black out everything except the three access channels. Courtney! I think that I have got to go on the negative side on this one form the standpoint that there is always some maintenance involved on this thing and if there are free users on the system that means that I am subsidizing l1mt wi111 whal I pay for the maintenance of the system. And to have a totally free to me I have to disagree. I can make it velY affordable but. Horow/ Could this be subtracted though from the franchise that we garner [rom this. In other words could there be some sort of billing system where the maintenance for 111ese free access channels. I can't imagine where it would be that much. Could it be subtracted form the franchise agreement. Kubby / Just the same issue then. Courtney/ You m-e still paying that franchise tax out of my pocket. Kubby / That solution doesn't take care of the intent behind not wanting. Novi If you are going to maintain this you can'l say you are only maintaining 1110se three channels. You are maintaining the whole cable system. Horow/ No. If it is being maintained and if the maintenance is being given to someone who is only receiving the access channel then I wouldn't have any problem- Courtney/But the maintenance of the system as a whole is an c,xpense and the people that are would be receiving it free are part of the system as a whole and you are expecting the users of the system to pay all of the maintenance. I just don't agree with that. Kubby / Assuming that the rates and not the inslallation fee include the maintenance costs. Where are the maintenance costs. Does , the installation have any maintenance cost associated with it or is it just the actual installation. Helling/ The latter. Gentry/ The latter. :--:,,: :t11':, ':. ;:~...,::: &j; ,':, :!'t+j" '. : ,.: .:. ". .'...,'. ':,::: :,: ,;;' " ~, " ',-" . I " , , 1 ' , ,," , .,. , \ . ' , ." The FCC is making rules now based on the J 992 legislation which will presumably be aimed at requiring the cablc companies to restructure some of their peripheral services or the peripheral charges like installaUon charges to more closely reflect the actual cost. So if there is any profit or any cost over and above the actual cost of tlle company in that installation fee that might bc for maintenance, some of that fle.xibility is probably going to bc taken away for the companies. Shaffer! Althe Ume that we began to write the RFP that particular item tlmt you are discussing was put in by the consultant. The FCC had not passed the rulcs that Dale is talking about so there was no other lower cost tier tImt now exists in Iowa City. Of the just the access channels cmd broadcast channels for the $10.00. So that is the additional factor, too. Kubby! Although, what is it, $10.00. For some people who might want to follow local government that have a night job and can't come or have lots of kids cmd can't afford child care. $10.00 buys a lot of potatoes cmd that people need to make those choices if you are going to choose food. Then I want them to have access to local government through public access and it is the only way to keep this in is to add some kind of a maintenance fee sentence in there, thai would be acceptable to me becausc I want people to have 111e option for as low as cost as possible to have just that spectrum on their dial. Ambr! Nothing is free. I agree with what I hope is the majority. There should be some cost attached to this because it isn't just sometIling that is an absolute right of a privilege. It is another amenity. And you pay for it or you don't. I don't think it is fall' to layoff all of the charges on the people who are paying tImt 5% fee. I just think there is an imbalance there. Nov! What is the current installation rate. Shaffer! About $45,00 depending upon what needs to be done. If you are talking underground it is more. It costs more for underground because they have to do the trenching. So I think it varies $45 to maybe $60.00. Kubby! Does it matter if there is a special. Do they have specials. Shaffer! Oh sure. Thcy have specials. Courtney! you gct installation free during some specials. Nov! But those specials are not for the access channels. Usually if you IVallt bravo or whatever. Kubby/ So what is our process to change things because this is a resolution and not an ordinance. Do we make informal agreements. Do we make amendments. Or do we just nod om heads. Helling/ The resolution is simply one authorizing us the city to submit the RFP. So 1 think with some general direction we can make the amendments and go ahead and submit the RFP. Courtney / 1 think we can ask for a proposalli'Om them on this particular issue and discuss it later. Helling/ 1 might point out that in the HFP the sentence starts the city encow'ages. This is not put forth as em absoiute requirement. We are at a disadvantage in this process because of the Iowa Open Ivleetings law prohibits you from discussing in executive session strategies tJlat we would use in negotiating this. So any discussion with you or BBTC as far as what strategies we will use as the negotiating pcu'ty must be done in open session imd in full view of any representatives of TCl who happens to IVant to attend. But these are the kinds of things that are put forth as requests and we can posture ourselves during the negotiaUons to see how well the company is to come half way on this or whatever. Cmu.tney/ Maybe we can arrange a power outage in the booth back there for a minute. Kubby/ Jerry didn't like that idea. Courtney/ 1 had a question on this reasons for outages. l(equesting for reasons for 1992. Do they typically note each reason as it happens. 1 can envision this as being almost impossible to go back if they didn't make notes along the way and give an absolute reason for it. Shaffer/ I don't think they always note the reason. I think most of the time they try to note the reason and it is usually attached to something like storms, lightning, something like that Courtney/ Can we do it reasons lor outages within reason. Kubby/ When possible. Whel1 the reason is known. The CHn only give us the information they have. Courtney/ For the future you could ask that because then they would just make a note on the service call. But to go back a full year might be a little unreasonable on our part Nov/ They will tell you if they don't have the reason. Helling/ The next Hem referred to the ability to interconnect insUtutions or interconnecl with other systems which might - -.. ... .. ---..,.--,. ...-'- .. ..~'t~---'--.r :,;..""@,",,:-.,.',-'~' ,', \tl~ .'.,,': ",: :...~'::., , , .. ill " 'j '., ' ..(.', ~:' ~, . , '~4" " ' ;" ' ,', ;: ~,' ',' :' ~ ,I ' ',' \ - . The state has the J1ber network that they are building now or the fiber trunk that is being built and apparently that would provide, hopefully, assuming that the state legislature allows the localities to tap into that at some point in time, would pr0\1de the mechanism or the conduit for V<lrious school distlicts to interconnect. And there is a term for it. They will provide for one point of access wmun each county. And then we could work from that or the school districts could work from that. Horow/That reminds me because on page ii The city expects the rebuilding including the replacement of old cable, electronic and passive devices. I wondered whether the word fiber optic. Does this system-is it possible to have this system inlerface with fiber optic at some point along the way. Shaffer! Oh, most definitely, yes. Horow/ Should that word be put in there then. Shaffer! We can put it in but 1 Illink it is a given. The rebuild is going to be fiber tmnked. It will not be libered to the house. It will be fibered to the curb. The only reason it ls not going to be fjbered to the house is that nobody is doing rebuilds like that at this point in time because of expense. This is too e.;xpensive to do, It will be fi bel' trunked and it wiII certainly give us the ability to connect with, if as Dale says the state legislature which is debating this particular item right now, the ability to tap into the state fiber optics or any other local (U'ea network. Wjde (U'ea network, project school net, or whatever. Horow! Okay. That has been my main interesl whether or not schools could connect and/or whether or not other local jurisdictions as they franchise with their own companies can inlerface with this one. And you say that the language is in here now that permits that in the future. Either this way or through l1ber optic. Shaffer! Yes. Horow! This is fantastic. This is a really good HFP. lUke this. Helling! Along this same vein the question of adding on page XXVI, a 5th evaluation criteria and talked about the ability to interconnect and that can be done very easily. Horow! Okay. Thank you. Again, it has probably more to do with negotiation strategy than anything else. We are asking them to provide a lot of infol11lation and propose a lot of things that they would do and I think it is to our advantage to have them propose also within what time frame in terms of a franchise- the length of the franchise that they could do that in. Horow/ We are asking for an awful lot of information in here. lli we, it is our responsibility then to have our staff check to see whether or not that they are telJing the truth. Or is this what the consultant does. Or how do we know what they are handing us is really the truth. Gentl)'/ I would suggest that you talk about that later since you are going to be acting as a quasi judicial body at some later point. Ambr/ Just to refresh my mind. The present franchise expires Aril of '94 so the company wants this work to be handled before that. At what point does the city council have there input. Shaffer/ the city council can have their input at any point in time that they want. The process is stated in your resolution. We won't really know what the cable company is going to have to say until we get their proposal. It won't be for at least 60 days. And they could come in and ask for an extension of that if they needed it and as it has been noted there is a lot being asked of in there. This is not. If you look at the RFPs in Cedar Rapids or Waterloo or olher cities tImt have recently gone through the franchising have given their cable companies this is far more extensive. So they may come in and ask for an extension in which case there might be an additional 30 days if the council so granted it. At that point in time we will begin to have some idea of what the cable companies are willing to offer. Council could certainly take a kx)k althat and begin to give us comments at any point about what they feel about the proposal. We will have 30 days to look at that by law and evaluate it. It is not a whole lot of time so we will have to work pretty fhst in 30 days to get a response back. It will be the colUlcil's-only with the council's permission that anything is accepted or whatever at that point in terms of ihe proposal. Kubby! They have GO days, they might ask for an extension and then we have 30 days. After our 30 days, is that when a final decision is made or do we go hack and forth a few more times yet. Shaffer! Yes. Ambr/ Mr. Mayor I voted against the first consideration because I have some rather deep seated philosophical differences with one of the paragraphs that is on the code that I think is more of a social issue than it has anything to do wilh the UBC. However the UBC text I will accept in total because I think it is in the best interest for the health and safety of all of our cilizens to who will be subject to this. So I will vote for this and for the passage. Kubby/ And after our last meeting when you had moved that we continue om p.h. and there was no second. I went home and I was sorry that I didn't second your motion and I want to apologize for that because I think if there is a COll11cil member who feels that the public should have an additional opportunity to speak that I want to also let that opport1111ity happen. So it was about content that I didn't second it but I realize that it is not really how I feel. That just because of the process that I would normally support that. So the next time something like that happens remind me that I said this. Ambr/ Concern. I went home and tossed andtmned for 10-15 seconds. Bit I appreciate. Kubby / There was an amendment to the ordinance last time so I am assuming that that is stal11s quo now and we don't have to do the amendment. Ami correct. gentry/ Right. Kubby/ Okay. But last night we had talked about accessory buildings so we have an additional amendment in front of us that I want to move the amendment but amend the amendment. Is that what I need to do. Gentry/ You could move the amendment and we can hand wrile it in here in what you have in front of YOll. Kubby/ So I want to make an amendment that accessolY buildings as defined in the Iowa City Code of Zoning Ordinances and having no historic significance shall be exempt from said nollce requirements. meaning that if you have a garage or something that is going to be demolished there will still be a seven day deJay but it won't be posted. We want to try to decrease people scavenging in people's backyards. We want to give an opportunity for cily Sah'.lge operations to go in or people to contact the property owner but not to have random people in " I '~:\,;,< ~ ,~." '~,... Courtney! Okay. We have an amendment by Kubby, seconded by Nov. Discussion on the mnendmen1. All in favor (ayes). Opposed- Back to the original ordinance as amended. Any further discussion. Kubby/ yes I do. we lJad some correspondence from someone yesterday asking that we also add something else to it so that a contractor would have to have a contractor's registered number that Uley get from the state. I didn't talk to Patrick Hughs, the person who left it with us. He left a message on my machine tlmt gave us some information in terms of nllmber of permits and people who have contractor registmtion numbers and he said that there were 7] permits issued in lvlarch and only four of the permits had registered numbers associated with them. That people aren't registering with the state or they are not getting their number or something. And that three of these were tIle same person. So there was really just two people who had registered contractor numbers. I am not quite sure what that means but I was asked to pass this information on. I am interested in exploring this. I asked some questions today and learned that Cedar Hapids, Dubuque, Davenport and Des Moines all use this in their UlJC and the pUI})ose of finding or obtaining that reglstratJon contractor number is to make sure that people who are employees aren't for purposes of insurance being considered subcontractors and therefore no workman's compo is being paid to these people. So I cUll interested in this. I don't know if other people are interested in this or if they have other questions. But since this is second consideration we would have another chance. I guess I want to put this up as an amendment to add this in especially since it doesn't seem like it would be a big deal for our dep1. to check the computerized list that we could get on a monthly basis from the state. Horow/ Karen, I agree with you that I would like to l(X)k into this. BlIt I don't agree with YOllthal I would wan to put an amendment on this partimlar ordinance at this lime. I think this Is something that the stnff needs to take a look at and I don't wan to keep the UBC fhrm being delayed CHANG E TAPE TO I{EEL 93-44 SIDE 2 ,< - ".....------..--. ...... ~...- , .. . 1.,," ~'", '1. Is it in the boiler plate that the contractor assures us that these peopJe are registered. It is minutia but it is interesting minutia and it does protect the citizens from fly by night contractors, but by the same token, no, I don't want to delay this light now. Kubby/ I am not asking for a delay. I am saying we could add it now if people felt fine about it or we can do it in two weeks an din the mean time in that two weeks ask some of these questions of staff and get some information and I would feel fine about that. Il'laybe we can get a hold of PatTick Hughes and have to have him, if we have questions, to I1nd out from his \1ew point- Horow/ But I would also like to ask Ms. Gentl)' if this is something-if we ask you for this within two weeks does this mean you are going to have to stop something else that we have already got high on the priority. gentT)'/ No. I think I can manage in two weeks. Horow/ Okay. We are forever doing stuff like this. KlIbby / It is not that complicated of a thing. gentry/ I think there is a simple preemption question. I have co-city attorneys in Dubuque and Cedar I~apids that I can call. Kubby/ That wOllld be great. So I woulcllike people to remember this for two weeks form tonight. Nov/ I would like more information. When I read it it sounded like all we needed was an application for a permit that had a line requesting what is your contractor's registration number. It sounded like all he wanted us to do is ask for it. gentry/ What do you do if you don't get Jt. That is what I don't know. Courtney/ Get feedback from Doug as well as legal. Horow/ The list of contractors registered in the County of Johnson I assume this is for Johnson County, not necessarily for Iowa City. Atkins/ I have not read that and been abJe to verilY that information yet. There is some work we have to do. Nov/ I read it. There are contractors there who are not in Iowa City but there is nothing 10 prevent a contractor who has an address in Coralville or North liberty or whatever 10 come into Iowa City and build something. J mean like Iowa Realties based in Des Moines and we just passed mld adopted sometIling for them t do. So it is not a way to e.,clude out of town builders but to just insure that if people really are employees, contractors, or subcontractors that they are not treated as subcontTactors and they are protected. Horow! Is there a reciprocal agreement. Courtney/It is all right for them to be treated as subcontTactors. That happens all of the time. Kubby / If they are. but if they are employees of a carpenter or an employee of a general contractor they should follow the laws in terms of workers compo This is a way of making sme that that happens. If they are indeed legitimate subcontractors, of com'se, they should carry their own insmance. That makes total sense to me. Horow/ I would be interested in the reciprocal agreements we have with for instance like Cedar Rapids. Because if they are registered there and our contractors and subcontractors work in Cedm' Rapids what do we do for those contractors mld subcontractors in Cedar Rapids that work dOlm here. Nov/ I don't tl1ink it is local registration. I think it is state registral1on. Horow/lf it is cited in om' code. That is my question. Kubby/ Cedar Hapids, Davenport, Des Moines, Dubuque in their Ulle. So Linda, will you be the person contacting at least Dubuque, Cedar Hapids. GentlY/ Yes. I will caB Bany LindaB and Dave McQuire. Kubby / Thank you. Courtney/ Any other disCllssion on this item. Roll caB- Ordinance passes sl'Cond consideration. Karr/ Could we have a motion to accept Patrick Hugh's correspondence.
