WHEREAS, the applicant Iowa Realty Company, has
requested that the City rezone approximately 30 acres of
land generally located west of Sycamore Street and
immediately north of the corporate limits, from ID,RS, Interim
Development Single,Family Residential, to RS.S, Medium
Density Single,Family Residential; and
WHEREAS, with the completion of the Sycamore Trunk
Sewer, development of the subject tract is considered to be
In,sequence development; and
WHEREAS, Iowa law provides that the City of Iowa City
may impose reasonable conditions on granting the applicants
rezoning request, over and above existing regulations, to
satisfy public needs directly caused by the requested change;
and
WHEREAS, the applicant has agreed to develop this area
In accordance with the terms and conditions of the
Conditional Zoning Agreement, attached hereto and made a
part hereof by this reference; and
WHEREAS, the applicant acknowledges that the terms and
conditions contained in the Conditional Zoning Agreement are
reasonable to impose on the land under Iowa Code 1414,S
11991) and satisfy public needs directly caused by the
requested zoning change.

ORDINANCE AMENDING CHAPTER 32.1,
ENTITLED "TAXATION AND REVENUES" OF
THE CODE OF ORDINANCES OFTHE CITY OF
IOWA CITY, IOWA, BY AMENDING SECTION
32,1-65 TO REVISE CERTAIN FEES FOR THE
RESERVATION, RENTAL, AND USE OF PARKS
AND RECREATION FACILITIES EQUIPMENT.
BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF IOWA CITY, IOWA, THAT:
SECTION I, Chapter 32.1, "Taxation and
Revenues' of the Code of Ordinances of the
City of Iowa City, Iowa should be and is hereby
amended by repealing Section 32,1-65, and
adoPting in lieu thereof a new sectlo~ to read
as follows:

Dear Council-persons:
I understand that the new Iowa City Building Code had its first
reading befo~e you at the last Council meeting. Had I been aware that
this was on the agenda, I would have attended that reading and
presented th~ material that I'm submitting to you now.
In 1988, the ,Iowa Legislature passed what became known as Chapter 91-
C. Registration of Construction Contractors. This law was fully in
effect on Feqruary, 1989. I have included a copy of that chapter for
you to look at.

Quite simply, the law says that construction contractors must register
with the state's labor commissioner and meet some other basic
requirements~ Upon meeting the requirements and paying the
registration fee ($25 every two years) the contractor is given a
number.
This law was seem to protect the State and the taxpayers of the State
from a coupl~ different problems that regularly haunt the construction
industry: (1.) The entry of out-of-state, "fly-by-night" contractors
who do shoddy work and are gone before they can be held accountable.
(2.) Worker~ are often denied access to protection under the State's
workers' compensation and unemployment insurance laws by being falsely
classified as "independent contractors". This latter problem is
violated an estimated 38% of the time across the State.

Although, this law is on the books; enforcement has been very
difficult due to inadequate funding. Most larger cities in Iowa
protect their citizens by adopting the some or all of Chapter 103A of
the Iowa Code: State Building Code. Provision 103A.20 reads "..a
permit...for 'construction of a building shall not be issued to a
contractor who...fails to obtain a contractor registration number
pursuant to ohapter 91C.". I have also included a copy of chapter
103A for you.
What this meqns is that when a contractor comes in to get a building
permit, they would have to put their number on the permit. The Office
of Contractor Compliance in the State's Department of Labor can
instantly cheok a nUlnber or a computer printout is available to cross
check number~ on. I have provided you the list printed out for me by
that office. : My information suggests that this process involves
little or no additional time for a building department.
Until the Iowa City Building Code addresses the contractor compliance
issue we have a loophole in the law which leaves many of our citizen's
without proteotions that are due them. I ask that you consider add
