Dubuque Street Iowa City, IA 52240 Dear Pat and Members of the Board: An application has been submitted to Johnson County by Cathy Mae Holeton, daughter of Minnie Neuzil, the property owner, to rezone 1.0 acre of an 80 acre tract from A-1, Rural, to RS, Suburban Resldentlalo The property is located In Fringe Area 1 on the north side of Neuzil Road S.W., Just west of Its Intersection with Kansas Avenue. At its May 20, 1993, meeting, the Planning and Zoning Commission recommended, by a vote of 6-0, that the City Council forward a comment to the County Board of Supervisors finding that the request to rezone the 1.0 acre tract from A-1 to RS is Inconsistent with the current, mutually agreed upon Fringe Area Policy for Area 1. The Commission acknowledges that the Fringe Area Policy is currently under review by a Joint committee of the Iowa City and Johnson County Planning and Zoning Commissions. The current policy for Fringe Area 1 states that agricultural use Is the preferred use, and that residential uses for family farm purposes will be considered, depending on site and soli conditions. Council agrees wllh the recommendation of the Planning and Zoning Commission, and therefore, respectfully forwards a comment to the Board that the requested rezoning of the 1.0 acre tract from A-1 to RS is Inconsistent with the current, mutually agreed upon Fringe Area Policy for Area 1. Neuzil Road Rezoning Cathy Mae Holeton has filed an application with Johnson County to rezone 1.0 acre of an 80 acre tract of land from A-1, Rural, to RS, Suburban Residential. This property Is located in Fringe Area 1 on the north side of Neuzil Road SoW., Just west of Its intersection with Kansas Avenueo The purpose of the application to change the zoning designation Is to allow the development of a single-family residence on the 1.0 acre lot. The remainder of the original tract, Including the existing house, would retain Us A.1 zoning designation. Ms. Holeton, who Is the daughter of Minnie Neuzil, the property owner, will reside in the new residence and will take ownership of the 1.0 acre parcel if the rezoning Is approved. The 1.0 acre parcel will be subdivided from the 80 acre parcel. The Fringe Area Policy Agreement states that for Area 1 agricultural use Is the preferred use, and that resldenllal use for farm family purposes wl/l be considered depending on soli and site conditions. Approval of the requested rezoning would allow development of a second slngle- family residence, In addition to the existing residence. This additional residence Is not In conformance wUh the policies established for Area 1. Even though the new house will Initially be occupied by a family member, there Is no guarantee that this sUuallon will continue once the 1.0 acre property Is subdivided off the larger tract. It Is staff's opinion that the development of this house Is not a residential use for family farm purposes. STAFF RECOMMENDATION Staff recommends that the City Council forward a comment to the County Board of Supervisors finding that the request to rezone a 1.0 acre tract from A-1 to RS Is Inconsistent with the mutually agreed upon Fringe Area Polley for Area 1 and should be denied. Conditional Use Permit To the Members of the Board: The Iowa City City Council and Planning and Zoning Commission have reviewed the request submitted to Johnson County by River Products Co. for a Conditional Use Permit for the expansion of a quarry located on the west side of Deer Creek Road SW, approximately one-half mile south of Its Intersection with Highway 6. To help assure that the quarry operation does not have negative Impacts on surrounding properties, the City recommends that approval of the Conditional Use Permit be subject to the following conditions: ' 1. The permit being Issued for a period of twenty years, at which time a new permit must be granted or the operations must cease, and 2. The subject property is located near the northern boundary of Fringe Area 1 of the Iowa CltylJohnson County Fringe Area Agreement. The Fringe Area Agreement Indicates that agricultural uses are preferred In this general area. The current zoning of the property Is A-1, Rural, and permits agrlcullural uses. Mining and minerai extraction may be permitted In the A-1 zone if the County grants a conditional use permit. If the County chooses to grant a conditional use permit for the quarry, conditions can be placed on the permit to assure that negative Impacts on surrounding areas are minimized. If the City Council objects to the Issuance of a conditional use permit, a 4/5th majority vote of the Board of Supervisors is required to approve the permit. The subject property Is located In an area that Is mostly undeveloped, however, the area directly to the east Is zoned County RS, Suburban Residential. The surrounding areas are currently used for agricultural uses, farm family residences, or are undeveloped. The property falls beyond the recently defined service area for future municipal wastewater treatment service. Access to the property Is via Deer Creek Road, a two-lane unpaved County road, which intersects with Highway 6 approximately one-half mile north of the site. Truck traffic from the subject property Is not anticipated to affect city streets. Given the Isolated location of the subject property and the unlikeliness of near-term urban development, the proposed quarry operation, in staff's opinion, would be a reasonable interim use of the property subject to conditions designed to assure the long-term development potential of this and surrounding properties. To allow the continuing monitoring of the operation, a time limit of five years on the conditional use permit would appear to be reasonable. At the end of the permit period, the Impact of the operation on the surrounding area could be reassessed. If it Is found that the Impacts remain minimal or can be suitably mitigated, the permit could be reissued. If it Is found that the operallon Is having Impacts on the surrounding area which cannot be dealt with, the permit could expire and the site be reclaimed.
